Today, Sunday, the House of Representatives decided to extend the first legislative term, while setting a date for holding its sessions and their agenda.

The Council's media department said in a statement received by Alsumaria News, "The Speaker of the House of Representatives, his first deputy and the second vice-president held a meeting, today, Sunday, May 8, 2022, to discuss the most important issues related to the work and holding of the Council's sessions during the coming period."
 
 
During the meeting, it was decided, according to the statement, "to extend the first legislative term / first legislative year / fifth electoral cycle, for one month, based on the provisions of Article (58 / second) of the Constitution, in order to complete a number of legislation, tasks and constitutional entitlements."

It was also decided, “The council will hold sessions this week on Wednesday and Thursday, May 11-12, and the agenda will include the first reading of the law criminalizing normalization with the Zionist entity, the vote on the emergency support law for food security and development, as well as the completion of the formation of parliamentary committees.”

It was decided during the meeting:  

1) Extension of the first legislative term/first legislative year/fifth electoral cycle, by one month; Based on the provisions of Article 58/Second of the Constitution, in order to complete a number of legislation, tasks and constitutional entitlements.  

2) Council sessions will be held this week on Wednesday and Thursday, May 11-12, and the agenda will include the first reading of the law criminalizing normalization with the Zionist entity, voting on the emergency support law for food security and development, as well as completing the formation of parliamentary committees.

The Presidency of the House of Representatives said in a statement / Mawazine News / a copy of it, that "the Speaker of the House of Representatives and his first and second deputies held a meeting to discuss the most important issues related to the work and holding of Parliament sessions during the coming period."

The representative of the Al-Halbousi Alliance explained that "the issue of loans in the food security law is one of the controversial points" and the parliamentary trend goes towards canceling debts in the budgets, pointing out that "the food security law will be temporary, not for all years, but during this stage, because The country is going through a difficult situation."

 

On April 17, 2022, Prime Minister Mustafa Al-Kadhimi and the First Deputy Speaker of Parliament, Hakim Al-Zamili, agreed on the necessity of passing the Food Security Law by the Iraqi Parliament to meet the economic challenges that afflict the world.

 

Al-Kazemi had called, last April, for the political forces to vote on the food security law without emptying it of its content in order to serve citizens, as it is a "very important" law, indicating that "the goal of the law is to provide the necessary protection for the Iraqi people."

 

On (3/28/2022), the House of Representatives completed its reading of the report and discussion of the draft law on emergency support for food security and development.

A deputy from Asaib: Delaying and disrupting parliament sessions will lead to the dissolution of Parliament

A legal expert clarifies the mechanism for dismissing MPs who are absent from parliament sessions

On Tuesday, legal expert Ali Al-Tamimi discussed the possibility of dismissing MPs who are absent from parliament sessions.  

 

  

Al-Tamimi said in a clarification followed by “Nass” (May 10, 2022): “Article 18 of the Parliament’s bylaw stipulates that absence and attendance are published on the parliament’s website and a newspaper, and that absentees are alerted to attend without an excuse and if the absence reaches 5 consecutive times or 10 separate times in a single legislative term. Parliament can vote on the dismissal of the absent by an absolute majority of the number of members, i.e. half of the total number plus one according to the replacement law. Parliament is the one who decides whether or not to dismiss the absent person according to the replacement law 49 of 2007 and the alternative is from the same list and the best losers according to the court decision Federal, which interpreted Article 46 of the Elections Law 9 of 2020.”  

  

He added that "the absent who does not attend after taking the oath contained in Article 50 of the Constitution, which emphasized the observance of the interests of the people, sincerely working, taking into account the interests of the people and applying the law. Failure to attend means perjury in violation of Article 258 of the Penal Code."  

  

The legal expert explained that "the absence, whether individually or collectively, is subject to legal treatment and the application of replacement laws, and the person affected by the replacement decision can appeal to the Federal Court."  

  

And he indicated that "one-third of the members of Parliament can request the Presidency of Parliament to vote on the dismissal and replacement of absent deputies. If Parliament votes by an absolute majority of the total number of deputies on this, they will be replaced in accordance with Article 1 of Replacement Law No. 49 of 2007, and the deputies who replace the replaced representatives are from the same list. According to the Federal Court’s interpretation of Article 46 of the Elections Law 9 of 2020, they are the best losers, that is, the one who follows the deputy who was replaced in the same list.  

  

He continued, "As for Article 52 of the Constitution, it is related to the replacement of a representative who loses one of the conditions for membership," noting that "the replacement procedures are preceded by a warning to those absent from the parliament presidency that they must attend sessions as a matter of dropping the argument."
