And a return to civility where no one doubts anymore that a Democratic person and a Republican person can both be known as a Patriotic American . I believe, that we all are just waiting for a system(s) to be developed that circumvents avenues of communication the Democratic Socialist Commy party has on death grip. As it relates to what communications, social media is available to us. Arizona Democrats, GOP settle over 2020 ballot review, but audit will continue

Arizona Democrats won concessions Wednesday in settling their challenge to Republicans' unprecedented audit of 2.1 million ballots cast in the 2020 election, but they failed to block the review as they had sought.

The state Democratic Party had sued the Republican Party and Cyber Ninjas, the Florida-based cybersecurity company it hired to conduct an audit of ballots in Maricopa, the state's most populous county. The audit, which grew out of Arizona GOP lawmakers' efforts to toss out Joe Biden's victory in the state last year, is being led by those who believe, baselessly, that the Arizona vote was stolen from former President Donald Trump.

The agreement orders Arizona Senate Republicans and Cyber Ninjas, which is run by a supporter of Trump, to allow independent elections experts to observe the process, take aggressive measures to secure personal voter information, turn over details about audit policies and procedures and make those documents public. If there is a breach of the agreement, Secretary of State Katie Hobbs, a Democrat, can take the company and the Senate GOP to court for breach of contract.

The agreement does not require either side to admit fault.

"From the beginning of this sham audit, the Arizona Democratic Party demanded transparency and adequate security to preserve the sanctity of the vote, and protect voters' private information," Raquel Terán, chair of the state Democratic Party, said in a statement. "When this sham started, Arizonans had zero assurances that the Senate GOP and the Cyber Ninjas would follow the law, give reporters and elections experts access to observe, or make procedures available to the public, as is standard in any legitimate audit. Our lawsuit changed that."

She added, "Now, as the Arizona Democratic Party has forced the Senate and the Cyber Ninjas to be more transparent, reporters and elections experts are seeing firsthand that this 'audit' is nothing more than an effort to satisfy fringe conspiracy theorists."

Arizona and Maricopa County have already conducted numerous accuracy tests and hired two independent companies to conduct a forensic review of the election results, all of which confirmed that the county's system performed properly.

Republican legislators have said an audit of ballots in Maricopa County would help them write new election laws and restore trust in the state's democratic process, even though all official reviews concluded that the election was secure and that its results were accurate. After Trump lost the state by around 10,000 votes last year, the same legislators spent months questioning the results.

Senate Republicans and Cyber Ninjas have fought in state court over the past few weeks to conceal details about the audit, arguing that they are protected by legislative immunity and the need to preserve trade secrets. Democrats sued last month to block the audit, alleging that the auditors were not protecting voter data and ballots.

The court declined to end the audit, which began late last month, but it ordered the release of more information.

In a letter to GOP Senate President Karen Fann on Wednesday evening, the Justice Department also expressed concern about how the ballots are being secured and potential voter intimidation. The agency also suggested the process may violate federal law requiring ballots to remain in the control of election officials for 22 months.

Pamela Karlan, deputy assistant attorney general, said plans by Cyber Ninjas to directly contact voters could amount to illegal voter intimidation under federal statute.

“Past experience with similar investigative efforts around the country has raised concerns that they can be directed at minority voters, which potentially can implicate the anti-intimidation prohibitions of the Voting Rights Act,” Karlan wrote. “Such investigative efforts can have a significant intimidating effect on qualified voters that can deter them from seeking to vote in the future.”

In a letter released Wednesday, Hobbs, the secretary of state, excoriated Republican Ken Bennett, a former secretary of state who is advising the GOP on the audit, and warned him to bring the review into compliance with state laws and regulations.

"I'm not sure what compelled you to oversee this audit," Hobbs said. "But I'd like to assume you took this role with the best of intentions. It is those intentions I appeal to now: either do it right, or don't do it at all."

• Workers at the Maricopa County recount are investigating an absurd theory that 40,000 Biden ballots were smuggled in from Asia.

• They intend to check the fiber of ballots with UV lights and 5K cameras to check for bamboo.

• The recount is partially funded by a lobbyist group, which raised over $1.5 million for the effort.

The Maricopa County vote recount has taken a surprising turn, with UV lights and high-tech cameras being deployed as workers comb through ballots, checking for traces of bamboo fibers in the paper.

The reason? To investigate a new theory that 40,000 ballots for Joe Biden were flown in from Asia and smuggled into Arizona's polls.

John Brakey, the co-founder of a group called AUDIT (an acronym for Americans United for Democracy, Integrity, and Transparency in Elections), told CBS reporter Dennis Welch that "5K cameras" were being used to take snapshots of the ballots and examine the folds in the ballots.

 

The far-fetched theory rests on the idea that tracings of bamboo would prove that the ballots were created abroad, despite the fact that not all paper made from bamboo is milled in Asia, and in fact, there are several bamboo forests in the US.

Additionally, while bamboo pulp paper does exist in China, not all paper produced in China contains traces of bamboo as the country continues to have a thriving wood pulp and timber industry.

"There are accusations that 40,000 ballots were flown into Arizona and it was stuffed into the box, and it came from the southeast part of the world - Asia -and what they're doing is to find out if there's bamboo in the paper," said Brakey, who is also an assistant to former Arizona secretary of state Ken Bennett, who is fronting the audit as its spokesman.

Biden won the county by more than 45,000 votes.

However, Brakey - who claims that he has been investigating elections for at least 16 years - clarified that he did not believe the theory about the bamboo ballots.

"I don't believe any of that. We're just saying that this is part of the mystery that we want to un-gaslight people about, and this is a way to do it," he added in the interview with CBS.

Maricopa County and Brakey did not immediately respond to a request for comment from Insider.

The bamboo theory first emerged in December

According to Slate, this bamboo ballot theory may have come from a man named Jovan Pulitzer, an individual who says he invented tech that can differentiate between real and forged ballots based on its ink and folds. Pulitzer claimed in December that there might be "detectable" bamboo particles in the ballot paper, which can be found via forensic analysis.

The ongoing recount of votes in Maricopa County has drawn criticism from both voting machine maker Dominion and the US Justice Department, after questions arose about the chain of custody and integrity of the ballots.

The Maricopa County audit is being run by Cyber Ninjas, a private firm based out of Florida that has been criticized for having no prior experience with handling election ballots. Doug Logan, its founder, is a "Stop the Steal" supporter who promoted several election conspiracy theories in favor of former President Donald Trump.

Cyber Ninjas has said it wanted the methods it uses to recount the votes to be kept secret, citing trade secrets and proprietary equipment.

Workers from Cyber Ninjas were seen leaving ballots unattended and laptop computers unlocked, The Post reported.

Bennett said in an interview with local radio station KJZZ.91.5 that the state senate audit of the Maricopa County ballots cost taxpayers around $150,000, but admitted during a press conference yesterday that private funds were also being used for the audit.

The Maricopa County recount is partially funded by a group called The America Project via an online fundraiser, which has at press time raised over $1.5 million.

The America Project is a section 501 (c) 4 not-for-profit organization. Non-profits classified as 501 (c) 4s have greater advocacy and lobbyist powers than 501 (c) 3s, and donations to them are not tax deductible. Other groups in this category include "super PACs," which can spend an unlimited amount of cash on political campaigns.

• Donald Trump, who falsely believes he won the 2020 election, has promoted the recount.

Dominion Voting Systems sharply criticized the election firm conducting a recount of ballots in Arizona, saying auditors had "already committed serious errors" and "demonstrated incompetence."

The recount, which is expected to take weeks, is being overseen by an obscure firm called Cyber Ninjas hired by Republicans in the Arizona Legislature.

The company's CEO, Doug Logan, promoted conspiracy theories about the integrity of the 2020 election on Twitter in January, the Arizona Republic first reported.

 

Dominion, which supplied election technology to several polling locations in Arizona, has been a target of false and convoluted right-wing conspiracy theories alleging that it helped "flip" votes from Donald Trump to Joe Biden.

In a statement on Tuesday, Dominion said that Cyber Ninjas wasn't qualified to conduct a recount and that its leader was "operating with a false, pre-determined conclusion" that votes were altered in the first place.

"The firms conducting this so-called audit are not federally-accredited Voting Systems Test Labs," Dominion said. "The lead firm, Cyber Ninjas, has no election experience, and publicly available information shows its leader has helped spread debunked lies about election fraud."

A representative for Cyber Ninjas didn't immediately respond to Insider's request for comment.

Trump has supported the audit and asked for updates about it multiple times a day, The Washington Post reported. He has demanded that Gov. Doug Ducey, a Republican he criticized for not supporting attempts to overturn Biden's victory, deploy the National Guard to protect the recount process, even though there have been no publicly reported threats on it. Trump advisors told The Post he'd also asked about using UV light to analyze the ballots, something experts say may destroy information on them.

Trump has falsely claimed that he was the true winner of the 2020 presidential election and that he won Arizona, which he lost to Biden. His lies about the election led to the insurrection at the Capitol on January 6, when a mob of his supporters sought to stop Congress from certifying Biden's victory.

Trump's campaign brought two lawsuits in Arizona seeking to overturn the state's election result, as did Arizona's GOP chair, Kelli Ward, a driving force behind the Cyber Ninjas audit. The cases were among the 40 Trump-linked election lawsuits that failed.

Maricopa County, the largest county in the state and the location of the recount, has already conducted two separate audits of its 2020 election results. Both found that the results were correct and that Dominion machines had produced accurate results.

In its statement, Dominion said it had numerous security measures in place for its election machines, including creating a voter-verified paper trail for each vote, using two-factor authentication that requires a physical key, and ensuring the machines don't connect to the internet.

"Local election officials securely store and monitor the machines at all times," the company said. "Thousands of poll workers, party officials, and election officials across Arizona watch over precincts on election day and guard tabulation sites in the days following."

Cyber Ninjas' insistence on secrecy during the recount has alarmed independent election experts. On Wednesday afternoon, the company reportedly reached a settlement with the state's Democratic Party to offer more transparency.

Dominion has launched a raft of defamation lawsuits against people and companies that promoted election conspiracy theories. Its lead defamation attorney, Tom Clare, previously told Insider the company was weighing filing a lawsuit against One America News, a far-right media organization that pushed false claims about Dominion.

OAN had quietly deleted stories about Dominion from its website even as it publicly pushed false theories, Insider reported. It is also a force behind the recount, helping finance the venture even as Arizona Republicans named the network an independent observer of the effort.
