Baghdad / Al-Mawred News

The head of the victory coalition, the former Iraqi prime minister, Haider al-Abadi, expressed his rejection of the Sinjar agreement, which was concluded between the federal government and the Kurdistan Region, adding: "We see in the agreement ambiguity and servitude, and this will not establish transparent and solid relations, nor will it solve the problem."

Al-Abadi said in a statement, "That what I say does not understand that I am intransigent towards the Kurds, no, I support fair constitutional solutions to ensure coexistence, peace and prosperity for all."

He added, "I am not an enemy of the Kurds, I am with my Kurdish people and their historical struggle and their true demands. Only I demanded and exercised my constitutional duties to preserve the unity and sovereignty of the state, and to achieve justice and equality for all the citizens of the state on their religious, sectarian and national diversity."

He indicated that the ruler must be honest in his judgment and not be biased towards one side or clash with interests at the expense of the interests of the people and the state, and this is what I have done and others have tried to distort him or distort his purposes.

Al-Abadi clarified that my problem was with the benefiting forces and not with the people. I wanted and want to liberate the people and the state from working with them and converting them to narrow interests.

There is a reasons why he is former her can’t make a decision..and makes worn ones ala abadi....flog

[Baghdad-Where] The
Arab tribes in the disputed areas between Erbil and Baghdad revealed, on Sunday, the conclusion of a "secret" agreement between the Kurdistan Workers Party (PKK), which opposes Ankara on the one hand, and the Iraqi Hezbollah in Sinjar district.
A statement by the tribal spokesman Sheikh Muzahim Al-Hawit said that the "secret" agreement between the Labor Party and the "Iraqi Hezbollah militia" leads to the support and arming of the latter's party for PKK elements to bully and rebel against Baghdad and Erbil in their recent agreement to return Sinjar and its suburbs to Embrace the homeland and replace all the outlawed forces with Iraqi regular forces, and the security file is managed by Baghdad and Erbil and under the supervision of the United Nations. "

On Friday (October 9), Baghdad and Erbil reached an agreement to normalize the situation in Sinjar, which provides for the administration of the judiciary in terms of administrative, security and service jointly.

ISIS invaded Sinjar district in 2014 and committed a massacre against its residents, before the Peshmerga forces regained it the following year.

However, the Iraqi army backed by the Popular Mobilization Forces invaded the region due to the tension between the region and the federal government against the backdrop of the independence referendum in 2017.

The Iraqi authorities installed new officials in the district to replace the elected officials who withdrew from the area to the Dohuk governorate when the Iraqi forces advanced.

Currently, there are two local governments for Sinjar, one of which was appointed by the federal government authorities, and the second is the elected government, which operates from Dohuk Governorate.

The anti-Ankara Kurdistan Workers' Party (PKK) has also formed a faction loyal to it there called the "Sinjar Protection Units" and receives salaries from the Iraqi government as a faction under the umbrella of the Popular Mobilization Forces.

The Kurdish workers reject repeated calls from the Kurdistan Region to leave the region that is under Turkish attacks from time to time, which impedes the return of tens of thousands of displaced Yazidis to their homes.

And the new agreement will address the issue of duplication of administration, and Al-Kazemi stressed Baghdad’s keenness on Sinjar being free of armed groups, whether internal or from outside the country, in reference to the Kurdistan Workers Party.

As a result of the demonstrators' pressure and the demands of political parties were thrown into the demands of the demonstrators, the Iraqi parliament formed a committee to amend the Iraqi constitution, which discussed amending a number of articles of the constitution, and Article 140 of the constitution raised disputes between the Kurds and other parties, as Shiite parties demand the abolition of this constitutional article, a demand rejected by it. Kurds altogether.

The Parliamentary Constitutional Amendments Committee is chaired by Representative Faleh Al-Sari and comprises thirty members, six of whom are Kurds.

Article 140 of the Iraqi constitution was formulated to solve the problems of Kirkuk and the disputed areas in three stages: normalization, the population census, and the referendum, and the article had set a time limit for its implementation ending at the end of 2007, but no part of this article was applied except in part of the first phase, and no additional steps were taken to implement it. .

In addition to the Parliamentary Constitutional Amendments Committee, the Presidency of the Republic of Iraq formed a committee for constitutional amendments headed by the advisor to the President of the Republic, Ali Shukri, and the membership of 27 experts in the constitution and law, including five Kurds.

A member of the Constitutional Amendments Committee in the Presidency of the Republic, Abdul Mohsen Saadoun, announced to Rudaw Media Network that the committee has completed its amendments to the paragraphs and articles of the constitution, leaving only a general review of these amendments, and he expected to complete the review in the next ten days.

Regarding Article 140 of the constitution, Saadoun said: “Our committee has put in place the best solutions for Article 140 ″, and this solution is to implement the article within two years from the date of approval of the amendments, and to hold the Iraqi federal government and the Kurdistan Regional Government accountable in case any of them fails to implement the article, and "This amendment is very necessary and a guarantee for the areas covered by it. The time limit has been set, and Article 140 has been amended in a way that ensures its best development."

On Sunday this week, the head of the Kurdistan Democratic Party’s bloc in the Iraqi parliament, Vian Sabri, announced that the Kurdish representatives had rejected a proposal by Shiite blocs to abolish Article 140 of the constitution. She said, "The Constitution Amendment Committee held (on Sunday) its meeting regarding Article 140 of the Constitution, and at the meeting a number of members of the Committee from the Shiite blocs proposed to delete the article, and the Kurdish representatives rejected the proposal completely, so the meeting was postponed to Wednesday and heads of parliamentary blocs will attend."

The deputy from the Sadiqoun parliamentary bloc affiliated with Asaib Ahl al-Haq, Fadhil al-Fatlawi, stated that Article 140 was a subject of disagreement from the beginning, and this dispute must be resolved through dialogue and understanding.

The Iraqi constitution consists of 144 articles, and it was ratified by a general referendum in 2005, and the Iraqi Council of Representatives formed committees for several times to amend the constitution, but all attempts to amend the constitution failed.

In May of the year 2019, and through a letter addressed to the Secretary-General of the United Nations, Antonio Guterres, the Prime Minister of the Kurdistan Regional Government at the time, Nechirvan Barzani, proposed five main points related to the work of the United Nations Mission in Iraq (UNAMI), and Barzani's message came three months ago. From the UN Security Council vote on a draft resolution extending the authorization of UNAMI to operate in Iraq for another year.

The first demands of Nechirvan Barzani directed at Gutierrez were related to Kirkuk and the disputed areas. It was stated in the message of the Prime Minister of the Kurdistan Region that UNAMI can “play a major role” as a mediator to start an “intensive dialogue” between Erbil and Baghdad in order to solve problems, including “the application of Article 140 of the Constitution of Iraq.”

When it responded to Nechirvan Barzani's message, the United Nations said that it would begin work on implementing Article 140 after the formation of the new government cabinet for the Kurdistan Region.

With a draft resolution, the UN Security Council extends annually the authorization of the UN mission in Iraq, and defines the mission's tasks and priorities, but Baghdad’s rejection and objection led to the Council not taking the Kirkuk issue and Article 140 as a priority for UNAMI’s work in past years.

On the other hand, the Iraqi Federal Supreme Court had announced a year ago that it “found that Article 140 of the Constitution of the Republic of Iraq for the year 2005 entrusted the executive authority to take the necessary steps to complete the implementation of the requirements of Article 58 of the Transitional State Administration Law with all its paragraphs aimed at achieving justice In areas that have undergone a change in the demographic situation through deportation, exile and forced migration, which are still in effect according to the provisions of Article 143 of the Constitution.

The Federal Court said that it had found that “these steps (stipulated in Article 140) have not been completed and that some of them have not been taken, and the goal of developing and enacting Article 140 of the Constitution remains required and the duty of implementation of all,” and confirmed that “the deadline for the implementation of Article 140 of the Constitution It was set for regulatory matters and urging the concerned parties to implement them that do not affect the essence of the article and the achievement of its goal.

SULAIMANI — Deputy Speaker of the Council of Representatives Bashir Haddad said on Saturday (November 14) that the Kurdistan Region’s three presidencies should decide to send a technical delegation consisting of oil experts to Baghdad to reach an agreement with the state-run Oil Marketing Company (SOMO) on the amount of oil the Kurdistan Region should send in order to receive its share.

On Thursday, the Council of Representatives approved the Fiscal Deficit Financing bill to fill deficits through borrowing 12 trillion Iraqi dinars (some $10 billion) in internal and external loans to finance the salary payments to public servants and other expenditures for the last three months in 2020.

The Kurdish caucuses walked out of the floor debate in protest of the Kurdistan Region's share from the loans.

According to the legislation, the KRG should commit to hand over an amount of barrels of oil per day (bpd) to the federal government that will be determined by the SOMO in order to receive 320 billion Iraqi dinars to pay its civil servants.

During an interview with NRT Tawtwe interview program, Haddad said that one of the options the Kurdistan Region has is Iraqi President Barham Salih to propose a new draft law in lieu of the federal passed deficit law bill to amend the latter.

“This is the option of the Region’s [political] parties,” he said.

“Iraq has borrowed $70 billion from the International Monetary Bank in the past years, but it has not given a dinar to the Region. Iraq borrows loans and does not give it to the Region, but it involves the Region to repay them.” He added.

He also said that the federal government has “punished” the people of the Kurdistan Region not the KRG.

In April, Baghdad cut off all budget transfers to Erbil after the latter failed to send any oil to the federal government, as it was required to under the 2019 federal budget law.

The two sides reached a temporary agreement in early August where Baghdad would send 320 billion Iraqi dinars, in return for bringing customs procedures at the Region’s international border crossings under federal control.

A meeting is expected to be held on Sunday between the three presidencies of the Kurdistan Region in Erbil.

On Thursday, the Kurdistan Region Presidency said that a meeting will be held between the three presidencies, relevant parties, and the Kurdistan Region’s representatives in the Council of Representatives regarding the legislation, but on Saturday, ten Kurdish lawmakers of the Council of Representatives rejected participation in the meeting, calling it “unnecessary”.

“The Region’s authorities want these meetings as showy performances to legitimize their failed [policies], thus we are not ready to be part of the policy,” the lawmakers said in a joint statement.

Iraq faces a serious financial shortfall due decline in oil prices marred by the coronavirus pandemic and endemic mismanagement and corruption the country has faced since the fall of the former Ba’ath regime, as the country almost exclusively counts on oil exports to finance its salary payroll and other expenditures.

ERBIL — The Kurdistan Region Parliament will hold a session on Tuesday to host a Kurdistan Regional Government (KRG) delegation and discuss the recent budgetary disputes with Baghdad.

MP Liza Falakaddin told BasNews that the lawmakers and KRG representatives will specifically focus on the Funding Deficit Law that was passed by the Iraqi parliament earlier this week.

The meeting comes after Kurdistan Region presidency today hosted legislative and executive bodies to discuss the same issue.

Kurds criticize Baghdad for passing the Funding Deficit Law without the consent of the Kurds who are one of the three main components of the country.

The law obliges the Iraqi federal government to cut all the fundings to Erbil and ask the regional government to hand over its oil and non-oil revenues to Baghdad for 320 billion Iraqi Dinar in return, which is not even enough for the KRG to pay the public servants’ salaries.

Deputy for victory: This is what the region’s politicians want and cannot be accepted

The deputy of the Nasr Alliance, Falah al-Khafaji, confirmed, on Sunday, that the region’s politicians want to take only and not give anything, indicating that this matter cannot be accepted.

In an interview with Alsumaria News, Al-Khafaji said, "There are a number of border outlets that are still outside the control of the federal government, including goods, table eggs, meat, agricultural crops, poultry and fish that harm the local product and without supervision despite the commitment of the rest of the border ports in Iraq to the laws to protect the local product." ", Indicating that" the national and economic security is required to confiscate all those goods that enter in contravention of product protection laws, whatever they are and from which party they were sent. "

Al-Khafaji added, "The region has also been exporting oil for years and it does not provide the state treasury with any shares of it, and what we got from them except on promises of commitment and adherence to agreements, but there is no application on the ground, the region’s politicians want to accept only and give nothing, which is something that cannot be accepted." Until "the House of Representatives went on to defend the rights of the Iraqi people, and in the event that the region wanted to defend the rights of its people, it must pay off the obligations they owed from the imports of the outlets, taxes and the oil share, and then the government will commit to pay its obligations to the region in accordance with the provisions of the law."

Today, Sunday, the President of the Kurdistan Region, Nechirvan Barzani, described the borrowing law as a "penalty" against the region's residents, while indicating that Kurdistan is ready to agree with Baghdad on the delivery of oil imports and border crossings.
