Earth News/ Legal expert Ali Al-Tamimi confirmed today, Sunday, that the Federal Court's decision regarding the parliament session for electing the President of the Republic into a suspended session, indicating that the current president, Barham Salih, will continue his work.
Al-Tamimi told "Earth News", that "due to the existence of a lawsuit filed by one of the candidates for the presidency of the republic asking for the nullification of the nomination of Hoshyar Zebari for violating the constitutional and legal rules, a request was made to issue a loyalty order for the purpose of using Parliament to vote on the position of President of the Republic until the case is decided."
He added that "the Federal Court decided to vote on Zebari's nomination until deciding on the case, and this means that the February 7 session for the election of the President of the Republic will also be pending until a decision is made on this case in accordance with this decision."
And he indicated that "this decision changed the constitutional time limits because the Federal Court is supreme, supreme and obligatory for all authorities."
He noted that "the current president, Barham Salih, will continue to work and perform his duties in accordance with this decision, confirming the previous decision of the Federal Court 51 of 2010."
It is noteworthy that the Federal Supreme Court suspended, earlier today, Sunday, the nomination of Hoshyar Zebari for the post of President of the Republic.

The Extension Movement announced, on Saturday, the submission of a candidate for the “Alliance for the People” for the post of President of the Republic.

The movement set 13 conditions for voting in the second round of electing the president of the republic after presenting a candidate for the “Alliance for the People” in the first round, noting that these demands are directed to the bloc or blocs that adopt the presidential candidate in the second round.

Among the demands, according to a document seen by Shafak News Agency, are “accounting the perpetrators of the bloody massacres against the October protesters, revealing the kidnapped and the disappeared, and launching a general and special amnesty for demonstrators convicted of non-criminal cases, finding real and effective solutions to the file of the displaced, ending their suffering and providing them with appropriate job opportunities.”

The movement also stipulated “striving to reduce the prices of oil and its derivatives for citizens throughout the country and in the Kurdistan Region, especially due to the difficult weather conditions, and to reduce the exchange rate of the dollar against the Iraqi dinar.”

**Parliament: Failure to elect a president for Iraq within the constitutional period requires early elections within 60 days**

The independent member of the House of Representatives, Basem Khashan, said on Sunday that failure to elect a new president of the Republic of Iraq within the period specified by the permanent constitution requires holding early elections in the country within a period of two months.

Khashan said in a post on the social networking sites “Facebook” today, “The Federal Supreme Court Decision No. (51 / Federal / 2010), which authorized the continuation of the President of the Republic to exercise his duties until the election of a new president (..) is incorrect, because the blocking third he may delay his election for four years, and this is very possible now or in the future,” he asked, “Will the (current) president and government continue for another four years?”

The Iraqi constitution stipulates that the president of the republic (whose term has expired) shall continue to exercise his duties, provided that the new president shall be elected within thirty days from the date of the first session of the parliament session in its new session. And Khashan, a lawyer, added: This period is inevitable, and may not be exceeded, and since the legalization of exceeding this inevitable period without restriction necessarily means the continuation of the permissibility of the continuation of the president and the expired government until the end of the electoral cycle.

He also continued by saying, “This contradicts the principles of democracy. The failure to elect the president within the period specified by the constitution requires early elections to be held within 60 days from the date of the last date for electing the president,” noting that “this is the nuclear solution that forces the competing blocs to abide by this period.” Inevitability, other than that, the country will remain captive to the third who has an interest in the continuation of the president and the outgoing government.”

Khoshnaw added, "Rationality is to wait and wait for the interpretation of the constitutional texts and to work in accordance with the constitutional balances. The candidate for the president of the republic means the Iraqi candidate and represents all Iraqi sects and components, but the others wanted to exploit the political weights, so they were hit by the decision of the Federal Supreme Court."

Khoshnaw went on to say, "The Democratic Party was in agreement with its tripartite alliance even before the agreement with us, and Barham Salih is politically and popularly acceptable, and he possesses the qualifications and conditions for candidacy for the presidency, and he also has important and strong relations with the Sadrist movement and the coordination framework together." 
Regarding the return to the 2018 scenario, Khoshnaw said, "We do not count on the 2018 scenario, but we are betting on the national space, and Paval Talabani made great efforts to bring the framework and the trend closer, and the Patriotic Union does not go beyond the approach of the late Jalal Talabani in all circumstances and Barham Salih is committed to it."
He continued, "We do not nominate any figure if he does not adhere to this methodology and believe in the judiciary. Barham Salih is an important and heavy number in the political equation in Iraq and the region. He is a miniature model of Mam Jalal, and despite all the differences between the patriot and the democrat, there are understandings."
Khoshnaw concluded, "We always extend our hands to everyone and are not rigid with our decisions, and two-thirds and one-third are complements to the national and democratic project, and the Iraqi legislator who wrote the constitution within the unity of Iraq and equal opportunities."

The Prime Minister’s advisor for financial affairs, Mazhar Muhammad Salih, revealed last Saturday that “the first measure and government law that the new government will take is to present the budget law due to its utmost importance,” noting that “the budget law will be one of the priorities of the government and parliament because of its importance and affecting the lives of citizens, especially since the law is prepared.” It is ready and some modifications may be made. 
He added, "The work of Law 12/1 will continue until the approval of the budget for 2022."

Today, Monday, an Iraqi parliamentary source announced that the parliament session on electing the president of the republic has ended.
The source told "Shafaq News" agency, " The House of Representatives ended its deliberative session, and the House of Representatives left the parliament building."
The source confirmed that the session ended without holding an official session due to the lack of a quorum.
It was planned to hold a parliament session to elect a new President of the Republic . There are 25 candidates, but only 58 deputies out of 329 attended the session, so the session was not held.
 
On Sunday, Iraq's Federal Supreme Court suspended former Foreign Minister Hoshyar Zebari's candidacy for the presidency due to corruption allegations.
 
Several members of the House of Representatives said they would boycott Monday's vote to choose the new head of state, prolonging a political standoff.

The presidency of the Iraqi parliament decided decided to convert a session scheduled to choose the new president of the country into deliberative, after breaking the quorum for the session following the boycott of most of the parliamentary blocs.

The presidency of the parliament turned the session into a deliberative session after a delay of half an hour, but only 58 deputies from civil forces, independents and a Kurdish opposition bloc in the Kurdistan region of Iraq attended.

 

The constitution requires the presence of two-thirds of the 329 members of Parliament in the session to achieve a quorum to elect the President of the Republic, while Parliament has the right to hold its other sessions with a simple majority (half members + 1), which was also not achieved.

It is expected that the Presidency of Parliament will announce a new date for the session to choose the President of the Republic, amid leaks that the session will be linked to the holding of the Federal Court session to decide the case against the presidential candidate  Hoshyar Zebari . .

The lack of a quorum came as a result of a number of political blocs announcing their boycott of the session due to differences over the presidential candidate, and among the most important forces that announced the boycott were the Sadrist Bloc (74 seats), the Sovereignty Alliance (more than 60 seats), and the Kurdistan Democratic Party (31 seats), in addition to welcoming the boycott by the " coordinating framework ", which has about 70 seats.

 

This comes while the political closure continues between the two main Kurdish parties regarding the position of President of the Republic, as the Kurdistan Democratic Party adheres to Hoshyar Zebari's candidacy, while the Patriotic Union of Kurdistan insists on renewing the outgoing president,  Barham Salih. . The political norm since 2005 has been that the position belongs to the Kurdish political forces.

On Monday, the "Kurdistan Democratic Party" renewed its adherence to the nomination of Hoshyar Zebari for the post of President of the Republic.

A member of the party's negotiating delegation, Rinas Jano, said that "the Kurdistan Democratic Party" believes in the democratic process, noting, in a statement to the Iraqi News Agency (INA), that the state order issued by the Federal Court against Zebari does not affect the original right, but until the final decision on the case and make sure of the charges against him.

He continued, "We have more than evidence that Zebari is innocent. When he was nominated, his name was subject to scrutiny and verification, whether from the Integrity and Accountability and Justice Commission or the Ministry of Higher Education, as well as the existing criminal facts," noting that he "passed all these stages, and then He was nominated as a candidate for the presidency by the Iraqi Council of Representatives.

 

Jano indicated that "what is going on now is a political game played by the competitors, as they are afraid of the match in Parliament, because they know very well that Zebari will win," stressing that "these methods are more political than legal, as the nomination doors have been closed, and whoever believes that There is scope for switching candidates, it offers an illegal interpretation."

He concluded by saying that "the Kurdistan Democratic Party submitted only one candidate, Hoshyar Zebari, and we are still insisting on his candidacy."

On the other hand, a member of the Patriotic Union of Kurdistan, Tariq Jawhar, said that "the political forces' boycott of the parliament session threatens the election of the president of the republic," noting in a press statement that "the political forces' boycott of the parliament session has no interest in Iraq."

He added that "negotiations are still ongoing between the Patriotic Union of Kurdistan and the political forces, in order to reach an agreement on passing the candidate of the Patriotic Union of Kurdistan (Barham Salih)."

He continued, "The decision of the Federal State Court will have a significant impact on the course of electing the President of the Republic."

Yesterday, Sunday, the Supreme Federal Court of Iraq suspended the procedures for nominating the leader of the Kurdistan Democratic Party, former Foreign Minister Hoshyar Zebari, for the position of President of the Republic, pending a decision on the case against him, related to waste of money and abuse of power during his work as Minister of Foreign Affairs between 2004 and 2014.

The Iraqi parliament postponed, on Monday, the session to elect a new president of the republic, after the parliament could not complete a quorum. And the Iraqi News Agency, "conscious", said that "the Presidency of the House of Representatives decided to convert its session into a deliberative session," according to a statement from the Parliament's media department.

 

The Council had called for the session to elect the president, which was threatened with cancellation or postponement due to a series of positions issued by parliamentary blocs and deputies who announced a boycott of the session.

 

Earlier, the Federal Court in Iraq announced the temporary suspension of the procedures for electing Hoshyar Zebari for the presidency of the Republic, until the legal case for his candidacy was resolved due to previous accusations of financial and administrative corruption and abuse of influence.

 

And Zebari declared his respect for the decision of the Federal Court. "We respect the decision of the Federal Court to temporarily suspend our candidacy until the case is resolved by some of those who cling to the days before the reform," he said, in a brief statement posted on Facebook on Sunday.

Zebari added: "We trust that the judiciary will confirm what state institutions have confirmed in advance that we fulfill the conditions for candidacy, and that what is rumored is nothing more than whining for more clinging to power."
