The Federal Supreme Court in Iraq decided today, Tuesday, to postpone the date for deciding the case of the largest parliamentary bloc until tomorrow, Thursday, and this court is considered the highest judicial authority in the country.

The coordination framework and the Sadrist bloc had submitted a request to the Presidency of the House of Representatives (Parliament) during the first session that was held on January 9, as the largest parliamentary bloc that will be tasked with forming the next government by the President of the Republic.

 

The coordinating framework considers that the first session of Parliament was marred by legal violations, and calls for the annulment of its outcomes represented in the election of the Speaker of the Council, Muhammad al-Halbousi and his two deputies.

The session witnessed violent verbal altercations between the deputies of the Sadrist bloc, which follows the leader of the Sadrist movement, Muqtada al-Sadr, and the coordinating framework regarding the largest parliamentary bloc, in the midst of which the (older) interim parliament speaker, Mahmoud al-Mashhadani, was assaulted by one of the representatives (whose identity is not known), which necessitated his transfer. to the hospital, and the second-oldest member was assigned to chair the session.

And yesterday, Monday, the Iraqi Council of Representatives approved the names of 25 candidates for the presidency, who will be voted on in the parliament session scheduled for February 7.

Among the most prominent candidates included in the list of names are the candidate of the Patriotic Union of Kurdistan, the outgoing President of the Republic, Barham Salih, and the Kurdistan Democratic Party candidate, Hoshyar Zebari, who previously held the foreign and financial portfolios for many years. Judge Rizgar Muhammad Amin, who was first known during his tenure, also emerged among the candidates. The position of trial judge for the late Iraqi President Saddam Hussein.

Since the adoption of the constitution in 2005, the Iraqi state is considered a federal state, in which the system of government is republican, representative and democratic, which means that the highest executive authority in the country is through the prime minister with limited honorary powers to the post of president of the republic.

In a related development, the leader of the Kurdistan Democratic Party, Massoud Barzani, put forward an initiative to end the political crisis in Iraq, while there were reports that the commander of the Quds Force in the Iranian Revolutionary Guard, Major General Ismail Qaani, had arrived in Erbil the day before yesterday, Sunday, to discuss with the region’s leaders the issue of forming the next Iraqi government. .

In a message to the Iraqi people, Barzani said that he had put forward a political initiative to solve the problems and provide an appropriate and good environment for the political process in Iraq, in which he suggested that the President of the Iraqi Kurdistan Region, Nechirvan Barzani and the Speaker of the Iraqi Parliament, Muhammad al-Halbousi, visit Najaf and meet the leader of the Sadrist bloc Muqtada al-Sadr and consult on how to continue the political process and remove Obstacles and problems.

"I hope that this initiative will have positive results, and will be in the interest of Iraq and all its components," he added, without further details.

As part of this initiative, Nechirvan Barzani, Muhammad al-Halbousi and Khamis al-Khanjar, head of the Sovereignty Alliance - which includes the Progress and Azm parties - arrived in Najaf Governorate (south of Baghdad) on Monday to meet with al-Sadr to discuss forming a government.

Sources told Al Jazeera that the delegation suggested to Al-Sadr that the Shiite "coordinating framework" be involved in the government formation talks, and also suggested that he be given his share of ministerial portfolios according to his results in the elections.

The sources added that al-Sadr promised to respond to the proposals within days, but stipulated that the leader of the State of Law bloc, Nuri al-Maliki, be excluded from the discussions.

In a tweet on Twitter after the meeting, al-Sadr said that he was still committed to forming a national majority government in alliance with the Kurds and Sunnis, and welcomed dialogue with what he described as the national opposition, and also called for an end to what he called terrorism and violence against political partners.

Before that, Al-Halbousi said in a tweet on Twitter yesterday, Monday, that a Kurdish-Sunni-Shiite movement had begun to form a purely national government, considering that "the time of foreign interference in the formation of governments is over."

He added, "Today, Iraq's mountains (majority Kurdish areas) and deserts (Sunni majority areas) are moving to Najaf for talks to form a purely national Iraqi government, neither eastern nor western.

In a related context, Iyad Allawi, leader of the Civil National Front (Mouj), the former prime minister, put forward an initiative for a political project supervised by Parliament and political forces, in which he suggested that Al-Sadr name the next prime minister, provided that the coordination framework approves it.

The Sadrist bloc topped the October 10 elections with 73 seats, followed by the Progress Alliance with 37, the State of Law coalition with 33, and the Kurdistan Democratic Party with 31 seats.

While the forces of the Shiite coordination framework did not officially exceed 60 seats, they spoke in a recent parliamentary session about including independents and reaching 88 seats out of 329 seats in the House of Representatives.

Al-Sadr seeks to form a national majority government, unlike the rest of the "coordinating framework" forces that demand a consensual government similar to what has been in place since the 2005 elections.

The formation of the new Iraqi government requires first the election of a new president of the republic by Parliament, so that the elected president assigns the candidate of the largest parliamentary bloc to form the government within 30 days, and Parliament is scheduled to hold a session to elect the president of the republic on February 7.

BAGHDAD, 2/1 (KUNA) -- An Iraqi court decided today, Tuesday, to postpone a decision on a case regarding the adoption of the most numerous parliamentary bloc in the Iraqi parliament, in a step that would postpone the formation of a new government in the country until this file is resolved.
The official Iraqi News Agency stated that the Federal Supreme Court decided to postpone the decision on the case submitted by two parliamentarians until next Thursday.
This is the second lawsuit filed before the Federal Court regarding the procedures of the first parliamentary session, which ended with the election of Muhammad al-Halbousi as speaker of parliament, Hakim al-Zamili as first deputy and Shekhwan Abdullah as second deputy, after a previous lawsuit that demanded the annulment of the session and rejected by the court.
The adoption of the parliamentary bloc is the most numerous of the important procedures within Parliament, as the President of the Republic is not entitled to assign any party to form another government, while the designation of this bloc is still a point of contention between the Sadrist bloc and the forces of the coordinating framework.
The issue of the bloc's largest number is described as one of the most important thorny issues especially in light of the dispute over it and the method of calculating it, whether according to the results of the blocs in the elections or according to their alliances with other blocs after the elections.
In this parliamentary session, the Sadrist bloc said that it is the most numerous and presented its papers in the first session of the House of Representatives without revealing the number of its registered deputies, and whether they are members of the Sadrist bloc who won the elections only, whose seats are 73, or did they include other blocs with them.
The Coordination Framework Forces also said that they are the most numerous and submitted their papers to President Mahmoud al-Mashhadani before the election of al-Halbousi, noting that they had collected signatures confirming that they were the most numerous.
Parliament did not officially disclose the details of the requests submitted to it to approve the bloc's largest number, nor the number of its seats, whether submitted by the Sadrist bloc or what was submitted by the forces of the coordinating framework.
Parliament is scheduled to resolve this file after the election of the President of the Republic in the next few days. Parliament is supposed to inform the president of the name of the largest bloc and the number of its seats, so that the latter will officially assign it to form a government in accordance with the constitution. Why they allowed Qaaani in the country baffles me.  Granted there is an iranian following in Iraq - but Al-Sadr should be strong enough at this point to ensure at least the high-profile bad guys are kept out. Obviously, there are lower ranking subversives crossing into Iraq daily.

I think it's about time for al Sadr to make a visit to the high courts, after hours of course and remind them that they can be replaced...

The Iranians have turned the Iraqi judiciary court into some second rate kangaroo court laughing stock committee. Sadr had better make a move soon or Maliki and the rest of the Iranians will drag this out until the next elections....

5. Expressing thanks and appreciation on behalf of the Supreme Judicial Council to the first judge of the Karkh First Investigation Court, Mr. Ali Hussein Jafat, for donating the amount of compensation awarded to him to the Cancer Center in the City of Medicine.

According to the court’s decision, which was reviewed by “NAS” (February 1, 2022), it was decided to “postpone the date for deciding on the lawsuit of the largest bloc filed by the framework deputies (9 federal) until next Thursday, 2/3/2022.”    

  

And issued a representative of the coalition of state law, Alia Nassif, earlier, a clarification on the lawsuits filed before the Federal Court recently.  


Nassif said in a statement received by "Nass", a copy of it, (January 27, 2022), that "the person who is well versed in law and who follows political events finds that these cases, whether related to the largest bloc or others, are among the most important cases that can be filed before the Federal Court, for example For example, the constitution in Article 54 did not specify the powers of the president of the age and mentioned only the election of the speaker and his two deputies, while many things happened in light of the powers enjoyed by the president of the age during the past parliamentary sessions, and therefore these decisions codify the norms that the House of Representatives followed. ".      

  

She added, "While I am astonished by this unjustified attack against me by people who have no legal, scientific or political awareness."       

  

Nassif stressed that "the aim of these lawsuits is to make the Federal Court clarify and interpret articles that the constitution did not clarify, and this matter serves everyone and achieves the national interest."

Nassif said in a statement that “Nass” received a copy of it, (February 3, 2022), that “the Federal Court has put in place today a correct mechanism that resolved the controversy through its interpretation of Article 70 of the Constitution, and as we previously explained that this article confirms that the election of the President of the Republic needs two-thirds Members of Parliament.  


She added, "We also thank the just judiciary for drawing the map of the largest bloc, and accordingly, from the date of this decision, there is no larger bloc, and the space will be available to form the largest bloc and submit it in a timely manner to the Speaker of the House of Representatives for administrative scrutiny only, then the approval and the controversy will be resolved by President of the Republic in accordance with Article 76 of the Constitution.   


And she continued, "Therefore, today both blocs are no longer the largest bloc, but it will start forming it from now and submitting it to the President of the Republic."   

  

On Thursday, the Federal Court issued a decision dismissing the lawsuit against the largest bloc.

The Supreme Judicial Council offered condolences to the Iraqi Bar Association on the death of lawyer (Tariq Harb), who died yesterday, Wednesday, of a heart attack.  

  

 

  

  

The media center of the council stated in a statement, "Nass" received a copy of it, February 3, 2022, that "in its session held today, Thursday, 3/2/2022, the women and gentlemen lawyers have mourned the death of lawyer (Tareq Harb), asking God to dwell in the vastness of his gardens and inspire him." On Thursday, a number of jurists held a central eulogy at the Rusafa Court for the spirit of the late legal expert, Tariq Harb.  

  

The head of the Lawyers Syndicate, Diaa Al-Saadi, said in a statement, "Nass" received a copy of it, (3 February 2022), that "it is a matter of sadness and pain, that we stand today to pay tribute to a great record of giving and valor of the men of our profession, what is the greatest sorrow as we read the words of condolences. For your soul, Abu Ziyad, our deceased was a good example of morals, kindness and dedication to work.    

The statement added that "the deceased had great services in legal and judicial work, and made great efforts to achieve justice and the rule of law, at the political, human rights, national, and media levels, and also presented legal, literary and cultural books, which enriched libraries, as well as About being one of the Iraqi personalities who enjoy a wide audience at the general level, and he was active in the trade union movement, and one of the most important members of the legal committee in the Iraqi Bar Association. He has respected opinions and distinguished additions.    

The statement indicated, "The lawyer has lost, with the departure of Professor Tariq Harb, a fading light in the sky of the profession, as he was one of the remnants of the archives of great lawyers.
We ask God to forgive him and include him in his mercy and care."

Shafaq News/ The Iraqi Federal Court, which is the highest judicial authority in the country, set, on Thursday, the required quorum for the number of members of the House of Representatives present during the presidential election session.

 

The court concluded with a decision that “the House of Representatives elects a president of the republic from among the candidates for the presidency of the republic by a majority of two-thirds of the total number of members of the total parliament, and the quorum is achieved in the presence of two-thirds of the total number of members of the total parliament.”

Today, Thursday, the Supreme Judicial Council decided to form a committee to amend some articles of the Judicial Organization Law.

A statement by the Council, received by the Iraqi News Agency (INA), stated that the Council "held its first session for the year 2022, headed by the President of the Federal Court of Cassation, Judge Faiq Zaidan."

He explained, "The Council approved, during the session, the promotion of a number of judges and the granting of a number of judicial positions that must be granted, in addition to approving formations in some federal appeal presidencies according to the proposal submitted by the Presidency of Appeal."

He added, "He decided to hold workshops at the Judicial Development Institute for judges of the Personal Status Court, with the participation of professors and jurists specialized in Sharia rulings."

He continued, "The Council discussed the amendment of some articles of the Judicial Organization Law No. (160) of 1979, and after discussion, it was decided to form a committee of representatives of the Federal Court of Cassation to study the opinions presented in the session to reach the final version of the legal articles to be amended."

, Thursday, the Federal Court rejected the lawsuit filed regarding the largest bloc.
A reporter for the Iraqi News Agency (INA) said, "The Federal Court held its session today to consider the lawsuit filed regarding the largest bloc."
He added, "The court dismissed the case."
It is noteworthy that the Federal Supreme Court decided earlier to set the date for the pleading in the lawsuit submitted by MPs Alia Nassif and Atwan Al-Sayed Hassan, related to the most numerous parliamentary bloc to the first of the current February, to be postponed again to today, Thursday.
