Lana Nusseibeh, the UAE's ambassador to the UN, has praised the “historic” conclusion of Iraqi compensation payments to Kuwait but called for more progress on finding missing persons and other issues tied to the decades-old invasion.

Ms Nusseibeh on Tuesday said more work was needed to find and return the remains of those who went missing during Iraq’s occupation of its smaller neighbour in the early 1990s, in addition to artefacts looted from the country during the invasion.

She made her comments during Security Council talks aimed at wrapping up a UN compensation commission after Iraq last month made its final payment towards a total $52.4 billion in damages claims.

“We commend the efforts made by Iraq, especially in spite of the challenges it faces, to pay all of its reparation payments,” Ms Nusseibeh said in New York.

“We hope to see further progress on the issue of missing Kuwaiti and third-country nationals as well as the issue of missing Kuwaiti property, including items from the National Archives.”

 

Former Iraqi dictator Saddam Hussein ordered his army to invade Kuwait in August 1990 and seize what he called “Iraq's 19th province”, before being pushed back seven months later by a US-led coalition.

Retreating Iraqi troops set ablaze an estimated 750 oil wells, creating one of the largest environmental disasters in history and effectively destroying Kuwait’s main source of income. Thousands were killed and Kuwait says at least 605 citizens remain unaccounted for.

The UN council created the Compensation Commission to process claims and organise payouts to people, companies and governments that suffered during Iraq’s invasion.

The payments are funded by revenue earned from Iraq’s oil exports.

The largest claim approved was for $14.7bn in damages incurred by the Kuwait Petroleum Corporation.

 

Baghdad’s payments were suspended between 2014 and 2018 when ISIS controlled large parts of the country.

Michael Gaffey, president of the compensation programme, said the body had worked for more than three decades on a mission “not just of restitution, but vitally also of reconciliation” between Iraqis and Kuwaitis.

“For them, it is important that we demonstrate that we are now turning a page of history, noting the remarkable level of national, regional and international co-operation which has marked the successful work of the commission,” he told the Security Council.

The UN Security Council voted unanimously on Tuesday to wrap up the three-decade program which has allowed Kuwait to recover more than $50 billionfrom Iraq for damages caused by its 1990 invasion.

Members approved a resolution to "terminate the mandate" of the United Nations Compensation Commission, concluding that the operation has "fulfilled" its purpose of adequately remunerating Kuwait.

The measure, drafted by Britain, says it "confirms that the government of Iraq is no longer required to deposit a percentage of proceeds from export sales of petroleum, petroleum products and natural gas into the fund."

The claims process "is now complete and final," having recovered some $52.4 billion in total from Iraq for Kuwait, it adds.

"Today Iraq turns a page that has lasted 30 years," Iraqi Foreign Minister Fouad Mohammad Hussein told the Security Council.

"It opens a new chapter" in which Iraq will seek to develop its relations and cooperation with the United Nations, the minister pledged, as he welcomed the commission's success.

The unprecedented panel is considered a model for reconciliation that could help resolve future conflicts if necessary.

Created in May 1991 by Security Council Resolution 692, the commission managed Iraq's financial compensation which featured a five percent tax levied on its oil sales.

Chapter VII of the UN Charter provides for "coercive measures" to be taken if peace is threatened, ranging from economic sanctions to resort to force.

 

Chapter VII allows the exercise of pressure on a country to compel it to abide by the goals set by the Security Council, before coercive measures are applied.

 

It also provides for such procedures in the event of "a threat to the peace, termination of a peace treaty, or the launching of an attack." The measures range from “economic and other sanctions that do not include resorting to armed force on the one hand and international military intervention.”

 

Initially, the Security Council could impose "general economic and commercial sanctions or more specific measures such as imposing arms embargoes, movement bans, and financial and diplomatic measures."

 

In the event that the Council considers that these measures were not “appropriate” it can resort to Article 42 of Chapter VII, which states that “the Security Council may take any action it deems necessary to maintain or restore international peace and security by means of air, sea or land forces.” .

The amount of compensation owed by him, which is (fifty-two point four) billion dollars, through the United Nations Compensation Committee, which was distributed to (one point five million) claim from all categories of claims, and according to what was stated in that, and the wording of the paragraphs of the Council’s resolution was approved The security approved in this session, and as a reminder of all relevant Security Council resolutions, the Compensation Committee has fulfilled its mandate in full, and has completed consideration of any future claims on the issue of compensation, and Iraq is no longer required to pay any additional sums of money in the future, or deal with Chapter VII procedures.

 

       In this context, my country's government affirms that working with the United Nations Compensation Commission and your esteemed council has been a successful model for multilateral action, a model that enhances confidence in international mechanisms and procedures in settling the crises that have afflicted and afflicted our world until today, and through this international mechanism and out of respect Iraq has fulfilled its obligations under the relevant Security Council resolutions and fully assumed its responsibilities, Iraq continued to fulfill these obligations in full in accordance with the timetables and percentages approved by the Compensation Committee, despite the difficult circumstances that Iraq experienced in the previous years of bearing the burdens and economic costs of fighting terrorism and taking its role at the forefront of the countries of the world To address the terrorist gangs of ISIS and recover the cities from the organization’s control, the costs of the programs to return the internally displaced to their cities, the programs to restore stability, services, provide aid and reconstruction costs, which were accompanied by a significant decrease in the prices of oil salesGlobalism.

 

       In this regard, the Government of Iraq considers the full fulfillment of its international obligations towards the international community and the sisterly State of Kuwait, as a major development that would enhance Iraq's relations with its regional and international surroundings, as well as the Iraqi-Kuwaiti historical relations and move them to broad future horizons based on trust and equal bilateral relations. .

 

      Iraq has sought to complete this unique model of work, international effort and joint cooperation under the frameworks and mechanisms of the United Nations, through its full fulfillment of its international obligations, which in turn highlighted an international legal and moral commitment to the international community and the United Nations, which is to remove Iraq from all procedures of Chapter VII, and to preserve Iraq’s rights, funds and international legal entitlements, and its protection from any future claims within the framework of the international effort led by the United Nations, based on the Charter of the United Nations, the rules of international law and the general principles of international law in justice and equity, which enhances confidence in these UN mechanisms. This is what we were keen to confirm and defended hard to include it in the UN Security Council resolution in cooperation with the (British) pen holder and the rest of the Security Council members. As this international effort will not have completed its success until after Iraq's legitimate demands are embodied and included in the UN Security Council resolution.

Hussein said during Iraq's speech at the Security Council session that was held today, "Iraq today turns an important page of its history that lasted more than thirty years," stressing that "today begins a new page of Iraq's diplomatic, political and economic history that enhances its regional and international role."
 
The Minister of Foreign Affairs added that "Iraq paid the last payment in accordance with its financial obligations and paid the full amount of compensation due to it, which is (52.4) billion US dollars," stressing that "Iraq is no longer required to pay any additional sums of money in the future or deal with Chapter VII procedures."
 
"We congratulate the Iraqi people and their government for the termination of these international obligations, and for Iraq's exit from Chapter VII procedures, and we extend our thanks and pride to those in charge of Iraqi diplomacy," he added.
 
Yesterday, Tuesday evening, the Security Council held a session on Iraq ending the Kuwait compensation file following the 1990 invasion.

Earth News/ The President of the Republic, Barham Salih, welcomed, today, Iraq's exit from Chapter VII procedures, against the background of paying all the debts it owed to Kuwait.
Saleh wrote on his Twitter page, followed by "Earth News": "By ending the file of Iraqi compensation to sisterly Kuwait, we are closing a terrible chapter of the absurd war of the tyrannical regime, and our people and the whole region paid the price for it."
