Al-Tamimi explained that "the tripartite judges panel is formed under the commission. Every decision that may be appealed is submitted to this panel, and its decisions are final."

I’m not an Al-Sadr fan but with him combining seats with a few other blocks he will seat this new government rather quickly is my guess….

The first is that the dispute over this constitutional text means referring to the State Council to request interpretation, and then transferring the ball from the court of the Federal Court, which decided on the matter to the Commission, and the second part is that the text of the constitutional article 76 framed this issue, It is the basis for organizing this part related to the formation of the executive authority, which may allow the consideration of the text of legal article 45 of the new election law for the year 2020, as a text contrary to the constitution as interference in the organization of a purely constitutional issue, especially since article 76 did not refer to the existence of the need to issue a law regulating it. , that is, adapting this article as a violation of the constitution, because the legislative authority is outside its jurisdiction, and since the decisions of the Federal Supreme Court are final, they will prevail in the end, and this is my reading of the scenario of what will happen after the elections in terms of deciding on the issue of who is the largest bloc.

Since the dispute that erupted between Iyad Allawi and Nuri al-Maliki, over the eligibility of either bloc to obtain the government mandate in 2010, this constitutional interpretation is in force as it has become a constitutional custom, as al-Janabi explains.

And about what the differences over the largest bloc will result in this time, the Iraqi academic says: “Now either the Sadrist bloc will be able to form the government, and this requires it to complete the necessary quorum of 165 seats, or it will be formed by the coordinating framework that includes the rule of law and Fatah, and although Article 45 of the Law The elections prevent the merger between the blocs, but they do not prevent the alliance between them. He added, "This is what is meant by these actionsIt is the normal that is non-deterministic and by which life does not stop, and the constitution specified this period at 30 days in articles 61 and 64, and most of the world’s constitutions specified that30 days, as in Germany and South Africa. The period should not be long, except within the limits of the national interest.  

He pointed out that "the oversight of the daily caretaker government is from the administrative judiciary, where its decisions can be appealed before it,It's called a narrow appeal."  

He explained, "The caretaker government does not have the right to propose amending the constitution, enacting laws, concluding agreements or entering into them, not even contracts with states or appointments to special grades, or in short, every work that needs parliamentary oversight... It is a government that is already finished with the end of the parliament from which it came. ".  

And he indicated that "what businesses have the right, for example, to sign contracts between ministries, to withdraw an amount for the payment of salaries, so their range is only one month."  

He pointed out that "he may question the caretaker government if it exceeds the limits of its work from the judiciary or the next parliament in accordance with articles 329 and 240 of the Penal Code."

Fifthly, Article 15 of the applicable election law, No. 9 of 2020, states the following:    

If any seat in the House of Representatives becomes vacant, the candidate with the highest number of votes in the electoral district shall replace it.

As for the vacancy of the seat of the Sadrist bloc's deputy, "Marwa Al-Kinani", this will mean the rise of the candidate for the "Conservative" party,  Haifa Hussein .    

The prominent leader in the State of Law coalition, " Katea al-Rikabi",  will need two vacancies out of the three, which will be filled by "the Minister of Labor in Al-Kazemi's government, the winning representative, Adel Hashush, the winning deputy from the extension of Kazem Al-Fayyad, and the deputy of the Sadrist bloc, Ammar Al-Salman."    

The candidate of the "Rights" movement in the fifth constituency, Mohsen Al-Amer , will need to displace two seats out of the three that will currently be occupied by the winning MP from Falah Al-Hilali extension, the winning MP from the State of Law Aref Al-Hamami, and the winning MP from the Sadrist bloc Ghassan Al-Saidi.

In the first constituency in Anbar Governorate, if former Parliament Speaker Muhammad al-Halbousi decides to occupy an executive position, he will give his seat to the candidate of his rival Azm Alliance, " Issa Sayer al-Issawi" .    

As for Anbar Governor Ali Farhan Al-Dulaimi's assumption of an executive position, it will not change the equation, because his replacement will be from the same party,  Ahmed Al-Alwani , the candidate of the Progress Alliance in the second constituency .    

In the third constituency, the representative of Hibat al-Halbousi's progress will have to remain in parliament, because a vacancy in his seat will mean the ascension of " Fares al-Fahdawi"  from the Azm Alliance to Parliament.

The legal advisor to the Presidency of the Republic, Munif Al-Shammari, said in a press statement, "The Iraqi constitution specified that the President of the Republic assign the candidate of the largest bloc to form the government," noting, "In the Presidency of the Republic we are waiting for the formation of the largest bloc."
He added, "If it is formed, it will adopt the name of a candidate for prime minister, and the President of the Republic is obligated, according to the constitution, to grant confidence to the candidate."
On the provincial councils law, Al-Shammari stressed that “there is no amendment to the law at the present time,” noting that “the law was amended in 2019 and this is the last amendment to the law.”
He pointed out that "it is possible to make an amendment to the provincial council law during the new session."
