And he stated, "We made a sincere effort to dissuade al-Sadr from the step of resignation, and reluctantly accepted the resignation of the Sadrist bloc's representatives from the House of Representatives," noting that "the replacements of the Sadrist bloc's representatives will be among the losers with the highest votes in the electoral district."  

  

  

  

  

And Al-Halbousi added, "We seek to form a government that will bear the responsibility of the political blocs for its success and failure, and the next steps may proceed quickly."  

  

The Speaker of Parliament said: "The region does not need any external interference, and we hope that Iraq will get rid of terrorism, especially since the upcoming challenges will be economic."

Representative Khashan clarifies the legal mechanism for accepting the resignation of members of the House of Representatives

Independent MP Basem Khashan on Monday clarified the legal mechanism for deputies' resignation from parliament, noting that it does not require an absolute majority.    

 

  

Khashan said in a blog post seen by "Nass" (June 13, 2022): "I did not want to give my opinion regarding the resignation of my colleagues from the Sadrist bloc, but various opinions emerged that failed to read the understanding of the clear legal text."  

  

He added, "The membership ends with the resignation of the representative, and its acceptance was not required for the approval of the Council, and according to Paragraph (Third) Paragraph (First) of Order No. (9) of 2005 applies to the resigning representative, if the representative submits his resignation after the continuation of his membership for a full year, and Paragraph ( First) the provisions for disbursing pension salaries to the resigning member, and this paragraph is now canceled, and I think that the General Retirement Law is what abolished it.”  

  

He continued, "As for the requirement of an absolute majority for the number of council members, it includes the president and his two deputies, who may retain their membership in the council after accepting their resignations by an absolute majority."

In a surprising step, 73 deputies from the Sadrist movement submitted their resignations from the Iraqi parliament, on Sunday, which constitutes a new turning point in the country that is going through a political crisis that disrupts the election of a president and the selection of a prime minister.

The Speaker of the House of Representatives, Muhammad al-Halbousi, appeared sitting in his office signing the resignations one by one, and in front of him the representative of the Sadrist bloc in the parliament, and later, al-Halbousi wrote on Twitter that he signed the resignations “down to the desire” of the leader of the Sadrist movement, Muqtada al-Sadr.

The law does not indicate the possible return of the resigned representatives, but the Iraqi law gives state employees a month before "their officials decide whether to accept or reject the resignation."

The political closure that Iraq is witnessing prompted Al-Sadr to take this step, as the Iraqi political analyst, Ahmed Al-Suhail, says that "the Sadrists' resignations were the inevitable result of the political escalation that Al-Sadr expressed in his previous speeches, but taking the step at this time was unexpected."

Al-Suhail added to Al-Hurra website, "The step, in theory, carries a way out of the political blockage that the country is going through, but in fact it carries a greater promise of the possibility of the Sadrists going out to demonstrate in the street, and perhaps forcing the entire parliament to submit its resignation."

Al-Suhail warns that "the time required to compensate Sadrist members of parliament and the time required to form new political understandings will further complicate the scene."

He pointed out that "the Sadrist bloc was the largest in Parliament and was unable to reach a solution, and its exit will increase the sizes of small blocs without giving a majority to a particular bloc or current."

The legal expert and former government inspector, Jamal Al-Asadi, says that "the replacements for the resigned representatives will be the highest losers in their electoral districts, according to the decision of the Federal Court in November 2021."

Al-Asadi says: "The parliamentary map of the House of Representatives will change according to my personal reading to the following: State of Law 41 seats, Al-Fateh and its allies 44 seats, State Forces 15 seats, Extension of 16 seats, Canon Sunrise 7 seats, Contract Alliance 9 seats, and the Rights Movement 6 seats." Al-Hurra was unable to confirm this statistic from an official source.

Also, many parliamentarians did not respond to Al-Hurra's questions regarding the resignations of the Sadrist MPs and the expected scenarios.

Al-Asadi described the resignation of the Sadrist MPs as "a bold and courageous decision to resolve the existing political impasse."

Following the resignation, controversy prevailed over whether the step was legal, especially since there is a paragraph in Iraqi law that indicates that the resignation can be accepted if it comes at least a year after the election of the deputy to the parliament.

The Iraqi expert in legal affairs, Ali Al-Tamimi, says that "the resignations came in the form of independent papers to the Speaker of Parliament, and his approval of them is sufficient."

He told Al-Hurra website that the requirement for "the council's vote on the resignations, and the condition for the passage of the year, are only for the purposes of calculating retirement, and not for the purposes of accepting the resignation or not."

Al-Tamimi adds that "resignation is different from dissolving parliament, and these resignations will not affect the work of parliament" from a legal point of view.

Al-Sadr called on his bloc, last week, to write their resignations, and said that he had "the choice of opposition or withdrawal" from the political process.

It seems that al-Sadr chose to withdraw, as he issued a decision, on Sunday, to stop work in the institutions affiliated with his bloc, except for those of a religious nature.

Shafaq News/ The Independent High Electoral Commission in Iraq confirmed, on Monday, that the General Secretariat of the House of Representatives had handed over lists of the names of the winning parliamentarians, in addition to other lists of substitutes (the biggest losers).

A member of the commission's media team, Imad Jamil, told Shafak News Agency, "The Presidency of Parliament will not need the Electoral Commission to know the replacements or the so-called first loser in the legislative elections that took place last October, regardless of his party or regional affiliation."

Jamil explained, "The Commission had handed over to the General Secretariat of the House of Representatives statements and lists of the names of the deputies who won the highest votes, as well as the names of the replacements or the first losers in each electoral district, and therefore they can review those lists and determine the replacements."

By dissolving parliament it take’s away the immunity from all including Maliki. 
This is where I’m guessing at Al-Sadr end game. I’ve been saying for weeks they need to start burning tires in the streets because that’s what gets the attention. 
I’m a thinking that Maliki and lots more of his thieves in parliament are about to be served. Al-Sadr was serious when he said Maliki wouldn’t be part of the government. Al-Sadr made sure the citizens were cared for before he pulled the plug. The PM and president will continue until next elections, what I can’t figure out is, are there anything else that needs to happen before the CBI makes a rate change. 
That’s my thinking, either Al-Sadr has made the gamble of the century and new elections rid them of Iran or he has sent the Iraq government into the abyss….

I think you are onto something there with your analysis. This might be an 'all in' move by Al-Sadr. Likely, carefully planned brinkmanship to avoid the same old swamp games with Iran as gator #1 and Maliki as gator #2 💩.

 

It is certainly going to mobilize voters to participate in the next election, as there was a lot of apathy among voters in the last election. This move by Al-Sadr now has all eyes on him--just the way he wants it.

 

I now think it is a systemic clarion call for independence, the State over the political clans and partisanship.

A political source revealed the most prominent issues discussed in the coordination framework meeting held at the home of the President of the Supreme Council, Hammam Hammoudi.
The source said in an interview with (the Iraqi Media News Agency) that “the leaders of the coordination framework discussed the resignation of the Sadrist bloc from the House of Representatives and its impact on the political process in Iraq,” noting that “the attendees were divided over the call for dissolving the parliament and holding other early elections.”
He added, "Some suggested forming a committee to negotiate with the Sadrist movement, to reverse the resignation, while others refused, on the pretext that al-Sadr refuses to hold any meetings with the coordination framework regarding the form of the next government."
He pointed out, "Most of the attendees confirmed that forming any government independent of the Sadrist movement would not last long and expressed their fear of the reaction of the masses of the movement in the street or going out

On Tuesday, the coordination framework held a meeting in the office of the leader of the State of Law coalition, Nuri al-Maliki, in the presence of the Patriotic Union of Kurdistan, the "Azm" coalition, the Babylon Movement and the Independents.  

  

  

  

An informed source told "Nass" (June 14, 2022), that "the coordination framework began its meeting with the Alliance of Azm, the Patriotic Union of Kurdistan, the Babylonian Movement and the Independents in the office of Nuri al-Maliki to discuss developments in the political situation and discuss ways of political openness to the rest of the political forces to speed up the formation of the government." .  

  

Yesterday, Monday, the coordination framework confirmed the continuation of dialogues with all political forces to form the government, after the resignation of the Sadrist bloc from the House of Representatives.  

  

The framework said in a statement that "Nass" received a copy of it (June 13, 2022), that "the coordination framework held its regular meeting today, Monday, to discuss the latest developments in the political arena."    

  

The framework stressed, according to the statement, "its continuation of the necessary steps to address the political crisis and to continue dialogues with all political forces to complete the constitutional entitlements and form a national service government, and the coordination framework hoped to go with all political forces, but it respects the decision of the Sadrist bloc to resign from the House of Representatives."    

  

He also stressed, "I will continue to work with everyone in a way that guarantees wide participation and achieves the aspirations and hopes of our people for security, stability and decent living, and enhances the role and position of Iraq in the region and the world," according to the statement.    

  

Earlier, the head of the Sadrist movement's political body, Ahmed al-Mutairi, commented on the withdrawal of the Sadrist movement's leader Muqtada al-Sadr from the political process.  

  

Al-Mutairi said, in a statement received by “Nass” a copy of it (June 13, 2022), that “the political altruism that Muqtada al-Sadr committed by withdrawing from the political process and leaving the seats of his representatives to his opponents from other politicians is a sacrifice for Iraq, as he made himself the holy ram of Ismail, By doing this, he transformed his altruism into eternal life. This is undoubtedly a brave position, and a lesson from the lessons of leaders who are loyal to their countries and peoples.      

  

He added, "It reminds us of the position of his grandfather Al-Hussein, peace be upon him, when he said his famous saying: (I do not give you with my hand the giving of the servile, nor do I approve the approval of the slaves). This is the attitude of the greats when they sacrifice the most precious and precious for the greater interest, and these positions are not new to the Al-Sadr family, as Muhammad Al-Sadr called before More than twenty years ago when he said: (The religion belongs to you and the doctrine belongs to you) and here Muqtada Al-Ibaa said it (Iraq belongs to you and the people belongs to you, I am not important).      

  

And he continued, "Oh, the immortal sacrificer, the symbol of all the faithful, and the title of sacrifice and annihilation, you will remain a beacon to every reformer, loyal and sacrificed person for the sake of his religion, his country and his people, and history will remember that you owned and waived for the love of your people and your country. With you with you for the sake of your Iraq and your people."      

  

In the latest comments regarding the resignation of the Sadrist movement's deputies, the leader of the Democratic Party, Massoud Barzani, said on Monday: "We respect the decision of His Eminence Muqtada al-Sadr, and we will follow up on subsequent developments."

According to a video obtained by "Nass" (June 12, 2022), Parliament Speaker Muhammad al-Halbousi is seen signing the resignations of the Sadrist bloc in the presence of the bloc's leader, Hassan al-Adhari.             

  

Earlier, the leader of the Sadrist movement, Muqtada al-Sadr, directed the resignations of members of the Sadrist bloc to Parliament Speaker Muhammad al-Halbousi.  

  

Al-Sadr said in a statement, of which "Nass" received a copy, (12 June 2022), that "the head of the Sadrist bloc, Hassan al-Adhari, must submit the resignations of the sisters and brothers in the Sadrist bloc to the Speaker of Parliament."            

  

And he indicated that "this step is considered a sacrifice on my part for the sake of the people and the country to rid them of their unknown fate." He also extended his thanks to "Jaafar al-Sadr, who was our candidate for prime minister."
