ERBIL, Kurdistan Region - Erbil and Baghdad on Monday will hold the first round of talks regarding the Kurdistan Region’s oil and energy sector weeks after the Iraqi top court ruled the Kurdish oil and gas to be unconstitutional.

A high-ranking delegation representing the Kurdistan Regional Government (KRG) is expected to meet with Iraqi officials in Baghdad to “discuss the executive procedures” and to “agree on a new and a standard mechanism” for managing the Region’s oil, read a statement from the Iraqi oil ministry on Monday.

The ministry noted that it has held “intensive and special meetings and workshops with local and international experts,” assigning consultants to review all contracts concluded between the KRG and international companies.

In mid-February, the Iraqi Federal Supreme Court ruled against the Kurdistan Region’s oil and gas law that regulates the oil sector in the Region, putting its industry in jeopardy. The ruling was widely condemned by Kurdish officials.

The KRG passed its oil and gas law in 2007, enabling it to administer and develop its own oil and gas resources.

The top court’s decision found the law to be “unconstitutional,” and therefore struck down the legal basis for the independence of the Kurdistan Region’s oil and gas sector. The decision came amid ongoing political tension and an ongoing government formation process as the country has failed to elect a president six months after the elections.

The KRG, at the time, responded to the decision saying the court’s ruling in unconstitutional and unjust.

Erbil has since expressed its readiness to discuss the matter with Baghdad.

The KRG’s delegation, which arrived in the Iraqi capital on Sunday, consists of government figures and officials from the natural resources ministry, along with three ministers, the statement noted, without disclosing names.

The talks aim to serve the public interest and to contribute to strengthening and supporting the national economy and the integration of the national oil industry, the Iraqi oil ministry noted in its statement.

Disputes rose between Baghdad and Erbil in early 2014, when Baghdad cut the Region’s share of the federal budget, setting into motion a series of crises that the KRG still suffers from. By March 2014, the KRG started exporting its oil abroad in an attempt to secure the salaries of its employees.

KRG’s Deputy PM Qubad Talabani on Saturday saidthe court’s decree against the Kurdish oil is an opportunity to settle the issue of oil with Baghdad. 

The Iraqi and Kurdish governments were once again brought around the table in 2021 when Iraq was drafting its budget law. Both sides agreed that the KRG would continue its oil sales, and in return would hand the revenue of 250,000 barrels of oil to Baghdad daily.

He added that "one of the topics of discussion between the two sides is the decisions recently taken by the Federal Court regarding the oil and gas sector in the Kurdistan region."

He pointed out that "the delegation consists of Khaled Shwani, Omid Sabah, Abdul Hakim Khosrow and Amanj Rahim."

A statement by the ministry, a copy of which was received by "Nass", (April 11, 2022), stated that " the first meeting between the Federal Oil Ministry and a high-level delegation representing the Kurdistan Regional Government will be held in Baghdad today, Monday, to discuss the executive measures, after the Federal Court's decision, and to agree on the MechanismsA new and standard approach to managing the oil industry file in the region, in a manner that achieves the highest benefit and financial returns in the service of the public interest, and that contributes to strengthening and supporting the national economy and the integration of the national oil industry.  

The statement indicated that "the Ministry of Oil has formed specialized committees in this regard to prepare a road map to discuss and circulate all files related to the oil industry in the region, and held intensive specialized meetings and workshops with local and international experts, and assigned specialized consultants to review all contracts concluded between the regional government and international companies."  

He also indicated that "the delegation of the regional government, which arrived in Baghdad, includes a number of officials in the government and the Ministry of Natural Resources, including three personalities with the rank of minister."

And the Federal Court ruled, last February, the unconstitutionality of the oil and gas law in the Kurdistan Regional Government.  

And the judiciary's media stated in a statement that "Nass" received a copy of it, (February 15, 2022), that "the Federal Court issued a ruling that the oil and gas law in the Kurdistan Regional Government is unconstitutional."      

He added that "the federal government obligated the region to enable the Ministry of Oil and the Federal Office of Financial Supervision to follow up on the conclusion of contracts for the sale of oil and gas in the region."      

The federal government also obligated "the regional government to hand over to the federal government, represented by the Federal Ministry of Oil."

On Tuesday (February 15, 2022) the Federal Court issued a decision that the oil and gas law of the Kurdistan Regional Government was unconstitutional, with its obligation to hand over all oil production from oil fields in the region and other areas from which the Kurdistan Ministry of Natural Resources extracted oil and handed it over to the federal government represented by the Federal Ministry of Oil And enabling it to use its constitutional powers regarding oil exploration, extraction and export.

The President of Kurdistan Region, Nechirvan Barzani, described the decision as "unconstitutional" and was based on a law of the time of the former regime, and the regional government stressed that "such an unconstitutional decision cannot be accepted."

The ministry said in a statement received by Shafaq News Agency that it will hold in Baghdad today, Monday, the first meeting between the Federal Oil Ministry and a high-ranking delegation representing the Kurdistan Regional Government, in order to discuss the executive procedures, after the decision of the Federal Court, and to agree on new and standard mechanisms for managing the file of the oil industry in the region, In order to achieve the highest benefit and financial returns in the service of the public interest, it contributes to strengthening and supporting the national economy and the integration of the national oil industry.

She added that the delegation of the regional government, which arrived in Baghdad, includes a number of officials in the government and the Ministry of Natural Resources, including three personalities with the rank of minister.

And the Kurdistan Region began to sell its oil in isolation from the federal government, after a stifling financial crisis as a result of the collapse of oil prices during the ISIS invasion of areas in Iraq, in addition to the disputes with Baghdad that prompted the latter to stop paying the salaries of the region’s employees.

Baghdad says its national oil company, SOMO, is the only one authorized to sell Iraqi crude oil, but each side claims the constitution is on its side. Since the Iraqi oil and gas law remained imprisoned in the drafting stage due to differences, there was room for maneuver.

The oil file is one of the most prominent outstanding issues between Baghdad and Erbil.

Baghdad used to pay 453 billion Iraqi dinars per month (about $380 million) as salaries to the employees of the Kurdistan Region, but it stopped them after the region conducted the independence referendum on its part, and because of what Baghdad said that the region was not committed to handing over its oil in accordance with the terms of the federal budget.

After several rounds of political negotiations, the region was obligated, according to an agreement with the government in Baghdad, to hand over 250 thousand crude barrels per day of crude oil produced from its fields to the state-owned company SOMO, and hand over the revenues to the federal public treasury.

SULAIMANI—The Iraqi Oil Ministry and a Kurdistan Regional Government (KRG) delegation have discussed the Kurdistan Region's oil and gas sector in a meeting in Baghdad today, 11 April. 

According to a statement issued on the Iraqi Oil Ministry's website today, the meeting is the first in a series of meetings between the two sides discussing "practical procedures" following the federal court's ruling on the "unconstitutionality" of Kurdistan Region's energy sector.

They also discussed "agreement on new and standard mechanisms for managing the region's oil industry to achieve the highest benefit and financial returns in the public interest, contributing to strengthening and supporting the national economy and the integration of the national oil industry" the statement added. 

In March, the court ruled that the independent sale of the Region's oil and natural gas was against the Iraqi constitution.

The KRG has said it is committed to its agreement with Baghdad and will take all legal and constitutional procedures to defend its rights and protect contracts and agreements with International Oil Companies (IOCs).

The ministry has formed specialized committees to "prepare a roadmap to discuss all the files related to the region's oil industry," it added.

In addition, the ministry has held intensive specialized meetings and workshops with local and international experts, and the Iraqi National Oil Company has tasked expert consultants to review all current contracts between the KRG and IOCs.

The KRG delegation included several senior officials, including Ministry of Natural Resources officials.

She added, "The Kurdistan Regional Government conducted a reading of the situation and the two parties (Erbil and Baghdad) considered it important that they meet to discuss a number of files, including agriculture, oil, energy and border crossings."
According to sources, the delegation of the Kurdistan Regional Government to Baghdad consists of the Minister of the Region for Dialogue with Baghdad, Khaled Shwani, the Chief of the Cabinet of the Presidency of the Council of Ministers of the Kurdistan Region, Omid Sabah, the Secretary of the Council of Ministers, Amanj Rahim, the Head of the Coordination and Follow-up Department in the Council of Ministers, Abdul Hakim Khusraw, and a committee Technology from the Ministry of Natural Resources. 
And the Kurdistan Regional Council of Ministers decided, in its weekly meeting held on April 6, to send a higher committee to Baghdad to discuss with the relevant authorities in the federal government for the purpose of developing coordination in the field of oil and energy on the basis of the constitution and taking into account the constitutional powers of the Kurdistan region in this sector.
It is noteworthy that the Federal Supreme Court of Iraq issued a ruling on February 15, deciding the unconstitutionality of the Oil and Gas Law of the Kurdistan Regional Government, issued in 2007, and its abolition for violating the provisions of constitutional articles, as well as obligating the region to hand over oil production to the federal government.
The oil file is one of the most prominent outstanding issues between Baghdad and Erbil.

SULAIMANI — The second deputy speaker of the Iraqi parliament, Shakhawan Abdullah, said on Monday (April 11) the Iraqi government knows it cannot manager the oil sector alone without coordinating with the Kurdistan Regional Government (KRG).

Abdullah said a delegation from the KRG met with a delegation from the federal government on Monday for talks on the country’s oil and gas law and the federal supreme court’s ruling in February on the Region’s independent oil sales.

The meeting between the delegations is the first in a series of meetings that will be held to discuss "practical procedures” following the federal court’s ruling on the "unconstitutionality” of the Kurdistan Region’s energy sector, according to the Iraqi Oil Ministry’s website. 

Abdullah said both delegations wanted to meet with parliament as well but were unable to do so on Monday. 

The deputy speaker stated the Iraqi constitution does not allow the government to manage an area’s oil sector without the approval of the locals and the delegations are meeting to resolve the issue.

SULAIMANI — Iraq’s Oil Minister, Ihsan Abdul-Jabbar, said on Monday (April 11) the ministry met with the Kurdistan Region’s delegation to discuss the Region’s oil contracts. 

Abdul-Jabbar said the Kurdistan Region’s oil contracts should be reviewed and a new company should be established in Erbil to manage the oil sector, which would be supervised by the federal oil company. 

He also said his ministry abides by the basic principles previously proposed by the oil ministry regarding the management of the Kurdistan Regional Government’s (KRG) oil. 

The basic principles were to send to the Iraqi Oil Ministry all contracts and agreements the KRG has made with other countries and their oil companies for the ministry to review, amend and develop, Abdul-Jabbar said. 

The minister said it would be in the best interest of the public for a joint effort to be made to resolve problems and fill the gap that has stemmed from the issues of previous years and begin a new phase. 

Speaking on the KRG delegation’s visit to Baghdad on Monday, Abdul-Jabbar said the Kurdish delegation will return to Erbil to discuss with the KRG the start of another round of meetings and dialogue with the delegation from the federal government.

Khalid Shawani, the head of the KRG delegation, said they were direct in Monday’s meeting and agreed to work on developing mechanisms that could form future work plans to resolve the oil problem between the Kurdistan Region and Baghdad. 

Shawani also said the oil and gas law was the best solution to the pending issues and Monday’s meeting signals a good start to cooperation between the oil ministry and the KRG. 

Iraq’s Federal Supreme Court ruled on February 15 that the KRG law on the independent sale of the Region’s oil and natural gas was against the constitution. 

The court asked the KRG to transfer the management of oil and gas sales to the federal government and required the KRG to allow the Iraqi oil ministry and the Federal Supervisory Board to investigate and supervise all of Erbil’s natural gas and oil contracts.

The statement came after a meeting between a high-ranking delegation from the Kurdistan Regional Government (KRG) with Iraqi Oil Minister Ihsan Abdul Jabbar in Baghdad, which discussed the issue in light of a recent ruling by the Iraqi Supreme Federal Court on KRG’s oil industry. 

After the meeting, Iraqi oil minister Ihsan Abdul Jabbar held a joint press conference with Khalid Shawani, KRG's minister of state for negotiation affairs with the federal government.

“Iraq's oil minister stressed on the basic principles that were previously suggested by the oil ministry regarding managing the oil dossier in the Kurdistan region, that includes reviewing and amending all contracts that were signed by the KRG with the international oil companies," the media office of the Iraqi oil ministry said in a statement cited by Arab News. 

The Kurdish delegation will return to Erbil to discuss the proposal with authorities at the KRG, the minister added, noting that the agreement also requires all contracts with foreign companies to be referred to Baghdad for revision. 

According to the Iraqi suggestions, international oil companies will no longer sign contracts with the KRG ministry of natural resources, rather a new oil company based in Erbil and under the supervision of the Iraqi oil ministry will be the only entity to be able to would sign contracts. 

“The company would open a bank account at an international bank and the revenues from selling oil from the Kurdistan region will be directly transferred into the Iraqi finance ministry," the Iraqi oil ministry added. 

Shwani, on his turn, explained that passing a federal oil and gas law would be the best option to address all the disagreements, but the establishment of the oil company, that would be named “Kurdistan Region Oil Company (KROC)” is also a good start for now to enhance cooperation between Erbil and Baghdad.

Erbil (Kurdistan 24) - Iraqi Oil Minister Ihsan Abdul-Jabbar on Monday proposed establishing a new oil company headquartered in Erbil to manage the Kurdistan Region's oil dossier. 

The oil minister called for reviewing the contracts and agreements signed by the Kurdistan Regional Government (KRG) with oil companies and foreign countries. 

He made the remark at a joint press conference with Khaled Swani, the head of the Kurdistan Region's negotiating delegation in Baghdad.

Abdul-Jabbar also called for opening a bank escrow account in one of the international banks to deposit the revenues from the KRG's sale and export of crude oil. That account will belong to the Iraqi Ministry of Finance. It will be used to arrange payments in favor of the Kurdistan Region if the Iraqi Ministry of Finance doesn't send the region its dues on time. 

"In principle, the KRG should send all contracts and agreements it signed with countries and oil companies for the purpose of reviewing, amending, and improving them, as well as transferring the contracting party from the KRG Ministry of Natural Resources to an oil company established for this purpose by a decision of the Iraqi Council of Ministers," Abdul-Jabbar stated. 

The minister emphasized the joint work between Baghdad and Erbil to solve all problems. He added that the KRG delegation will go back to Erbil for consulting with the KRG before holding another round of negotiations. 

"Legislating the Iraqi oil and gas law is the best solution for solving all the problems," Shwani said. "This meeting is a new beginning for cooperation between the Iraqi oil company and the KRG."

The Oil and Gas Law, as previously written, does establish a new oil company for all of Iraq. It dissolves the old (current) one and puts in place a new Oil and Gas company going forward. In 2019, or so, they tried to implement this part of the Oil and Gas law but were thwarted. Which is why they, Shwani and the Baghdad delegation, are clamoring for legislating the Iraqi Oil and Gas Law.

Abdul-Jabbar said in a press conference followed by Shafak News Agency; "The joint mechanisms for managing the oil and gas industry in the region were discussed with the delegation of the Kurdistan Region, in a manner that protects the interests of the parties and leads to the development of this industry and its establishment in its right position and the maximization of the federal state's revenues, all of which would protect the rights of the parties and achieve the general balance of the state."

He added, "The goal of the Ministry of Oil is clear in the various companies and activities, which is to maximize state revenues and interests in a way that secures the state's inevitable spending needs and in a manner that secures the salaries of all the people of the country and leads to the establishment of development rules."

Abdul-Jabbar emphasized; "The delegation of the region came very understanding of these necessities in which the ministry operates, as the ministry's policy is almost standard policies. We are working to develop all instructions and documents to conform to international standards and lead to raising the level of performance in all activities across the country."

He pointed out that "these problems need discussions. He pointed out that "these discussions are a good start between the federal government and the Kurdish region in resolving the oil and gas file in a manner that achieves the highest benefit for the Iraqi people in accordance with the mechanisms stipulated in the constitution."

Today, Monday, the Ministry of Oil announced that it had received the first delegation from the Kurdistan Region to discuss the oil file.

The Federal Supreme Court had declared last February 15 that the oil and gas law of the Kurdistan Regional Government was unconstitutional and abolished, and obligating the regional government to hand over all oil production from oil fields in the Kurdistan region and other areas from which the Ministry of Natural Resources in the Kurdistan Regional Government extracted oil and handed it over to the government Federal, represented by the Federal Ministry of Oil.
