The House of Representatives, in its session today, Thursday, elected Abdul Latif Rashid (of Kurdish nationalism) as President of the Republic after two rounds of secret ballots in front of his rival, former President Barham Salih, and the first won by 162 votes against 99 votes for the latter.

A legal expert clarifies the constitutional steps after assigning Al-Sudani

{Political: Al Furat News} A legal expert clarified the constitutional steps after assigning the most numerous parliamentary bloc candidate, Muhammad Shia Al-Sudani, to form the government.

Ali Al-Tamimi said in a statement, which {Al-Furat News} received a copy of: “The representative of the parliamentary bloc, the largest in number, has 30 days to present his cabinet and the ministerial curriculum for presentation to the House of Representatives, as stated in Article 76 of the Iraqi constitution.”
He added, "The Prime Minister-designate deliberately presents the names of his cabinet and his ministerial platform during the thirty-day period to the House of Representatives, and he is considered to have the confidence of Parliament when the ministers are approved individually and the ministerial platform by a simple majority, half the number of attendees plus one, after the quorum is achieved."
And Al-Tamimi said, "If the Prime Minister-designate is unable and fails to present his cabinet and ministerial curriculum within the thirty-day period, the President of the Republic assigns a new candidate to replace the designate who failed."
He continued, "
The legal expert pointed out that “whoever is assigned by the President of the Republic, if the previous commissioner fails or does not vote for him or for his cabinet, is from the same bloc that has the largest number and which was initially identified because the generality of the text contained in Article 76 of the Constitution was determined in the capacity by the first nomination by the President of the Republic. The constitution defines it as the most numerous bloc, and therefore any candidate is one of them, and this is consistent with the nature of the parliamentary system and the democratic context.
He pointed out that "a decision of the Federal Court of 2010 No. {93} did not require the Prime Minister-designate to name all members of his ministry, whether they are original or agency, but they can be in the form of payments, and the Parliament can approve the curriculum and ministers outside the period stipulated in the constitution. .
