The Ministry of Finance said, in a statement, that it had started auditing procedures for the Federal Budget Law No. 23 of 2021 after the President of the Republic approved its publication in the Official Gazette No. 4625 on April 12, in accordance with the powers vested in the ministry.

 Al-Maliah added that she noticed errors in the tables and texts, which will be approached by the Presidency Office. For the purpose of issuing a correction statement in accordance with the authority granted to them under the provisions of Article (8) of the Publication Law of the Official Gazette No. (78) of 1977 AD.

The Ministry indicated that all the errors that were mentioned in the draft project sent by the House of Representatives according to its letter No. 1/9/3022 on April 6, 2021 and sent by the Presidency of the Republic to the Official Gazette according to its letter No. April.

The Ministry announced its observation, which included errors The first of these was that it was mentioned in Article 1 / First / A that the revenues of the federal budget for the fiscal year 2021 are estimated at a value of 101.32 trillion dinars, as indicated in Table (A) Revenues according to the preparation attached to this law, indicating that Table (A) has not been amended according to the total revenues referred to. And she continued: "Likewise, Article 2 / First / Expenditure is allocated an amount of 129.99 trillion dinars for the year 2021, of which A- operating expenses by 90.56 trillion dinars, distributed according to field (1, 2 and 3) of Table (B) expenditures according to the ministries, while the correct total is 98.97 trillion dinars, not 90.56 trillion dinars, because the additional operational fields are not included, because the last amount is the sum of the field in Column No. (1), plus 1.88 trillion dinars, of the new operational amounts. "

The Finance indicated that with regard to total capital, it was stated within the same law at an amount of 29.14 trillion riyals, distributed according to (field / 4 total expenditures) from (Table / B expenditures according to ministries) and Table (E) attached to this law, including the following amounts .

And she added: "While it was mentioned in Table (B) prepared by the House of Representatives an amount of 25.71 trillion dinars, and when adding the new additional capital field contained in Table (B) prepared by the House of Representatives, it will be 29.14 trillion dinars, and that the total amount contained in the table attached to the law sent from Before the government, it is 27.76 trillion dinars, which cannot be approved because Parliament has reduced total capital expenditures, and schedule (e) referred to in paragraph (3) above cannot be approved because the original schedule was not approved by the House of Representatives, but was changed according to Schedule (B). "

Finally, Al-Maliya pointed out that it was included in the schedule of page (9) regarding paragraph (III) deficit 1 = (A + B) Total revenues 320.14 trillion riyals and it does not match the total of paragraph (A + B), but the correct one is 101.32 trillion dinars, confirming that The Presidency of the Republic will be approached for the purpose of issuing the above-mentioned correction statement.

Some of the items included in the budget copy published in the Al-Waqi’a newspaper have provoked mixed reactions that reached the claim that there are two copies of them.
In this regard, a member of the Parliament's Legal Committee, Hussein Al-Oqabi, said, according to the official newspaper, that "appealing against the budget's articles is an existing constitutional legal right, and any affected party can appeal those articles before the Federal Court in the event that the article violates the constitutional law."
In response to the hadiths about the difference between the version of the budget voted by Parliament and the version approved by the President of the Republic, Al-Oqabi clarified that "there are errors in the budget copy related to the digital tables, and it is considered enforceable according to the law because it was published in the Official Gazette."
Al-Aqabi considered, "It is wrong to publish the budget without auditing, because in this case it has become part of the law, and there must be an original copy voted on in Parliament that includes the tables that have been amended by the government according to the amendment of Parliament."
He explained, "This reduction, which was voted on, leads to a change in tables and numbers, as we have a 25 percent reduction in the value of public expenditures, and it must be reduced in the tables, not to remain as sent by the government, and this is a serious and unacceptable mistake."

Shafaq News / The head of Bayariq Al-Khair Parliamentary Bloc, Muhammad Al-Khalidi confirmed, on Monday, that the government's appeal to the 2021 General Budget Law does not delay its implementation and does not return it to Parliament.

 

Al-Khalidi told Shafaq News, "The appeal that the government and some political blocs intend to submit to the Federal Court regarding the articles and paragraphs of the General Budget Law does not delay its implementation and does not return the law to the House of Representatives."

 

And that "the appeal will be only on specific articles and paragraphs and not on the entirety of the law," indicating that "the Federal Court will only consider the contested articles, and this does not mean challenging the budget law."

 

Al-Khalidi continued, "The budget law came into effect after it was approved by the Presidency of the Republic and published in the Official Gazette, and it will be implemented by the Ministry of Finance."

 

The Iraqi government and some political blocs and MPs announced that they would submit appeals to the budget law to the Federal Court, to amend some of the paragraphs contained in the law.

Mubasher: The Iraqi Ministry of Finance revealed, today, Tuesday, that there are errors in the tables and texts of the 2021 budget announced in the Official Gazette, indicating that the Presidency of the Republic will be approached for the purpose of correction.

The Ministry of Finance said, in a statement, that it had started auditing procedures for the Federal Budget Law No. 23 of 2021 after the President of the Republic approved its publication in the Official Gazette No. 4625 on April 12, in accordance with the powers vested in the ministry.

 Al-Maliah added that she noticed errors in the tables and texts, which will be approached by the Presidency Office. For the purpose of issuing a correction statement in accordance with the authority granted to them under the provisions of Article (8) of the Publication Law of the Official Gazette No. (78) of 1977 AD.

The Ministry indicated that all the errors that were mentioned in the draft project sent by the House of Representatives according to its letter No. 1/9/3022 on April 6, 2021 and sent by the Presidency of the Republic to the Official Gazette according to its letter No. April.

The Ministry announced its observation, which included errors The first of these was that it was mentioned in Article 1 / First / A that the revenues of the federal budget for the fiscal year 2021 are estimated at a value of 101.32 trillion dinars, as indicated in Table (A) Revenues according to the preparation attached to this law, indicating that Table (A) has not been amended according to the total revenues referred to. The above, but the total revenues sent by the government project, amounting to 93.16 trillion dinars, were preserved.

And she continued: "Likewise, Article 2 / First / Expenditure is allocated an amount of 129.99 trillion dinars for the year 2021, of which A- operating expenses by 90.56 trillion dinars, distributed according to field (1, 2 and 3) of Table (B) expenditures according to the ministries, while the correct total is 98.97 trillion dinars, not 90.56 trillion dinars, because the additional operational fields are not included, because the last amount is the sum of the field in Column No. (1), plus 1.88 trillion dinars, of the new operational amounts. "

The Finance indicated that with regard to total capital, it was stated within the same law at an amount of 29.14 trillion riyals, distributed according to (field / 4 total expenditures) from (Table / B expenditures according to ministries) and Table (E) attached to this law, including the following amounts .

And she added: "While it was mentioned in Table (B) prepared by the House of Representatives an amount of 25.71 trillion dinars, and when adding the new additional capital field contained in Table (B) prepared by the House of Representatives, it will be 29.14 trillion dinars, and that the total amount contained in the table attached to the law sent from Before the government, it is 27.76 trillion dinars, which cannot be approved because Parliament has reduced total capital expenditures, and schedule (e) referred to in paragraph (3) above cannot be approved because the original schedule was not approved by the House of Representatives, but was changed according to Schedule (B). "

Finally, Al-Maliya pointed out that it was included in the schedule of page (9) regarding paragraph (III) deficit 1 = (A + B) Total revenues 320.14 trillion riyals and it does not match the total of paragraph (A + B), but the correct one is 101.32 trillion dinars, confirming that The Presidency of the Republic will be approached for the purpose of issuing the above-mentioned correction statement.

The legal expert stressed the need for the House of Representatives to submit an official apology that explains the error in the budget, adding: “There must be filtering by the House of Representatives before sending the budget law to the Presidency of the Republic.
He continued, that in accordance with the laws, what is published in the Official Gazette is legal, in the sense that the budget law came into force, pointing out that he is supposed to the House of Representatives to publish a correction of this error in the newspaper facts. "

1- In Article 1 / First / A, the federal budget revenues for the fiscal year 2021/2021 (101320141984) are estimated one thousand dinars, as indicated in Table (A), the revenues are according to the numbers attached to this law.

While the table (A) was not amended according to the total revenues referred to above, but rather the total revenues sent by the government project, which amounted to (93159954484) thousand dinars, were retained.

2- Article 2 / First / Expenditures also mentioned an amount (129993009291) thousand dinars for the year / 2021 of them.

1-A- Operating expenses (90559139482) one thousand dinars distributed according to field (1, 2 and 3) of Table (B) expenses according to the ministries.

While the correct total is (98974139482) one thousand dinars and not (90559139482) one thousand dinars, because the additional operational fields are not included, because the last amount is the sum of the column number (1) field plus (1882000000) one thousand dinars, the new operational amounts

3- As for the total capital, it was mentioned within the same law in the amount (29136869809) one thousand dinars (twenty-nine trillion one hundred and thirty-six billion eight hundred and sixty-nine million eight hundred and nine thousand dinars) distributed according to (field / 4 total expenditures) of (table / b) expenditures According to the ministries) and Schedule (E) attached to this law, including the following sums.
