She added that the spending ceiling in the budget was reduced from 164 trillion dinars to 130 trillion, and other revenues were increased, stressing that the budget included a lot of economic reforms.

Deputy Majda Al-Tamimi explained that she headed the special subcommittee of the three presidencies in the budget and was able to deduct 20% of the budget of each presidency from the three presidencies in the budget.

Al-Shaddd emphasized that the activation of the productive sectors will greatly reduce the growth of unemployment rates in Iraq, which are estimated at about 5.5 million people (according to World Bank sources) for the year 2007, adding to this number what is known as underemployment, which means that a large number of workers in the sectors The unorganized workforce has low wages and fluctuating working hours, reaching 30 percent of the workforce in the year

During the media hype and the current disagreements about Iraq’s budget for 2021 between the governmental and parliamentary viewpoints, we found it necessary to raise some key points about the nature of the intense debate going on between the two parties from the financial and legal standpoints and based on our modest knowledge of the subject, and with complete independence without prejudice. And for the benefit of the Iraqi people as a whole.

Abbreviation: -

First - The general budget is nothing but a government plan for one year regarding how (appropriation) for each of the expenditures (operational and investment) in order for the government to implement its government programs which are monitored by Parliament, this means that (preparing the general budget) is a purely governmental work It is not (a parliamentary act) and this matter is in effect at the level of all civilized countries, ... why ...?, Because the government, whether it is good or not, is the one who knows best about the nature of its work, its problems, or its daily tasks from any other side, including Parliament.

Second - In order for the government to be able or legally authorized to undertake these expenditures during the year in order to implement its programs, parliament must approve the general budget plan, and through the budget law legislation, the government can (implement) its programs under the (actual control) of Parliament and hold it accountable for its performance. .

Third - So .... What is the current Iraqi parliament’s role in the question of ratifying the current 2021 budget .. ?, and what are the nature of the current problems between the two parties ..?

It is absolutely true, that according to Article 62, paragraph b) of the Iraqi constitution, Parliament is authorized ((to conduct transfers between the chapters and chapters of the general budget, and to reduce the total of its sums, and he may, when necessary, suggest to the cabinet to increase the total amounts of expenditures))

This means, and for economic reasons and when (necessity) for parliament to exercise its authority in those transfers and reductions and (in consultation) with the government and not just simply, so that the parliament will remain with the argument of monitoring government performance when implementing the budget provisions by it, and in the event that Parliament performs these measures in the budget Without consulting the government, parliament in effect loses the government's oversight over the implementation of that budget.

Conclusion ... What is happening now regarding the budget ... ??.

Through what has leaked out of the news from within the respected Financial Committee as well as by respected members of Parliament, it appears that there are proposals to reformulate the General Budget Law by Parliament that exceed its authority according to (Article 62, b) above, where the following is common:

1- There is an intention for Parliament to reduce the size of the general budget from (164 trillion dinars) to 127, meaning a reduction by approximately (23%).

2- Parliament's intention to reduce the size of the (fiscal deficit), as is rumored, from the amount of (63 trillion dinars) to 19, i.e. by approximately (30%).

3- There is an intention to add an amount (10 trillion dinars) to the expected revenues in the year 2021, i.e. a percentage (10%).

4- As is rumored in the circles of Parliament, that there is an intention to delete some (appropriations) and add new allocations and transfers outside the government plan, according to the political whims of the parliamentary blocs.

5- And more than this and that, and according to unofficial leaks, Parliament is working to (write off) a number of articles and provisions of the General Budget Law prepared by the government and add new articles whose texts are prepared by it and within (20) legal articles.

6- ..... etc from leaks and proposals.

In conclusion ... we are not here in a position that allows us to evaluate or support any of the governmental or parliamentary views regarding the 2021 budget, as to whether one is more correct or correct than the other.

But if the situation continues like this, then it reflects an unconstitutional interference (to some extent) by Parliament in government work, and parliament bypassed its supervisory, cooperative and legislative powers towards the executive authority and struck the principle of non-interference and separation of powers in countries that are supposed to be democratic, where the parliament must He must approve (after recording his observations) the general budget sent to him by the government, and then monitor the results of its implementation and hold the government accountable for it, as is usual.

Where in the case of Parliament imposing its tendency and direction with this (large amount) in passing and ratifying the budget, without consulting and consenting to the government, it leads Parliament to lose (its supervisory authority) over the government on how to implement the provisions of the budget and its desired outcome, because no one can The government is held accountable when implementing the general budget plan that has been changed course by Parliament, and then the (cooperative relationship) between the executive and legislative branches turns into (the conflictual relationship), which is considered one of the main factors for the disintegration of the state and society.

In any case, when politics prevailed over law, peace came to the people's conclusion.

Committee member Shirwan Mirza told Shafaq News Agency, "The price of the dollar is fixed and has not been tampered with, considering that it was determined according to the financial policy of the Iraqi government."

He added that "the requests of members of Parliament regarding changing the exchange rate of the dollar against the Iraqi dinar, do not go beyond being requests only," stressing that "the Parliamentary Finance Committee does not have any authority to change the exchange rate."

Mirza added, "The Parliamentary Finance Committee worked according to the powers granted to it only to amend and replace some articles of the budget law for the year 2021."

 

A member of the Parliamentary Economic and Investment Committee, Mazen Al-Faily revealed earlier to Shafaq News, that a request had been submitted by a group of deputies to change the exchange rate of the US dollar to 130,000 Iraqi dinars in the general budget law for 2021.

The Central Bank of Iraq had decided to raise the price of selling the dollar to banks and exchange companies to 1460 dinars, from 1182 dinars to the dollar, with the aim of compensating for the decline in oil revenues caused by the deterioration of oil prices.

Mubasher: Parliamentarian Badr Al-Ziyadi, a representative of the Saeron Alliance, revealed that the approval of the new budget for Iraq could be delayed for several days due to the Kurdistan region's failure to clarify until the present time about his financial liability to the authorities in Baghdad.

He indicated that the Kurdistan region has not paid the debts owed by it from 2003 until the present time, adding that the problem is related to the region’s disclosure of the non-oil resources it owes to Baghdad, and so far there is no consensus on this file.

The Parliamentary Finance Committee announced that it had reached the final stages before the vote on the 2021 budget.

 

The committee stated: "It has accomplished more than 90 percent of its work in the budget, confirming the inclusion of administrators, craftsmen, writers, guards and volunteer service employees, similar to the free lecturers with financial appropriation within the budget law."

 

For its part, the Iraqi Forces Bloc announced, on Saturday, that the vote on the General Budget Law for 2021 will be imminent, noting that the final version of the law will be presented to the political blocs before the voting session.

 

The deputy head of the bloc, Raad al-Dahlaki, said, "The Parliamentary Finance Committee is in the process of setting the last points of the budget law and is very keen to present the latest version of the law to the political blocs despite the difference of views on some articles of the law."

 

He added that "the Finance Committee includes representation of the political blocs and is aware of the amendment taking place on the articles and paragraphs of the budget law. The final version of the law will be considered before voting."

 

Al-Dahlaki pointed out that "the budget law will be presented to a vote in the coming days:soon: but it has not yet been determined when the date for the vote on the law has been set."

 

Representatives in the Iraqi parliament announced that the Finance Committee has completed nearly 95% of the articles and items of the current year budget.
