Iraqi judiciary initiates procedures to hold MPs accountable on corruption charges

The Supreme Judicial Council in Iraq has asked the speaker of parliament to lift the immunity of a number of legislators in order for them to be investigated on charges of corruption. While this request was previously made on an individual level, this time around, the immunity lifting request was for a group.

On May 11, the judiciary requested that the immunity of 18 members of parliament belonging to various political blocs be lifted on charges of corruption and defamation. The parliament, which has yet to convene, has not been able to respond to the Judicial Council’s request.

A source in the office of parliament Speaker Mohammed al-Halbusi told Al-Monitor, “We have received these requests but have yet to respond thereto. We will do so during the coming period. The speaker of the parliament is to include such requests in parliament’s agenda and put them to the vote in a bid to lift the immunity of MPs included in the requests.”

According to Article 20 of the internal regulations of the Iraqi parliament, a member of parliament cannot be arrested during their legislative term unless caught in the act of committing a crime or accused of a crime, and only then once a majority approves of lifting the concerned legislator’s immunity.

The same article also says that a member shall only be arrested beyond their legislative term if caught in the act of committing a crime or if accused of a crime and only if the speaker approves of lifting their immunity.

Among the members of parliament who were included in the Judicial Council's request is the Faik Sheikh Ali, a controversial lawmaker whose immunity was previously lifted at the request of a number of legislators. This time around, however, the request was made by the judiciary. 

Member of parliament Alia Nassif, who is well known in the Iraqi media for “fighting corruption,” was also among the legislators whom the judiciary is asking to have their immunity lifted. She indicated that she thought there was no real case against her as the charges are related to three cases previously filed against her, two of which were dismissed.

Nassif said in a press statement that the first dropped case against her relates to her saying that Mosul residents who approved of Islamic State crimes are partners thereof. She said the second lawsuit was closed after the former defense minister was questioned in the previous parliamentary session. She said the third case concerns the Publishing Court and that will she "will appear in court in response to all the cases filed against me.”

Salah al-Arabawi, the former director of the office of the leader of the al-Hikma political coalition and a legal specialist, told Al-Monitor, “I think that the immunity issue will be politicized just like other issues that included the replacement of MPs. The speaker of the parliament should be firm in enforcing the law.”

Arabawi said he believes that the measures taken by the government headed by Prime Minister Mustafa al-Kadhimi can help boost accountability as far as legislative and governmental officials are concerned, and this is “an important message to the Iraqi citizens whereby lawmakers are accountable.”

During the protests witnessed in the country, the Iraqi parliament voted Oct. 29 to lift the immunity of lawmakers accused of corruption once their file is received from the judiciary. While this decision can facilitate the implementation of the judicial request, it is expected to face political obstacles.

Activists in Iraqi civil society consider the lifting of the immunity of a number of parliamentarrians as necessary and believe it is an essential step toward the Iraqi judiciary exercising its role in holding to account legislators who enjoy “and exploit” their immunity in illegal ways.

Musa al-Aaraji, a civil society activist who took part in the protests, told Al-Monitor, “We support such necessary measures. Most MPs took advantage of their immunity to indulge in blackmail practices and pass illegal contracts and deals.”

The Iraqi parliament does not seem serious about lifting the immunity of lawmakers and allowing the judiciary to interrogate them. There are many cases where legislators have been implicated in corruption files. About five years ago, former member of parliament Mishaan al-Jubouri admitted on Aletejah TV that he received a bribe during his work as a member of parliament, and no action has been taken in this regard.

A professor of political science at Baghdad University, Adel Bedewi, told Al-Monitor, “The judiciary’s request to lift the immunity of some MPs is a positive step, but I believe that parliament will deal with this request from a political rather than technical perspective, and favoritism may get in the way.”

Legal expert Tariq Harb told Al-Monitor that in order to lift the immunity of the legislators whose names were mentioned in the request of the Supreme Judicial Council, parliament needs a simple majority during its session, meaning half plus one. “In the event that the parliament does not lift the immunity of the MPs included in the request of the Supreme Judicial Council, the council will have to wait until the end of the parliamentary session to be able to interrogate them. If the immunity is not lifted, it will have no other option,” Harb added.

The first decision to lift such immunity in Iraq was in 2008 when the parliament voted to lift the immunity of former member of parliament Mithal al-Alusi following his visit to Israel.

In August 2019, the immunity of six members of parliament was lifted, but no action has been taken against them, as their blocs interfered, be it directly or indirectly, to mislead public opinion and accuse the speaker of the parliament of taking “a non-technical decision based on political calculations.”

After years of facing accusations of favoring politicians and serving their interests, the Iraqi judiciary is seemingly trying to stand up for itself, but it still may be unable to interrogate lawmakers who belong to large political blocs or are linked to armed factions. In the best case scenario, it will be starting with the most vulnerable members of parliament.

On Sunday, MP Sadiq Al-Sulaiti confirmed that the health insurance law has been completed and voted on after the Eid holiday.

Al-Sharq Al-Awsat newspaper said that US Secretary of State Mike Pompeo paved the way for the upcoming strategic dialogue between Washington and Baghdad, through a phone call, which the newspaper considered to be meaningful as he held it with Iraqi Prime Minister Mustafa Al-Kazemi.  

The newspaper pointed out in a report, which was viewed by "people" (May 24, 2020), that the dialogue between Baghdad and Washington should be transformed from a political-security dialogue to an economic-investment dialogue, and “here it will test the ability of Al-Kazemi and his government team and the intentions of the Iraqi political forces ruling In the political process. "  

 

The following is the text of the report:  

US Secretary of State Mike Pompeo paved the way for the upcoming strategic dialogue between Washington and Baghdad, with a meaningful phone call he made with Iraqi Prime Minister Mustafa al-Kazemi.  

Pompeo, according to the statement issued by the US State Department, discussed with Al-Kazemi «the economic crisis in Iraq, and the next strategic dialogue between the United States and Iraq».  

The statement added that «the minister urged Prime Minister Al-Kazemi to follow the real reforms while working with international institutions, to provide financial assistance to Iraq».  

And if the State Department statement focused on the economic crisis, as a first priority that the Iraqi government should address, including the trend towards international institutions to provide assistance to Iraq, the statement issued by the Information Office of the Prime Minister of Iraq did not go away on the essence of Iraqi-American priorities, including In that upcoming dialogue between the two countries, described by both of them as strategic dialogue.  

According to what political observers see in Baghdad, the prospective dialogue is linked from the viewpoint of the parties close to Iran, particularly the armed factions, to the American military presence, which must end with the departure of the American soldiers from the bases in which they are located, starting from "Ain al-Assad" in western Iraq. , To a "silk" base in Kurdistan in northern Iraq.  

The Iraqi government, which finds itself between several pathways and anvils, has not yet disclosed the nature of this dialogue, and what it might include.  

For its part, the political parties that make up the Iraqi parliament are divided among themselves, who reject the survival of the Americans, who are the majority of the Shiite forces, and support for their survival, namely the Sunnis and the Kurds.  

In this context, American support for al-Kazemi comes as a reliable and worthy prime minister. In return, Iran is still declaring its support for Al-Kazemi without reservation of any step I take, knowing that Al-Kazemi’s priorities now are how to pay the salaries of employees that amount to more than two billion dollars per month. In this context, there is an equation that seems very imbalanced, and that is a complete openness to Saudi Arabia by Al-Kazemi, with the beginning of a strategic dialogue with the Americans in light of the ambiguous relations between the Iranians and the Americans.  

Member of the Committee on Foreign Relations in the Iraqi parliament, Dr. Dhafer Al-Ani, trying in his speech to "Al-Sharq Al-Awsat" to try to solve the mystery of this equation, saying that "Al-Kazemi's government was born amid the complexities of the Iraqi scene economically, security and health; Indeed, even internationally, according to Iraq, according to its current capabilities, Iraq is unable to face these conditions without external assistance.  

Al-Ani added: "The government, which is based on an initial positive external impression on it, is trying to invest this in overcoming its plight through a wide openness to countries that are characterized by assistance, in order to consolidate the pillars of the new government and push it towards rational rational decisions."  

Al-Ani explained that “the Arab Gulf states, especially the Kingdom of Saudi Arabia, the Emirates and Kuwait, have ties of Arabism and neighborliness with them, and have previously helped Iraq in previous years, and they are at the forefront of countries that will initiate Iraq to seek aid to support its stability, driven by a certain awareness that the stability of Iraq is stability For the entire region, and that strengthening the new government is an important factor for restoring Iraq’s independence and sovereignty. ”  

With regard to Iran, Al-Ani says that "Iran continues to interfere in Iraq to steal its sovereign decision, through direct sabotage action economically, security and culturally, and indirectly through the armed factions loyal to it in Iraq." Regionally and internationally, it is continuous and wide, to send enough assurances that it is determined to take serious steps towards consolidating the independence and unity of Iraq.  

As for the professor of national security, Dr. Hussein Allawi, he sees in his talk to "Al-Sharq Al-Awsat" about the strategic dialogue between Baghdad and Washington, that "both countries are ready for dialogue in an open manner without reservations or red lines; As it is time for Iraq to make the right choices without Iranian pressure or local investment by armed factions.  

Allawi adds that «the position of Prime Minister Mustafa Al-Kazemi represents today the forces of national moderation, the government apparatus, and society, in terms of dialogue with the Americans.  

Allawi explained that «the fate of the American forces will remain in the light of the advisory and coordination work, training, information exchange, and maintenance of American equipment in the ranks of the armed forces, through American companies, and this was determined in the light of the strategic relocation plan in the Iraqi military bases, at (Ein Al-Assad base) And (Harir), and in the event that the Iraqi government asks for more than that, the American response will be through the International Alliance and the North Atlantic Treaty Organization (NATO).  

Allawi pointed out that «the dialogue must be transferred from a political-security dialogue to an economic-investment dialogue, and here it will test the ability of Al-Kazemi and his government team and the intentions of the Iraqi political forces ruling in the political process», explaining that «the back rooms of the Iranian-American negotiations are capable of dismantling The complex of the American-Iranian conflict, but Al-Kazemi wants to launch relations towards a comprehensive and parallel path, in order to preserve Iraqi national interests, since Al-Kazemi is closer to the protest forces that reject Iranian influence over the Iraqi political-economic decision, but want a normal relationship without interference, which is what He made the Iranians realize this through decision-making systems that showed a clear retreat, which makes them focus on interests, markets and trade between Iran and Iraq, with the parallel line of aid continuing to their friendly parties in Iraq.

Baghdad On Sunday (24 May 2020), the Kurdish MP, Hoshyar Abdullah, called on the Minister of Finance, Abdul Amir Allawi, to take steps to stop manipulating Iraqi imports from Zakho to Basra.

Abdullah said in a tweet on his platform via "Twitter", addressing the Minister of Finance: "We support you in reducing the salaries of the higher grades, cutting the huge petty cash on the three presidencies, abolishing the extra administrative bodies and links, and preventing any manipulation of Iraq's imports from Zakho to Basra."

 Abdullah had said Saturday (023 May 2020), "There is optimism in the performance of the Minister of Finance and I see that he is yet accurate in his proposals to reduce the repercussions of the financial crisis to a large extent, and therefore I see that his steps deserve support and support." 

The statement added: "We are waiting for him to look at the employees of the region as he looks at the employees of the rest of the provinces," noting that "there is an opportunity to resolve financial problems with the region constitutionally, and we must make this crisis an opportunity to implement radical financial reforms." 

He stressed "the need for the regional and center governments to solve their problems away from prejudice to employee salaries."

Diplomat: Iraqi headed to strike a balance in relations with Iran and Saudi Arabia

An Iraqi diplomat revealed today, Sunday, that there is a general trend within the political elites towards Saudi Arabia and neighboring countries after years of inclination for Iran.

The former Iraqi ambassador, Ghazi Faisal, said that the enhancement of Iraqi-Saudi relations comes within the framework of a general trend within the Iraqi political elites to strike a balance in the Iraqi foreign relations with neighboring countries that since 2003 have tilted towards Iran politically and economically.

He added in a statement to the Russian "Sputnik" radio that "this form of unilateralism in relations between Iraq and Iran is considered a defect in relations between countries and it is a form of dependency."

Faisal indicated that "what is required now in Iraq is to confront the corruption that is spreading in the country in multiple ways. Iraq is the second most corrupt country in the world, and opening up to neighboring countries such as the Gulf states, Egypt, and others, and attracting investments from those countries, requires a parallel effort in eliminating corruption."

Earlier, Saudi Foreign Minister Prince Faisal bin Farhan assured, during his meeting with Iraqi Deputy Prime Minister Ali Allawi, that Bladdah was keen on the return of its ambassador to Iraq to practice his work at the earliest time, to translate the Kingdom's desire to strengthen relations between the two countries.

Bin Farhan also stressed "the Kingdom's support for Iraq in a manner that achieves its security and stability and countering terrorism." He pointed out that "Saudi Arabia respects the sovereignty and territorial integrity of Iraq away from foreign interference." In this context, the Saudi Deputy Minister of Defense, Khalid bin Salman, said that he looked forward to returning Iraq, one of the pillars of the Arabs, as a rising power.

He pointed out that the representatives of his governorate "chose five candidates from among the sixty candidates who applied to be nominated and were differentiated according to the criteria of competence, experience and independence," noting that "the representatives of Basra met the Prime Minister the day before yesterday and handed him the names of the five candidates to occupy the oil portfolio."

 Iraqi Prime Minister Mustafa Al-Kazemi received on Monday an invitation from Russian President Vladimir Putin to visit Moscow, while the latter expressed his country's aspiration to double Russian investment in Iraq

This came in a telephone conversation between the two sides, according to a statement issued by the Iraqi government

The statement stated that Putin and Al-Kazemi discussed "strengthening relations and conditions in the region, low oil prices and effects, the OPEC agreement, the Corona pandemic, and the security situation in Iraq and Syria

The statement quoted the Russian President as his country's aspiration "to develop bilateral relations between Russia and Iraq and their importance in all fields, economic, commercial, and energy, and to increase the volume of investments to more than they are now, as well as in the field of electric energy

Al-Kazimi stressed, "The government's interest in strengthening cooperation with Russia, inviting Russian companies to come to Iraq and   invest in all fields, and working to overcome difficulties before these companies because of their positive repercussions on Iraq and in the relations between the two countries

According to the statement, Putin extended an invitation to Al-Kazemi to visit Moscow, and Al-Kazemi also sent a similar invitation to Putin to visit Baghdad

And Iraqi Finance Minister Ali Allawi denied earlier the validity of the news circulated about Iraq’s request from Saudi Arabia to borrow about $ 3 billion

The former minister in the Ministry of Transport, Amer Abdul Jabbar, on Tuesday directed a "advice" to Prime Minister Mustafa Al-Kazemi, in which he said that if Al-Kazemi revised the constitution and converted the system to a semi-presidential category, "history will remember him."

Abdul-Jabbar said in a televised meeting, "If Al-Kazimy now had rebuilt and built Iraq, even though he does not have money, nothing will be mentioned to him," noting that "the former prime ministers had not left anything to be mentioned in them, despite Explosive budgets that were in their era."

He stressed "the formation of this team to prepare a mechanism for amending the constitution, and if it is amended, Al-Kazimi will be mentioned in history as changing the parliamentary political system in Iraq," noting that "Al-Kazimi will succeed within 6 months to amend the constitution, if he made the amendment steps from now."

Abdul-Jabbar continued, addressing Al-Kazemi: "I do not ask you to amend the constitution in all cases so that it does not clash with the region, but you must do four paragraphs of the amendment according to Article 126, and it does not conflict with the interests of the region."

He explained, "The steps for amendment that Al-Kazemi must take, firstly, changing the system from a parliamentary to a semi-presidential one, and secondly, reducing the number of parliamentarians to 101, and thirdly, abolishing the provincial councils, and fourth, canceling a number of bodies and merging them with other bodies." Stressing that "these four paragraphs do not conflict with the interests of the region."

Prime Minister Mustafa Al-Kazemi received, today, Wednesday, a phone call from United Nations Secretary-General Antonio Guterres.

Guterres congratulated at the beginning of the communication, Al-Kazemi, on the occasion of his assumption of his duties, expressing his wishes for the success of the government in facing various challenges, as well as the completion of the ministerial cabinet.

He also congratulated Al-Kazemi and the Iraqis on the occasion of Eid Al-Fitr.

During the call, they discussed the repercussions of the crisis that is sweeping the entire world, its economic effects, and the efforts of the government to combat it, as a humanitarian crisis that requires solidarity and mobilizing all efforts to cross it, in addition to discussing the political, security and economic conditions in Iraq and the region.

 Guterres confirmed the United Nations' willingness to help identify opportunities and work in constructive partnership with the Iraqi government to stabilize the country. 

He also expressed optimism about the steps taken by the Al-Kazemi government, describing them as important, encouraging and prudent steps.

For his part, Al-Kazemi called on the United Nations and its Secretary-General to show the required cooperation in achieving the legislative elections in Iraq and prepare for them, after completing the approval of the new election law, calling for international cooperation by friendly countries and international organizations to help Iraq overcome its financial crisis, and the effects of the Corona pandemic on the economy Iraqi. 

The Prime Minister also assured the Secretary-General that the new government team is making efforts to enhance the sovereignty and stability of Iraq, as it continues to address challenges that include providing services, developing the economy, fighting corruption, as well as establishing justice and human rights principles and strengthening the rule of law.

Legal Expert .. The Prime Minister And President Of The Republic Have The Right To Dissolve Parliament

The legal expert, Tariq Harb, revealed that the Prime Minister and the President of the Republic have the right to dissolve Parliament according to their powers granted to them by the Constitution in Article 64A, which does not depend on the approval of another party. 

War, about the Prime Minister’s visit to His Excellency the President of the Republic today, was whether it was to dissolve the House of Representatives according to their joint authority without the need for approval of another party, because 64 / First of the Constitution decided that there are two ways to dissolve the House of Representatives before completing its electoral cycle, that is, before completing the four years.

Noting that the first parliamentary path when the House of Representatives dissolves itself at the request of one-third of its members, that is, at the request of 110 parliamentarians, is followed by a vote by a majority of members, that is, a vote and approval by 165 representatives to dissolve the House of Representatives, and this is far because the deputies do not want to leave this characteristic and the privileges resulting from it. 

The second way that the constitution decided to dissolve the House of Representatives is its executive way, at the request of the Prime Minister and the approval of the President of the Republic without the need for any approval from any other party, meaning that the Presidents and Ministers have the right to dissolve Parliament even if Parliament rejects the solution, and this is clear from the word (or) contained In Article 64 of the constitution, which stipulates that: “The House of Representatives shall be dissolved by an absolute majority of the number of its members upon the request of one-third of the members of Parliament (or). This benefits the allowance and option - or a request from the Prime Minister and with the approval of the President of the Republic.

What is stated after (or) is the executive way to dissolve parliament when the Prime Minister and President of the Republic agree to dissolve the House of Representatives, and contrary to the parliamentary regulations that granted the Prime Minister to dissolve Parliament without the need for the approval of any other party such as the Head of State as in Britain, Germany, Italy, India and South Africa, these countries It gave the Prime Minister the dissolution of Parliament without the need for the approval of another party.

So did Al-Kazemi’s State agree with His Excellency Saleh to dissolve Parliament now or after a period of known reasons, but what we know is that there is a constitutional authority established for them to dissolve Parliament without the need for approval from any other party.
