Today, Monday, the Iraqi Federal Court decided to postpone the settlement of a complaint to cancel the legislative elections, which was previously submitted by Hadi al-Amiri, the head of the "Al-Fateh" coalition.

And the Iraqi News Agency, INA, said that the Federal Court postponed consideration of the complaint until the twenty-second of this month.


On Monday morning, the Federal Court opened a hearing in Al-Amiri's complaint, in which he demanded the annulment of the results of the elections that took place on the tenth of last October, alleging that there were cases of fraud in the results.

Leaders from the "coordinating framework", which includes the "Al-Fatah" coalition and other forces opposed to the results, arrived in the courtroom. Media and platforms close to the " coordination framework " indicated that Al-Amiri's lawyer also arrived at the court, and demanded measures towards the manipulation that occurred, according to what he was quoted as saying.

The difficulty of canceling or changing the results of the Iraqi elections
Lawyers and specialists stress the difficulty of the Federal Court annulling or changing the election results, explaining that the constitution grants the court the right to ratify the results, so that Parliament can then hold its first session, without referring in any of its articles to what allows the court the right to annul the results.

The "Al-Fateh" coalition's lawsuit submitted to the court is based on about 20 files that include various documents, numbers, data and testimonies, related to what the coalition considers evidence of fraud and manipulation.

The "Al-Fateh" coalition is one of the most prominent losing forces in the elections, as it won 17 seats, a clear decline from the number of seats it obtained in the 2018 elections. The elections also witnessed the loss of other prominent forces such as the "Wisdom" movement led by Ammar al-Hakim, and the "Victory" coalition. headed by Haider al-Abadi, and the “Sadiqun” and “Haqq” movements, which are linked to armed factions, also suffered a great loss, which prompted these parties to reject the results and to form a coordinating framework that opposes the election results.

Today, Monday, the Federal Supreme Court is expected to hold a hearing to consider the appeal submitted regarding the integrity of the results of the Iraqi elections that were held on October 10.

This is the challenge presented by the "Al-Fateh" coalition, the political representative of the "Popular Mobilization", which adheres to its position rejecting the results, which it describes as "forged", considering that it was "manipulated", after it ranked late in the lists of political blocs in the elections.

 

Amidst speculation about the Federal Court’s decision, which ranges from rejecting the appeal and going to ratify the results to be constitutionally effective, or postponing the complaint to another time, judicial sources in Baghdad confirm to Al-Araby Al-Jadeed, the possibility that the Federal Court may summon the head and members of the Iraqi Electoral Commission, And also parties involved in supervising the conduct of the elections, including local observers.

The sources also talk about the possibility of summoning a representative of the German company responsible for supplying the counting and sorting equipment for the ballot, due to the emergence of problems related to the occurrence of discrepancies in these machines, as well as the delay in transmitting information after the closing of the ballot boxes.

Options for the Federal Court to accept the appeal does not mean canceling the results of the Iraqi elections

 

The court will not annul the results of the Iraqi elections

According to the same sources, the options for the Federal Court to accept the appeal do not mean canceling the results of the Iraqi elections, as the forces allied to Iran want, as it is possible that the submitted invitation (the appeal) will take some legal measures, in order to convince the refusing forces to exhaust all their legal options.

However, in the end, according to the sources, the general internal political orientation, and even the external one, revolves around the refusal to cancel the results of the Iraqi elections and the need to proceed with the current elections without change.

The "Al-Fateh" coalition's invitation to the court is based on about 20 files that include various documents, numbers, data and testimonies, related to what the coalition considers evidence of fraud and manipulation.

Regarding this step, specialists, including an observer in the “Al-Rafidain” organization that participated in supervising the elections, told Al-Araby Al-Jadeed that “many appeals were dealt with within the commission, and this resulted in the cancellation of entire electoral stations and centers, without any They leave a legal impact on the final results of the elections.”

In the meantime, intense political meetings are taking place in Baghdad, Erbil and Najaf between the various parties, including the forces rejecting the results of the Iraqi elections, which are preparing to send a delegation to go to Najaf and Erbil.

Regarding these developments, a member of the “Al-Fateh” coalition, Muhammad Al-Darraji, stresses, in an interview with Al-Araby Al-Jadeed, that the coalition is waiting for “the decision of the Federal Court in the appeal submitted by them, before entering into any formal negotiations with the rest of the blocs on the form of the government, its program and candidates for positions.” in it, as well as the posts of Speaker of Parliament and the Republic.”

 

And on the way they dealt with the court’s decision in the event that their invitation was rejected and the results were approved by ratification, he reveals that “there is an agreement to respect the opinion of the Federal Court, whoever it is, and the others should do the same.”

Al-Darraji points out that "the current meetings between the blocs are like feeling the pulse and opening channels of communication, and they cannot be considered negotiations. Also, the reports quoted about candidates for the prime minister or the presidency are inaccurate, and no name has been proposed, not at the level of the initial nomination." 

Government assignment after the approval of the results

But another member of the "Al-Fateh" alliance, Mukhtar al-Moussawi, revealed, the day before yesterday, Saturday, that "the Shiite forces, with the exception of the Sadrist movement, have agreed on the names nominated to head the next government."

Al-Moussawi added, in statements reported by local media, that the Shiite consensus for the position of prime minister may be in the interest of the former minister, Muhammad Shia al-Sudani, or the current governor of Basra, Asaad al-Eidani, but the matter of assignment will be decided after the approval of the Federal Court on the results of the Iraqi elections.

The political crisis in Iraq has worsened since the end of the Iraqi elections on October 10 and the refusal of the losing powers to recognize the results.

In response to the new data, Issam Hussein, a member of the Sadrist movement, stressed in an interview with Al-Araby Al-Jadeed that the movement led by Muqtada Al-Sadr "will not give up the option of the majority government, and there are political blocs that have actually started in the past few days to move politically in light of the election results."

Hussein talks about what he described as "a decline among the forces objecting to the election results in terms of rushing towards demands for their cancellation, after the recent results became a fait accompli."

A member of the Sadrist movement believes that "some forces tended to deal with these results, and headed towards political dialogues in order to form the next government."

Hussein considers that "the option of a national majority government guarantees the representation of all election winners in the administration of the state, and there is no longer any room to talk about sectarian consensus rejected by the Iraqi people, because it has proven its failure over the past years."

Hussein points out that the approval of the results will lead to the exit of the current consultations and meetings to their official and declared form.

Kurdish concerns go beyond the Iraqi election crisis

For the leader of the Kurdistan Democratic Party, Majid Shankali, "most political parties and alliances have crossed the crisis of the unsatisfactory election results of some of the losing parties."

Shankali said, in an interview with Al-Araby Al-Jadeed, that "these forces, including the (coordinating framework), are going in two tracks: the first is electoral, with the aim of objecting to the results of the Iraqi elections. The second is political, linked to the formation of the government and the distribution of ministries and influence."

The best option for the Kurds in the next stage is to move towards forming a majority government

Shankali explains that "the Kurdish forces have greater concerns than positions and ministries, and they are in the process of discussing a visit to Baghdad as a Kurdish delegation or a Kurdish bloc, opening files related to the rights of the Kurdistan region of Iraq, and discussing the file of Article 140 (concerning the management of the disputed areas), and the Sinjar Agreement, which has not been implemented. So far, the financial budget, in addition to the issue of true partnership and achieving the principle of balance in the management of the state.

Shankali points out that the best option for the Kurds in the next stage is to "go towards forming a national majority government."

It is noteworthy that in the context of the government formation process, a delegation representing the forces of the "coordinating framework", which brings together a number of blocs and alliances backed by Tehran led by former Prime Minister Nuri al-Maliki, was scheduled to go to Najaf, in the last period, to meet the leader of the Sadrist movement, Muqtada al-Sadr, In response to the latter's visit to Baghdad earlier this month, however, the visit was postponed until the Federal Court decided on the results of the Iraqi elections, which need judicial approval, before they are considered constitutionally effective.

In an interview with Al-Araby Al-Jadeed, Al-Mizan considers that "the political parties that worked to cancel the elections, aimed at disrupting the ratification of the elections in order to ensure sufficient time for further dialogues. This applies to all parties, Shiite, Sunni and Kurdish."

Al-Rikabi indicated, "The New Resilience Alliance is the closest in terms of visions and views to the framework, and it is possible to speak with it clearly, and this rapprochement confirms the move to form the largest parliamentary bloc."
And he concluded, "the coordination framework with the consensus government, which includes all Iraqi components."
Last Sunday, the Federal Supreme Court held a session to consider the complaint submitted by Hadi Al-Amiri, the head of the Al-Fateh Alliance, against the Electoral Commission for the legal and technical violations it committed and the consequences of the electoral process.
The court listened to the defenses of the defendant’s attorney (the Commission) on the list submitted by the head of the Al-Fateh Alliance, and the court was interested and proved many of the points mentioned by Al-Amiri as the plaintiff, in particular the reports of the German Examiner Company and the observations it contained on the Commission’s procedures and the hardware and software used in the electoral process.
Then the Federal Court decided to adjourn the session and set the 13th of this month as the date for another session to consider the case after seeking the assistance of experts to study the reports of the German examining company.

Political analyst: The majority government will not accept the coordination framework and the Federal Court will postpone its decision tomorrow

Sarraj said; For the (Unannounced) program broadcast by Al-Furat satellite channel tonight, "the tension still exists and the disputes are in full swing. The Sunnis were clearly divided, in addition to what was produced by the Kurdish forces, as well as the existing differences between the Shiite forces regarding the largest bloc." 
 He added, "Therefore, I imagine we need two strengths to properly resolve the crisis," likely "the Federal Court's postponement of the decision to resolve the ratification of the results tomorrow, Sunday, and the views are still distinct between the political positions."
Al-Sarraj continued, "The external factor wants to conduct things as they see fit, and the majority and the opposition are not after the elections, but are supposed to present a program that precedes them, and the opposition is not selective, but according to a specific project and a shadow government."
He stressed, "the need for a realistic program that can be implemented in the government project, and the reality of the political situation will force the Shiite forces to get out of the crisis."
And between Al-Sarraj, "the majority government that Mr. Al-Sadr calls for is national, not political, and the framework does not see a national interest in sharing positions, and all the coordinating forces have one vision and will make a political movement very close and will start from Erbil with two major poles in order to coordinate the issue of government formation; but he will not proceed from without the Sadrists. 
The political analyst concluded, "The seats in the parliamentary framework are more than the seats of the Sadrists, and the idea of a government of the national majority is not accepted by the framework, and the Kurds and Sunnis will not ally themselves except with an acceptable Shiite formation."

Al-Sadr needs to start forming the next government. These Iranian terrorist will bog down this weak Iraqi court system down for years.

If even one of their federal court members had half a brain they would ratify the election results and tell Al-Sadr to form the next government. Then tell the Iranian regime they would set dates in the near future to hear all complaints.

Still haven’t figured out why it’s ok for Iran to interfere with their elections but not the USA or other countries…

Wael Al-Rikabi, a member of the State of Law coalition affiliated with the framework, told {Euphrates News}, "So far, no decision has reached the coordination framework from the Federal Court to study the recount of 20% of the polling stations, and we do not expect such a ruling if all the cases presented to it are arranged." .
He pointed out that "it is premature for the court to take such a decision, and the decision is taken in the name of the court that is looking into the appeals, which postponed its session to the 22nd of this month, so how do they appoint these stations, and so far we have not received any news in this regard."
It is noteworthy that the Al-Fateh Alliance, led by Hadi Al-Amiri, had submitted appeals attached to some documents challenging the integrity of the elections to the Federal Court for consideration, followed by former Prime Minister Iyad Allawi, who submitted a number of appeals documented with evidence, according to his claim.
Al-Amiri stressed during his meeting yesterday with the delegation of the Kurdistan Democratic Party headed by Hoshyar Zebari that: "The accurate evidence presented to the Federal Court is enough to prove the electoral fraud and cancel its results." 
He added, "The examining company's report mentioned the possibility of falsifying the election results without any criminal effect, and the Commission says that this serious threat is acceptable," he said.
And an informed source said, today, Wednesday, that the Federal Supreme Court may issue a decision to re-count the manual count of all electoral stations across the country, at a specific rate.
The source said in a press statement, "The Federal Court has two options to overcome the crisis of the election results, including the partial counting of stations in some governorates, and the second is a comprehensive recount of all electoral centers in a specific percentage."
He explained that "according to the information received from there (the Federal Court), it is in the process of issuing a decision to re-count the manual counting of all polling stations in the Baghdad governorate, in addition to another governorate specified or named by the court, since most of the violations that accompanied the electoral process were recorded in the electoral centers of Baghdad governorate. Or re-counting and manual counting of all electoral stations across the country, at a rate of 20%.
The source added, "The court is obligated to issue decisions that end the controversy over the election results, and the decision to postpone means that it is heading towards one of the aforementioned decisions."
