A small, but growing, number of Republicans have a message for President Trump: The election is over and he lost. Now it's time to move on.

The message became louder over the weekend, after a far-fetched press conference by Trump lawyers Rudy Giuliani, Sidney Powell and Jenna Ellis on unfounded mass election fraud, which Trump ally and former New Jersey governor Chris Christie called a "national embarrassment."

"I have been a supporter of the president's. I voted for him twice," Christie said Sunday on ABC's "This Week." "But elections have consequences, and we cannot continue to act as if something happened here that didn't happen."

 

On Saturday, the Trump campaign suffered a big loss as a federal judge in Pennsylvania dismissed a lawsuit trying to invalidate millions of votes in that state as full of "strained legal arguments" that were "unsupported by evidence."

Maryland Governor Larry Hogan, a popular Republican in a fiercely Democratic state, told the president Sunday to "stop golfing and concede," after Mr. Trump called him a "RINO," or Republican in name only. Hogan and his wife secured critical testing equipment on their own when the federal government failed to come through. Hogan recognized Biden's victory on November 7, the day major networks including CBS News called the race for the president-elect.

"If you had done your job, America's governors wouldn't have been forced to fend for themselves to find tests in the middle of a pandemic, as we successfully did in Maryland," Hogan quote-tweeted the president. "Stop golfing and concede."

Mr. Trump, who has only had a handful of public events since the election, was at his Virginia golf club when Hogan tweeted.

Republican Fred Upton, a congressman from Michigan, also expressed that the election is over for the president, at least in Michigan, as the president's team presents baseless accusations of mass fraud. Upton said there is no such evidence, and the Trump campaign has been unable to present such evidence in court.

"You know, the voters spoke. And here again in Michigan, it's not a razor-thin margin, it's 154,000 votes," he said Sunday on CNN. "154,000 votes is too many to overcome. It's over."

On Saturday, Republican Senator Pat Toomey of Pennsylvania issued a statement congratulating Mr. Biden and Harris after the dismissal of the Trump campaign lawsuit in Pennsylvania.

"With today's decision by Judge Matthew Brann, a longtime conservative Republican whom I know to be a fair and unbiased jurist, to dismiss the Trump campaign's lawsuit, President Trump has exhausted all plausible legal options to challenge the result of the presidential race in Pennsylvania," Toomey wrote. "I congratulate President-elect Biden and Vice President-elect Kamala Harris on their victory. They are both dedicated public servants and I will be praying for them and our country."

That number of Republicans publicly conceding Mr. Trump lost, if not urging him to concede, is only likely to grow as states certify their election results. Electors will meet to certify the election results on December 14th, at which point it will be challenging for influential Republicans to insist the election is undecided.

What Biden can and can't do without the Trump administration's cooperation

A number of Senate Republicans have urged the Trump administration to at least allow President-elect Joe Biden access to classified briefings, something he currently does not have. Vice President-elect Kamala Harris does have access to classified briefings, but only because she is a current member of the Senate Judiciary Committee, and she cannot share that information with Mr. Biden.

Sharing the letter "M" was apparently enough to confuse the Trump campaign's legal team into using data from Minnesota in an affidavit filed in Michigan.

In the latest court filing fail for the president's campaign, paperwork purporting to show evidence of voter fraud mixed up counties between the two states .

An Atlanta lawyer working for the campaign, L Lin Wood, on Wednesday filed an expert analysis of suspiciously high turnout in Democrat-leaning areas of Michigan, according to The New York Times.

 

But some of the counties identified in the affidavit are in Minnesota: Monticello, Albertville, Lake Lillian, Houston, Brownsville, Runeberg, Wolf Lake, Height of Land, Detroit Lakes, Frazee and Kandiyohi.

The apparent mix-up was first discovered by conservative legal website Powerline, with litigator John H Hinderaker writing it was likely made due to the state's similar abbreviations of MI and MN.

The Wisconsin county data was included in a nine-page affidavit from Russell James of the cybersecurity firm Allied Security Operations Group.

“This is a catastrophic error, the kind of thing that causes a legal position to crash and burn,” Mr Hinderaker wrote.

“Has Mr Ramsland inadvertently stumbled across evidence of voter fraud in Minnesota? I seriously doubt it. The venues in question are all in red Greater Minnesota, not in the blue urban areas where voter fraud is common.”

Mr Wood did not immediately respond to The Independent's request for comment.

The analysis of voting patterns in battleground states using Dominion Voting Systems and Smartmatic software has been put forward by Rudy Giuliani as evidence of election fraud.

At Thursday's "path to victory" press conference, Mr Giuliani and attorney Sidney Powell said the Dominion election system, supposedly created in Venezuela at the direction of its former leader Hugo Chavez, flipped votes across the country.

“One of (the software’s) most characteristic features is its ability to flip votes. It can set and run an algorithm that probably ran all over the country to take a certain percentage of votes from President Trump and flip them to President Biden,” Ms Powell said.

This latest mix-up comes on the heels of the Trump campaign filing a lawsuit in the wrong court, the Federal Claims court instead of a District Court.

While the United States Court of Federal Claims responded to the suit, Judge Elaine D Kaplan made clear the court's usual jurisdiction over monetary actions doesn't cover the Trump team’s claims against state and local governments.

"The complaint is captioned as though it were filed in the United States District Court for the Western District of Michigan," Ms Kaplan wrote.

"Instead, however, it was filed with this Court, presumably by accident."

The suit was transferred to the correct court in Michigan, where the complaint had already been filed.

The misfiling was first identified by CNN's Katelyn Polantz, who reported that the lawyer on record for the case said it was a mistake. Pacer, the Public Access to Court Electronic Records, supposedly misfiled the suit in the wrong court.

Political reporters in Washington, D.C., have been saying a lot of Republicans in Congress privately despise President Trump, but few have publicly criticized him — and likewise, few have publicly acknowledged his defeat to President-elect Joe Biden. Carl Bernstein, one half of the journalistic duo that uncovered President Richard Nixon's Watergate scandal, named 21 names on Sunday night, saying that in private conversations, these Republicans senators "have repeatedly expressed extreme contempt for Trump" and his fitness to be president.

 

The 21 senators he named include names you would expect, but also some surprises, like Sen. John Cornyn (Texas), Sen. Rick Scott (Fla.), and Senate Majority Whip John Thune (S.D.). The other 18 GOP senators are Rob Portman (Ohio), Lamar Alexander (Tenn.), Ben Sasse (Neb.), Roy Blunt (Mo.), Susan Collins (Maine), Lisa Murkowski (Alaska), Mitt Romney (Utah), Mike Braun (Ind), Todd Young (Ind.), Tim Scott (S.D.), Marco Rubio (Fla.), Chuck Grassley (Iowa), Richard Burr (N.C.), Pat Toomey (Pa.), Martha McSally (Ariz.), Jerry Moran (Kansas), Pat Roberts (Kansas), and Richard Shelby (Ala.).

"With few exceptions" — Romney and Sasse, mostly — "their craven public silence has helped enable Trump's most grievous conduct — including undermining and discrediting the U.S. the electoral system," wrote Bernstein, who's made his own feelings about Trump clear for a while. He had named 15 of those senators on CNN late last week, saying "many, of not most, of these individuals, from what I have been told, were happy to see Donald Trump defeated in this election, as long as the Senate could be controlled by the Republicans.

 

Bernstein added that he is "much more concerned" now than at the end of Watergate, because "Nixon left — Republicans convinced him to go, and he did."

Keep in mind Antrim County Michigan is nowhere near southeast Michigan....it's very white in fact, which would never fit Trump's fraud narrative.

Fact check: Incorrect reporting of Antrim county election results due to human error; Nancy Pelosi’s husband does not own Dominion Voting Systems

Posts shared on social media in the days following the 2020 U.S. election claim that the husband of House Speaker Nancy Pelosi owns the software company whose product “glitched in favor of Biden”. This claim, implying widespread voter fraud in the election, is false.

 

One version of the claim, found here , states, “Hmmm Pelosi husband is owner of the soft ware (sic) that glitched in in (sic) favor of Biden, anyone else find this odd?” It has received more than 2,300 shares. Other iterations can be found here and here .

According to the Detroit Free Press, “Political observers had expressed shock” early in the morning after Election Day “when the county transferred numbers to the state showing Biden beating Trump by about 3,000 votes” in Antrim County, Michigan  ( here ). The Detroit Free Press describes Antrim as “a Republican stronghold where local GOP officials have mostly run unopposed in recent elections.”

As reported here by Snopes, a temporary miscount that briefly marked thousands of Republican votes as Democrat votes in Antrim was a result of human error. The county used Dominion Voting Systems equipment ( here ), also referred to in some of the posts. The software itself, however, was not responsible for the tabulation error that was quickly caught and fixed.

In response to Republican National Committee chairwoman Ronna McDaniel’s claims of deliberate election fraud, Michigan Secretary of State Jocelyn Benson put out a statement ( here ) on Nov. 6. explaining that “the erroneous reporting of unofficial results from Antrim county was a result of accidental error on the part of the Antrim County Clerk.”

 

 

With 95% of expected votes counted, 56.4% of Antrim County votes went to President Donald Trump while 42.0% went to now President-elect Joe Biden ( here ). An official “Statement of Votes Cast” for Antrim County as of Nov. 3 is available here .

Paul Pelosi, who has been married to House Speaker Nancy Pelosi since 1963 (here) does not own Dominion Voting Systems.  As mentioned by Politifact ( here ) he is the owner of Financial Leasing Services, a San Francisco Real estate venture capitalist firm.

A spokesperson for Dominion told Reuters via email that the company has “no ties to Mr. Pelosi.”

Dominion cannot be found on the speaker’s most recent financial disclosure form, available here , neither under the “Earned Income” section listing the sources of her husband’s income nor elsewhere.

 

 

On the last page of the form, Pelosi answered “No” to questions about whether she had excluded from the report details of a trust benefiting herself, her spouse, or a dependent child as well as whether she had excluded “any other assets, ‘unearned’ income, transactions, or liabilities of a spouse or dependent child because they meet all three tests for exemption.”

VERDICT

The work of the Michigan Board of State Canvassers is not glamorous and rarely draws much attention. Its members handle matters like reviewing petition signatures and helping local clerks find voting machines.

But on Monday, the national spotlight will fall on one of the board’s normally mundane tasks: reviewing results from the presidential election that have been certified by Michigan’s 83 counties and giving a stamp of approval.

The winner is clear. Joe Biden beat President Donald Trump in the state by more than 150,000 votes, according to the Michigan Bureau of Elections. But Trump and his Republican allies are trying to upend that reality by urging the board to refuse to certify the election results. They have made baseless claims about discrepancies in the vote tallies, especially in Wayne County, which includes Detroit and is predominantly Black, and have argued that an investigation should be carried out before the state’s 16 electoral votes are awarded to Biden. (Michigan’s Democratic secretary of state, Jocelyn Benson, said Sunday that state law dictated that no audit or investigation could be done until the election was certified, because state elections officials cannot legally gain access to poll books or ballot boxes before then.)

The Board of State Canvassers, which will meet at 1 p.m. Eastern on Monday, includes two Republicans and two Democrats. While election law experts say the certification vote is a strictly ministerial duty that the board members are obligated to fulfill, political operatives in Michigan are preparing for a chain of events in which the two Republicans on the board follow the Trump campaign’s wishes.

A 2-2 deadlock, which would prolong Republicans’ unprecedented attempts to overturn this year’s presidential race, would most likely prompt Democrats to ask the state Court of Appeals to order the board to do its constitutional duty and certify the election results.

So who are the members of the canvassing board? Three of them have served on the panel for several election cycles; the fourth was appointed in 2018 by former Gov. Rick Snyder, a Republican.

The Democrats

Jeannette Bradshaw, 44, the chairwoman of the board, is from Ortonville, about 40 miles north of downtown Detroit. She is an electrician by trade, but serves as the recording secretary and registrar for her International Brotherhood of Electrical Workers local in Detroit.

Appointed to the board in 2013, Bradshaw said she was hoping for a smooth and efficient meeting Monday despite the possibility that it could turn into the same type of live-streamed virtual brawl that occurred last week in Wayne County. There, two Republicans on Wayne’s canvassing board initially refused to certify the county’s results before backtracking after several hours of outraged comments from voters who said they were being disenfranchised.

“I’m trying to block out all the noise and focus on my job,” Bradshaw said. “That’s where I’m at.”

She said she would look at the report on the results by the state Bureau of Elections and make a decision based on its recommendation.

That report found that out of more than 250,000 votes cast in Detroit, there were problems with about 350 ballots. Biden won the city over Trump by 94% to 5%, and he carried Wayne County by 68% to 30%. The number of discrepancies, 72% of which could be easily explained, according to the state Bureau of Elections, was significantly lower than during the 2016 presidential election.

“I’m getting lots of emails, asking me to certify, not to certify,” Bradshaw said. “We get the report, and that’s what we go off of. I appreciate that people are participating.”

In the meantime, she added, “I’m going to turn off my phone and go outside and rake some leaves.”

Julie Matuzak, 66, of Clinton Township in Detroit’s northern suburbs, said she expected the board to certify the election results.

“I have confidence that we will do what we’re supposed to do,” said Matuzak, a retired political director for the American Federation of Teachers in Michigan who was appointed to the board in 2010. “We are the third step in a process that checks and crosschecks and balances the results. It’s all done in public. The statute says the board shall certify the election. If you follow the rules, you certify the election.”

Matuzak views her job as safeguarding elections. She recalled, with a touch of irony, how Trump sued in 2016 to stop a recount in Michigan requested by Jill Stein, the Green Party presidential candidate.

“I would have loved to finish that recount because what it showed before it was stopped was there were very few problems,” Matuzak said. “My biggest fear now is that no matter what we do, there are going to be people out there who are never going to believe that it was a fair election.”

The Republicans

Norm Shinkle, 70, of Williamston, near Lansing, is an open supporter of Trump, volunteering for the campaign and even singing the national anthem at a rally for the president in Michigan last month.

A longtime politician in Michigan, he has served as a poll challenger in the past. His wife, Mary Shinkle, was a poll challenger this year at the TCF Center in Detroit, where absentee ballots were counted, and she filed an affidavit complaining about the tense environment there.

Shinkle, who was appointed to the board in 2008, said that he had some concerns about the vote tally in Wayne County, especially in Detroit, and that an investigation there would be acceptable. He, too, said he had been receiving hundreds of phone calls and emails from people pressuring him either to certify or not to certify the results. He said he had not heard from Trump or his campaign.

Shinkle said his time as a judge on the Michigan Tax Tribunal had taught him that you can’t make up your mind until you see both sides of a case. He said that was what he planned to do.

“I’m just focused on Monday and reviewing all the information for the meeting,” he said. “No one knows how the vote is going to go. But I just have to do the best that I can based on what’s ethical and legal.”

Aaron Van Langevelde, 30, of Charlotte in mid-Michigan, is the unknown quantity on the board. Appointed in 2018, he has declined interview requests from The New York Times and other news outlets.

He is a lawyer who works for the Republican caucus in the Michigan House of Representatives.

After the state’s primary elections in August, he said he was seriously worried about the number of precincts that had voting disparities in Detroit, despite the fact that the problems were relatively minor, and expressed reluctance to certify the results without a pledge that the secretary of state would take control over the city’s elections.

“I want to make sure we’re doing whatever we can to prevent the same thing from happening in November,” he said at the time. “That would be a disaster.”

The state was involved in helping the city prepare for the Nov. 3 general election, providing workers and training.
