Members of the Iraqi Council of Representatives voted in favor of a proposed law to “criminalize normalization” with Israel, a law proposed by the Sadr bloc and its former allies, the “Save a Homeland” alliance, which broke apart after al-Sadr withdrew from the political process.

The new law stipulates penalties, including life or temporary imprisonment, and aims, according to its first article, to "prevent the establishment of diplomatic, political, military, economic, cultural, or any other form of relations with the occupying Zionist entity."

Article 201 of the Iraqi Penal Code stipulates that anyone who promotes the principles of Zionism, including Freemasonry, or affiliates with any of its institutions, or helps them financially or morally, or works in any way to achieve its purposes, shall be punished with death.

Iraq does not establish any relations with Israel, and the government and the majority of political forces reject normalization with it.

Out of 22 Arab countries, 6 countries, namely Egypt, Jordan, the UAE, Bahrain, Morocco and Sudan, have declared relations with Israel.

Those who reject normalization of relations with Israel say that it still occupies Arab lands in Palestine, Syria and Lebanon since 1967 and rejects the establishment of an independent Palestinian state with East Jerusalem as its capital.

I usually don’t agree with anything the crooked Kurds have to say but I’m all in with this thief. 

What Al-Sadr needs to understand now is, he is nothing more than the average Joe in Iraq. One of his followers needs to remind him that he and the Sadrist movement no longer exists. He gave up any of his power or influence last week.

He needs to go back to Iran and just chill for a few years…

For the third day in a row, the debate continues in Iraq, over the issue of the outgoing Iraqi President Barham Salih ’s failure to sign the law “criminalizing normalization with the Zionist entity ”, which was approved by Parliament on the twenty-sixth of last month, after an unprecedented attack by the Iraqi religious leader Muqtada al-Sadr , accused In which the Iraqi president refused to sign the law, describing it as "normalizing" and "unpatriotic".

Al-Sadr’s attack was followed by a written clarification of the presidential office, appended to the signature of the “presidency spokesperson,” without mentioning his name, in which he confirmed that President Barham Salih “directed dealing with this law in the form sent by the parliament without any note, and it was published in the Iraqi Al-Waqa’i newspaper on June 20 June 2022 to enter into force.


The statement did not refer to the issue that the president signed the law like many other laws that bore his signature, but rather stated that "he directed the publication of the law in the official Iraqi Gazette," referring to its passage to gain finality and be enforceable. 

The clarification also stressed that "the position of the President of the Republic, Barham Salih, as is well known, is a firm and supportive position for the Palestinian cause and the attainment of the full legitimate rights of the Palestinian people and the liberation of their homeland from the occupation of the Zionist entity."

 

The clarification of the Presidency of the Republic was followed by the publication by media platforms and local Iraqi news websites of a document explaining the marginalization of the Presidency Office about sending the law to the official Gazette as it was sent by Parliament.

 Regarding the ongoing controversy, a senior official in the legal department of the Iraqi parliament in Baghdad told Al-Araby Al-Jadeed that the law had been passed to Al-Waqa’i newspaper from the presidential office to become effective, but without the signature of President Barham Salih’s approval of it, as he contented himself with accepting its passage for publication as it arrived from Parliament. But he did not sign an endorsement like other laws," he said.

And he considered that it is possible to notice the difference between the copy of a law criminalizing normalization and its devoid of the phrase (the President of the Republic decided), and contentment with the phrase based on what was approved by the House of Representatives, while in other laws published in the previous issues of the Gazette, it begins with the phrase (The President of the Republic decided).

 He explained that the attack of the leader of the Sadrist movement Muqtada al-Sadr was not due to Saleh obstructing the law, as its constitutional passage does not require the approval of the Iraqi president. Sherzad Samad, a leader in the Patriotic Union of Kurdistan, to which Iraqi President Barham Salih belongs, defended the latter as "having completed the private belongings that fall upon him", in reference to what is related to the law, commenting on al-Sadr's sharp attack in statements to reporters in Baghdad, that "there are Parties tried to hide these matters (from Al-Sadr) and portray them as unrealistic, in a move to target political interests."

On the other hand, legal expert Ali Jaber Al-Tamimi said that the constitution considered that the president’s ratification of laws is a formality, as he has the right to ratify only and does not have the right to veto or return the law to Parliament.

 

 

He added, in a clarification, he wrote to him that “if the president does not ratify after 15 days, it will be automatically ratified in accordance with Article 73, Paragraph III of the Constitution, but he has the right to appeal before the Federal Court in accordance with Article 93 of the Constitution of the laws enacted in Parliament in accordance with the principle of separation of powers. According to Article 47 of the Constitution,” he said.
