The pace of discussions between the political and legal circles escalated after the tweet of the leader of the Sadrist movement Muqtada al-Sadr and his request to dissolve Parliament and talk about the possibility of the Supreme Judicial Council dissolving it in light of the political impasse in Iraq nearly 10 months ago from the early elections that were held on 10/10/2021.


Yesterday, the leader of the Sadrist movement, Muqtada al-Sadr, called on the Supreme Judicial Council to dissolve the House of Representatives next week, while the President of the Republic called for setting a date for early "conditional" elections.


Al-Sadr said in a tweet via Twitter, followed by Alsumaria News, "I am addressing my words to the Iraqi judiciary, from which we still hope for the best despite the political and security pressures and leaks it is subjected to from here and there, provided that it dissolves Parliament after constitutional violations within a period not exceeding the end of next week." Assigning the President of the Republic to set a date for early elections, conditional on several conditions that we will announce later.

expert, Ali Al-Tamimi, confirms that there are two opinions regarding the eligibility of the Federal Court to dissolve the Iraqi Council of Representatives.

Al-Tamimi says in an interview with Alsumaria News, that the first opinion is as follows, “The Federal Court has no right to dissolve the Iraqi parliament, and the argument for this opinion is that the dissolution of Parliament is precisely defined in Article 64 of the Constitution, as it dissolves itself at the request of one-third of the members and the approval of the absolute majority of the number of members.” .


He added, as for the second opinion, it is "a request from the Prime Minister and the President of the Republic and the approval of the majority for the number of members, and this method is not possible because the current government is a caretaker government, and thus the first opinion remains the only solution to dissolve Parliament."

And he continued, "As for those who say that the judiciary can dissolve Parliament, their argument is that a case should be submitted to the Federal Court. These cases are based in the appeal that Parliament has been reluctant to implement constitutional entitlements first and second to articles 47 and 59 of the Civil Code related to legal personality and they consider Parliament a personal It is morally permissible for the judiciary to dissolve it in the event of reluctance to perform its duties as stated in Article 59 of the Civil Code. ".

He stressed, "In the end, the final say remains if the cases are submitted to the Federal Court, as it is financially and administratively independent in accordance with Articles 92, 93 and 94 of the Constitution, and it is the one that decides to dissolve Parliament or not."


For his part, legal expert Fawzi Karkan says that the dissolution of the House of Representatives is within the jurisdiction of the Constitutional Court and not the Court of First Instance, which has jurisdiction over so-called minor cases.
Karkan adds: "It is possible to resort to the beginning to challenge the legitimacy of the House of Representatives because it has violated the constitution and the constitutional terms and did not respect them. How can it be asked to dissolve itself in accordance with the constitution?"

 
And he continued, "Article 94 of the constitution allows for the possibility of challenging the legitimacy of the council, with the presence of a legal opinion mentioned by the head of the Supreme Judicial Council, Judge Faiq Zaidan, where it is possible to resort to a joint request from the heads of the government and the republic and under the supervision of the judicial authority to dissolve Parliament, as a possible solution."

 
The legal expert confirmed that "the Federal Court will reject any lawsuit demanding the dissolution of the Council because it is not within its jurisdiction according to the Constitution."


* Sticking to the coordinating

* Judiciary and dissolution of Parliament
On 04/01-2022, the President of the Supreme Judicial Council, Faiq Zaidan, issued a clarification regarding the penalty for violating the constitutional rule and dissolving Parliament.

 
Zaidan said in the article that was received by Alsumaria News, "The Constitution of the Republic of Iraq for the year 2005 stipulates the procedures for dissolving the House of Representatives according to Article (64 / first) of it in two ways. This request and this procedure is not expected to happen in practice, as it means that the legislative authority imposed the penalty (dissolving Parliament) on itself.As for the second way, it is represented in a request from the Prime Minister, with the approval of the President of the Republic, to be submitted to the House of Representatives. The text stipulated for the implementation of this request the approval of the absolute majority of the number of members of the House of Representatives. The House of Representatives is a means of withdrawing confidence from the government, which upsets the political and constitutional balance between the two authorities (we have referred to this problem in detail in the doctoral thesis submitted to the Islamic University of Beirut in the year 2020).

 
He added, "The Iraqi political reality is witnessing a clear violation of a constitutional rule stipulated in Article (72/Second/B) of the constitution by specifying the period for the President of the Republic to continue exercising his duties until after the end of the elections for the new Council of Representatives and its meeting within a maximum period of thirty days from the date of the first meeting of the Council and the necessity of electing a President Although the Federal Supreme Court worked hard to find a way out for this constitutional violation when it permitted the President of the Republic to continue exercising his duties until a new president was elected in accordance with the decision issued on (13/2/) 2022) by No. (17/Federal/2022), however, this jurisprudence, although it was necessary to avoid a situation of vacancy of the position and the consequent politically unconsented procedures, was not sufficient to address the continuation of violating the constitution for an indefinite period due to the two-thirds majority requirement stipulated in Article (70/first) of the constitution regarding quorumThe convening of the session of the House of Representatives devoted to electing the President of the Republic and the absence of a provision for the existence of a “constitutional sanction” for this violation, so we see the amendment of the constitutional text contained in Article (64/First) that the House of Representatives be dissolved by a decision of the Prime Minister and with the approval of the President of the Republic, provided that it is not During the prime minister’s interrogation period, thus achieving a balance between the legislative and executive authorities, the penalty for violating the constitutional rule is by a decision of the legislative authority in the event of its violation by the executive authority by withdrawing confidence from it, and vice versa. In the event of violation of the constitutional rule by the House of Representatives by dissolving the House without the condition of approval of the House of Representatives on the dissolution procedures and to ensure that the executive authority does not arbitrarily impose the penalty by dissolving the House of Representatives and for the importance of this procedure exclusively, the decision to dissolve the House of Representatives issued by the executive authority is subject to appeal before the Federal Supreme Court .

Khaled Al-Saray, a member of the State of Law coalition led by Nuri Al-Maliki, confirmed, on Wednesday, that the coordinating framework is coherent so far, noting that the latter will be with any decision after the parliament meeting.  

  

  

Al-Saray said, in an interview with his colleague Adnan Al-Tai, followed by "Nass" (August 10, 2022), that "the framework is living the best days of harmony and continuous communication."  

  

He added, "The attempt to limit the dispute between al-Sadr and al-Maliki has become illogical," noting that "the street is available to everyone."  

  

Al-Saray continued, "The mechanisms for selecting presidencies are based on constitutional provisions," stressing that "the framework is coherent and united so far, and attempts to tear it up from within are not possible."  

  

He pointed out that "the Iraqi state is not owned by the framework or the current," stressing the importance of "forming the government and then going towards amending the constitution."  

  

He continued, "Solutions come at a Rahmani hour, and parliament must meet and we will be with any decision or change it decides... and otherwise, let them declare a revolution and overthrow the regime."
