Iraqi Oil Minister Ihsan Abdul-Jabbar confirmed that his ministry is going towards the literal implementation of the Federal Court's decision regarding the oil of the Kurdistan region of Iraq.

In a speech by the Minister of Oil at the opinion board meeting, he said, "One of our complaints about the sale of crude oil in the Kurdistan region of Iraq is that the cost of producing a barrel represents 50% of its price, which is much lower than the price of SOMO."

He added that "revenues in the Kurdistan region of Iraq do not exceed 50% of the value of the oil sold," noting that "there is no country in the world that produces oil and gas with two policies as is happening in Iraq."

Iraq was unable to abide by the limitations of OPEC due to the lack of commitment by the Kurdistan region of Iraq to those limitations, according to the minister, who believes that the energy file in Iraq “should be managed in an integrated manner, and not on the basis of the political mood.”

According to Abdul-Jabbar, "The ministry's policy is to grant its companies the authority to manage all activities," continuing: "We assured the delegation of the Kurdistan Region of Iraq that the Kurdistan Oil Company will have very broad powers, with the exception of approving the development plan and oil pricing."

“We made it clear to the delegation of the Kurdistan region of Iraq that we do not want a central administration for the oil file, but rather a federal administration.”

According to the statement, the Iraqi Oil Minister said, "We have repeatedly emphasized that the Ministry of Oil has no desire to control oil activity in the Iraqi region, but the ministry wishes to organize that activity and turn it into a transparent activity that guarantees the rights of all parties."

The minister called for “the oil activity in the Kurdistan region of Iraq to be managed by a company owned by the federal state, and that the oil revenues go to an account owned by the Ministry of Finance that secures the region’s revenues in case the finances are unable to secure them.”

He believes that "the flexibility and the desire to bridge trust and address the problems of the past and all our initiatives to solve problems with the Kurdistan region of Iraq have not yielded any result," stressing that "it seems that we are going towards the literal application of Federal Court decisions (59) for 2012 and (110) for 2019, which is what It will present us with great challenges.”

“There is a historical rift in trust between the federal state and the Kurdistan region of Iraq, and we must prepare to face the internal and external challenge when implementing the Federal Court’s decision.”

The ministry’s companies provide “more than 90% of the state’s revenues, so the Ministry of Oil must stay away from political interference, because any interference will lead to the collapse of the economic system and then the collapse of the country, and this is what we are working to prevent,” according to the Minister of Oil.

The Ministry of Oil seeks, according to the minister’s words, to “lay the foundations of a strong federal state that manages its oil activity in a scientific, standard management that aims to achieve the highest financial returns with the most sustainable and lowest cost.”

And he declared his readiness to "resuming dialogue with the Kurdistan region of Iraq, but we will enter the stage of implementing the decision of the Federal Court, because Iraq's unity in the field of oil policy is vital and important for our present and future."

The Minister of Oil, Ihsan Abdul-Jabbar, asserted on Saturday, that the activity management of the oil of Kurdistan is incorrect, pointing out that the net income of KRG does not exceed 50% of the value of sold oil.

"The management of the oil activity in KRG is incorrect, since it is not correct to be selling much lower prices than oil prices of SOMO," said Abdul-Jabbar during the body of opinion of the Ministry meeting, followed by the Iraqi News Agency - INA.

He noted that "Net revenues that go to the KRG budget does not exceed 50٪ of the value of sold oil,".

"There is no country in the whole world has two policies for the management of energy, and raised this difference negative to deal with OPEC, as well as the multiplicity of destinations is not true too," Abdul-Jabbar added, pointing out that "the Federal Court decision on KRG oil explained the provisions of the Constitution, as the political mood can not be a pioneer in the oil industry, for oil file is very profitable and is influenced by the country's foreign policy with  states dealing with it."

Al-Jubouri said in a statement to a local satellite channel, that the Federal Court's decision of the unconstitutionality of the oil and gas law in the region obligates all parties concerned to implement it.

He added that there is no way or option for the federal government and the Kurdistan Regional Government but to implement the decision, and it can be implemented through options, including the legislation of the oil and gas law, or the development of paragraphs that include constitutional and legal deadlines in the budget law if it is legislated.

He went on to say that it is possible to reach a solution through the oil and gas law, whose legislation is very necessary and urgent, and the budget cannot be legislated without applying the Federal Court's decision.

On the budget file, al-Jubouri indicated that the government is ready to submit the 2022 draft budget in the event the House of Representatives votes, authorizing it to send the law to the legislative authority, and the Ministry of Finance completed the initial draft after holding several meetings with the ministries.

Regarding the price of a barrel of oil in the budget, he said that it is not possible to adopt the current selling price in global markets, which exceeds $100 because it was built on global crises such as the Russian-Ukrainian war and made it a price for a whole year in the budget. I believe that setting a price ranging between $60-70 is a safe and realistic price. .

Regarding the closest option to verifying between budget legislation or voting on the emergency support law, he indicated that the government’s completion of the budget and sending it to the House of Representatives for discussion requires a significant period between 3-4 months, and the best is to legislate the emergency support law to provide strategic food storage and pay some debts on Iraq Paying the gas dues to ensure the permanence of the supply of electric power, and it can be approved in one parliamentary session

IMF, WB & UN know it...hell, anyone who follows what's really going on anywhere in the world knows it.

You can bet citizens from both countries know it. 

I'm surprised the Iraqis haven't risen up in even greater force than they did several years ago.

These criminal politicians have proven they can drag this out for 2 decades. They've got this thing down to a science. They know how to keep the people in check and steal, steal, steal.

Kurdistan Region and their constitution. Maybe they should become their own country. Iraq has oil fields in the west that they have started to re open, and plenty of opportunity for new fields. On Saturday, Iraq’s Minister of Oil, Ihsan Abdul-Jabbar, said the federal government would proceed with implementing the federal court’s ruling from February regarding the Kurdistan Region’s oil and gas law

Abdul-Jabbar said the process of administrating the oil file should be in partnership between Baghdad and the Region.

The Federal Supreme Court issued a verdict in February that the KRG’s law on the independent sale of the Region’s oil and natural gas was against the Iraqi constitution.

ERBIL — The Kurdistan Democratic Party (KDP) has called for the establishment of federal institutions in Iraq, including the Federation Council, a constitutional Iraqi Federal Supreme Court (FSC), and an Iraqi oil and gas law.

The Leadership Council of the major Kurdish party on Sunday held a meeting under the supervision of KDP President Masoud Barzani.

Following the meeting, the KDP issued a statement and explained that the political situation in Iraq, including the efforts to form a new government in Baghdad, was discussed during the meeting.

The council also placed emphasis on defending the Kurdistan Region’s constitutional rights, implementing Article 140 of the Iraqi Constitution, and forming constitutional institutions such as the Federation Council, and re-establishing the FSC in accordance with the constitution, which emphasizes federalism instead of rigid centralization.

Discussing the general situation in the region, the KDP leadership underlined the need to continue relations between the Kurdistan Region and neighboring countries based on protecting the common interests and security of both sides.

It also emphasized the necessity of holding the parliamentary elections in the Kurdistan Region on time, expressing support for the Kurdistan Regional Government (KRG) and its reform process.

The KDP with the Sadrist Movement and the Sunni Siyada alliance have formed the Saving the Homeland coalition, which is the largest in Iraq’s parliament. The coalition is expected to resume negotiations with other political parties in efforts to form the next Iraqi government.

Agreed LB, my only concern with the Federal Court is how much influence the crooked Barzani family has over it. 
My money is still on Al-Sadr, if he will stick to his guns and get some help from the Federal Court and a couple of the Kurdish blocks they will get this HCL passed. 
I will also finally agree with Adam Montana that nothing will happen until the HCL is passed….

The Kurdistan Regional Government announced, on Sunday evening, a date to respond to the proposals submitted by the Federal Ministry of Oil regarding the management of the oil file in the Kurdistan Region.

The Chief of the Office of the Presidency of the Council of Ministers of the Kurdistan Region, Dr. Omid Sabah, said, “The Kurdistan Regional Government is still busy studying the proposals sent by the Federal Ministry of Oil following the visit of the last delegation of the Region to Baghdad and its meeting with the Iraqi Oil Ministry, and it will respond to these proposals officially as soon as possible. And that could be by the end of this week.”

He added that "dialogue, joint action and coordination between the Kurdistan Region and the Federal Ministry of Oil will continue within the framework of the Iraqi constitution."

Regarding the recent decision of the Federal Court regarding the file of oil and gas in the Kurdistan Region, the head of the Office of the Presidency of the Council of Ministers of the Kurdistan Region said, “The position of the four presidencies in the Kurdistan Region was clear in this regard, which was emphasized by the Council of Ministers of the Region,” noting that “the Federal Court Al-Iraqiya deals selectively,” adding, “For example, not implementing its decision issued in 2019 with regard to the Kurdish areas outside the administration of the Kurdistan Region or the so-called (disputed) and defining these areas and implementing Article 140 and obligating the federal government to implement it, and this file was not followed up with any government department or institution.

He continued, "This matter shows that there is a kind of selectivity, and a kind of targeting of the Kurdistan Region with regard to these issues that we want to deal with the entitlements of the Kurdistan Region within the framework of the constitution," stressing, "So we affirm our constitutional rights that we will not give up."

ERBIL (Kurdistan 24) – The Chief of Staff of the Kurdistan Regional Government’s (KRG) Council of Ministers Presidency Omed Sabah revealed on Sunday that the KRG will respond to Baghdad's proposal on the KRG's oil and gas dossier by the end of this week.

"Following the KRG delegation's visit to Baghdad and its meeting with the Iraqi Oil Ministry in April, the Iraqi Oil Ministry gave a proposal to the KRG delegation regarding a deal over the KRG oil and gas dossier," Sabah said. "The KRG is now discussing the proposal."

"By the end of this week, the KRG will formally respond to the Iraqi Ministry of Oil," he revealed. "Within the constitution's frame, we will continue joint work and cooperation, and the talks will continue." 

In early April, Iraqi Oil Minister Ihsan Abdul-Jabbar proposed establishing a new oil company headquartered in Erbil to manage the Kurdistan Region's oil dossier.

The oil minister called for reviewing the contracts and agreements signed by the KRG with oil companies and foreign countries. 

Abdul-Jabbar also proposed opening a bank escrow account in one of the international banks in Erbil to deposit the revenues from the KRG's sale and export of crude oil. That account would belong to the Iraqi Ministry of Finance and be used to arrange payments in favor of the Kurdistan Region if the Iraqi Ministry of Finance fails to send the region its dues on time. 

Regarding the Iraqi Supreme Federal Court's ruling on the KRG oil and gas dossier, Sabah reaffirmed that the stance of the Kurdistan Region's presidency, government, and parliament is unequivocal and was previously announced. 

In its ruling in February, the top court said the KRG is obligated to "hand over all oil production from oil fields in the Kurdistan Region and other areas from which the KRG's Ministry of Natural Resources extracted oil" to the federal government.

On multiple occasions, Kurdistan Region Prime Minister Masrour Barzani has firmly rejected the court's ruling, describing it as "unconstitutional." Nevertheless, he has said that his government is willing to make agreements with Baghdad based on the constitution. 

Sabah criticized the Iraqi government's double-dealing with the decisions of the Iraqi Supreme Federal Court over the Kurdistan Region. 

"While the Iraqi government is very keen to implement the unfair decision of the Iraqi Federal Supreme Court's decision over the oil and gas dossier, it neglected the same court's decision in 2019 over committing the Iraqi government to implement Article 140 to solve the issue of the disputed areas between Erbil and Baghdad," he said. 

In an early April meeting of the KRG Council of Ministers, Prime Minister Barzani emphasized that the KRG believes the permanent solution for this dossier is to legislate the Iraqi federal oil and gas law mentioned in the Iraqi constitution. 

"The KRG reaffirms its commitment towards the oil companies until reaching a final agreement, according to the constitution, under which the rights of all sides are protected," he said.
