Baghdad - people

Deputy Speaker of Parliament Bashir Khalil Al-Haddad called, Thursday, of the federal government and the Kurdistan Regional Government to return to the dialogue table and resume discussions in order to resolve the outstanding issues between the two parties in accordance with the constitution.

Al-Haddad said in a statement that "People" received a copy of it (August 13, 2020) that "in light of the two statements issued by the Kurdistan Regional Government of Iraq and the Federal Ministry of Finance recently regarding the region's relationship with the federal government and the constitutional obligations of the two parties."

The deputy speaker called on the federal government and the Kurdistan regional government to "speed up the return to the dialogue table, resume and complete the talks and agree in accordance with the constitutional and legal mechanisms to resolve all outstanding issues and files between the two parties," noting that "the one affected by the results of the delay in the talks and failure to reach an agreement is Citizen in the region. "

He added that "the federal government is obligated to secure financial dues and to secure the salaries of the region’s employees and retirees, similar to the rest of the Iraqi provinces, and in return, the region must fulfill its constitutional obligations and reach common solutions to enhance cooperation between Baghdad and Erbil."

The Federal Ministry of Finance responded, on Wednesday, to the statement of the Kurdistan Regional Government, which accused Baghdad of stalling in the file of sending the salaries of the region's employees

The text of the statement, which was followed by "People", (August 12, 2020), stated that:

"The Federal Ministry of Finance expresses its surprise at the statement issued by the Council of Ministers of the Kurdistan Region today, Wednesday (8/12/2020), regarding the results of the discussions related to financial payments and the regulation of federal imports and border crossings between the federal government and the regional government.

The Ministry affirms that the dialogue has made advanced strides, and that the federal government has started since the beginning of the dialogue to ensure the rights of the citizens of the Kurdistan Region of Iraq, and to ensure that their salaries are secured, especially after it became clear that the financial payments sent to the Ministry of Finance of the region did not reach all the beneficiaries, in addition to receiving requests Signed by tens of thousands of regional employees to achieve linking of their salaries through banking mechanisms.

And that the Ministry of Finance, confirming that the regional government’s statement lacked the required accuracy in determining the basis of the problem, especially with the great flexibility provided by the federal government to facilitate reaching an agreement that serves the people of Iraqi Kurdistan, it indicates at the same time that the federal government is within its constitutional rights to secure border crossings and monitor Imports and customs deductions, I put forward the principle of partnership contained in Article 114 (First) of the Constitution to secure control over border crossings in the region.

In this regard, it can be noted that the regional government’s failure to show sufficient flexibility to resolve this issue, and then attempt to blame the federal government for financial payments before resolving aspects related to imports represents an unacceptable evasion of responsibility, in exchange for the federal government's keenness to secure employees ’demands And retirees and eligible citizens within the legal frameworks and contexts, and in a manner that does not allow them to be deducted or wasted.

The basis for the discussions came within the framework of the letter sent by the Ministry of Finance to the President of the Kurdistan Regional Government No. 802 dated May 19, 2020, which includes the payment of the Ministry of Finance an amount of 400 billion Iraqi dinars for the month of April, and the entry into intensive meetings to reach a final settlement between the two sides Within a period of one month, by adopting the Federal Financial Management Law as a basis for it, including counting non-oil imports to the region and checking them before sending any additional financial payments.

The regional government has approved the aforementioned content in the book of the Minister of Finance and Economy of the Kurdistan Regional Government, No. 201, on 5/19/2020.

The Ministry of Finance affirms the federal government's keenness to reach a final settlement on this issue in an amicable and constitutional framework, and also indicates the directives of the Prime Minister, Mr. Mustafa Al-Kazemi, on the necessity to find the necessary solutions and to show sufficient flexibility to secure the rights of the Kurdish people who have suffered greatly under difficult health and economic conditions, especially a group. Employees, retired and beneficiaries.

In this context, we call on the Kurdistan Regional Government to speed up fulfilling its constitutional obligations and duties and to return to the negotiating table in the service of the public interest.

On Wednesday, the Kurdistan Regional Government expressed its dissatisfaction with what it called the "procrastination" of the federal government in the file of sending salaries.

A statement of the provincial government, which "people" received a copy of, (August 12, 2020) said, "The Council of Ministers held its regular session headed by the Chairman of the Council, Masrour Barzani, with the participation of the Vice President of the Council Qubad Talabani, through a closed-circuit television system (video conference)."

He continued, "At the beginning of the meeting, the current financial situation in the Kurdistan region was discussed and the results of the talks between the regional government and the federal government were discussed."

He added, "While the Council of Ministers appreciates the efforts made by the regional government delegation to negotiate with the federal government, it confirms that the Kurdistan Regional Government has not left any constitutional, legal, administrative or financial justification without presenting it during the discussions in order to reach an agreement, and the region has agreed to all The conditions of the federal government within the framework of the constitution, but unfortunately, for more than three months, the federal government has not shown any willingness to send the part of the salaries that it was sending, which led to the regional government being unable to disburse financial dues to those who receive salaries, and this cast a shadow and its effects. The negative impact on the living conditions of those who deserve salaries in the midst of the difficult health situation that the region faces.

The statement continued, "As the Council of Ministers confirms that the region, like all other parts of Iraq, the laws in force in Iraq grant it the right to receive the salaries of its employees, as it is not necessary to distinguish between citizens of the Kurdistan region and the rest of Iraq, especially in the issue of salaries, and this is a right." Constitutional, and accordingly, the Council of Ministers of the Kurdistan Region expresses its great dissatisfaction and concern about the negative position of the federal government, and on this basis we call on the federal government to respond to the serious efforts made by the regional government with the aim of resolving the problems radically according to the constitution, in a manner that guarantees its respect for constitutional rights and dues and the fulfillment of its constitutional obligations towards Territory. "

The statement indicated, “The Cabinet directed the negotiating delegation to continue its discussions with the federal government to reach an agreement, as the region had previously expressed in the past period its readiness to implement its constitutional obligations in the oil and financial file, and the federal government must assume its constitutional responsibilities for the rights and dues of the region. Financial. "

The cabinet also called, according to the statement, the President of the Republic, the ministers and representatives of the Kurdistan region in the House of Representatives, to "defend the financial and constitutional rights and entitlements of the people of the Kurdistan region."

He added, "The cabinet decided to consider early next week approving a mechanism for distributing salaries to those who deserve it, according to the capabilities currently available to the region."

At the conclusion of the meeting, the Council of Ministers directed both the Interior and Peshmerga Ministers to "follow up the problems and obstacles at the border crossings to ensure the prevention of any violations or illegal activities at those ports."
