However, this announcement was met with widespread rejection by the representatives of the Shiite blocs, who preferred not to pass the agreement within the budget for the year 2021, except after the region hand over all its oil exports to the "SOMO" company and put its border ports under the management of the central government, as well as rejecting any settlements outside the dome. There is no choice but to deliver oil and import

A member of the Finance Committee, Abd al-Hadi al-Saadawi, believes that the only option for the region to obtain its share in the budget is to deliver its oil and imports from its official and unofficial border outlets to the federal government, pointing out that the Kurdish delegation that came to negotiate in Baghdad failed to reach results.

Al-Saadawi expects that the Council will draft a text similar to the text of the fiscal deficit law that requires the delivery of oil and imports in exchange for the region’s share of the budget, indicating that “Parliament will not approve the government text for the region in the budget or any other text agreed upon between the governments of Baghdad and Erbil outside what is mentioned in The Budget Deficit Act.

Al-Saadawi talks about the region selling its oil to Turkey from 2011 to 2024, so he has nothing to negotiate with, and he has 21 border outlets, four of which are official and negotiated with the federal government and the rest are informal, indicating that without closing the 17 unofficial outlets, any An agreement between the two parties will be useless.

Under the draft budget voted by the Council of Ministers, a paragraph has been drawn up that includes the payment of the dues of the oil companies in the region, which are estimated at 27 billion dollars, provided that the region hands its oil to the Oil Marketing Company (SOMO), according to Saadawi, who is likely to reject this agreement and confirm the text on the Kurdistan share In the Deficit Financing Law of the Budget Law of 2021.

 

There is no formal agreement

 

While the Kurdish representative in the Finance Committee, Ahmed Hama Rashid, says that there is no agreement with the federal government regarding the percentage determined for the region within the federal budget for 2021, he indicates that this issue is linked to negotiations in the House of Representatives between the political blocs and within the Finance Committee.


Rashid added that the Kurdistan Regional Government did not agree with the central government to set a rate of 12.5 percent for the region in the 2021 budget, especially since the previous agreement stipulated that the percentage be 17 percent, and it was reduced to 12.65 in the 2018 budget, which the Kurds rejected, pointing out that the Ministry's data Planning indicates that the proportion of citizens of the region is 13.93%, and thus the figure in the budget is not based on any scientific facts.

Article 7 of the Deficit Financing Law stipulates that the Kurdistan Region’s share of the total actual spending be determined after excluding the sovereign expenditures specified in the Federal Budget Law, on the condition that it is committed to paying the value of oil exported from its fields and in the quantities specified by the Iraqi Oil Marketing Company (SOMO) exclusively and non-oil revenues, Under the supervision of the Federal Office of Financial Supervision. In the event of non-compliance with them, the expenses of the region may not be paid, and the violator of this provision bears legal responsibility.

They will not repeat the withdrawal

Al-Shammari added that the crisis in the region has become a great pressure on the Kurdish forces to move towards Baghdad, and the current climate is closer to consensus and concessions to Baghdad, especially since the Kurdish parties are embarrassed and threatened by renewed demonstrations in the region, pointing out that the Kurds have realized that the budget will pass, especially After passing the fiscal deficit law. Thus, they will not repeat the withdrawal method.

He believes that Baghdad wants to sign an agreement that will be a long road map for problems between the two parties, and not sign an interim agreement, as happened with the government of former Prime Minister Adel Abdul Mahdi.

Agreements are quick to break down

Basil Hussein, head of the Kulwada Center for Studies and Measuring Iraqi Public Opinion, believes that the problem of agreements between the federal government and the region is that they are rapidly collapsing, because they are not based on solid ground due to the presence of suspicion and distrust between the two parties.

Hussein adds that "suspicion and distrust between the two parties cast a delusion on the relations of the federal government and the region, and in the past years they have taken root and embodied in the matter of the budget."

Hussein asserts that with the approach of the election season, this issue falls within the circle of political and electoral auctions, which complicates negotiation paths and understandings and enhances the chances of breaking wills and imposing a coercion curve, which adds more complexity to the relations between the parties.

Erbil MPs spoke to Rudaw following Monday's meeting, saying not all in Baghdad are supportive of a deal with the KRG.

"One of their intentions is the intent of the Iraqi government, which has not been hidden, which is to have a solution,” Omed Khoshnaw, head of the Kurdistan Democratic Party (KDP) parliamentary bloc said in an Monday interview with Rudaw's Sangar Abdulrahman.

“But where does the great danger begin? The parliament.”

“Some Iraqi parliamentarians have spoken harshly about the Kurdistan Region and threatened it, and a small group has been on the side of peace,” MP Peshawa Hawrami told Rudaw.

“Iraq is divided into two parts, one strong and one weak, the strong front is against everything in the Kurdistan Region,” he added.

The Kurdistan Region’s allocation of the federal budget has been a point of contention with Baghdad. Iraq has not sent the autonomous region money for several months of 2020 amid oil disputes, preventing the KRG from paying the salaries of its public servants.

The already-existing budget dispute between the two governments was further complicated on November 12 when Iraqi MPs passed the Fiscal Deficit Coverage Bill to approve loans for civil servant salaries in Iraq and the Kurdistan Region for the last two months of this year.

The bill passed with a majority vote, despite a walk-out staged by Kurdish MPs, who were angered that Erbil is obliged to hand over an unspecified amount of oil in exchange for funds- a clause they say was not in the original bill. 

The agreement comes as Iraq and the Kurdistan Region plunge further into economic crisis. KRG civil servants have gone unpaid for much of this year as a result of the budget disputes – prompting protests earlier this month across Sulaimani, Halabja and the Garmyian administration in which ten people were killed.

ERBIL, Kurdistan Region — The Kurdistan Regional Government (KRG) is ready to hand over oil to Baghdad, Deputy Prime Minister Qubad Talabani said following a meeting with the Kurdistan Region parliament on Monday. 

"If the budget is approved, we, as the KRG, are ready to deliver 250,000 barrels per day of Kurdistan Region oil through SOMO [State Organization of Marketing of Oil]," Talabani said following a four-hour parliament meeting, adding that the KRG has “always wanted to reach a comprehensive agreement with the federal government.”

Talabani led a KRG delegation to Baghdad at the beginning of December amid heightened tensions between Erbil and the federal government over budget disputes. 

On December 22, Talabani announced Erbil and Baghdad had reached a deal on Iraq’s Federal Budget Bill for 2021 that “keeps the common interest of all Iraqi people, including the people of Kurdistan Region.”

Talabani said that the KRG’s share of the budget is the same as in 2019 - at 12.67 percent - "less than what we expected and deserve.”

ERBIL - The Iraqi federal government confirmed on Monday that talks on the Kurdistan Region's share from the federal budget are ongoing.

Hassan Nadhim, a spokesperson for the Iraqi government, said in a statement that the Kurdistan Regional Government (KRG) delegation, previously dispatched to Baghdad, had agreed on the Budget Deficit Law.

The budget bill for the year 2021 will be sent to the parliament presidency on Tuesday, Nadhim added.

He further noted that the Iraqi public servants will receive their salaries on time without any delays.
