A parliamentary meeting expected to consider the election law after the Eid holiday

The nature of the districts and the absence of a modern population are baffled by political blocs wishing to hold parliamentary elections. This issue impeded the completion of the law despite voting for most of its paragraphs in December 2019.

Hussein Al-Oqabi, a member of the Legal Committee in the House of Representatives, said in a statement to (Al-Mada) that “Article (15) of the Parliament’s Elections Law, which talks about the distribution and division of multiple constituencies in each governorate, remained stuck, and was not resolved,” noting that “the mechanism of this Division and distribution are the subject of great debate and controversy among the political blocs.

He asks, "On what criterion or method is it possible to divide the province into multiple circles, based on data on paper that we know is inaccurate and largely unrealistic?", Adding that "some are unsure of this data on paper and are pushed back with regard to conservatism as one department." And the winning candidate is the one who achieved the highest votes regardless of his electoral list. ”

Last December, the House of Representatives voted on the Parliamentary Elections Law without mentioning the article related to the scheduling or distribution of electoral districts, which is considered the basis for conducting the elections, which hindered sending the law to the Presidency of the Republic for approval, and did not specify a date to complete the approval of these districts until now.

Al-Oqabi continues, “The multiple districts need two basic issues. The first concerns the existence of an existing population census and it is not available at the present time. The second is obligated to number the homes and residential areas because the multi-constituency system requires knowledge of the geographical area and the population number for each electoral district”, indicating that there Parties have "fear of tampering with these constituencies for political, national or sectarian accounts at the expense of other political parties."

The political blocs had agreed before the vote on the law to postpone the decision of the electoral districts because they collided with the presence of more than (80) judicial and overlapping areas in terms of geography and population, and the absence of population statistics, as well as the presence of unregistered districts.

Among the technical problems facing the completion of the electoral law are those that relate to the issue of the existence of (41) unlicensed courts in the Ministry of Planning, as well as a quota for women, as it is not possible to count votes at the level of the judiciary with a population of one hundred thousand (...) Will it be for a woman or a man.

The MP adds to the National Approach that "there is a lack of confidence in this matter in large part due to the lack of a solid database essential for the adoption of multiple constituencies", pointing out that "this controversy remained and remains stuck between the blocs and political parties."

He believes that "it is very necessary to go to an available solution that secures the early parliamentary elections, and that it is easy to implement by adopting the governorate as one constituency, and the winning candidate is the highest number of votes in one constituency."

The new law divided the governorates into electoral districts on the basis of districts and cities, and every 100,000 people in those cities have a parliamentary seat, and in case the population of the judiciary is less than 100,000, it merges with a neighboring district to avoid this problem.

Prime Minister Mustafa Al-Kazemi had confirmed in a televised speech on Monday that his government would "work to hold early elections and that he was determined to hold them." And remove obstacles to early elections. He renewed his request from the Speaker of Parliament to “send the election law to the President of the Republic for approval so that we can announce soon the time set for early elections,” calling for “preparing people for the elections, and we must all work for the elections to be fair, just, and representative of the will of the Iraqis.”

Parliamentary blocs intend to make amendments to some paragraphs of the House of Representatives election law, while differences arise between multiple political parties over determining the paragraphs and articles that will be presented for amendment in the upcoming Parliament sessions. It is reported that Imad Yohanna, Adviser to the Speaker of the Parliament for Component Affairs has told (Al-Mada) that "the real problem behind the delay in ratifying the early parliamentary elections law is the difference between the political blocs over the multiple constituencies."

And John added that "there is a move to collect signatures to amend the Parliamentary Elections Law," explaining that "until this moment, the amendment of the election law or voting on the electoral districts has not been decided within the House of Representatives."

About 170 deputies signed the amendment of the election law approved by the House of Representatives incomplete under the pressure of demonstrations during the past months, as this move was considered a retreat from Parliament from the pledges made to protesters, in amending the parliamentary elections law and adopting multiple parliamentary constituencies.

And the former member of parliament continues his speech that "the government, the commission and the parliament have proposed holding elections in the month of April, June or October of next year."

It is believed that "the amendments to the election law if they will take place will include multiple paragraphs and articles, including the abolition of multiple constituencies," stressing that "political blocs will meet after the holiday to complete their consultations on the election law."

Mustafa Al-Kazemi’s government intends to send amendments to the draft election law to parliament, and the government is targeting in its amendments 15 articles to support the idea of popularizing the biometric system and modern technological systems to accelerate results. He continues that "the large blocs do not want to hold early parliamentary elections, and these parties want to complete the current parliamentary session that will end in the year 2022 ″, indicating that" among other problems that face holding early elections is that the ballot needs $ 500 million because of the multiple constituencies. .

The Electoral Commission requires setting dates for early parliamentary elections by enacting the election law with the tables attached to it, demarcating the boundaries for electoral districts, and approving the federal fiscal budget for the current year to implement the electoral practice.

And it shows that "the Electoral Commission is not prepared after the changes it made in the division and people managers to conduct the elections."

The Parliamentary Security and Defense Committee revealed, Wednesday, its decision to host officials in the Ministry of Interior to discuss the Information Crime Law in preparation for its approval, while indicating that it is seeking to agree on the appropriate age for admission to the Police College.

"The committee held a meeting to discuss the draft informational crime law and to amend the age requirement for admission to the police college," said committee member Ali al-Ghanimi.

He added that "it was agreed to hold another meeting after Eid Al-Adha with the committee concerned in preparation for approval in the House of Representatives."

Al-Ghanimi added, "The Parliamentary Security Committee decided to host officials in the Ministry of Interior after Eid Al-Adha regarding the Information Crime Law and took their opinion to amend the age requirement for admission to the Police College and to agree on the appropriate age for admission before proceeding with the procedures for legislating the law in Parliament."

The parliament’s endeavor to pass the “Information Crimes” law had been met with a strong popular and parliamentary rejection, because of its approval of restrictions on freedoms, according to what civil society organizations and representatives stated.

Representative Hoshyar Abdullah confirmed, earlier, his categorical rejection of passing the Information Crime Law in its current form, noting that this law imposes restrictions on freedom of expression instead of deterring information crimes.

"compromise", ends dispute over election law

Election Law
 2020-08-03 07:23

Shafq News/ The Parliamentary Legal Committee revealed on Monday that the political blocs agreed to adopt a "compromise" to end the dispute over the new electoral law in preparation for passage in parliament.

"The presidency of the House of Representatives and the heads of political blocs have agreed to compromise on the dispute over the adoption of the judiciary as a single electoral district or province," committee member Bhar Mahmoud told Shafq News.

"The solution ensures that the judiciary, which had a population of 100,000 in the 2010 legislative elections, is one electoral district, while the other districts are a market that is merged into a single electoral district," she said.

Prime Minister Mustafa Al-Kadhimi announced Friday that early parliamentary elections would be held on June 6th.

The new draft electoral law is the biggest obstacle to the holding of elections, as the bill has been in place since last year due to disagreements by political blocs over some of its provisions.

The Iraqi parliament began discussing the new legislation late last year under the pressure of popular protests calling for reform laws. The new law is expected to give more room for the rise of independents and small blocs to Parliament.

However, differences remain on key provisions of the law, including those relating to the adoption of a single electoral district at the level of one or multiple constituencies.

Parliamentary Legal: One article that hinders the approval of the Federal Court Law

382020234125275581_5.jpg

Digital Media NRT

The Parliamentary Legal Committee revealed, on Monday, three opinions to solve the problem of the stipulated paragraph of the Federal Court Law.

Committee member Hassan Faddam said in a press statement, which was followed by Digital Media NRT, today (3 August 2020), "The Federal Court Law is complete and there is only one article that is not complete yet, and it needs a national consensus between the political blocs", pointing out that " Some of the components insist that the vote within the Federal Court be unanimous, others want two-thirds of the members, and others want an absolute majority, and among these three opinions, a final formula must be reached between the components .

He added that "the Kurds are determined to vote unanimously within the Federal Court on the decisions of the court and this is not accepted by the Sunni and Shiite blocs," revealing "the existence of a political dialogue between all the components to come up with a decisive solution to the law of the Federal Court."
