Shafaq News/ The State of Law coalition bloc led by Nuri al-Maliki considered, on Thursday, the emergency food security support law illegal and cannot be applied despite the vote of the Iraqi Parliament unless the next federal government is formed.

The parliamentary bloc added that "according to the decision of the Federal Court, the law is no more than a dead letter but to be implemented when the new government is formed."

She also indicated that "the situation was limited between allowing others to proceed with it in its first form, which is marred by suspicions of corruption and waste of public money, and allocating funds from the financial in an explicit violation because the current government is a daily caretaker government, and between making amendments that fulfill the demands of the Iraqi people and its various segments and meet the need." To the requirements of food, electricity and real services provided that the judicial authority is respected and that this law does not conflict with the decision of the Federal Court.

And he indicated, "The law does not contradict the constitution or its articles, and it guarantees important allocations to the food security sectors by providing allocations for the ration card, electricity fuel, outstanding debts and farmers' entitlements, in addition to the allocations of lecturers, development of the regions and some special funds for some provinces, including Dhi Qar."

Al-Amiri added, "The law was born in very difficult circumstances, and therefore there will be strict control over its implementation by Parliament, and this is what the leader of the Sadrist movement Muqtada al-Sadr suggested in a tweet to him about the necessity of forming a parliamentary committee to monitor the implementation of the law from the competent committees and not to lose the people's summit again." He stressed that "the Sadrist bloc will have intensive follow-up after the law is activated, and today we have passed the smallest challenge in legislating the law, so we have the biggest challenge in monitoring its implementation, and as we succeeded in the first challenge, God willing, we will succeed in the other challenge."

He continued, "We will work to form specialized committees, follow up the implementation of the law, achieve its goals for which it was initiated, and provide service to the Iraqi people."

For his part, the independent representative, Yasser Al-Husseini, indicated that Parliament, after completing the legislation of the emergency food security support law, will face a greater challenge in monitoring the implementation of the law.

Al-Husseini said in an interview with Alsumaria News, "Most of the paragraphs of the law of emergency support for food security are responsive to the aspirations and the need of Iraq and its people, but we must beware of illegal aspects in the origin of the law and the decision of the Federal Court."

He continued: "Regardless of the law's consistency with Federal Court Decision No. 121, some paragraphs are inconsistent with the original decision and the fact that we in the Economics Committee have a vision about what economic security is, the law in its final version includes secondary projects that are far from economic security."

Al-Husseini added, "The law in some aspects departed from the goal of economic security, and this matter makes us feel afraid of colliding with the decision of the Federal Court and may challenge it and waste all efforts made in providing basic aspects, not to mention the fear of wasting public money as the previous budget law."

And he continued: "After we finished the first challenge and legislated the law, today we will enter into another challenge, which is the supervisory aspect of implementing the law, which is more difficult than the previous step in legislating the law, as we will clash with the mafias of corruption."

Adel Abdul-Mahdi comments on seven points on the passage of the “Emergency Support for Food Security” law

Abdul-Mahdi said, "Let us leave the legal debate on the jurists and constitutionalists. Going to "federalism" means basic and fundamental societal, conceptual and institutional differences. When we do not perform our duties to build our system on clear and effective foundations that pay harm in times of adversity and achieve benefits in prosperity, the system will conspire against itself, and push us to choose between the most harmful and the most harmful.  

1- We suffer from the deviation of the prevailing economic philosophy in the state, the political class and public opinion. It is about looking at the national economy through the budget, and not the other way around. The increase in oil imports was considered a surplus, as it exceeded the budget estimates. While in fact it is a real surplus profit for the economy, just as the increase in the prices of our imports is an increase in real losses for the economy.  

When the budget - not the economy - becomes the beginning and the end, and when its approval is delayed for any reason, it will delay and disrupt everything with it. The machine stops spinning. Rather, it rotates backwards. The experience of the previous year (1/12) is reproduced despite the change of circumstances and data. Everything is related to oil. We lose both times. If its prices collapsed, we will be plunged into deficit, indebtedness and crises. If it rises, it will be spent on consumptions and absurdities. There is no doubt that the pressures of reality, especially in the field of employment and dues, will rightly press for urgent solutions. It may not be as integrated and coherent as it should be. This will deepen the real and disguised unemployment crisis, increase the slackness of the state and society, and deepen the rentier economy, which destroys everything else.  

2- Several officials and legislators, who are a minority, worked to develop serious solutions to this situation. But the resistance - conscious and unconscious - to the rentier minds and interests in the state, political forces and society remained the strongest, and represented the overwhelming majority. As many attempts have been made to apply the oil-for-reconstruction argument, or to harness oil money to stimulate the economy outside the budget. However, as soon as these efforts achieve a correct step, they are obstructed, obstructed, or distorted. These are (3) examples of large files that have been completed, or almost done. There are others, which could have been used in our present circumstance.  

3- The “National Oil Company” with its law in force (facts -4486- 9/4/2018), in which brother Dr. Ibrahim Bahr al-Ulum played a prominent role - in consultation with experts - to reformulate some of its articles and pass it in the House of Representatives. For example, Article (12) allocates no more than (90%) of the company's profits to the state treasury, that is, oil imports minus costs and some deductions. And no less than (10%, subject to increase) for the “citizen’s fund” as shares for citizens, the “generations fund” for the benefit of the future, and the “reconstruction fund” for strategic projects. And Article (18) in particular (fifth and sixth) for the development of the agricultural, industrial and service sectors, and many other things.  

4- With a joint effort from the Presidency of the Republic and the ministers, the Council of Ministers voted on 18/9/2019 on the draft “Council for Reconstruction” bill, and it was sent to the House of Representatives for approval. Provides for allocating (5%) of oil resources to strategic projects and infrastructure. To replace the "Council of Reconstruction" law in the fifties of the last century, which contributed to many projects whose benefits we are still enjoying today.  

5- The Iraqi-Chinese agreement. (100) thousand barrels / oil / day (subject to increase). It has currently collected about (1-2) billion dollars. Prepared - with the addition of funds allowed by the mechanisms of the agreement - to invest in infrastructure, anchor and investment projects in various sectors. It absorbs more labor, develops the gross national product and reduces dependence on oil.  

6- (3 and 5) above are legislators and are effective, and (4) requires action from the legislative authority after the completion of the first reading, and after the current government has already made amendments to the draft of the previous government.  

7- These laws alone allow - for the purposes of budgeting - to dispose of resources close to - and may exceed - what was allocated for "food security". Not to mention that this will take place in a fundamental, legal, regulatory and sustainable manner. It gives us flexibility to solve some urgent problems of benefits, contracts and food security, and the ability to develop the non-oil sectors as well. We better deal with issues of employment and development. We face developments, whether when oil prices drop or rise."  

He concluded by saying, "Therefore, the necessity of unifying our word, our philosophy and our conceptual references, and the priority of economic and societal visions over financial and routine visions, and over visions of the rentier state and economy."

He continued, "Now, after this atmosphere, the law is not considered a substitute for the budget, given that the budget determines the exchange doors and is one of the original government's prerogatives, and the framework focused on the need to include a single within the law that it would not be contrary to the decision of the Federal Court."

Parliamentary Finance sets a condition for contracting with graduates within the Food Security Law

Shafaq News/ The Minister of Water Resources, Mahdi Rashid Al-Hamdani, considered on Saturday that his ministry had received the lowest financial allocation among the Iraqi state ministries in the emergency food security support law recently approved by the House of Representatives.

This came in a statement he made to reporters today during an inspection visit conducted by the Floating Tharthar Pumping Station in Anbar Governorate / Fallujah District.

In his statement, the minister said, "Unfortunately, we were disappointed with the allocations that were specified in the Food Security Law, and we would have liked the support to have been more than that, because the issue is related to food security and water security, the most important part of food security."

He added that "it was supposed to allocate a trillion Iraqi dinars to the Ministry of Water Resources as a maximum and about 400 billion dinars as a minimum, but we were surprised by the allocation of only 100 billion, which is the lowest ministry among the Iraqi state ministries."

Al-Hamdani reiterated his position regarding the country's water quotas from upstream countries, saying: Iraq's water rights are a red line that cannot be crossed for any reason.

Noting that "this law transformed a government that does not have financial powers to an original government that has all the financial powers, because its powers as a caretaker government (only the operating budget according to the 12/1 mechanism), but according to this law it has a full operating budget in addition to the investment budget, and it has not There remains a difference between the caretaker government and the original government, in fact, the paragraphs of this law constitute half of the entire budget.”

For his part, an expert in financial affairs, Obaid Mahal, said in an interview with “Al-Sabah”: “The law does not include evidence of (food security) in its paragraphs, as the presence of large and ongoing projects within it constitutes two-thirds of the budget, while the government can provide balance, which is in its power.”  
He explained that "the government, before turning into a caretaker government, was obligated to submit the budget in accordance with the Financial Management Law, and the period during which the ministries should have submitted their budgets was in May 2021 and they are discussed by the Ministry of Finance, then they are sent to the Finance Committee and then to the Council of Ministers." He added, "The number of contracts is large, and the amounts allocated in the law may be insufficient, as happened in the 2021 budget, which did not include everyone," noting that "the Food Security Law will address urgent and not permanent issues, but the budget law will address all matters." 
He pointed out, "The implementation of the Food Security Law will be after the approval of the President of the Republic and its publication in the Official Gazette," noting that "the money is supposed to be released to the parties that have been set on schedules within the law after publication in the Official Gazette." 
He pointed out that “there are important issues that do not bear the delay in disbursing money, such as paying electricity debts, the ration card, and other aspects related to contracts and lecturers,” explaining that “every executive employee should realize the importance of these issues related to the citizen and prepare as long as there is sufficient time to know the implementation mechanisms and the instructions that It should be issued in this regard.” 
Yesterday, Tuesday, Prime Minister Mustafa Al-Kazemi directed all ministries and agencies not associated with a ministry to expedite the preparation of an inventory of the names of contractors who have contract service of no less than two years in preparation for their confirmation, while the Council of Ministers issued decisions regarding contracts and daily procedure.
A statement issued by the Prime Minister's Media Office, received by (Al-Oula News), said:
Al-Kazemi stipulated in the above directive to ensure that the necessary financial allocations are available without requesting additional financial allocations; This is in fairness to the segment of contracts and daily wages, and for the purpose of improving their standard of living and calculating their services.”
The Council of Ministers approved calculating the daily wage service for daily wage earners in accordance with the provisions of Article (5) of Labor Law No. (37) for the year 2015, which authorized the calculation of the worker’s service for the purposes of determining salary and retirement in the event that it is fixed on the permanent owner, provided that pension contributions are met, in coordination with the Ministry of Finance, and the Federal Public Service Council.
The Council affirmed the suspension of appointment as a contract or daily wage in a way that does not contradict the law of emergency support for food security and development, which the House of Representatives recently voted on.

Parliamentary Finance reveals the government’s options to install contractors
  
{Economic: Al Furat News} The Parliamentary Finance Committee revealed the government's options for installing contract holders.

Committee member Jamal Cougar told {Euphrates News} that "the committee authorized in the law of emergency support for food security and development to install the segment of contractors who have served two years for the owners and for a period of three years."
He added, "The government is free to deal with the decision to confirm them within the food security law allocations, with the approval of the Ministry of Finance. If they are permanently proven, this is considered that the government dealt with the food security law similar to the budget law."
On June 8, the House of Representatives voted on the proposed emergency support law for food security and development, while the Parliamentary Finance Committee indicated that the law included the allocation of 15,000 new contracts for bachelor graduates for three years and a salary of 300,000 dinars, provided that these contracts are distributed among 15 governorates within Regional development allocations.
Parliamentary Finance specified a condition in contracting with graduates, including having a diploma or a bachelor’s degree and according to the need or specialization for each governorate,” noting that “the contract will be for a period of three years with a salary of 300,000 Iraqi dinars for the purposes of training and development.”

Shafaq News / Wasit Governor Muhammad Jamil Al-Mayahi demanded today, Saturday, the Ministry of Finance to clarify the mechanism for appointing contracts in the governorate from bachelor and diploma graduates within the "share of his governorate" in accordance with the law of emergency support for food security and development.

 

Wasit Governor Muhammad Jamil Al-Mayahi said in a document that he addressed the Ministry of Finance regarding contract appointments, obtained by Shafak News Agency; “A letter to the Ministry of Finance that includes contracts with holders of bachelor’s degrees and diplomas and for all specializations at a rate of 1,000 contracts for each governorate according to the Emergency support Law for Food Security and Development.”

 

The governor called on the Ministry of Finance to "describe the mechanism that we adopt in appointing contracts so that we can report on those grades."

 

On June 14, 2022, Prime Minister Mustafa Al-Kazemi directed the ministries and state institutions to expedite the inventory of the names of contract employees in all departments who have a job service for two years or more in preparation for their confirmation on the permanent staff.

 

And the Ministry of Finance decided, on May 30, 2022, to include the allocations necessary to convert free lecturers and administrators in the Ministry of Education into contracts in accordance with Resolution 315, and it had no objection to implementing this, in the event the House of Representatives desired, a request to include a text authorizing the Federal Minister of Finance to create degrees for the nominees to add allocations Financial for the purpose of the research.

 

In many governorates, over the previous periods, demonstrations were witnessed in which the lecturers, the daily procedure, and the contractors were demanding their confirmation and fairness of their rights in permanent appointment to the owners of the ministries to which they belong. And the law enforcement forces to protect the Green Zone, which includes the headquarters of the Iraqi government, after the demonstrators demanded their inclusion in Resolution 315, before the protest developed into a verbal altercation and friction with the security forces.

 

Resolution "315" includes mechanisms to address the status of workers as contracts and daily wages in various government institutions, which the Council of Ministers voted on in 2019.
