WASHINGTON (Reuters) - The top Democrat on the U.S. Senate Judiciary Committee on Monday blamed partisan gridlock for stalling the confirmation of President Joe Biden's attorney general nominee, Merrick Garland, and called on Republicans to set a Feb. 8 confirmation hearing.

In a letter to the Judiciary Committee chairman, Republican Senator Lindsey Graham, incoming Democratic Chairman **** Durbin said it was "regrettable" the two sides were still unable to reach a deal on a timetable for proceeding with Garland's confirmation.

"There is simply no justification to object to a Feb. 8 hearing," Durbin wrote in his letter to Graham, saying the date will not conflict with former President Donald Trump's impeachment trial, which is due to start the following day, and will still afford the committee members "ample time" to review Garland's record.

 

Garland, 68, is currently as a judge on the U.S. Court of Appeals for the District of Columbia Circuit, one of 13 federal appeals courts

In response, Graham wrote to Durbin that a one-day hearing on Garland's nomination was not enough, noting that the last five nominees for attorney general had two-day hearings.

"I look forward to questioning Judge Garland and potentially supporting his nomination, but not on February 8," Graham wrote. "Proceeding with the confirmation of an attorney general and the impeachment of a former president at the same time would give neither the attention required," he wrote.

Since Biden was sworn into office on Jan. 20, the Senate has confirmed several key members of his cabinet, including Defense Secretary Lloyd Austin and Treasury Secretary Janet Yellen.

However, Garland's nomination has yet to be scheduled, as Democrats and Republicans continue to hash out control of the Senate going forward.

Democrats control the 50-50 split chamber by virtue of Democratic Vice President Kamala Harris' holding the tie-breaking vote in the Senate. But Democratic and Republican leaders were working out details on how committees will operate.

Durbin is expected to become the chairman of the Senate Judiciary Committee.

Democratic former President Barack Obama nominated Garland to the Supreme Court in 2016 while Biden was vice president. The Republican-controlled Senate refused to hold hearings on the nomination, allowing Trump to fill the seat after he assumed office in January 2017.

The first thing I thought of was well there goes Hunter’s case right out the window .... I’m disgusted with our Government and agencies .

The line of questioning won't come from the Dems and the Repubs questions will be drowned out with noise.

The Dems will want this line of questions buried or silenced. They don't want to know what is on the lap top much less aires in the court of public opinion.

You can never have compromise when the other side wants you dead or gone.

Ask Israel with concern about Iran.

Democratic Sen. **** Durbin of Illinois will be the new head of the Senate Judiciary Committee, replacing Graham, once the Senate finalizes an organizing resolution that will determine the heads of committees. Until it is completed, the Republicans — who were previously the majority — still hold their positions from the previous Congress.

In a letter to Durbin, Graham, the South Carolina Republican, wrote: “The Senate is about to conduct its first-ever impeachment trial of a former president and only its fourth trial of a president, incumbent or not. Under the procedure the Senate has adopted, Donald Trump’s trial is set to start on February 9. But you want us to rush through Judge Garland’s hearing on February 8.”

 

“A one-day hearing as you are proposing the day before the impeachment trial of a former president is insufficient,” Graham contended. “Democrats do not get to score political points in an unprecedented act of political theater on one hand while also trying to claim the mantle of good government on the other.”

Durbin indicated in his earlier letter to Graham requesting Feb. 8 as the day to start Garland’s confirmation hearing that Democrats have encountered “obstacles that needlessly delay” the confirmation, which he calls a matter of national security. He also wrote he was “prepared to take other steps to expedite the Senate’s consideration of Judge Garland’s nomination should his hearing not go forward on February 8,” even without Republican support.

 

Garland was famously denied a confirmation hearing by the Republican-controlled Senate in 2016 when then-President Barack Obama nominated him for the Supreme Court.

Graham wrote “the reason we can’t give Judge Garland two days next week is, of course, that Senate Democrats voted to proceed with former President Trump’s impeachment trial on February 9.”

I think it can be safely said that should Merrick Garland be confirmed as the next A.G.....he'll certainly be every bit as professional, fair, forthright, and honorable as A.G. Barr was.

Well that certainly isn’t saying much .   AG Barr knew about the investigation for what a year ?  Without saying a word about it .... Shame on whoever sweeps it under a rug ... the rug sure is getting lumpy from all the Biden family corruption

Ever notice how AG Barr was considered an upstanding patriot for everybody on the Right....until he publicly professed there's no evidence of massive election fraud?...Coincidence?  :shrug:

I started wondering about him , first when he kept saying Durham report has a lot evidence that needs to sort through and then when I found out about him keeping quiet about the Hunter Biden and family investigation

the American people should have been made aware of this corruption and this national security threat Biden’s have put this country in

That can be a 2 way street....you can come out with evidence that might have an affect on an election.....or if you suppress the information it can do the same.... 

 

I'm a put the cards on the table guy......and the ridiculous amount of time these investigations take really makes me question these 3 letter agencies..

In my mind....the longer an investigation takes the less chance serious crimes are found.....When that happens, they usually come back with indictments against obscure individuals the common man has never heard of....an attempt to justify the amount of money spent on the investigations themselves is how I see it.

That was certainly the case with the Mueller report... 

 

The flip side......perhaps the depth of the crime/corruption runs so deep.....the farther you dig... the more you find....  and that may get exponentially worse the deeper you dig..

Sure, that's possible.....the trick will be convincing whichever side of the public that doesn't have their dreams come true with the results, to accept said results.
