ERBIL — The Kurdistan Region has begun official procedures to amend the Oil and Gas Law No. 28 of the year 2007 to restructure the Oil and Gas Council and its voting process. 

The amendment is proposed to the parliament by the Kurdistan Regional Government (KRG) to increase the number of the Council members from five to six, according to lawmakers. 

MP Khadija Omar, a member of the Legal Committee of the Parliament, told Kurdistan 24 that amending procedures require the first reading and the finalization of the law by the relevant parliamentary committees before the second reading of the draft. 

According to MP Sherko Jawdat, the amendment is not in relation with the recent rulings by the Iraqi Supreme Federal Court against Kurdistan Region’s energy industry. 

“The Council is responsible for the Kurdistan Region’s oil and gas policies. Therefore, there should be a balanced share of the three main parties in the government. They are planning to amend the law in order to maintain the balance between the parties in the Oil and Gas Council,” he explained.

I think you’re right. The only number I’ve seen over the years is 12.5%.

So while Bagdad never follows the constitution on what they pay the Kurdistan region, why not just take that oil that belongs to all of the people(including the Barzani family), and sell it for profit. Jerks for jerks. None of them are following the constitution. They need the HCL. But now that I'm saying this, what makes me think they will follow the HCL once legislated. :lmao::lmao::lmao:

A statement by the Supreme Oil Committee in Kurdistan, received by (Baghdad today), stated that "the American company informed it of its commitment to Federal Court Decision No. 59 of 2012 and the withdrawal, to be the first oil company to comply with the decisions of the Iraqi government and leave the Kurdistan Region." The Iraqi Oil Ministry had started a series of steps to implement the Federal Court’s decision regarding the Kurdistan region’s oil management file and make it the prerogative of the Iraqi government exclusively, after Erbil and Baghdad failed to reach an agreement formula that ends the crisis that has been going on between them for more than a decade, a demand from oil and gas companies operating in the region. Kurdistan has signed new contracts with the Iraqi Oil Marketing Company "SOMO" instead of the regional government, in a new attempt to control revenues from the region. Baker Hughes is a global industrial services company and one of the largest oilfield services companies in the world. It provides the oil and gas industry with products and services for well drilling, production and reservoir consulting. The company operates in more than 120 countries, has 60,000 employees, and has an estimated capital of $38 billion. The company is currently investing in gas associated with oil extraction.

According to a post by Al-Masawry, seen by Earth News, "The American Baker Hughes Oil Services Company announced its full commitment to implementing Federal Court Decision No. 59 Federal / 2012 and the instructions of the Ministry of Oil and the Supreme Steering Committee regarding the Kurdistan Region's oil."

He explained that "Baker Hughes is one of the world's largest companies in the field of oil field services and provides the oil and gas industry with products and services for oil wells, formation assessment, well completion, and consulting on production and reserves."

Al Marsoumi continued, “Baker Hughes operates in more than 120 countries around the world. Its total assets are $38 billion and employs 60,000 employees. The company has many businesses in Kurdistan, including its implementation of development plans in the Miran and Bina Bawi gas fields.

He pointed out that, "While Baker Hughes is currently investing gas associated with oil extraction in the Nasiriyah and Al-Gharraf fields in Dhi Qar Governorate, with a capacity of 200 million standard cubic feet of gas per day, in addition to producing 1,000 tons of liquid gas and 900 cubic meters of condensate per day, at a cost of 370 Million dollars".

Major international oil companies began withdrawing from the Kurdistan region, after being informed by the federal government on the impact of the dispute between Baghdad and Erbil over the Federal Court's decision to cancel the oil and gas law in the region .

In this regard, the economic expert, Nabil Al-Marsoumi, said today, Friday, that the major international oil companies of American origins withdrew from the Kurdistan region, in compliance with the decision of the Federal Court .

A member of the Parliamentary Economy and Industry Committee, Soran Omar, expected, on Sunday, that the Kurdistan region will witness withdrawals of international companies from the region, indicating that these companies preferred their interests in the south over the problems and disputes between the region and the center.

Omar said in a statement reported by the official "Al-Sabah" newspaper, "It is expected that we will witness other withdrawals of international companies from the region that have major projects in southern Iraq, which preferred their interests with the federal government in a legal manner over the problems and disputes between the region and the center."

He added, "All talks and negotiations so far are about positions and not about the region's entitlement or the problems between it and the center, especially with regard to oil and gas, and it was necessary to solve the problem since the beginning of the Federal Court's issuance of its decision to cancel the oil and gas law in the Kurdistan region."

Regarding the economic effects of the withdrawal of companies from the region, Omar said, “The withdrawal of foreign companies operating in the Kurdistan region will greatly affect the regional government in economic terms, especially since 90% of the revenues of the regional government come from oil imports, and therefore the withdrawal of these companies will stop the export of Oil, and this means ending the region economically, and we hope that this will not happen and that we will not reach this point.”

He continued, "In my opinion, international companies are not in their interest to fight this battle with the Federal Court," noting that "the only solution to this problem is the issuance of (the oil and gas law) in the Federal House of Representatives."

"If the federal government continues with this approach, the territory will have to submit to the federal court's decision and go to pass the federal oil and gas law and, on the contrary, all companies operating in the region will withdraw in order to preserve their reputation and invest them inside or outside Iraq, and the territory will therefore become a spectator to oil underground without extraction," he said. U.S. oilfield services company Schlumberger announced Monday its withdrawal from the Kurdistan Region in compliance with the Federal Court's decision.

"The U.S. company Schlumberger sent a letter with an official document to the Iraqi Ministry of Oil in compliance with the Federal Court's decision, number 59, which includes not dealing with the Kurdistan Region in relation to the oil file," sources told The Iraqi News Agency (AA).

Baker Hughes, the global oilfield services giant, had earlier announced its withdrawal from the Kurdistan Region in compliance with the Federal Court's decision.

The Federal Supreme Court of Iraq, the country's highest judicial authority, ruled in February that the law adopted by the Kurdistan Regional Parliament in 2007 to regulate the oil and gas sector was unconstitutional.

The federal court's decision obliged "the regional government to hand over the entire oil production from the oil fields in the Kurdistan Region ... That is, the federal government represented by the Federal Ministry of Oil."

The ruling, published on the court's website, also included "requiring the KRG to enable the Iraqi Ministry of Oil and the Federal Financial Oversight Office to review all oil contracts concluded with the KRG regarding the export and sale of oil and gas."

In early June, the judiciary in the Kurdistan region of Iraq rejected the decision of the country's Supreme Federal Court.

"The Federal Court has no powers to issue a decision to repeal the Kurdistan Regional Oil and Gas Act of 2007," the Kurdistan Regional District Council said in a statement, adding that "the KRG Oil and Gas Act will remain in force."

The KRG statement went further when it considered that "the current Federal Supreme Court does not have "constitutional authority" because the Iraqi constitution requires a law to be passed by the Iraqi Parliament to establish it, "but the law has not yet been passed."

In recent years, this thorny file has repeatedly returned to the forefront. Baghdad demands that all oil exports extracted on Iraqi territory pass through the federal government.

In 2012 and 2014, Baghdad criticized the role played by neighboring Turkey. The Kurdistan Region exported its crude oil to it to refining it. Ankara subsequently announced that it was handing over oil to the world market originating from Iraqi Kurdistan.

The Kurdistan Region has pledged to deliver 250,000 barrels of its daily production of more than 400,000 barrels to the central government through the Oil Ministry, in exchange for salaries from Kurdish officials and Peshmerga fighters, the region's armed forces.

This is good news, progress. The infrastructure is in place, there is oil in the ground. The contracts need re-written. This is kind of like a safety stand down. Need to start fresh again with Bagdad and Kurdish Region on the same page. Some of the big international companies are listening and this is MUCH BETTER THAN WAR!!

PKK member Reboir Hamad on Monday commented on the withdrawal of oil companies from the Kurdistan Region.
"The withdrawal of oil companies confirms that these companies are complying with the Iraqi judiciary's decision and do not want to cause themselves to be in legal trouble," Hamad told Al-Ita'a.
"This will have a negative impact on the economic situation in the Kurdistan region, and the best solution at this critical stage is to deliver oil and gas to the federal government in full, because neutralizing the judiciary and the Federal Court will never be in the region's interests," he said.
A number of oil companies operating in the Kurdistan Region announced their withdrawal from work in the Kurdistan Region in accordance with the federal court's decision.
