Today, Friday, Parliament Speaker Muhammad al-Halbousi announced his support for holding early elections.

ERBIL — Iraqi Parliament Speaker Muhammed al-Halbousi said on Friday that he supports the call for an early parliamentary election within a specific time frame. 

Halbousi issued a statement to back Shia cleric Muqtada al-Sadr, whose supporters stormed the parliament last Saturday and, after three days inside the chamber, the moved a massive sit-in to the outside of the building of the legislature. 

“The will of the people on the early election cannot be neglected,” Halbousi said. 

“We support the steps towards an early election within a specific time frame so the democratic process will resume under the Constitution and understanding,” he added. 

The speaker noted that any move in this direction must be in line with the best interests of the nation.

Iraqi Parliament Speaker: We support al-Sadr's call for early elections

Today, Friday, the Speaker of the Iraqi Parliament, Muhammad al-Halbousi, announced his support for Muqtada al-Sadr's call for early elections.

Al-Halbousi said, in a tweet to him, that "the House of Representatives is the representative of the people, and those masses that mobilized are part of his entity and conscience, and whose will in the early elections that Mr. Muqtada al-Sadr called for, cannot in any way be neglected."

He added, "We support proceeding with parliamentary and local elections within an agreed period of time to re-start the democratic process under the roof of the constitution and understanding in line with the country's supreme national interest."

And on Wednesday, Al-Sadr called for the dissolution of parliament and the holding of early elections as part of a nine-month-old political crisis that has prevented the formation of a government since the October 10, 2021 elections.

The reactions of the political class in Iraq to Sadr's call were divided between supporters and opponents, in light of calls for a national dialogue with the aim of getting out of the crisis in the country.

And last June, the 73 Sadrist movement’s representatives (out of 329) submitted their resignations, after they were unable to form a “national majority” government, as the “coordinating framework” stuck to a “national consensus” government as usual, and now has a parliamentary majority that enables it to form a government. .

And on Saturday, Sadr's supporters stormed for the second time in less than a week, the parliament headquarters in the capital, Baghdad, to reject the nomination of the "coordinating framework" Muhammad Shia Al-Sudani for the position of prime minister.

Al-Sudani is close to Iran and has previously held government positions, while the Sadrist movement and other forces are calling for the selection of a figure who has not held any positions.

There has been talk these days about another solution that cuts the way to the political stalemate, which is to go to a second election. The weights of the political blocs may change, and consequently, alliances may change and lead to the possibility of forming a new government. It must be remembered that the Al-Kazemi government, when it was formed, the purpose of that government was to hold early elections.

The scenario of dissolving Parliament and rerunning the elections faces obstacles, including:
1- The Federal Court, when it rejected the framework’s appeal (Monday, December 27, 2021) regarding the illegality of the elections, but the Federal Supreme Court at the same time recommended two points, namely:
A- Legislating a new election law
B - Not using electronic counting and sorting, and
here lies the problem, which is that the current government is the caretaker of daily affairs, and it does not have the constitutional legitimacy for that, according to Article (64-second) and according to the Federal Supreme Court’s decision No. 121 / Federal / 2022, but after enacting a law Food security, despite its violation of the Constitution, it became possible to legislate a law during the period of a caretaker government, despite that it is unconstitutional.

2 - Some large blocs, as well as some small ones, who are independents, will not accept going to the second elections because of the possibility that their seats will be reduced.

3 - The dissolution of Parliament is the step that must precede going to elections, and this paragraph was referred to in Article 64 of the Constitution, where it clarifies that the period shall be a maximum of sixty days. Elections must take place after the Parliament is dissolved.
But the dissolution of Parliament will face several obstacles, including:
1 - The ways to dissolve Parliament are in two ways defined by the constitution in Article 64 of it, and in two ways:
First: The Parliament is dissolved by an absolute majority of the number of its members, at the request of one-third of its members, or a request from the Prime Minister and with the approval of the Prime Minister Republic, and the Council may not be dissolved during the period of questioning the Prime Minister.
Second: The President of the Republic, upon dissolving the House of Representatives, shall call for general elections in the country within a maximum period of sixty days from the date of the dissolution, and the Council of Ministers in this case is considered resigned and continues to run daily affairs.
And that the two paths end with the parliament’s vote on it by an absolute majority, meaning that the ball is in the range of the members of the House of Representatives and it is the final decision-maker in the matter.
2 - The dissolution of the House of Representatives means that the government will turn into a daily caretaker government devoid of any powers, but how if it is a caretaker government.
3 - The second way to dissolve Parliament is a call from the President of the Republic to dissolve Parliament, how if the President of the Republic is the end of powers, Article 72 of the Constitution shows that the President of the Republic ends his term at the end of the Parliament, i.e. when the House of Representatives is dissolved and someone else comes after the first session, then his validity ends. Everyone knows that the first session was months ago, and therefore the President of the Republic is by virtue of the expired powers.
4 - The first way requires the process of convening a session of the Iraqi parliament, and then submitting a proposal to dissolve parliament to the presidency of the council and vote on it, but this process must be evacuating the building and its surroundings from the demonstrators, otherwise how can the deputies come amid a building full of demonstrators.
5 - The election process requires large funds. In the last elections, the government cost an amount of about 300 million US dollars, i.e. 450 billion dinars, or nearly half a trillion dinars, but here the question arises, from where this amount is allocated, and this is not possible because:
A - The current government is a caretaker government and does not have the authority to transfer or any authority to control funds except in matters appropriate to the situation.
B - We need a general budget to allocate money to the election process, and therefore, before going to the elections, the government must be formed and the federal budget law is enacted.
C - Legislating a law for elections, and this would be unconstitutional, and that any appeal by the deputies would be rejected because the law would include financial aspects. Despite that, it also needs Parliament to return to its work and the demonstrators to leave.
6 - Going to elections will be in two ways:
A - the use of the old law, and this will be contrary to the decision of the Federal Supreme Court
B - the enactment of a new law and this is not possible and we talked about it above and it is also contrary to the decision of the Federal Supreme Court, and the new legislation needs that Parliament exercises Duty for several months until this law is enacted.

The result
is that the second elections, which some may call for, are difficult to hold because they violate the decisions issued by the Federal Supreme Court, which are irrelevant and binding on all (Article 94) of the Constitution. Likewise, the constitution made the government a caretaker, so how is it now a caretaker government?
The solution is to form a government whose most important duty is to hold early elections, and since the preparations take several months, a government with full authority can legislate the budget law and serve the people until elections are held and turn it into a caretaker government as well.
But if the parliament is dissolved and elections are held by other than the methods mentioned above, which are originally found in the constitution, these procedures will be unconstitutional.

Shafaq News/ Several sources reported on Friday, that there is no meeting in the coming hours that brings together the leader in the coordination framework Hadi Al-Amiri and the leader of the Sadrist movement Muqtada Al-Sadr.

A leading source in the Sadrist movement told Shafak News Agency; "The head of the Al-Fateh Alliance, Hadi al-Amiri, told some figures in the Sadrist movement that he would like to meet the leader of the movement, Muqtada al-Sadr, as soon as possible."

The source added; "These figures informed Al-Amiri that there is no dialogue that brings Al-Sadr together with the leadership of the framework unless the leadership of the coordination framework relinquishes the nomination of party figures, and actually agrees to hold early elections, as the Iraqi people and the sit-in aspire for it."

However, a source in the coordination framework told Shafak News Agency; That "Tritha occurred during the visit of Al-Amiri to Al-Hanana until the coordination framework was informed of the details of what Plasschaert discussed with Al-Sadr in today's meeting."

An informed political source revealed, earlier on Friday, that the leader of the Al-Fateh Alliance and the leader in the coordination framework, Hadi Al-Amiri, intends to visit the leader of the Sadrist movement, Muqtada Al-Sadr, at the latter's headquarters in Al-Hanana in the city of Najaf, in the coming hours.

The United Nations envoy to Iraq, Jeanine Plasschaert, confirmed earlier on Friday that her meeting with the leader of the Sadrist movement, Muqtada al-Sadr, was positive.

"The meeting that brought her together with Al-Sadr witnessed the importance of finding a solution to the current political crisis," Plasschaert said, during a press conference, followed by Shafak News Agency.

In her response to whether there was an important message from al-Sadr, or signs of a political initiative, Plasschaert emphasized, "Al-Sadr will say what he has later."

On Friday morning, Plasschaert arrived in Najaf on an "unannounced" visit, during which she met al-Sadr at his residence in Hananah.

The leader of the Al-Fateh Alliance, Mahmoud Al-Hayani, revealed, earlier, an upcoming meeting that will bring together the head of the Al-Fateh Alliance Hadi Al-Amiri and the leader of the Sadrist movement, Muqtada Al-Sadr, while he disclosed that a religious reference mediated between the framework and the movement .

 

Al-Hayani said in an interview on the official Iraqi channel, which he watched (Baghdad Today), that "the head of the Al-Fateh Alliance Hadi Al-Amiri and the leader of the Sadrist movement, Muqtada Al-Sadr, will meet in the next few days to discuss the political crisis," noting that "Al-Amiri seeks to resolve the dispute between the rule of law and the movement."

 

Al-Hayani added, "The religious authority, Mr. Hussein al-Sadr, will be a mediator between the framework and the current to resolve differences." He pointed out that "the dialogue between the framework and the current may lead to the formation of a new government and the selection of a new prime minister," stressing "the need for dialogue and agreement on some points before going to the early elections."

He added, "There are two paths to dissolving the parliament and holding new elections, the first is by submitting a proposal from the prime minister and the approval of the president of the republic, and the second is through a request from a third of the members of the House of Representatives and voting by an absolute majority, which is half plus one."  

  

He continued, "We are addressing all the Iraqi forces inside and outside Parliament. Those who supported the idea of early elections should disclose the method for implementing those elections."  

  

 

  

He pointed out that "Parliament does not dissolve itself directly, and it is assumed that if it is agreed to hold elections through the constitutional institutions, the political blocs will be responsible for providing the requirements for those elections, financial allocations, the issue of the Commission and other obligations."  

  

And he stated, "It is not permissible to skip any constitutional or legal rule because this leads to a lack of confidence in the citizen. We live in a state of not choosing the President of the Republic and the Prime Minister."

I will try, in a legal reading, to talk about the constitutional options for dissolving the Iraqi parliament after the confusion increased after this parliament became a burden on the political process and persisted in legislative fraud, spreading corruption, ignoring the higher interests of society and turning it into a tool to legitimize enrichment and perpetuate class differences..? At the outset, I would like to answer the sterile legal debate that has begun to spread about the legal formulas and methods for dissolving Parliament.. Let us talk specifically about the alternative options that are reflected in Article 64 of the Iraqi Constitution of 2005.. Where I find that this constitutional article in some of its pillars is in a state of (clinical death). We are surprised by the statements of some jurists when they still consider it a constitutional basis for dissolving Parliament..!! Especially since this Article 64 / first tells us (((The House of Representatives is dissolved by an absolute majority of its members and at the request of one-third of its members... or a request from the Prime Minister and with the approval of the President of the Republic...)...)?

Here, we find that the Iraqi constitution specified the methods for dissolving Parliament, as follows:

First, the provision of Article 64 necessitated the dissolution of the constitution at a request submitted by (one third of the members of Parliament), in a figurative sense, with a proposal submitted by more than 108 deputies.

Second.. He must agree to the proposal of the representatives above, which is the necessity of having an absolute majority of the number of members of the House of Representatives.. And the absolute majority of the number of members of the House of Representatives according to the interpretation of it by the Federal Court is (a two-thirds majority), that is, the availability of more than 220 deputies approximately until the House of Representatives is constitutionally dissolved ..? This, in my estimation, requires the approval of the Kurdistan Democratic Party and the Sovereignty Bloc for Halbousi, in addition to independent deputies and other deputies to gather 220 deputies who agree to dissolve parliament at the will of its members..?

Third.. It is not constitutionally permissible to dissolve the House of Representatives with a proposal submitted by the Prime Minister asking him to dissolve Parliament.. which was also referred to in the other part of the same Article 64 of the Constitution because the Prime Minister is currently representing a caretaker government and neither he nor the President of the Republic has the capacity and constitutional link to dissolve Parliament Because the one who gave them eligibility and constitutional justifications for their legal and governmental positions has ended and has been dissolved and has no constitutional existence, neither in form nor in substance. In this case, they have become devoid of any capacity or constitutional cover that gives them the authority and jurisdiction of the constitution to dissolve the existing Iraqi parliament..??

A statement of the framework, a copy of which was received by “Nass”, a copy of it (August 4, 2022), stated that it “confirms its support for any constitutional path to address political crises and achieve the people’s interests, including early elections after achieving national consensus around them and providing a safe environment to conduct them, and all of this precedes work on respecting institutions.” Constitutionalism and not to disrupt its work,” stressing in the same regard, “Our roof remains the law, the constitution, and the people’s interest.”
