The reporter of the Finance Committee in the House of Representatives, Ahmed Al-Saffar, stated that the Kurdistan Regional Government must implement four paragraphs of the General Budget Law for 2021, in order to send its share of the budget from Baghdad.

Al-Saffar said that the Kurdistan region must implement four paragraphs of Article (11) of the General Budget Law for 2021, so that the federal government will implement the fifth paragraph of the same article, which is related to sending the Kurdistan region’s share of the budget, according to Rudaw.

He added that "the issue of the general budget is finished in both the political and legislative terms. The share of the Kurdistan region was determined during Article 11 of the Budget Law, which is a conditional article in which Erbil must implement four paragraphs in order for Baghdad to initiate the implementation of the fifth paragraph related to sending the Kurdistan region’s share of the budget."

It is noteworthy that the Iraqi Council of Representatives voted on March 31, 2021, to approve Article (11) of the Budget Law for 2021 regarding the Kurdistan region's share of the budget.

Article 11 of the Iraqi Federal Budget Law for the year 2021 states that the Kurdistan region must produce from its fields at least 460,000 barrels of oil per day, and after deducting production and transportation expenditures, the amount required for domestic consumption and the petrodollar share, the Kurdistan Regional Government must hand over to the federal government Daily revenues of at least 250 thousand barrels of oil, at the price of SOMO. The Kurdistan region must also hand over 50% of its non-oil revenues to Baghdad, so that the latter will spend its share of the general budget.

The reporter of the Finance Committee of the Iraqi Parliament indicated that "a joint technical delegation from the Ministry of Finance, the Ministry of Natural Resources and the Financial Supervision Authority of the regional government, was supposed to head to Baghdad, two weeks after the approval of the General Budget Law, to end the outstanding issues."

With regard to the Kurdistan Region’s share in the past months, Al-Saffar explained that “the federal government deducts monthly imports of 250 thousand barrels of crude oil at the price set for SOMO, in addition to half of the non-oil revenues in the Kurdistan Region, so that the remaining amount is sent to the Kurdistan Region.”

The federal budget for the year 2021 was estimated at more than 129 trillion dinars, thus the Kurdistan region’s share of the federal budget for this year is 11 trillion and 482 billion and 394 million dinars.

 3/20/2003 and not as stated by the Public Retirement Authority from 1/1/2014 It will lead to a distinction between the martyrs and the wounded, and we consider it a violation of the laws in force and the constitution.

2- The Ministry of Finance and the Public Retirement Authority must expedite the issuance of instructions on the issue of the right to combine the salary of injury and martyrdom and their salaries in accordance with the laws in force and related to the rights of martyrs and wounded employees and employees of the Ministry of Interior, Defense and the Popular Mobilization.

3- The General Retirement Authority must start disbursing the accumulated pension salaries to the families of the martyrs and the injured, especially after approving the general budget law for the current year and releasing the amounts allocated by the Ministry of Finance.

4- The necessity of seeking to find realistic and urgent solutions and solutions regarding the issue of the right to housing for the families of the martyrs and the wounded and stipulated in the laws in force. We suggest the following:

a. Moving towards the Ministry of Agriculture to obtain agricultural plots and convert their gender to residential, especially in the capital, Baghdad, as an exception to the agricultural reform law.

B - Agreement with the National Investment Commission for the purpose of distributing apartments in the newly developed investment complexes, with the provision of the amount provided for the families of the martyrs and the wounded, and providing all the necessary facilities.

5- The government should strive to provide advanced prosthetic limbs from well-known international origins for the wounded and injured, especially the members of the Defense, Interior, Popular Mobilization and other security services.

He pointed out that "we indicate the existence of serious suspicions of corruption, especially in the compensation committees and the public retirement authority, from the demand for bribes and bargains by lawyers and trackers who are colluding with some weak-minded employees and the manipulation of a large number of transactions of the martyrs and the injured. The money of the rights of the martyrs and the wounded was wasted, and we also call on the Martyrs Foundation to exercise its role as the executive body responsible for this segment in accordance with the laws.

Cougar pointed out, "If oil prices rise significantly, we will have several areas that we can benefit from. Either we go to a supplementary budget or adjust the bank reserve because it was 82 billion dollars, it fell to 56 billion dollars, now it began to rise to 65 billion dollars, and therefore We are trying to restore it to what it was, or we go to repay the debts owed by the state, including loans from Iranian companies, contractors' dues, and foreign loans."

It is noteworthy that the Iraqi government has suffered during the last period from a lack of financial liquidity, which has caused the difficulty of distributing employee salaries on a continuous basis, as a result of the drop in oil prices, which constitute more than 90 percent of Iraq's general budget before oil prices rise again.

Yesterday, Saturday, the Parliament’s Finance Committee confirmed that the important part of the current budget has not been implemented so far, while revealing that the government formed a committee to prepare the draft law for the next year, expecting to present a draft that does not depend on real data and data because of ignoring the final data.

In an interview with Al-Sabah Al-Jadeed, the committee’s rapporteur, MP Ahmed Al-Saffar, said that “the important part of the current year’s budget has not yet been implemented, which is surprising.”

Al-Saffar added, "Last week, the Parliamentary Finance Committee had continuous meetings with governors to discuss reconstruction plans and investment projects."

He pointed out, "This delay in implementation coincides with the start of the government forming a committee to develop a budget strategy for 2022."

Al-Saffar pointed out that “the theory of public finance requires starting from a certain level reached by previous budgets.”

He stressed, "For the past years, Iraq has been undertaking the preparation of budgets and then legislating them without reviewing final statements, and without relying on previous data."

Al-Saffar stressed, "The government may be able, in both theory and form, to prepare a budget that does not differ much from the draft law for the current year."

Al-Saffar explained, "The Finance Committee made efforts over a period of two months until it was able to change the rigid financial paper that was devoid of a social and economic vision and fairness in distribution, and turned it into a budget that was voted on in the House of Representatives."

He noted, "These negatives did not prevent the government from directing the appeal to ten paragraphs of the law."

Al-Saffar went on to say, "What is currently happening is that a government committee was formed to develop the budget strategy, which is supposed to be consistent with the ministerial curriculum and include data starting from the foundations of the institutions to the top of the pyramid before presenting it to the cabinet."

For his part, committee member MP Ahmed Hama Rashid said, in a statement to Al-Sabah Al-Jadeed, that “what we fear is presenting mere tables as a draft budget, as happened at the beginning of this year.”

Rashid continued, "The House of Representatives in its current session may not be able to pass the budget, and it will be carried over to the next session; Because we are heading to early elections.”

He continues, "The Financial Management Law stipulates that the government submits the budget bill before October 15, a date that is usually skipped."

Rashid concluded, “The current budget has taken us a long time, and that the experience is repeated is very expected, and of course Parliament will reformulate it and then challenge it every year by the government.”

It is noteworthy that the House of Representatives had voted on the current year's budget at the end of March, while the Finance Committee revealed that the government submitted appeals that included ten paragraphs distributed over six articles in the law.

4 entities filed appeals against 10 paragraphs of the 2021 budget with the Federal Court.

A member of the Parliamentary Finance Committee, Ahmed Hajji, told "Economy News", that the government, Wasit Governorate, Representative Uday Awad and the Iraqi Industrialists Union challenged the 2021 budget, adding that the appeals relate to 6 articles in the 2021 budget law, which includes 10 paragraphs.

He continued that the articles objected to are 2, 4, 18, 12, 50 and 58, adding that the legal department in Parliament is pleading for Parliament.

He noted that the legal objection does not stop the procedures for implementing the articles only after the issuance of the Federal Court's decision.

On the other hand, the rapporteur of the Finance Committee, Ahmed Al-Saffar, said that the Finance Committee has the right to amend and transfer the articles of the draft law, adding that the 2021 budget is an expansionary budget, and the committee reduced expenditures from 164 trillion dinars to 128 trillion dinars.

He pointed out that the Finance Committee's amendments were in the interest of the economy by diversifying its revenues and not keeping oil.

The government’s objections relate to the following paragraphs, namely Article 2, Paragraph 4g, which says, “The Ministry of Finance must abide by the ceiling of the allocations contained in the “amended” table and redistribute those allocations, both operational and capital, and classify them on the basis of the level of departments, chapters, materials and types.

As well as Article 2, Paragraph 4h, which relates to the allocations of revenues obtained from collection and fees to municipal and health departments in the governorates, which is found in their balances for the years 2019, 2020 and 2021, and authorizes the governor to ratify the spending plan. And Article 2, paragraph 8, which relates to the establishment of funds in all governorates producing crude or refined oil or gas under the name of the Petrodollar Fund, which is managed by the governor and financed monthly.

The objection also relates to Article 12 Second B, which speaks of “The Council of Ministers must disengage and restructure departments and departments in ministries and entities not affiliated with a ministry that exercise, under its laws, tasks equivalent or similar to the tasks stipulated in Federal Public Service Law No. 4 of 2009 amended to activate the role of the Council in public service.

The government also submitted an objection to Article 18 III B related to the imposition of a 15% tax on imported fuel that is sold directly through car filling stations.

The government appealed, Article 50 A, which states, “The Minister of Finance may add financial allocations to fill the shortfall in employee compensation from salaries, contractors’ wages and daily wages, if any, provided that the total amount does not exceed 500 billion dinars, provided that it is audited by the Federal Financial Supervision Bureau later.”

The government also appealed, Article 50 C, which talks about “the Council of Ministers must increase the current prices for the purchase of wheat, barley and rye crops from farmers by 50 thousand dinars per ton for each of the mentioned crops.”

The appeals also included Article 56 III, which says, "The extractive oil companies are obligated not to include the expenses for the license tour contracts in the lists of calculating the cost of the current activity, with the exception of the salaries of employees seconded to work with contracting companies within the license tours, taking into account what was stated in the Council of Ministers decision No. for 212" on 6/29/2013.

It also submitted an objection to Article 58, which obligates the Council of Ministers to assign the names of those entrusted with the positions of heads of independent bodies, special degrees, deputy ministers and advisors to the House of Representatives no later than 30/6/2021, and the House of Representatives is obligated to take its decision by voting within 30 days from the date of sending the names.

On the other hand, Wasit Governorate submitted an objection to Schedule C related to new employees.

Wasit Governor Muhammad Al-Mayahi said that the Wasit government submitted an objection to the Federal Court against Schedule C in the 2021 budget, noting that the failure to implement Resolution 315 issued by the Council of Ministers is considered a big bomb that could explode at any moment.

      Parliamentary Finance: The 2021 budget will be passed by consensus of the political blocs

      , the Parliamentary Finance Committee confirmed, today, Monday, that the 2021 budget will be passed in agreement with all political blocs.
      A member of the committee, Naji Al-Saeedi, told the Iraqi News Agency (INA): "The vote on the budget will be at the end of this week," indicating that "the budget will not be passed without consensus."
      He added, "The budget will pass in agreement with all political blocs, including the Kurdish blocs," ruling out "voting on the budget by the majority."
      Al-Saeidy added, "If there had been a majority vote, negotiations would not have continued and the approval of the budget would have been delayed until this moment."
      Earlier, the Parliamentary Finance Committee announced the completion of all articles of the General Budget Law, and delivered a letter to the Presidency of the Council of Representatives since February 15, 2021, for the purpose of setting a date for voting on it.

A member of the committee, Jamal Cougar, said in a press statement, "The committee has officially received a copy of the draft federal budget law for the current year 2021, from the Presidency of the House of Representatives."
      He added that "the House of Representatives will hold a session next Saturday to conduct the first reading of the budget bill," indicating that "the committee will make its observations on the draft budget law after the first reading."
      Cougar stressed, "The House of Representatives will not hold a session tomorrow, Thursday, to hold the first reading of the draft federal budget bill."
      And the media had reported news that the House of Representatives would hold a session tomorrow, Thursday, to hold the first reading of the draft federal budget bill for the current year 2021.
      It is noteworthy that the Speaker of Parliament, Muhammad al-Halbousi, announced on the 29th of last month the arrival of the government's 2021 fiscal budget bill and the extension of the current legislative term for one month, in order to complete many important legislations for the coming period, including the budget.
      His deputy, Bashir Al-Haddad, confirmed that "the legislative procedures to complete the federal budget law may take 20-30 days, and that the parliament will begin the first reading of the bill in early January." 
      "Serious and intense discussions will take place towards reducing unnecessary expenditures in the budget law, and reducing the deficit ratio for the benefit of the middle classes, the poor and those with low incomes," he added.
