'The government is ready to submit the project'

Technical Adviser to the Prime Minister expects the price of a barrel of oil in the 2022 budget

Technical Adviser to the Prime Minister expects the price of a barrel of oil in the 2022 budget

Baghdad - people

Haitham al-Jubouri, technical advisor to the Prime Minister, expected, on Saturday, the adoption of the price of a barrel of oil in the 2022 budget between 60 to 70 dollars a barrel, while indicating that the "safe price" will be adopted, not the current prices based on the crisis of the Russian-Ukrainian war and other global crises.

Al-Jubouri said in a statement to the official channel, followed by "Nas" (April 7, 2022), that "the government and parliament do not have the right to waive the decision of the Federal Court regarding the management of the region's wealth, and the latter must implement it and not discuss its merits or application or not."

He added that "the budget will not be a solution to the differences between Baghdad and the region, because its paragraphs are not fully applied, and the budget cannot be legislated without implementing the decision of the Federal Court or enacting a law in this regard (the region's oil)."

And he added, "If the parliament votes to authorize the government to send the budget, the latter is ready, especially since the finances have finished their work."

And he indicated that "Finance and the Council of Ministers will choose the safe price of oil in the budget, and I expect that the price of 60 to 70 dollars will be adopted if the sale is at 100 dollars."

He stressed that "in the event that the Ministry of Finance finalizes the draft and agrees with the Ministry of Planning, the Council of Ministers is ready if Parliament votes to authorize the current government to submit the budget law."

The Head of the Legal Committee in the House of Representatives, MP Muhammad Anouz, announced, earlier, that work is currently being done to issue a parliamentary resolution obligating the government to submit the budget, while noting that the constitution did not prevent the caretaker government from sending bills to Parliament.

Anouz told the official newspaper, and "Nass" (April 28, 2022), that "the political blockage led to the delay in approving the budget and the disruption of bills, which cast a shadow on the economic situation of the country and the living reality of citizens."

He pointed out that "there are about 120 laws that have been transferred from the previous parliamentary session to this session, some of which affect the economic aspect."

Does fluctuation in oil prices affect the lost budget?

{Economic: Al Furat News} Oil prices rose significantly during the past six months, with the escalation of the rate of rise in conjunction with the Russian military attack on Ukraine.

Oil prices continue to fluctuate between high and low, but they still maintain their position at more than $100 per barrel.
In a question to the Prime Minister’s Adviser for Financial Affairs, Mazhar Muhammad Salih, about the fluctuation of oil prices in the absence of a budget in the country, he told Al Furat News, “Despite the high oil prices and the absence of the budget law, there is no loss or impact in the absence of the budget law because it It depends on a specific average price on the basis of which the revenue is decided.
He pointed out that it "affects spending ceilings, controlling them and hedging a financial deficit with mentioning its sources of financing, with mentioning the difference in real and assumed financial revenues."

Calls to approve three-year budgets

Saturday 14 May 2022 234Calls to approve three-year budgets

 Baghdad: Israa Al-Samarrai

Researchers participating in the twelfth annual scientific conference of the College of Political Science at Al-Mustansiriya University urged the preparation of the state’s general budgets for the next three years and preparing them in the middle of each year, in addition to adopting a fair electoral system and forming a committee to review the constitution and activate the law (from where did you get this), as well as to stop relying on rentier economy.
Dean of the College of Political Science, Dr. Khaled Abdel-Ilah, told Al-Sabah: "The conference's recommendations urged reducing dependence on the rentier economy, and speeding up the revitalization of the oil industry to stop importing derivatives and achieve self-sufficiency in them." Abdel-Ilah called for "paying great attention to the tourism sector, increasing agricultural and animal production using modern technology and supporting farmers and farmers, in addition to reviving stalled factories and building new ones in cooperation with the private sector and foreign companies." He pointed out that "the researchers emphasized during the conference that the state's general budget is the backbone of any sustainable development, so they submitted two proposals that the concerned authorities submit it before the middle of each year for approval for the next year, and it is preferable to legislate budgets for the next three years because they are speculative and can be reviewed and corrected based on the Existing and potential circumstances and data. As for the head of the scientific committee of the conference, Dr. Taha Al-Anbaki, he warned during his speech to Al-Sabah on “the necessity of conducting a comprehensive review of the legislative system in force and working to amend or cancel everything that could impede the sustainable development process, as well as the issuance of laws that contribute to facilitating procedures for local and foreign investment.” ". Al-Anbaki urged "to support experts, specialists and patent owners, whose number exceeds two thousand, especially in the fields of security, electricity, agriculture, industry and oil, as well as to involve graduates in internal and external courses to qualify them and employ their energies in various sectors." And he indicated that "the adoption of a comprehensive database of state institutions and citizens establishes the implementation of governance and combating corruption," calling at the same time to form an expanded committee that includes stakeholders to conduct a comprehensive review of the constitution and reformulate most of its texts to achieve justice and guarantee the rights of all.

A Kurdish MP rules out approving the 2022 budget: food security instead

{Political: Al Furat News} The parliament member of the Kurdistan Democratic Party, Majid Shankali, ruled out approving a federal financial budget for 2022.

Shankali said in a press statement: "All Iraqi budgets are failing because they are consumer and have one resource, which is oil."

He added, "The budget needs to issue a parliamentary decision to send it from the current government, and the legislative term ends on June 9, after which a legislative holiday will last for a month, and then the budget will be for only three months, which is useless."

Shankali indicated that "the emergency support law is not a small amount, especially since it included the majority of the funds that the citizen needs, and we have to build a real budget for 2023 that is developmental and investment and completely different from previous years."

A legal expert determines the parliament's choice in approving the budget

{Local: Al Furat News} Legal expert Mosaddeq Adel clarified, on Monday, that the House of Representatives can vote on a parliamentary resolution authorizing the government to send the draft general budget law.

Adel said in a press interview with {Euphrates News} that "the House of Representatives can vote on a parliamentary resolution authorizing the government to send the draft general budget law."

He added, "The authorization is for the budget only, and it is not permissible for a food security law or any other law."

Yesterday, the Federal Supreme Court decided to cancel the draft law on emergency support for food security and development, based on a lawsuit filed by Representative Basem Khashan.
According to documents obtained by {Euphrates News}, the court issued a ruling to cancel the Food Security Law sent by the Council of Ministers to the House of Representatives.
Adviser to the Prime Minister for Financial Affairs, Mazhar Muhammad Salih, announced that the court’s decision regarding the powers of the caretaker government prevents it from sending the draft financial budget law for 2022 to Parliament.
Saleh told Al Furat News: "There is no alternative for us except by applying the Financial Management Law 1/12 until the legislation of the new budget, which appears to be linked to the formation of a new government, and the current government cannot send the budget even if Parliament requests that because the court's decision has suspended any legislation currently."

Article 13 Second of the Financial Management Law No. 6 of 2019, in the event of delay in approving the budget, gives the government the right to spend on ongoing investment projects, based on the completed work or the actual preparation of the project, after ensuring the availability of cash and which have allocations within the draft budget law for the year suffix. And in a third of the same article, the law considered (the final financial statements actually disbursed as a basis for the financial statements for the year, in which the budget was not approved) as soon as they were submitted to the House of Representatives for the purpose of approval, as well as the right to exchange at a ratio of 1/12 or less of the total actual expenditures for the current expenditures for the year Previous financial under Article 13 first and until the approval of the federal general budget.
Law No. 6 of 2019 was published in the Iraqi Gazette and became effective in August of 2019, after working for sixteen years with the Financial Management and Public Debt Law No. 95 of 2004 whose provisions were heavily foreclosed by civil governor Paul Bremer, who did not grant the right to exchange Except for 1/12 of the value of current expenditures for the past year only, in the event that the general budget law is not passed. This hindered for years all sincere attempts to implement projects due to the political tensions that prevented the enactment of the budget law in 2014, and for about four or five months of each year, the legislation of the annual budget law was obstructed, in light of repeated calls for the enactment of a new law.
And when Law No. 6 of 2019 was enacted, those concerned about financial exchange breathed a sigh of relief, and it was considered a visionary gain later on the tracks of events during which we witnessed the repercussions of the Corona pandemic, which led to a financial deficit caused by low oil prices. It was truly a timely treatment to support government performance. Today, we are witnessing a remarkable rise in oil prices as a result of the repercussions of the war in Ukraine, and a financial accumulation that can be invested in financing ongoing investment projects, based on the completed work excuses or the actual preparation of the project, while the current government has the right to present the final financial statements actually disbursed, as a basis for the financial statements For the current year in which the budget has not been approved, as soon as it is submitted to the House of Representatives (as data and not as a law) for the purpose of approving it, the government has the right to spend according to these data, as well as the right to exchange at a ratio of 1/12 or less of the total actual expenditures for current expenditures for the fiscal year

A bit bizarre, but this is part & parcel for their mindset, isn't it.

Perhaps they have a special " Standings of the Levels of the Poor "

Such as POOR all the way down to Scraping Meals From Rubbish Bin Poor.

God forbid these people might have an opportunity to raise themselves out of this wretched condition...

Legal expert Ali Al-Tamimi confirmed that Parliament can pass the 2022 budget despite the presence of the caretaker government in power, pointing out that the Financial Management Law allows Parliament to do so.

Al-Tamimi said in a press interview, "Parliament has the authority to authorize the caretaker government to send the general budget law because it is related to food security, which is one of the first priorities of the caretaker government."

He added that "the mandate to send the budget requires a vote of the absolute majority of the number of members in Parliament, and that this right is limited only to the budget law exclusively."

And he indicated that “the mandate should include the approval of the final accounts of the previous year’s budget in accordance with the Financial Management and Public Debt Law No. 6 of 2019, as all of this comes in accordance with Articles 62, 5 and 61 of the Constitution and 12 and 13 of the Financial Management and Public Debt Law No. 6 of 2019 and articles From 128 to 138 of the Parliament’s Bylaws and Procedures.
