Former White House counsel Don McGahn agreed Wednesday to speak with the House Judiciary Committee about former President Trump's alleged attempts to obstruct the Russia investigation — with certain conditions, per a court filing.

Why it matters: The agreement ends a two-year standoff after McGahn, a key player in former special counsel Robert Mueller's investigation, repeatedly refused to agree to a subpoena for testimony — resulting in the matter being taken to court.

Of note: One of the conditions is that the committee conducts a "transcribed interview" to happen behind closed doors, rather than calling for McGhan to testify at a public hearing, according to the filing.

The big picture: The Judiciary committee and the Biden administration announced Tuesday they had "reached an agreement in principle" in the case of McGhan.

  • The Mueller report found no evidence of a Trump campaign conspiracy with Russia, but his team compiled 10 different episodes where the former president may have potentially committed obstruction of justice. Trump was never charged over the matter.

  • The Judiciary committee stressed in its Tuesday court filing that Trump isn't a party to the McGahn case and is "not a party to the agreement."

What they're saying: Judiciary Committee Chair Jerry Nadler (D-N.Y.) said in a statement Wednesday, "When the former President vowed to fight 'all of the subpoenas' aimed at his Administration, he began a dangerous campaign of unprecedented obstruction. We begin to bring that era of obstruction to an end today."

The other side: Representatives for Trump did not immediately return Axios' request for comment. But his spokesperson Jason Miller said Tuesday that the former president hadn't agreed to the deal and he was reviewing his options as he regarded communications with close advisers as confidential, per Politico.

Yet they failed to hear a case between the states.  That is a job specifically pointed out in the Constitution yet they failed to do it. They were afraid of riots and burning. Roberts in particular.

You're speculating.  Pretty sure if California sued Idaho because they didn't like the way Idaho was doing things, Idahoans would go nuts.  As always, just my opinion.

No speculating. Several states election committees violated their state constitution in allowing mail out ballots without requests. Judges that by-passed the legislature to change the rules.

So yes, if Idaho did those things WE the people would be vocal about it and would not be upset with another state sueing to get it straightened out. Yet the people in those states are quiet. They evidently want their judges to run their elections not the body they elected to do so.

And now we find ourselves full circle again....as in the hand picked, Trump heavy SCOTUS, found no lawsuits that merited a judgment.  Otherwise, nothing to see here.

You are absolutely right...NOTHING TO SEE HERE! That's exactly what the Mueller reported stated. Why then are the demonrats beating a dead horse? Because they are afraid of President Trump and his return, and so they should be!!!

The Left knows that POTUS Trump knows what they have been up too for Decades.....They have been ripping off the American People, Satisfying their Deviant Sexually Needs and the list is long.......They "Know" they will Hang at the end of a Rope and that would be the Easy Way......Should POTUS Trump put it out there what these Animals have been up too....Most would end up like the Final Scene in Braveheart but with John Deere Tractors and Dodge Ram Trucks.

Mueller neither charged Trump, nor EXONERATED him......he merely submitted his report.  Facts matter.

Considering the expensive and lengthy report was created and completed with the sole purpose of finding criminal activity and prosecuting it.....doesn't that tell you anything....?

If they could have charged Trump they would have....!

Common sense and logic!😮

675 DAYS IN, THE DURHAM INVESTIGATION HAS LASTED LONGER THAN THE MUELLER INVESTIGATION

March 18, 2021/35 Comments/in 2016 Presidential Election, Mueller Probe /by emptywheel

Today marks the 675th day of the Durham investigation into the origins and conduct of the investigation that became the Mueller investigation. That means Durham’s investigation has lasted one day longer than the entire Mueller investigation, which Republicans complained lasted far too long.

The single solitary prosecution Durham has obtained in that span of time in which Mueller prosecuted George Papadopoulos, Mike Flynn, Paul Manafort, Rick Gates, Richard Pinedo, Alex Van der Zwan, Michael Cohen (for his lies about Trump’s Trump Tower Moscow deal) was the guilty plea of Kevin Clinesmith, based on conduct discovered by DOJ Inspector General Michael Horowitz.

In addition to those prosecutions, Mueller referred further Cohen charges to SDNY, Sam Patten for prosecution to DC, and Bijan Kian for prosecution in EDVA. Mueller charged Roger Stone and handed that prosecution off to DC. He further charged Konstantin Kilimnik, 12 IRA trolls, Yevgeniy Prigozhin, and 12 GRU officers. He referred Paul Manafort’s influence peddling partners, Republican and Democratic alike, for further investigation, leading to the failed prosecution of Greg Craig. Mueller referred 12 other matters — most still sealed — for further investigation, along with the Egyptian bribery investigation originally started in DC.

Meanwhile, Durham has never released a public budget, though by regulation he had to submit a budget request to DOJ in December.

Say what you will about Mueller’s investigation. But it was an investigation that showed real results. Durham, meanwhile, has been churning over the work that DOJ IG already did for as long as Mueller’s entire investigation.
