She stressed that "this news is untrue and no statement has been issued by the Finance Committee in this regard, and we would like to make it clear that the net salaries of the three presidencies do not exceed 20 million dinars per month."
The committee called on the media to "be careful when publishing such news, and to make sure of the bodies authorized to declare, supported by documents and evidence of the information they transmit."

The committee's reporter, Ahmed Al-Saffar, said in an interview with (Baghdad Today), that "in the event that the Federal Court issues a decision in favor of the government in its appeal, the budget does not need to be sent to the House of Representatives, and it will go to implement it directly." He continued, "The Finance Committee added many paragraphs and articles, some of which are outside its mandate, related to reducing some numbers and transferring funds." Al-Saffar pointed out, "Most of the article that was changed in the budget law came after the government's approval during hosting a number of government officials more than once." Earlier in the day, the financial advisor to the Prime Minister, Mazhar Muhammad Salih, said that the government will challenge more than 10 articles in the federal budget law for the current year before the Federal Court, while some amendments are considered restrictions on the government's work and an interference in the powers. The constitution also gives the government the legal basis to appeal before the Federal Court to cancel and annul the provisions that Parliament added to the Budget Law in accordance with the provisions of Article (13) of the Constitution, as they are unconstitutional.

So.... let me get this straight. ... They passed and ratified the budget. Put it in the gazette so it is now law... Now they are going to appeal some parts of it....Have they actually released any of the monies? Or is this further delayed until they get the appeals done and maybe change the rate? 🙃🤫

"The Supreme Court will look into the government's appeals, as Article 62 of the constitution grants parliament the power to transfer budget funds and reduce them and not increase them, and the constitution prohibits parliament from manipulating imports and expenditures and limiting its authority to transfer," the source told Al-Furat News.
He added, "The Supreme Court has never responded to a governmental appeal against a parliamentary financial decision," stressing that "the court's decision is binding and will raise the amendments, correct the budget path, return it to the cabinet and apply it, and it does not require a vote by the House of Representatives regarding any amendment to the budget."
The source expected that "the Federal Court will give priority in considering appeals, and it is not permissible to be slow with them, which is easy to consider and does not need much time to clarify the constitutionality and unconstitutionality of the articles challenged."
The Council of Ministers, during its session held last Tuesday, authorized Prime Minister Mustafa Al-Kazemi to file an appeal with the Federal Court regarding some provisions of the fiscal budget for the year 2021.
Cabinet spokesman Hassan Nazem said in a joint press conference with Finance Minister Ali Allawi and Planning Khaled Najm After the cabinet meeting last Tuesday, "The Council of Ministers discussed the changes that took place in the draft budget law in Parliament before its approval."

Mubasher:  The Parliamentary Economic and Investment Committee in Iraq confirmed, today, Friday, that the treatment of the exchange rate increase needs time.

MP Salem Al-Tufayli, a member of the committee, told the Iraqi News Agency (INA) that the real treatments for the high exchange rate need time to stabilize the market.

Al-Tufayli added that many deputies called for a reduction in the dollar’s price, not at the previous rate, but in a gradual manner so that the citizen would not be affected economically, indicating that the citizen with limited income and the poor was affected by the change of the exchange rate.

He pointed out that the budget supported the private sector and large projects in order to attract part of the workforce so that there would be a work movement, and that his committee presented a program and recommendations to the Prime Minister that included supporting the private, agricultural and industrial sector.

A member of the Parliamentary Economic and Investment Committee in Iraq explained that his country has all the infrastructure to improve the agricultural and industrial reality, but it needs fair and efficient hands.

The House of Representatives’s decision to dissolve itself on October 7, 2021, in preparation for early parliamentary elections on the tenth of the same month, may cause confusion, disruption, or cancellation of the process of preparing, discussing and approving the draft federal budget bill for the fiscal year 2022 .. and it applies. This is based on the timing, procedures, trends, content, policies and strategies related to this sensitive and dangerous economic-political document (and detailed in accordance with the provisions of the laws in force that regulate this process). This can be clarified through the following:

First: The most important provisions of Federal Financial Management Law No. (6) of 2019 related to the process of preparing the federal general budget

- Article 4 - Third: The Federal Ministry of Planning and the Ministry of Finance prepare, during the month of May of each year (that is, a month from now) "guidelines" in light of the objectives of the fiscal policy, with clarification of the main economic parameters based on the national development plan, and realistic indicators of the economy Macro.
Article 6- First: The Federal Ministry of Finance receives the proposed estimates for the current budget for the following year (which is here in 2022), and discusses them during the month of July of each year (that is, three months from now).
Article -8: The Federal Ministers of Planning and Finance submit to the Committee for Economic Affairs in the Council of Ministers (or whatever replaces it in the Council of Ministers), at the beginning of August of each year (that is, four months from now), the draft budget law for study, and the committee submits Recommendations to the Council of Ministers at the beginning of September of each year (that is, five months from now, and before the elections, and the government is transformed into a caretaker government for one month only) !!!
Article 9- (This is a very important article, I hope you note and read it carefully): The Ministry of Trade, in coordination with the Central Bank of Iraq, prepares a "foreign trade plan" and submits it to the Council of Ministers for discussion and unification with the draft federal budget law, during the month of July of the year of preparation The budget (that is, after three months from now).
Article 10-a: The Central Bank prepares a report on the “foreign exchange budget” and the “national currency offer plan”, and submits the “report and plan” to the Council of Ministers for discussion and unification with the draft budget law during the month of July of the budget year (i.e. after Three months from now).
Article 10-b (and this is an important article as well, I hope you note it, and understand its content very carefully): The Ministries of Planning, Labor and Social Affairs prepare a “gender budget” and submit it to the Council of Ministers for discussion and unification with the draft Federal Budget Law, during the month of July From the year of preparing the budget (that is, after three months from now).
Article -11-: The Council of Ministers discusses the budget bill, approves it, and submits it to the House of Representatives before the middle of October of each year (that is, one week before the House of Representatives dissolves itself !!!).



Second: Conclusion and Conclusions

Based on the aforementioned , I would like to clarify what comes, while reserving my right to ask questions (for which I do not have sufficient and accurate information) to those concerned about answering them in detail:
1- How will the federal budget for 2022 be prepared, in light of The political-electoral conditions in which Iraq is experiencing its bitter conflicts since now? How will a government that will be, within a few months, a "caretaker" government? Who decides and defines the orientations and the content of the policies? When will the election result appear? When will the next parliament be formed? When will the next government be formed? Consequently, when will the draft general budget for 2022 be prepared, discussed and approved ??
2- What, and how much, are the economic and social costs that Iraq (government, citizens and state) will incur due to the delay in completing the state's general budget for the year 2022? Can Iraq and the Iraqis bear that twice in a row in less than a year?
3- Regarding Article 4- Third- of the Financial Management Law referred to above ... on what will we rely on in preparing the “guidelines” for the financial policy? On what "plan" and on which "document"? Will we rely on the "National Development Plan 2018- 2022", or on the "White Paper"? Are these “plans” and “papers” binding on the presidency of the next government, and for its new ministers, which may have their own “plans and papers” in a country whose policies and plans (always) lack two important elements in efficient administration and good governance, which are commitment Sustainability (whatever identity the next rulers are)?
4- Regarding Article 9- related to preparing the "foreign trade plan" and unifying it with the draft general budget ... How many people know about this plan? How many people have seen it? When was it prepared and unified with the draft budget bill, and how? Put before you the General Budget Law for 2022, and guide me to such a plan, please.
5- Where is that legal text (found in the previous Administration, Finance and Public Debt Law No. 94 of 2004, Section 6), which required the government to submit “final accounts” to the federal budget for the previous year, as a condition for approving the draft general budget for the following year? Has this text disappeared from the provisions of the Federal Financial Management Law No. (6) of 2019, and if this is the case, do you see why, and how?
6- Regarding Article 10-a, related to preparing the “foreign exchange budget” and the “national currency offer plan,” I hope to see these two paragraphs (really) unified with the draft budget law, and are very clear in it, so that the role of the bank does not diminish The Central Bank in preparing the budget, in coordination with the Ministry of Finance, to the extent that the matter is related to this issue.
7- With regard to Article 10-b, related to preparing the “gender budget” and unifying it with the draft budget law, I think that this has not been implemented at all. The general budget in Iraq from 1921 until 2021 is a traditional budgeting “item” budget, not a “gender responsive” (GRB) budget. UN Women aims to prepare a gender-responsive budget in Iraq. Unfortunately, this was not achieved for many reasons, which cannot be mentioned now. This is neither the first nor the last failure to develop and choose a new approach to preparing the public budget in Iraq. This was preceded by the failure of a "supreme" committee formed in the Council of Ministers since 2012 to prepare for the implementation of the "programs and performance" budget.

Third: What is the solution?
If the main conclusion (based on the reasons mentioned in detail above) is the inability to prepare the general budget for the year 2022, and to approve it in the appropriate and necessary times to put it into practice, then there is no other solution before us (to limit the dangerous repercussions of that) other than resorting to the provisions of the law Federal Financial Administration No. (6) for the year 2019 related to dealing with such cases, namely:
1- Article -13-: In the event that the approval of the federal general budget is delayed until December 31 of the year preceding the year of preparing the budget, the Minister of Finance issues a general disbursement rate of 1 12 / And less than the total actual expenditures for the current expenditures of the previous fiscal year, on a monthly basis, and until the approval of the federal budget by the House of Representatives.
2- Article 13- Third: In the event that the draft federal budget law for a specific fiscal year is not approved, the final financial statements for the previous year are considered the basis for this year's financial statements, and are submitted to the House of Representatives (this means here the new House of Representatives) for the purpose of approval.
I think that is what will happen.
An "old" parliament - "cloned" - "new" ...
and a "old" general budget - "cloned" - "new" ... and
all of them are "valid" for use in every "parliamentary session" and in every "fiscal year", And in every "federal general budget" ... until God decides, something that was effective.

Mistakes in the public budget .. Signs of inefficiency

I wrote a lot on the subject of the federal general budget, and every time I say it is the last article in the budget, because I believe that the topics included in the budget have been exhausted, but the strange thing is that the surprises of this budget do not end.


I want to shed light in this article on two important topics, the first is the errors in the budget and the implications of that, and secondly, there is an article that I have not heard from a deputy, analyst or researcher that he mentioned and it concerns the Kurds, and I will explain it in the below.


First: Errors in the general budget
after publishing the Federal Budget Law in the Iraqi Documentation Newspaper No. 23 of 2021 in Issue No. 4625 on April 12, 2021, which the law considers to be in effect when it is published. We were surprised and surprised by the presence of errors in it, and among those errors is
1 - a mistake between the first article related to revenues and the revenues in the attached table, where the amount of revenues was modified as a result of changing the price of a barrel of oil from 43 dollars to 45 dollars.
2 - Expenditures, Article II of the budget, includes expenditures that have been reduced by members of Parliament. They have been reduced in this article and no number has been changed in the tables attached to the expenditures, as well as in the deficit schedules.

 

The implications of this:
1 - During the past years and after 2003, I have not heard that the government made the same mistake.
2 - Typically these tables are written in programs such as Excel or others, which are very easy to change any output that results from a change in the input, and since the price of a barrel of oil is one of the inputs, as soon as the price changes, the revenues, expenditures, deficits and any number related to them will change. The result is that the data is written in an unprofessional manner, even if these programs are used.
3 - Those responsible for preparing the budget fall between two things:
A - Either they did not pay attention to these errors, and therefore they are incompetent and unworthy of the order.
B - Or they are intentional in doing so and pause.
4 - The strangest thing about the matter is that the members of Parliament had the draft for more than a month, and then a paragraph was voted on, how could they not pay attention to those mistakes and what were they voted on, 327 MPs who did not pay attention to the issue?
5 - The budget was returned to the government in order to write it in the new amendment, check it and change it according to the new data, so why did they not pay attention?
6 - It was approved by the President of the Republic, so does he or anyone else read it?
7 - In conclusion, the number of those who read and checked the budget reached a thousand officials and employees, and despite that they did not notice the errors until late, which is after it was published in the Official Gazette, and this gives the impression to others that they either did not read it or that they do not have the ability to distinguish those numbers and their connotations, The subject is greater than their mental capabilities?

Mubasher:  The Parliamentary Finance Committee confirmed today, Saturday, that there is a mistake in sending the old schedule that was received from the Council of Ministers to the Presidency of the Republic. The total amount of the budget was estimated at 164 trillion dinars, while it confirmed that its correction does not return the budget to Parliament.

A member of the committee, Majid Al-Waeli, denied in a special statement to the Iraqi News Agency (INA), "The Parliamentary Finance Committee knew of the perpetrator of sending the old schedule to the Presidency of the Republic."

Al-Waeli pointed out that there is a schedule worth 164 trillion that has been canceled, and that there is a paragraph dealing with this issue that reduced the total amount, and the right of the Minister of Finance was given to amend and transfer what is in proportion to the attached schedule, which set the total budget amount at 129 trillion and 900 million dinars.

He stated that the correction is the responsibility of the Ministry of Finance, and it does not need to return the budget to the House of Representatives because the total amount is 129 trillion and 900 million, which is indicated in the body of the budget officially voted on and within the first paragraphs.

He pointed out that "there is another error in one of the tables related to social researchers to the Ministry of Justice," explaining that "Article 12 of the budget includes a request to contract with 1,000 social researchers to the Ministry of Labor, and it was rejected during the voting process in the House of Representatives, but in consideration of the circumstances and the need of the ministry, it was allocated." An amount for contracting with 500 researchers for this ministry, because the issue of social welfare is very important, and social researchers are one of the pillars of this ministry’s work.

Al-Waeli added, "The Parliament's initiative to monitor the implementation of the budget is welcome, and that the formation of a committee to monitor the implementation of the budget does not intersect with the constitution and the internal system and the work of the House of Representatives," noting that "the constitution and the internal system allow the deputy to follow any item in the budget, as happened in many items. The 2019 budget that was followed up by the Finance Committee.

Earlier, 71 deputies submitted a formal request to the Presidency of the Council of Representatives to form a temporary committee to monitor the implementation of the budget.

Mubasher: The Parliamentary Finance Committee in Iraq expected, today, Saturday, that the current price of the dollar will remain for years, indicating the ability of the Central Bank to control its current price in the market and prevent it from increasing further.

Committee member Shirwan Mirza said in a special statement to the Iraqi News Agency (INA), "The current exchange rate of 1450 dinars against the dollar and determined by the central bank may last for years as it cannot be reduced because the budget is built on it."

He added: "With regard to the rise in the dollar’s price above 1470 dinars, we believe that there is an attempt by the central bank to stop the rise. The bank has a strategic stockpile of the dollar and it can contribute to the stability of the exchange rate and not to rise more than that."

Yesterday, the Parliamentary Economic and Investment Committee confirmed that the treatments of the exchange rate increase need time in order to achieve stability in the market.

The Budget Law holds governors accountable and fair to act

Economic expert Majed Abu Killal confirmed that the General Budget Law No. 23 of 2021 brought new treatments that entail greater responsibility for governors, to act wisely and impartially with these important sums and spend them in a way that achieves the public interest and protects them from corruption and waste.
He stressed that "the positive new that the law brought to the governorates is the allocation of 4 trillion dinars for regional development projects in all governorates, an increase of double the amount allocated in 2019."
 
Provincial financing
He pointed out that «the law included a text requiring the Ministry of Finance to finance the governorates with these allocations in 3 payments, the last of which was in September 2021 in an attempt to avoid what happened in previous years from the lack of commitment of the Ministry of Finance to finance these amounts». 
 
 The public treasury
He pointed to an important matter included in the budget law represented in allowing the governorates to place unspent regions ’development funds in the trust account and not to return them to the Ministry of Finance at the end of the year, in order to be disbursed in the following year to avoid what happened in previous years of returning these amounts to the public treasury at the end of the fiscal year, and not benefiting Governorates, including due to lack of time and delay in arrival to the provinces from the Ministry Finance ».

{Economical: Al Furat News} The Ministry of Finance called on, on Sunday, all ministries' spending units to review them to receive instructions for implementing the budget / 2021.
 

In a statement, the Euphrates News received a copy of it, the ministry said, "The instructions for implementing the federal budget law for 2021, approved by the Presidency of the Republic, have been completed."  

She added that, "in view of the legislation and publication of Law No. 23 of 2021, the federal state budget of the Republic of Iraq for the fiscal year 2021 in the Official Iraqi Gazette No. / Budget Department on Monday corresponding to 4/26/2021 for the purpose of receiving instructions for implementing the general budget for the fiscal year 2021 and instructions for implementing the planning budget for the public sector and self-financed bodies and companies.  

The Finance confirmed "the completion of the federal budget instructions for the year 2021 after a final audit by the Ministries of Finance and Planning," stressing that "appeals to the budget will not delay its implementation."
