He added that "the decision of the Federal Court is related to the fate of Parliament and the political process, and depends on it the continuation of the state of justice in the formation of the rest of the authorities," noting that "on the other hand, there are pressures on the Federal Court from the influential political forces that want to move things in any way and pass the stage, in addition to The presence of external pressures on the entire political process.

Yesterday, Wednesday, the Federal Supreme Court announced the postponement of the plea to challenge the constitutionality of the first session of Parliament until next Tuesday, January 25, and contented itself in the session, which was broadcast live, to take the statements of the two parties to the case, the representative (Bassem Khashan) and the representative of the representative (Mahmoud Al-Mashhadani) on the one hand. I’m thinking Iraq could save a lot of money and wasted time if they did away with this crazy parliament system they have and just let the high court run the country. 
The court could set up a couple of smaller committees to handle the little stuff and eliminate most of the corruption and foreign influence going on….

The Federal Supreme Court of Iraq ruled , on Tuesday, the legality of the first session of parliament, which witnessed the election of a speaker and two deputies, while the leader of the "Sadr bloc" Muqtada al-Sadr praised the decision.

On January 13, the Federal Court decided to suspend the work of the Presidency of Parliament until two cases regarding the legality of the first session were resolved by MPs Mahmoud al-Mashhadani (from the "Azm" coalition) and Basem Khashan (independent).

The Iraqi News Agency said, "The Federal Court decided to reject the challenge to the constitutionality of the first session of Parliament," noting that "MP Khaled Al-Daraji's presidency of the first parliament session does not contradict the provisions of the constitution."

She added, "The court also decided to cancel the order regarding the temporary suspension of the Presidency of the Parliament," stressing that "the oldest interim Speaker of Parliament, Mahmoud al-Mashhadani, cannot continue to run the parliament session after announcing his candidacy for the presidency."

The leader of the "Sadr movement", whose list topped the elections, commented on the court's decision, saying: "Once again, the Iraqi judiciary proves its integrity and independence and does not succumb to political pressures."

Al-Sadr added, in a tweet via his Twitter account: "We are proceeding with the formation of a national majority government, and our door is still open to those we still think well of."

And he added: "Everyone will remain our brothers, even if they take the opposition or boycott as long as they seek reform and Iraq's prestige is working."

Al-Sadr concluded by saying: “No to subordination, no to violence, and no to breaking the law.”

On January 9, the first session of Parliament witnessed violent verbal altercations between the deputies of the "Sadr bloc" and the "coordinating framework" regarding the "largest parliamentary bloc", in the midst of which the (older) interim Speaker of Parliament Mahmoud al-Mashhadani was assaulted by one of the representatives (did not know). His identity), which necessitated his transfer to the hospital, and then assigning the second oldest member, Khaled Al-Daraji, to chair the session.

Parliament chose Muhammad al-Halbousi as speaker of the council after he won the votes of 200 deputies, compared to 14 votes for his rival, al-Mashhadani.

Earlier on Tuesday, the court postponed consideration of two cases submitted by members of the House of Representatives, Alia Nassif and Atwan Al-Sayed Hassan, regarding the demand for the announcement of the "most numerous parliamentary bloc", and the invalidity of the parliament session, until the beginning of next month.

With the issue of the legality of the session being resolved today, the court has no choice but to consider the case for determining the "most numerous parliamentary bloc" that will be tasked with forming the government, during a session in early February.

The Sadrist bloc topped the October 10 elections, with 73 seats, followed by the Progress Alliance with 37, the State of Law coalition with 33, and the Kurdistan Democratic Party with 31.

Baghdad (AFP) – Iraq's top court on Tuesday confirmed the re-election of Mohammed al-Halbussi as parliament speaker, following appeals against its conduct, paving the way towards the formation of a new government.

 

Two lawmakers had appealed Halbussi's re-election as speaker, a position historically reserved for Iraq's Sunni Arab minority, during parliament's opening session earlier in January which was overshadowed by disputes between rival blocs from the Shiite majority.

"The Federal Supreme Court rejected the appeal of two MPs who demanded the annulment of the inaugural session of parliament on January 9," in which Halbussi was re-elected, said presiding judge Jassim Mohammed Aboud.

The ruling will allow the resumption of parliament sessions, and along with them deliberations over the selection of a new president, who will in turn choose the next prime minister, to be approved by the legislature.

Lawmakers have until February 8 to elect a president -- a post historically allocated to a Kurd.

But negotiations between parties and coalitions seeking to form a parliamentary majority have been marked by tensions, particularly between key Shiite currents seeking to exert their influence.

Both the Coordination Framework and another bloc formed by firebrand Shiite cleric Moqtada Sadr claim to have the majority needed to elect a president.

The legislature opened to furious arguments between the rival factions.

Amid the debate, Mahmud al-Mashhadani -- the oldest member of parliament who was therefore chairing the opening session -- was taken ill and rushed to hospital.

When the session resumed an hour later, lawmakers re-elected Halbussi of the Sunni Taqadom party as speaker.

Appeals against the speaker's re-election were filed by Mashhadani and another MP, Bassem Khachan.
