Two of the world’s biggest oil services companies have informed the Iraqi Oil Ministry that they will comply with a Federal Supreme Court (FSC) ruling invalidating the legal foundations of Iraqi Kurdistan's energy sector by not bidding for any new contracts in the semi-autonomous region without Baghdad’s approval.

The U.S. companies Baker Hughes and Schlumberger said in separate communications to Iraqi Oil Minister Ihsan Ismaael, copies of which were seen by Iraq Oil Report, that they would honor the ministry's demand to forego projects managed by the Kurdistan Regional Government (KRG), though they left vague their intentions regarding existing contracts.

National Union member Ghaith al-Sorgi said Tuesday that the regional government would not be included in the budget because it failed to send oil revenues to the center's government.
"The region has not complied with the oil and gas law and has not sent oil revenues to the center, and therefore will not be included in the next budget because of its violation of federal court decisions," Al-Sorji told Al-Sorji.
He called on "the regional government to abide by the laws and regulations established by the Federal Court and the center government," noting the need for "consensus between the two governments to resolve all outstanding differences."
"The withdrawal of oil companies from the Kurdistan region will be in the interest of the whole of Iraq," legal expert Ra'aye al-Khazali said in an earlier interview.

The Necessary U.S. Role in Fixing the Baghdad-Kurdistan Energy Dispute

On February 15, 2022, Iraq's Federal Supreme Court ruled that the 2007 oil and gas law for the Kurdistan Region was unconstitutional, requiring a review of numerous production sharing contracts and oil sales agreements.

If the case prevents oil exports via Iraqi Kurdistan, then the world market will almost immediately lose 500,000 barrels per day, triggering higher oil prices, expanded windfalls for Russia and Iran, the collapse of Iraqi Kurdistan's economy, and a dangerous turn in Baghdad's ties with Erbil and with Ankara.

In this timely Policy Note, Iraq expert Michael Knights calls for the United States to act with other concerned states to resolve the Baghdad-Erbil energy crisis. In doing so, he categorizes the sub-issues of FSC implementation on a spectrum from higher to lower consensus, and explains both sides' views in an unvarnished, direct manner.

A targeted intervention by the United States and its partners, the author argues, could guide the dispute toward a long-overdue resolution that greatly aids U.S. interests and the global effort to find a substitute for Russian and Iranian oil and gas.

The ministry explained that "their latest attempts and plans were to issue an illegal decision far from the constitutional articles and clauses by the Iraqi Oil Ministry in the absence of (the oil and gas law by the federal government), and to put pressure on companies operating in the oil and gas field to leave the Kurdistan Region," stressing That "this step by the Iraqi Oil Ministry is inconsistent with the constitution, the law, the principle of federalism, the economic mentality, and the relations between the region and Iraq."

A member of the State of Law coalition, Wael Al-Rikabi, revealed a political orientation to legislate the Federal Oil and Gas Law from within the House of Representatives to be an alternative to the Federal Court's decision.

Al-Rikabi said, "At the present time, it is difficult to say that there are conditions and dictates between the political blocs, but such points may be raised to establish certain guarantees, including the oil and gas law."

He added that "there is an alternative to the oil and gas law approved by the Federal Court, which is represented by the legislation of the Federal Oil and Gas Law from within the Iraqi parliament."

And that “the legislation of the Federal Oil and Gas Law by the House of Representatives may cancel the decision of the Federal Court,” noting that “there are trends by the political blocs to move towards Parliament and the legislation of the Federal Oil and Gas Law.”
