Law experts confirmed that there is no relationship between Parliament’s conduct of its regular sessions and the exercise of its legislative and oversight role and the deadline for choosing and electing the new president of the republic, indicating that the recent Federal Court decision to lift the state order to stop the work of the parliament’s presidency restored to the legislative authority its full powers, including holding the expected second session. .
A parliamentary source had said earlier that the Presidency of the Parliament had not yet determined the timing of the second session, likely to be on the second of next February.
The head of the Deans of Law Committee and the Dean of Babylon University, Dr. Miri Kazem Al-Khikani, explained in an interview with "Al-Sabah" that "the decision of the Federal State Court to stop the work of the Presidency of the House of Representatives elected in the first session of the House of Representatives will not affect the date of the election of the President of the Republic on the eighth of next February."
He pointed out that "if the parliament's procedures were incorrect and disrupted, this would have an impact on the date of the session for selecting the president of the republic, in addition to the fact that the parliament's work has nothing to do with the specified constitutional periods," and with regard to the resumption of regular sessions between Al-Khikani, "the possibility of carrying out their work and the procedures drawn up for them in accordance with the Constitution".
On the other hand, KDP representative Nehru Raundozi confirmed in an interview with Al-Sabah that "the regular sessions of Parliament, according to the law, will not resume until the session for selecting the president of the republic is held, because the parliament's drafts and the legislation of laws come from the executive authority, so it is assumed that The government is being fully formed so that we can proceed with the regular sessions of Parliament.”
Regarding the date of the session to choose the president of the republic, Raundozi explained that “according to the constitutional period set within a month, and on February 8, the last date for choosing the president of the republic, it is likely that the session to choose the president of the republic will be held on the 6th or 7th of next month before the expiry of the period, after the file of the file is resolved. The Presidency of the House of Representatives said in a statement today that it held a meeting to discuss the provisions and procedures related to the nomination of the post of President of the Republic.

During the meeting, the presidency decided to announce the names of the candidates for the post of President of the Republic who met the legal conditions on next Monday, January 31, after completing the legal procedures based on the Law No. 8 of 2012 on the provisions of the nomination for the post of President of the Republic.

 

In its statement, the Presidency set Monday, February 7, as the date for the House of Representatives session to elect the President of the Republic.

 

 

More than 40 people submitted their names to the Iraqi Council of Representatives as candidates for the post of President of the Republic.

According to the political custom followed throughout the previous sessions, the Patriotic Union of Kurdistan has held the position of President of the Republic since the overthrow of Saddam Hussein's regime in 2003.

But in terms of numbers, the fact that the Kurdistan Democratic Party won 31 parliamentary seats in the recent legislative elections, compared to only 17 seats for the Patriotic Union of Kurdistan, may reverse the equation this time.

The outgoing President of the Republic, Barham Ahmed Salih, is competing for the same position with the Kurdistan Democratic Party's candidate, Hoshyar Zebari.

The Democratic Party says that the Union nominated Saleh for the position without the approval of the rest of the Kurdish political forces, which prompted him to put forward a candidate from his side to fill the position.

4. Restart employee promotions.  

5. Dissolution of Article 140 and the isolated areas and ensuring the budget of the region.   

6. Providing university and institute students' funds.  

7. Employing graduates of universities and institutes with contracts.  

8. Retirees must pay their salaries monthly, provide them with bank cards, and receive their salaries through that card.  

9. The Kurdistan Parliamentary elections will be held on time.   

10. Amending the election law and ensuring the impartiality of the commissioners.

Shafaq News/ The First Deputy Speaker of the Iraqi Parliament, Hakim Al-Zamili, announced on Saturday that an expanded meeting will be held to check the names of the candidates for the presidency, stressing the adoption of "data, provisions and restrictions imposed on each candidate away from all external or internal tendencies, trends or influences."

 

Al-Zamili's office said in a statement issued today, and received by Shafak News Agency, that the latter chaired, today, the expanded meeting to check the names of the candidates for the presidency, which is to be announced two days from now, provided that the vote on the presidential candidate will be officially held during the second session of the fifth session. Parliament on Monday, February 7, 2022 next week.

 

He explained that during the meeting, which was held in the parliament building, in the presence of the Minister of Higher Education and Scientific Research, the Chairman of the Integrity Commission, the Vice-President of the Accountability and Justice Commission, the Senior Undersecretary of the Ministry of Interior and members of the Diwaniyah Order, all 26 candidates for the position of President of the Republic, in terms of restrictions, were discussed and audited. and their position on accountability, justice, academic degrees, and their integrity.

 

Al-Zamili stressed the need to adopt documents, certificates and resumes in a professional and transparent manner, and to remove any kind of political pressure that may be exerted on the relevant authorities to prevent them from performing the duties assigned to them, stressing that everyone has placed their full confidence in these authorities by applying professional standards to all candidates on the Both and in a manner different from what was in place in the past, confirming that the House of Representatives approved all mechanisms, procedures, statements, provisions, and restrictions imposed on each candidate away from all tendencies, trends, desires, or external or internal influences.

And he indicated that "the above decision says the most numerous parliamentary bloc after taking the oath, which is the first session devoted to electing the Speaker and his two deputies, and it means that the registration of the most numerous bloc is presented to the head of age according to Articles 54 and 55 of the Constitution and Article 5 of the Parliament's internal system and this is the direction of the Federal Court in the decision 25".

Al-Tamimi pointed out that “the Federal Court can, although its decision is in accordance with Article 94 of the Constitution, but this does not mean finality. ".

He pointed out that "the difference between the national majority and the political majority, where the first means the majority of the government that takes over the formation of the government and bears the results, and the other side is an opposition that monitors the national majority."

He continued, "If the new approach is implemented, we will approach the form of the parliamentary system, which is adopted by 25% of the countries of the world and is called the master of political systems."
