On Sunday, legal expert Ali Al-Tamimi detailed how to declare emergency according to the Iraqi constitution.  

  

  

Al-Tamimi stated in a statement, of which “Nass” received a copy, (March 27, 2022), that “it is stated in Article 61 ninth of the constitution that the state of emergency is declared with the approval of a two-thirds majority of the attendance after the quorum is achieved and at a joint request by the President of the Republic and the Prime Minister, and it is announced.” That is, the emergency for a period of 30 days, subject to extension, and approved by Parliament with the same vote every time it votes on it.  

Al-Tamimi added that "the caretaker government has the right to submit this request, because security is one of the first priorities of the caretaker government, and Iraq is going through a more dangerous stage than the war on fear."  

He pointed out that "emergencies are usually declared for security reasons, unrest or security problems in some areas, but the state of emergency is in which the usual laws are disrupted, and we are faced with exceptional cases, including arrests without reference to the judiciary, restrictions on freedoms, travel bans, and closing of the media, all of which are temporary and need not be surprising for long.. Usually countries resort to emergencies in the narrowest of cases.

{Political: Al Furat News} The House of Representatives will hold, tomorrow, Wednesday, a second session to elect the President of the Republic, after it failed last Saturday to accomplish this task as a result of differences between the coordination framework and the Patriotic Union of Kurdistan on the one hand and the allied forces in {Save the Homeland}.

With expectations of a new failure in the absence of consensus, Wednesday's session will be the penultimate; The constitutional deadline set by the Federal Supreme Court expires on April 6.
While some legal experts believe that there is no longer a solution to the political impasse, other than for Parliament to dissolve itself, other experts believe that the Federal Supreme Court is the one that takes final and binding decisions for all authorities, to disrupt the election results, or even resort to dissolving Parliament from On the premise that one of the first tasks of the elected parliament is to elect a new president of the republic.

It is customary for Sunnis to head the parliament, Kurds to head the republic, and Shiites to head the government, according to a constitutional custom that has been in place since 2003.
The elected president of Iraq is the one who assigns the parliamentary bloc's most numerous candidate to form a government.

The House of Representatives is scheduled to hold a second session to elect the country's president after failing to do so in last Saturday's session due to the continuing differences between the political forces and their incompatibility with one of the candidates.

Ali Al-Tamimi told {Euphrates News}: "According to the Federal Court's decision to open the nomination for the position of President of the Republic for one time only, No. 24 of 2022.. the Presidency of Parliament has a period of 30 days in accordance with Article 72 II of the Iraqi Constitution from March 6 to April 6. During which the President of the Republic is elected in a binding manner, and after the session on March 26, which was postponed to March 30, the Parliament presidency can postpone it again if Parliament fails to elect the President of the Republic until April 6 only. It permitted the opening of the nomination door for one time, indicating that We will be faced with an irresolvable failure. Parliament may be dissolved at the request of a third of the members and the approval of the absolute majority of the number of members in accordance with Article 64 of the Constitution, or a referendum of the Federal Supreme Court if this is done to find out the constitutional outlet. And in the event that happens, we may be facing new early elections and the current government will continue to conduct daily affairs. ...in accordance with the same article above. 

And he continued: “In the case of starting to vote on choosing the new President of the Republic, who stipulated the Federal Court’s decision to open the session with a two-thirds majority of the total number of Parliament, it means 220 deputies and to be present at the start of voting in accordance with the Federal Court’s decision to open the nomination door with this percentage in the first round. If any of the candidates gets this percentage, we will be facing a second round in which the competition is limited to the first and second highest winners, and either of them gets the majority of votes, meaning if the first gets 50 votes and the second gets 30, the owner of the 50 votes is the President of the Republic who is the president and takes the constitutional oath before Parliament and in the presence of President of the Federal Court in accordance with Article 70 of the Constitution and Law 8 of 2012. 

He added, "The election is by direct secret ballot by placing the papers in the box in both rounds, and the President of the Republic can be voted on and the Prime Minister appointed in one day," noting, "Then the President of the Republic assigns the candidate of the most numerous parliamentary bloc within 15 days of taking the oath. Which has not yet been specified, assigning him to form the government and the government curriculum within 30 days of his assignment in accordance with Article 76 of the Constitution with all its details.

Shafaq News/ The Iraqi parliament failed for the third time in a row to hold a session to elect a new president for the country.

The council's president, Muhammad al-Halbousi, decided to hold a regular session, according to a brief statement issued by the council's media department.

The parliament had previously held two sessions, one after the election of the speaker and members of the House of Representatives, and the other last Saturday, and in both of them, it failed to achieve a quorum for holding them to elect a president of the republic due to the intensification of the dispute between the Triple Alliance (the Sadrist bloc, the Kurdistan Democratic Party, the Sovereignty Alliance), and the coordination framework that includes Shiite political forces.

Shafaq News/ An Iraqi legal expert explained, on Tuesday, that failure to elect the President of the Republic within the specified constitutional period will lead to the dissolution of Parliament with the approval of the majority, and then to new early elections, indicating that the Federal Supreme Court may have a constitutional way out.

 

And legal expert Ali Al-Tamimi said, in a statement received by Shafaq News Agency, that "according to Federal Supreme Court Decision No. 24 of 2022 to open the door for nomination for the position of President of the Republic for one time only, the Presidency of Parliament has a period of 30 days in accordance with Article 72 II of the Iraqi constitution from the date of March 6 to April 6 to elect the President of the Republic in a binding manner.

 

And he added, "After the session on March 26, which was postponed to March 30 tomorrow, Wednesday, the parliament's presidency can postpone the session again if the parliament fails to elect the president of the republic until April 6 only."

 

He added, "If we exceed the constitutional period, we will be in front of a clear violation of the decision of the Federal Court above, which authorized the opening of the nomination door for one time, and we will be facing an irresolvable failure, and Parliament may be dissolved at the request of a third of the members and the approval of the absolute majority of the number of members in accordance with Article 64 of the constitution."

 

Al-Tamimi added, "The Federal Supreme Court could have a referendum if this was done to find out the constitutional outlet, and we might be in front of new early elections in the event that happened, and the current government will continue to conduct daily matters according to the same article above."

 

He pointed out that "in the event that voting begins to choose the new president of the republic, and in accordance with the decision of the Federal Court, which stipulated the opening of the session with a two-thirds majority of the total number of parliament, i.e. 220 deputies, and to be present at the start of the voting, and in the event that one of the candidates does not win in the first round of voting, we will be in front of A second round in which the competition is limited to the first and second highest winners, and whichever of them obtains the majority of votes is the President of the Republic.

 

Al-Tamimi indicated that the President of the Republic "should take the constitutional oath before Parliament and in the presence of the President of the Federal Court in accordance with Article 70 of the Constitution and Law 8 of 2012, and the election is by direct secret ballot by placing papers in the box in both rounds."

 

Al-Tamimi suggested that "the vote on the President of the Republic and the assignment of the Prime Minister will take place in one day."

 

He concluded by saying, "The President of the Republic assigns the candidate of the most numerous parliamentary bloc, which has not yet been determined, within 15 days of taking the oath, and assigns him to form the government and the government curriculum within 30 days of his assignment in accordance with Article 76 of the Constitution, in all its details."

 

Last Saturday, March 26, the Iraqi Council of Representatives held a session dedicated to electing the president of the republic. The coordination framework and other blocs and deputies broke the quorum of the session by not attending, which called on the Presidency of the Council to adjourn the session to Wednesday, March 30, to elect the president.

 

According to the data, the framework, forces and representatives that boycotted the Saturday session are still refusing to attend tomorrow's session, and it was not clear whether some of them changed their minds or joined them by new MPs.

Today, Wednesday, a parliamentary source reported that the parliament bell has been ringing to invite members of the House of Representatives to enter the session scheduled for today.

In an interview with Alsumaria News, the source said, "Parliament rang its bell to invite deputies to attend the session devoted to electing the president of the republic and forming permanent parliamentary committees."

Parliament raises its regular session after determining the members of the legal and parliamentary foreign affairs

The House of Representatives announced, on Wednesday, the names of the members of the Parliamentary Legal Committee and Social Relations.  

  

  

  

The Media Department of the House of Representatives said in a statement that “Nass” received a copy of it (March 30, 2022), that “the House of Representatives voted, in its sixth session, which was held today, Wednesday, headed by Muhammad Al-Halbousi, Speaker of the House, to amend a number of articles of the internal system and the tasks of the parliamentary committees, in addition to To vote on naming members of three committees.  


At the beginning of the session, Al-Halbousi announced that "the legal quorum has not been achieved to elect the President of the Republic."  

  

The parliament voted to "amend a number of articles of its bylaw related to the tasks of parliamentary committees, including changing the name of the committee's rapporteur to a second deputy chairman."  

  

In the same regard, the Council voted on “11 members of the Legal Committee, while leaving the field open to complete the total number of the Committee, in addition to voting on a number of members of the Foreign and Financial Relations Committees.”  

  

The Speaker of the Council called on the heads of the parliamentary blocs to "submit the names of their members to complete the formation of the committees," stressing the commitment of the Presidency of the Council to adopt the principle of professionalism, competence and competence as a basis for the distribution of women and gentlemen of Representatives to the committees.

Earlier, Parliament Speaker Muhammad al-Halbousi had inaugurated the sixth session of the fifth electoral cycle for the first legislative year of the first legislative term, while voting on the tasks of the Parliamentary Committee on Economy, Industry and Trade.

At the beginning of the session, the Council votes on amending some paragraphs of its bylaw and the tasks of its parliamentary committees, and also voted on the tasks of the Parliamentary Electricity and Energy Committee.    

  

The department indicated that "the council also voted on the tasks of the committees of economy, industry and trade, the parliamentary investment and development committee, the strategic planning and federal service committee, the transport and communications committee, the labor committee and the parliamentary civil society institutions."    

  

The statement pointed out that "the House of Representatives voted on the members of the Legal Committee, and on the names of the members of the Foreign Relations Committee."

ERBIL, Kurdistan Region - The Iraqi parliament on Wednesday failed to elect a new president of the republic for the second time in a week due to the lack of legal quorum after the pro-Iran Shiite parties boycotted the session, keeping the government formation process in the war-torn country in a stalemate.

The session to elect a president was delayed several hours in an attempt to meet the legal two-thirds quorum before the legislature eventually decided to adjourn the session indefinitely. However, the deadline to elect a new president is April 6 before the Iraqi political process falls into a constitutional gap.

While the Iraqi constitution gives a period of one month to the parliament to elect a new president once nominations are closed, it does not specify what happens in case the legislature fails to do so in the given period. A decision to reopen nominations shall only be permitted by the Iraqi Federal Supreme Court upon an official request from the parliament.

The adjournment of the session came after over a third of MPs boycotted the session.

Footages from Telegram channels affiliated with pro-Iran political parties showed leaders of the Coordination Framework and MPs gathering at the residence of Hadi al-Amiri, head of the Shiite Fatih Alliance, instead of attending the parliamentary session.

MPs of the Patriotic Union of Kurdistan (PUK), Azm Alliance, New Generation Movement, and various independents also boycotted the session.

In an address to local media outlets, Amiri called on the tripartite alliance consisting of the Sadrist bloc, Kurdistan Democratic Party (KDP), and the Sunni Sovereignty Alliance to shift to dialogue in order to remove Iraq from the current political crisis.

“Our hearts are open and hands are extended to everyone in order to reach a solution for Iraq's problem,” Amiri said, adding that “there is a good opportunity in front of the tripartite alliance to shift to dialogue in order to solve the current crisis.”

Iraq held up the vote to elect a president for the third time since October’s early elections.

The parliament last met on Saturday to elect a president, but the session fell short of the legal quorum as only 202 MPs attended the meeting.

Former Iraqi Prime Minister Nouri al-Maliki's State of Law Coalition, a key component of the Coordination Framework, presented 126 signatures to the presidency of the parliament from MPs that had decided to boycott Saturday’s session, as per their media outlets.

According to media affiliated to the Coordination Framework, the number of MPs who boycotted the session on Wednesday had increased further.

The rise came as members of the Kurdish New Generation Movement decided to boycott the session following remarks from the party's leader Shaswar Abdulwahid.

“According to our 17-point agreement, at least some of the points of that agreement were supposed to be actualized in the days following the signing, especially decreasing the price of fuel and removing the heavy load that is troubling the people of the Kurdistan Region. Yet, those Iraqi parties have remained silent. If none of the points are actualized by Wednesday, do not attend the parliamentary session,” said Abdulwahid on Tuesday. 

The primary candidates for the presidency are KDP’s Reber Ahmed, backed by the tripartite alliance, and PUK’s incumbent Barham Salih backed by the Coordination Framework.

While the political stalemate in Iraq is seen to be because of the PUK and the KDP disagreement on having a mutual candidate, Shiite parties are also broken into two with the Sadrists calling for a national majority government that would exclude the Coordination Framework, and the framework insisting on a consensus government, a system that Iraq has abided by for years following the US invasion of the country in 2003.

From these articles I gather that if the time passes to elect a President, the constitution states things revert to the current government until new elections can be held again.

I didn't realize Iran has been backing Barham Saleh. It's hard for me not to think this has  been one of the hold ups.

ERBIL (Kurdistan 24) – The Iraqi Parliament could not elect the country's president for the third time on Wednesday after the Shiite Coordination Framework (SCF) boycotted the session.

Only 178 lawmakers attended Wednesday's session, which is less than the two-thirds quorum required to elect one of the candidates for the largely ceremonial position. 

According to the Iraqi Parliament website, the session was adjourned as a result. No date has yet been set for another vote. 

The Saving the Homeland coalition has nominated Rebar Ahmed of the Kurdistan Democratic Party (KDP) for the presidency. The tripartite alliance includes the Sadrist Movement, the KDP, and the Sunni Siyada (Sovereignty) Alliance.

Parliament needs a two-thirds quorum, at least 220 out of the 329 deputies, to elect a president.

The leader of the Sadrist movement, Muqtada al-Sadr, pledged not to ally with the SCF, which primarily consists of Iran-backed political factions, declaring that the current political deadlock is "easier" than agreeing or compromising with his rivals.

Parliament previously failed to elect a president in February and last Saturday due to the lack of a quorum caused by repeated SCF boycotts of its scheduled sessions.
