Earth News/ A member of the State of Law coalition, Ahmed Al-Sufi, criticized today, Sunday, the current government because of its position on the Kurdistan region, while indicating that its president, Mustafa Al-Kazemi, is interested in his media activity and television screens.

Al-Sufi told "Earth News" that "the government had to find a way to compel the regional government to comply with the decision of the Federal Court," adding that "there are many steps that it had to take to receive the oil money and cancel all decisions and actions taken by the legislative and executive authorities of the region."

He added, "Unfortunately, the current government is weak, and the prime minister's basis is media activity and appearances on television and social media without real interest in the country's situation and finding solutions to its many problems.

And he stated, "What made matters worse was the suspicious silence of the current parliament on the matter, fearing the tripartite alliance would break up, which would harm their interests.

He continued, "All patriots and honorable people must stand together to implement the law and the constitution and compel the regional government and its allies to implement the decisions of the Federal Court, which the leaders of the regional government had underestimated and refused to implement."

It is noteworthy that the current government sends from time to time an amount of 200 billion dinars to the Kurdistan region without any commitment on the part of the region to pay its dues to the federal government.

Exclusive.. Baghdad takes new measures regarding the oil dispute with the Kurdistan Region

Shafak News Agency obtained a special document from the National Oil Company, to the Kurdistan Regional Government, to implement the decision of the Federal Court related to oil and gas contracts in the region, requesting the regional government to direct those concerned to take certain measures.

According to the document, these measures are to provide the National Oil Company with a copy of contracts and agreements concluded since 2004 regarding oil and gas with companies in the field of "exploration, production, transport, sale and export."

The company also demanded, according to the document, to nominate a specialized team to work with the Supreme Steering Committee to submit a request to the Council of Ministers to establish a public oil company entrusted with the tasks of managing the overall oil and gas activity in the fields contracted by the Kurdistan Region.

The document also stipulated the nomination of a specialized employee of no less than a general manager's rank to open a fund account in one of the international banks for the purpose of depositing all proceeds resulting from the sale and export of oil and gas.

The document indicated that all the incoming procedures constitute a new future policy for the management of oil wealth, and that all concerned parties bear the future obligations arising from them.

 

The National Oil Company revealed to Shafaq News agency that it had contracted with international consulting companies to study and evaluate oil and gas contracts in the Kurdistan Region.

A source in the company said in an interview with Shafaq News Agency, "The company has developed a plan to transfer Kurdistan Region contracts and a mechanism for receiving export funds after completing the evaluation process."

On February 15, the Federal Supreme Court declared the unconstitutionality of the oil and gas law of the Kurdistan Regional Government and its abolition, and obligating the regional government to hand over all oil production from the oil fields in the Kurdistan Region and other areas from which the Ministry of Natural Resources extracted oil and handed it over to the federal government represented by the Ministry of Oil Federal.

An official source in the National Oil Company had announced on the first of this March that joint committees from Baghdad and Kurdistan will discuss how to implement the Federal Court's decision.

Honestly I don’t think the Barzani’s wants to handed all oil production from the Kurdistan region to the Federal government. 
This is one of the reasons why the HCL is taking this long.
The Barzani’s don’t want to let go the golden goose

One thing about these folks __ EVERYONE loves to run their mouths and each issue no matter how large or small is layered like an onion: gives rise to a multitude of roaring debates, shoe throwing, crises and a general sense of chaos. 

With the kinds of criminal politicians & corrupt knuckleheads in these governments from 2003 forward: well, good lord it's such a mess and thankfully I live here and not there.

Having said that, we definitely need a " New Sheriff " in the Good ole USA,huh.

Earth News/ The legal expert, Majed Mijbas, confirmed today, Tuesday, that the decisions of the Federal Court are final and binding because they are not subject to appeal.

Mijbas told Earth News, "The decisions of the Federal Court are final and binding under Article 94 of the Iraqi constitution, and accordingly there is no way to implement the court's decisions because these decisions are not subject to appeal, discrimination, or any kind of delay in implementing these decisions."

He added, "With regard to the implementation of the decision issued by the oil and gas law for the Kurdistan region of Iraq, it is a final and binding decision that this law is unconstitutional, and there is no room for the authority in the region except to implement this court decision."

And the legal expert continued, "If all extractive operations, investment operations, and the operations that continue, and the contracts of the Kurdistan region continue, now are against the law and outside the context of the law, even institutions that disobey the decisions of the Federal Court, they lose legitimacy and lose constitutionality."

And he stated, "We look at with great regret and responsibility what is issued by the authorities in the region, even at the official level, to the statements of many personalities that the Kurdistan Regional Government will not comply with such a decision and will not implement this decision.

ERBIL, Kurdistan Region - The decree by Iraq's top court against the Kurdish oil and gas industry is an "opportunity" for Erbil to settle differences with Baghdad and improve relations "once and for all," Kurdistan Region Deputy Prime Minister Qubad Talabani said at an economic forum in Greece on Saturday.

Talabani viewed the widely-criticized federal decree regarding the Kurdistan Region's oil and gas industry as an opportunity to "settle the issue of oil with Baghdad," as he gave his remarks at the seventh Delphi Economic Forum in Greece, adding that the improvement of relations with Baghdad could ensure that Kurdish oil gains a foothold in the global market amid an ongoing economic crisis.

"We have no doubt that Kurdish gas can contribute, and alleviate many problems that the world is facing with gas shortages," Talabani said.

The deputy premier highlighted Russia's ongoing invasion of Ukraine as a key factor in the aggravation of the current economic crisis that has far-reaching implications way beyond that of solely oil, extending to the food market as global food prices have reached an all-time high.

Talabani stated that Iraq is "still locked in crisis, still locked in war, whether it's political war or cold war, or sometimes a physical war with missiles and bombs," as he noted the parliament's failure to form a government six months after snap elections were held in October.

An overreliance on oil is also an issue that needs tackling according to Talabani. The deputy PM addressed the Kurdistan Region's untapped potential in the tourism industry.

"If we can manage our tourism sector better than we're doing now ... we can have a thriving industry," he said, calling the country's dependency on oil a "curse."

"When Kurdistan becomes a government that has increased sources [of income] and doesn’t solely rely on oil, we can distance ourselves from the current financial crisis," Talabani told Rudaw’s Znar Shino following his speech.


Iraq's top court's decision on February 15, found the Kurdistan Region's oil and gas law to be "unconstitutional," and therefore struck down the legal basis for the independence of the Region's sector. The decision came amid ongoing political tension as the government formation process is shrouded with instability with the parliament having failed to elect a president almost seven months after the elections.

Officials in the Region were quick to condemn the controversial decision. President Nechirvan Barzani said that the court's decision could further complicate matters between Erbil and Baghdad, while PM Masrour Barzani deemed the decision as "unconstitutional." 

The seventh edition of the Delphi Economic Forum began on Wednesday, lasting for four days. This is the first time a delegation from the Kurdistan Regional Government (KRG) attends the event, and the delegation is led by Talabani.

This is good. From a practical political point of view. In Iraq, it's all about playing off the ethnicities, all of whom despise each other, in order to progress. They all compete for power. What works in that situation, is sometimes reasonable negotiations. That failed with the Kurds. Now on to Plan B: imposing the will of the majority on the minority: We are there.

 

How: Kurds are about 20% of the Iraqi population. America isn't in Iraq now, protecting them. No military support for them. They are vulnerable, militarily. They remember the horrors Saddam inflicted on them, back in the 1980s.

 

Kurds are one of the main obstacles, to passing an oil law. The Kurdish position is insecure: They have no sea port. Land locked country. They depend on the central government of Baghdad. The Shiite Arabs are 60% of the population. The Kurds, only 20. They are outnumbered.

 

Till now, they have used their hand, to press for more. Now they can't offer any legal challenge. If they don't go along, force will be inflicted upon them. Not a support for force, just an obvious observation: deal or you will be forced to deal. The minority Kurds can no longer obstruct progress, legally. Good. Eventually the majority will rule. Rochester Thanks,  Excellent analysis and 100 Percent Totally in agreement.  The KRG primarily the KDP Group are the worse which are the Barzani Family...I hope the Iraq GOI hold them accountable to the Federal Courts ruling on the Oil & Gas Law.  Force the Parliament to vote on the "HCL" immediately and take full control of the Oil / and distribute amongst the Iraqi citizens..👍👍🙏🙏.

ERBIL — A delegation from the Kurdistan Regional Government (KRG) will visit Baghdad on Monday to discuss strengthening coordination in the field of oil and energy.

Led by Umed Sabah, President of the Diwan of Council of Ministers, and accompanied by Khalid Salam Saeed, Minister of State for Negotiation Affairs with the Federal Government, the high-level delegation will discuss the recent decision by the Iraqi top court against the oil and gas sector of Kurdistan Region.

In mid-February, the Iraqi Federal Supreme Court issued a ruling that deemed the Kurdistan Region's oil and gas law "unconstitutional", and said that Erbil should hand over its crude supplies to Baghdad.

However, Kurdistan Region Prime Minister Masrour Barzani has made it clear that the Kurdistan Region will not give up on its constitutional rights.

During a press conference in early March, the Kurdish leader reiterated that Erbil sees the ruling "unconstitutional" as the Iraqi court itself has no constitutional basis and it relied on a law from 1976 of the Baath regime that was designed for a fully centralized government back then, not for a federal country.

ERBIL (Kurdistan 24) – A delegation from the Kurdistan Regional Government (KRG) will visit Baghdad on Monday for talks on the autonomous region’s oil and energy sector.

The delegation will hold consultations on the oil and energy file, in addition to the recent decision of the Iraqi Federal Supreme Court (FSC), KRG spokesperson Jotiar Adil told Kurdistan 24

The delegation consists of the Minister of State for Negotiation Affairs with the Federal Government, Khalid Shwani, Chief of Cabinet Office Omid Sabah, Head of the Coordination and Follow-up Department Abdul Hakim Khasraw, and Cabinet Secretary Amanj Rahim.

In its last session, the Kurdistan Region Council of Ministers decided to send a high-level committee to Baghdad to discuss strengthening coordination and cooperation with the central government on oil and energy.

On Feb. 15, the FSC ruled that the oil and gas law of the Kurdistan Regional Government was unconstitutional.

The KRG called the ruling unconstitutional and unacceptable.

The capital, Baghdad, will host today, Monday, the first meeting between the Ministry of Oil and a delegation from the Kurdistan Regional Government to discuss the oil file.

A statement by the Ministry of Oil, received by the Iraqi News Agency (INA), stated that “the first meeting between the Federal Oil Ministry and a high-ranking delegation representing the Kurdistan Regional Government will be held in Baghdad today, Monday, to discuss the executive procedures, after the Federal Court’s decision, and to agree on new and standard mechanisms for managing a file.” The oil industry in the region, in a manner that achieves the highest benefit and financial returns in the service of the public interest, contributes to strengthening and supporting the national economy and the integration of the national oil industry.”

It is noteworthy that the Ministry of Oil has formed specialized committees in this regard to prepare a road map to discuss and circulate all files related to the oil industry in the region, and held intensive specialized meetings and workshops with local and international experts, and assigned specialized consultants to review all contracts concluded between the regional government and international companies.

Kurdish media reported that a delegation from the Kurdistan Regional Government is scheduled to visit the capital, Baghdad, on Monday; To discuss the oil file and the Federal Court's decision regarding the unconstitutionality of the Oil and Gas Law in the Kurdistan Region.

"The purpose of the visit is to discuss the energy issue and solve outstanding problems," said Jutiar Adel, a spokesman for the Kurdistan Regional Government.  

He added that "one of the topics of discussion between the two sides is the decisions recently taken by the Federal Court regarding the oil and gas sector in the Kurdistan region."

He noted that "the delegation consists of Khaled Shwani, Omid Sabah, Abdul Hakim Khusraw and Amanj Rahim

{Political: Al Furat News} A representative of the Kurdistan Democratic Party revealed that a delegation from the Kurdistan Regional Government intends to visit the capital, Baghdad.

 

Najwa Kakai said in a press statement: "A delegation from the region is scheduled to visit Baghdad, tomorrow, Monday, to meet with officials in the Iraqi federal government to discuss a number of files, the most important of which are oil and energy."
She added, "The Kurdistan Regional Government conducted a reading of the situation, and the two parties (Erbil and Baghdad) considered it important that they meet to discuss a number of files, including agriculture, oil, energy and border crossings."
According to sources, the delegation of the Kurdistan Regional Government to Baghdad consists of the Minister of the Region for Dialogue with Baghdad, Khaled Shwani, the Chief of the Cabinet of the Presidency of the Council of Ministers of the Kurdistan Region, Omid Sabah, the Secretary of the Council of Ministers, Amanj Rahim, the Head of the Coordination and Follow-up Department in the Council of Ministers, Abdul Hakim Khusraw, and the Committee Technology from the Ministry of Natural Resources. 
And the Kurdistan Regional Council of Ministers decided, in its weekly meeting held on April 6, to send a higher committee to Baghdad to discuss with the relevant authorities in the federal government for the purpose of developing coordination in the field of oil and energy on the basis of the constitution and taking into account the constitutional powers of the Kurdistan region in this sector.
It is noteworthy that the Federal Supreme Court of Iraq issued a ruling on February 15, deciding the unconstitutionality of the Oil and Gas Law of the Kurdistan Regional Government, issued in 2007, and its abolition for violating the provisions of constitutional articles, as well as obligating the region to hand over oil production to the federal government.
The oil file is one of the most prominent outstanding issues between Baghdad and Erbil.
