Erbil (Kurdistan 24) - Iraqi Oil Minister Ihsan Abdul-Jabbar on Monday proposed establishing a new oil company headquartered in Erbil to manage the Kurdistan Region's oil dossier.

The oil minister called for reviewing the contracts and agreements signed by the Kurdistan Regional Government (KRG) with oil companies and foreign countries.

He made the remark at a joint press conference with Khaled Swani, the head of the Kurdistan Region's negotiating delegation in Baghdad.

Abdul-Jabbar also called for opening a bank escrow account in one of the international banks to deposit the revenues from the KRG's sale and export of crude oil. That account will belong to the Iraqi Ministry of Finance. It will be used to arrange payments in favor of the Kurdistan Region if the Iraqi Ministry of Finance doesn't send the region its dues on time.

"In principle, the KRG should send all contracts and agreements it signed with countries and oil companies for the purpose of reviewing, amending, and improving them, as well as transferring the contracting party from the KRG Ministry of Natural Resources to an oil company established for this purpose by a decision of the Iraqi Council of Ministers," Abdul-Jabbar stated.

The minister emphasized the joint work between Baghdad and Erbil to solve all problems. He added that the KRG delegation will go back to Erbil for consulting with the KRG before holding another round of negotiations.

"Legislating the Iraqi oil and gas law is the best solution for solving all the problems," Shwani said. "This meeting is a new beginning for cooperation between the Iraqi oil company and the KRG."

{Political: Al Furat News} A representative of the Kurdistan Democratic Party revealed that a delegation from the Kurdistan Regional Government intends to visit the capital, Baghdad.

Najwa Kakai said in a press statement: "A delegation from the region is scheduled to visit Baghdad, tomorrow, Monday, to meet with officials in the Iraqi federal government to discuss a number of files, the most important of which are oil and energy."
She added, "The Kurdistan Regional Government conducted a reading of the situation, and the two parties (Erbil and Baghdad) considered it important that they meet to discuss a number of files, including agriculture, oil, energy and border crossings."
According to sources, the delegation of the Kurdistan Regional Government to Baghdad consists of the Minister of the Region for Dialogue with Baghdad, Khaled Shwani, the Chief of the Cabinet of the Presidency of the Council of Ministers of the Kurdistan Region, Omid Sabah, the Secretary of the Council of Ministers, Amanj Rahim, the Head of the Coordination and Follow-up Department in the Council of Ministers, Abdul Hakim Khusraw, and the Committee Technology from the Ministry of Natural Resources.
And the Kurdistan Regional Council of Ministers decided, in its weekly meeting held on April 6, to send a higher committee to Baghdad to discuss with the relevant authorities in the federal government for the purpose of developing coordination in the field of oil and energy on the basis of the constitution and taking into account the constitutional powers of the Kurdistan region in this sector.
It is noteworthy that the Federal Supreme Court of Iraq issued a ruling on February 15, deciding the unconstitutionality of the Oil and Gas Law of the Kurdistan Regional Government, issued in 2007, and its abolition for violating the provisions of constitutional articles, as well as obligating the region to hand over oil production to the federal government.
The oil file is one of the most prominent outstanding issues between Baghdad and Erbil.

Today, Monday, the Ministry of Oil announced its agreement with its counterpart in the Kurdistan region, on a number of issues regarding the oil file, in the first meeting of the two committees formed for this purpose.

This comes after the decision of the Federal Supreme Court last February, handing over oil and managing its facilities to the Federal Ministry; This sparked widespread controversy and anger in the region.

The ministry said in a statement, "It was agreed on the basic principles, which is to send all contracts and agreements concluded by the Kurdistan Regional Government with countries and oil companies."

The statement added that this is for the purpose of “reviewing, amending and improving it, and transferring its contracting party from the Ministry of Natural Resources to an oil company established for this purpose, headquartered in Erbil, owned by the federal authority.”

The statement quoted Iraqi Oil Minister Ihsan Abdul-Jabbar as saying: "The basic principles also included opening a bank guarantee account in one of the international banks."

According to Abdul-Jabbar, this account is for the purpose of “depositing all revenues from the sale and export of crude oil, and it is owned by the Ministry of Finance, and is used to secure payments in favor of the region in the event of a delay in sending it from the Federal Ministry of Finance.”

The Iraqi minister stressed that "work is continuing to solve all problems, bridge the gap left by the problems of the past years, and launch a new phase of cooperation in a way that serves the public interest."

For his part, the head of the region's delegation, Khaled Shwani, said that "the meetings were characterized by frankness, as it was agreed to put in place mechanisms that could form a future plan of action to address the oil problem in all its aspects in a radical way."

Shwani stressed that "the oil and gas law (not yet approved) is the best solution to remove all problems, and that this meeting represents a good start for cooperation between the Ministry of Oil and the regional government."

The Federal Court of Iraq had ruled that an oil and gas law regulating the oil industry in Iraqi Kurdistan was unconstitutional, and demanded that the Kurdish authorities hand over crude supplies to the federal government.

It is noteworthy that the Kurdistan region is semi-autonomous and has untapped oil reserves, profitable contracts to participate in production, and a secure environment that has prompted international oil companies over the past few years to pledge to invest billions of dollars there.

The Kurdistan Regional Government has been developing oil and gas resources independently from the federal government in Baghdad, since 2007, when it enacted its own law, establishing the directives through which it manages these resources.

The decision of the Iraqi Federal Court obligated the Kurdistan Region to “hand over oil to the federal government represented by the Iraqi Ministry of Oil.”

An official source in the National Oil Company had announced in an interview with Shafaq News Agency that joint committees from Baghdad and Kurdistan will discuss how to implement the Federal Court's decision.

SULAIMANI— Iraq's State Organization for Marketing Oil (SOMO) said on Monday (April 11) that it respects the federal court's decision on the unconstitutionality of the Kurdistan Region's oil contracts with International Oil Companies (IOCs).

"SOMO's position is based on respecting the federal court's decision which it is the only official body authorized to market Iraqi oil," according to a statement on SOMO's official website.

It added that from the beginning, SOMO has expressed its position and warned the IOCs who are dealing with the Kurdistan Regional Government (KRG) without the permission of the federal government and the Oil Ministry that all contracts in the Kurdistan Region for the production and sale of oil are "unconstitutional and unlawful."

It went on to say that "the Iraqi Oil Ministry is the only body who can lawfully and in accordance to the constitution manage Iraq's oil and gas fields, including those in the Kurdistan Region."

SOMO added that the Iraqi Oil Ministry had taken all steps required to implement the Iraqi Federal Supreme Court's ruling in February that ordered the oil ministry and the Federal Supervisory Board to manage the Region's oil and gas fields.

In February, the KRG spokesman, Jotiar Adil, said that the authorities in Erbil assured the oil companies operating in the Region that the KRG remained committed to their agreements.

While Adil said the KRG was committed to its agreement with Baghdad, he said the KRG would take all legal and constitutional procedures to defend its rights and protect contracts and agreements with oil companies.

ERBIL (Kurdistan 24) – The Kurdistan Regional Government (KRG) delegation will visit Iraq's capital Baghdad in the "coming days" to continue oil and gas talks with the central government, a Kurdish media official said on Tuesday.

"The Kurdistan Regional Government will meet the Iraqi Oil Ministry and other Iraqi officials once again in coming days to discuss the KRG oil and gas sector," Lawk Ghafuri, head of the KRG's Foreign Media Relations, tweeted on Tuesday. "The negotiation will be ongoing until Erbil and Baghdad reach a concrete agreement regarding this outstanding issue."

A Kurdish delegation met with the Iraqi Minister of Oil Ihsan Abdul-Jabbar and other relevant authorities in Baghdad on Monday for the first time since the country's Federal Supreme Court (FSC) contentiously ruled against the Kurdistan Region's oil and gas sector.

The officials discussed a number of proposals made by the Iraqi authorities to reach an agreement on Kurdish oil and gas. One proposal was to establish a national company managed by Baghdad to oversee all the contracts the KRG signed with local and international oil companies, Abdul-Jabbar announced on Monday.

Under the FSC ruling, the Kurdish oil and gas deals are "unconstitutional" and must be brought under Baghdad's authority. Kurdistan Region Prime Minister Masrour Barzani has firmly rejected the decision and described it as "unconstitutional" and "politically motivated".

Despite strong objections to the decision, Barzani has expressed the Kurdistan Region's willingness to resolve all the existing issues with Baghdad constitutionally.

Yesterday, Tuesday, the Federal Supreme Court issued its decision regarding the lawsuit filed by the Ministry of Oil against the Kurdistan Regional Government, regarding the oil dues, according to which it obligated the region to pay all dues to the Center since the date of oil production in the region in the year 2004 to the date of filing the lawsuit in 2012.
An official in the Kurdistan Democratic Party promised that the decision was "unfair" to the region because there is no oil and gas law legislated by the central government, but stressed the region's "commitment" to this decision.
A member of the Kurdistan Democratic Party, Mahdi Karim, said in an interview with "Al-Sabah": "The court's decision is binding on all parties, including the region, and there will be no gap because of this decision," expressing his hope that the (oil and gas law) will be legislated by the parliament in the center. To avoid problems, this is what we will emphasize.”
He added, "The decision is a natural matter and we respect the decisions of the Federal Court, but there must be fairness first, given that the main (oil and gas law) in Baghdad has not been legislated until this moment, and this includes unfairness to the region and even to Baghdad because if the law was legislated, there would be no work. outside the constitution.
He added that "the region is bound by the decisions of the Federal Court by virtue of the agreement between the region and the center, and financial control exists and supervises all export matters, and this is clear evidence of the region's commitment to the decisions of the court."
In the meantime, the legal expert Haider Al-Sufi explained in an interview with “Al-Sabah” that “the Federal Court’s decision included obligating the regional government to pay the federal government the oil revenues from the date of 2004, that is, since the start of oil production until 2012, which is the date of the lawsuit, but after that, the decision was given to the government.” The right to demand another lawsuit for the dues from 2012 until now.”
Al-Sufi said: "The Federal Court ruled from the date of the region's oil production until the date of the lawsuit. As for what follows, it needs a new lawsuit, and the lawsuit that will be filed contains a fixed constitutional document that is the current court's decision, meaning that it does not need investigations and evidence."
And he stated that "the federal government must demand these dues, because the court's decision obligates it to do so, even if the issue is political, because the issue is also legal."
And he added, "If the region refuses to pay, other measures are taken against it, including cutting its share of the budget or cutting its entitlements," noting that "the delay in the lawsuit's decision was due to many issues, the first of which is that the representative of the regional government has not attended the court for nearly four years, and it cannot be The court was held without the presence of the parties to the case, and after their presence there were delays and delays.”
He continued, "The change of court members also led to the suspension of the case until the new court is held," stressing that "the government, in the event of a second lawsuit, will not be delayed because it will be based on the ruling issued (yesterday on Tuesday), meaning that during one or two sessions it wins the ruling." .
Yesterday, Tuesday, the Federal Court issued a ruling that the oil and gas law in the Kurdistan Regional Government is unconstitutional. The court also obligated the region to hand over oil to the federal government. The court’s decision also obligated the Federal Oil Ministry to follow up on all contracts of extraction, production and export that were unique to the region.

Now this decision , and the Kurdistan response makes sense. Why send in the oil dues since it is not based on a written and enforceable HCL, just legal opinions.  At least they are not outright rejecting this decision . Write the law ! Get your oil dues.

Representative Ali Shaddad
(Al-Akhbar) - Representative Ali Shaddad Al-Faris praised the outcomes of the meeting held between the Federal Ministry of Oil and the delegation of the Kurdistan region, which requires the importance of the provisions of the Ministry of Oil on all oil operations in the region, including production and export operations.

Al-Fares said, "This meeting, which is considered the most important of its kind to manage the oil operations in the region in accordance with the Iraqi constitution and the laws in force, came after the Federal Court Decision No. (110 in 2019) issued on February 15 2022, according to which the oil and gas law in the region was rescinded accordingly. On a lawsuit submitted by Qebna before the Iraqi judiciary, he will contribute, if the region is committed to all its outputs, in a fair distribution of wealth, and will have the largest role in re-establishing the federal government’s authority over all the files that the Iraqi constitution has limited to it only.”

Al-Fares pointed out that "the meeting that took place in the Iraqi capital, Baghdad, between the delegation of the region and the Ministry of Oil concluded several basic outputs, including a comprehensive re-study and evaluation of all oil contracts concluded by the regional government with international oil companies, as well as obligating the region to hand over the exported oil revenues to The Ministry of Finance through a bank account that is established for the same purpose, provided that a new company owned by the Ministry of Oil is established to manage the oil operations in the region.
