Economic expert Wissam Al-Tamimi warned of new employees, owners of contracts and daily wages going out with millions of demonstrations due to the failure to pay their dues by the new government, stressing the need for the government to resort to several options to solve the budget crisis after the low oil prices
Al-Tamimi said in a statement to "Information", that "the rise in oil prices to more than $ 30 a barrel does not serve the purpose and the budget remains below ambition, as the government will not be able to secure employee salaries beyond the first half of this year."
He added that "many of the new employees and owners of contracts and daily wages are still without salaries for more than 6 months, and therefore their dues must be secured. Otherwise, they will demand their rights with large millions of demonstrations that bring down the government."
He stressed the necessity of resorting to the communications sector and extending the state’s authority over mobile phone companies in addition to satisfying Kurdistan’s funds and recovering them, and taking advantage of gas fields to finance the budget instead of resorting to external borrowing that will shackle Iraq large sums over the coming years. 25 n ended

Legal: Lifting the immunity of a deputy needs the approval of 84 parliamentarians to achieve a quor

Baghdad - Mawazine News
, the legal expert, Tariq Harb, confirmed on Wednesday that lifting the immunity of the deputy needs the approval of 84 deputies if the quorum is achieved in the presence of 165 deputies.
Harb told Mawazine News: "We propose to the esteemed parliament to respond to the request of the Supreme Judicial Council to lift the horse from eighteen deputies, as the judiciary must take the role set by the constitution and not desirably requesting the Supreme Judicial Council means moving away from the constitutional oath ruling that The deputies stated in Article Fifty of the Constitution performed it, noting that Article 63 of the Constitution required the approval of the absolute majority when the immunity of the deputy was lifted, and the absolute majority of the number of members was not required, as required by Article 61 / VIII / 3 of the Constitution, which stipulated the absolute majority of the number of members, which is 165 Deputy being Kun T half when the withdrawal of confidence under this Article. "
He added: "As for the lifting of the immunity of the deputy, an absolute majority is required only and not from the number of members as in withdrawing confidence. Therefore, if the quorum is achieved in the presence of 165 deputies considering that they are more than half, then more than half of them raise the immunity."
And he added: "And that is achieved with the approval of 84 deputies only. Thus, if the attendance is 200 deputies, 101 votes for the deputies are sufficient to lift the immunity of the deputy. Thus, the majority required to lift the immunity of a simple deputy is easily attainable." End 29 / A 43

To a new Iraq: Al-Kazemi's mandate ... an optimistic start on the path to mines

12/05/2020

image

Baghdad - Mawazine News

New Iraqi Prime Minister Mustafa Al-Kazemi inaugurated his mandate with a series of confidence-building steps. He has ordered the courts to release the detainees who appear before them on charges of participating in the demonstrations, and asked the prison authorities to release the prisoners who have ruled for such violations, and a spokesman for the Ministry of Justice explained that this step came because “that the demonstration is a right guaranteed in the Iraqi constitution, provided that the demonstrators do not violate institutions Country". Al-Kazemi also ordered the compensation of the families of about 550 civilians killed in the demonstrations that started on October 1, and pledged that those involved in the killing of the demonstrators would be investigated.

In parallel, the Prime Minister appointed General Abdel-Wahab Al-Saadi as head of the anti-terrorist agency, after he was dismissed by the former Prime Minister Adel Abdel-Mahdi. Al-Saadi was considered a "hero of Mosul" after he stood at the head of the forces that liberated the city from ISIS control, and the demonstrators chanted his name Those who demanded his return to his job after his dismissal.

Al-Kazemi, a former journalist and head of the intelligence agency during the outbreak of the demonstrations, stood by the demonstrators and opposed the repression by Shiite militiamen at the direction of Iran. And now, as prime minister, he promises them a democratic Iraq that gives them their rightful place in power. The new spirit blowing from the prime minister’s office is an optimistic start, and indicates the prospects of his success in managing the country, which has tried for five months to find for itself a prime minister after three failed.

Exceptional support

Exceptionally, Al-Kazemi's appointment is supported by Iran and the United States. Estimates have already spread to this agreement, among them the estimate that both countries mired in the Corona crisis and its huge economic repercussions, have exhausted their preoccupation with politics. Within a relatively short period of time, Al-Kazimi succeeded in obtaining the approval of the Iraqi parliament on 15 of the 22 ministers he proposed. 5 others are still awaiting ratification, while no candidates for the post of oil and foreign ministers have been offered so far - two important bags.
But Kadhimi's sweeping support, as well as his encouraging first steps, will be on the line soon when he will be asked to prove his leadership. In the beginning of June, he is expected to have a round of talks with representatives of the American administration, which will focus on the issue of the continued presence of American forces in Iraq after the parliament approved the demand for its withdrawal. The two parties will also discuss how the Iraqi forces operate against attacking American targets, renew political training for the Iraqi army after it was frozen in the wake of the Corona epidemic, and the civilian assistance Iraq requests from international financial institutions. Washington intends to present practical demands and will not be satisfied with declarations of condemnation, as senior figures in the American administration have made clear to the Prime Minister. "The United States is very disappointed by the performance of the government of Iraq in everything related to the defense of the coalition forces," said David Shankar, Assistant Secretary of State for Middle East Affairs.

Taking military steps against armed factions may put Al-Kazimi on a collision course with the parties that support it, and in front of Iran, which sees it as an executive arm to implement its policy in Iraq. Al-Kazemi, like his predecessors, will have to face a complex dilemma. Should he embrace the American demands and thereby guarantee the international financial assistance that he needs for the purposes of the current financing and to pay the deferred salaries that he pays for several months and fight Corona, or will he allow Iran to continue dictating its policy and thereby guarantee the vital bilateral trade with Iran, which was estimated before the epidemic at more than 12 billion dollars, It ensures the continued supply of electricity and water from Iran, as well as the political calm it needs from pro-Iranian parties.

Exploding puzzle

Al-Kazemi announced that he is looking to expand economic cooperation with Iran and will not allow Iraq to be turned into a platform for launching attacks against it, but he also does not look to turn Iraq into an arena of sensitivity between Iran and the United States, losing the only channel that can help him overcome the economic crisis. According to estimates by Iraqi economists, Iraq needs a financing injection of about $ 50 billion, while the Accreditation Company "Pitch" estimated in April that the budget deficit in 2020 could reach 30% of the gross domestic product, and the national debt would reach more than 80% who are they. Iran cannot put Iraq at the disposal of Iraq with the required size, and without international funding with an American green light, Al-Kazimi will find himself in front of a new mass protest, as in the previous protest, and may lead to the overthrow of the government.

This is not the only dilemma for the Iraqi prime minister. Despite the offensive speech, The United States, like Iran, prefers stability in Iraq and a government that is doing its work on chaos, which may lead them to confront and grow up new armed factions, and may even provide an opportunity for IS remnants to renew their activities. Iran, which has begun withdrawing part of its forces from Syria, and the United States, which seeks to reduce its presence in the Middle East, will have to coexist in Iraq in order to maintain even a portion of their influence there.

The explosive puzzle posed by Iran and Iraq is not separate from the political minefield that Al-Kazemi seeks to dismantle with a new election law and early elections. His goal will be to give adequate representation to women and youth who have demonstrated their strength in the demonstrations, and to dismantle political monopolies that stifle the state's treasury in particular. Drafting a new constitution would stop all those with sectarian and political interests on their hind legs, while retracting the initiative could take hundreds of thousands to the streets. And if this is not enough to fill Al-Kazemi’s agenda, there is what awaits him behind the corner .. His confrontation with the Kurdish region, which demands the application of the oil agreement in exchange for a budget signed with the Prime Minister, according to which the government of Iraq must transfer to the Kurdish region about 14% of the total state income in exchange for Part of the oil extracted from the Kurdish region. It will not be boring in Baghdad in the coming months.

" Parliament is a representative of the people and is an observer of the government's performance, and therefore criticism of the government and its performance. This does not mean defamation and does not mean that the government raises a case in court.

Report: A sudden step in Iraq .. Will the phenomenon of 'impunity of officials' end?

2020.05.13
Report: A sudden step in Iraq .. Will the phenomenon of 'impunity of officials' end?

People - Baghdad

On Wednesday, a press report addressed the Iraqi judiciary requesting the lifting of the immunity of 18 deputies, indicating that the move came in a remarkable time.

The report, published by the London-based Al-Arab newspaper and its follower, Nass, (May 13, 2020), indicated signs of "harmony" between the executive and the judiciary that might end the phenomenon of "impunity of officials."

The Supreme Judicial Council in Iraq has taken a sudden step by directing a request to the Presidency of Parliament to lift the immunity of 18 deputies accused of corruption cases, influencing the progress of legal procedures, and issuing sukuk without credit, insult, slander and others.

The timing of this step drew the attention of the followers to the Iraqi issue, as it came directly with the beginning of the period of work of the government of Prime Minister Mustafa Al-Kazemi, who seems ambitious to open a new era of accountability and ending the phenomenon of impunity for officials and politicians, which prevails in Iraq in a large way.

Al-Kazimi considered "combating corruption and corrupt people a national task," and pledged in his speech to parliament during the session of obtaining confidence for his government to "confront corruption firmly and with all legal capabilities."

The list sent by the Judicial Council to Parliament included representatives of the Sunnis, Shiites, and Kurds belonging to various representative forces and blocs, including former Minister of Electricity Qasim al-Fahdawi, who belongs to the Salvation Front led by Osama al-Nujaifi, former Minister of Education Muhammad Iqbal al-pharmacist, Muthanna al-Samarrai from the Watan Bloc, and Kazem The fisherman close to the leader of the State of Law coalition, Nuri al-Maliki, Abdullah al-Kharbit, Ahmad al-Jubouri and Falah al-Zaidan, from the Alliance of Forces led by Parliament Speaker Muhammad al-Halbousi, Sadiq al-Sultani and Alia Nassif from the State of Law Coalition, and Harim Kamal from the Kurdistan Democratic Party led by Miss Dr. Barzani, and Nada Jawdat alliance victory, led by former Prime Minister Haider al-Abadi, an independent high-MP Sheikh Ali and other deputies.

Observers say it is not possible to separate the strong start of Mustafa Al-Kazemi's government after its formation and this great judicial momentum, which may find in the new executive a strong partner.

They point out that the introductions of harmony between the executive and the judiciary emerged with the rapid response of the Supreme Judicial Council to the call made by the Prime Minister to release all detainees from the demonstrators. Just hours after that call, the council issued a statement saying that it was in line with Al-Kazemi’s call. All the courts that present cases to protesters were directed to release them.

The request for lifting immunity focuses on three articles of the effective Penal Code, which is Article 340, which stipulates that “A period of no more than seven years shall be punished with imprisonment for any employee or a public servant who intentionally caused damage to the money or interests of the authority in which he works or is related to by virtue of his job or With the funds of the persons entrusted to him. ”And Article 331 stipulates that“ he shall be punished with imprisonment and a fine or one of these two punishments: Every employee or person charged with a public service who has intentionally committed something that violates his job duties or refrains from performing any of his duties with the intent to harm the interest of one of the individuals or with the intention of benefiting a person On another account or at the expense of the state. ”And Article 433 regarding defamation and Slander and defamatory.

According to the Iraqi constitution, if the accusation is brought against the deputy during the term of the legislative term, the House of Representatives must approve the absolute majority of its members to lift the immunity from it. As for the accusation outside the legislative term, the approval of the Speaker of the House of Representatives must be lifted, which means that it is lifted from A member of the House of Representatives is within the jurisdiction of the House itself when the legislative term exists and it is within the jurisdiction of the Speaker only when the legislative term ends.

Because of the urgent circumstances imposed by the procedures of public closure due to the outbreak of the Coruna virus, and the suspension of the parliament sessions, it is not decided whether the legislative separation is continuing now, or is there a legislative holiday.

Legal interpretations have contradicted with regard to considering the session of granting confidence to the Al-Kazemi government that was held on the seventh of this May an extraordinary event that took place within the legislative or regular holiday that occurred within the legislative term.

In the event that it was recognized that the session of granting confidence was exceptional, it will be confirmed that Parliament is in a legislative holiday now, which means that the decision to approve the request for immunity from 18 deputies is in the hands of the Speaker of Parliament, Muhammad Al Halbousi only.

Informed political sources say that Al-Halbousi prefers to accompany judicial measures to reinforce the parliamentary momentum resulting from the formation of Al-Kazemi’s government, but he awaits the legal interpretation of the previous or current legislative term.

But the same sources say that the need for articles in the Iraqi constitution to be interpreted is often used for the benefit of certain entities, recalling the most famous and influential interpretation of the course of Iraq, which came in 2010 when Iyad Allawi won the legislative elections, which enabled him to form a government without his opponent Nuri al-Maliki taking refuge in the court The Federal Federation to define the concept of the largest parliamentary bloc, and I have issued an explanation in its interest that it considered the owner of the largest bloc to be the one holding the largest possible parliamentary coalition and not the one who possesses the highest number of parliamentary seats. Oz in various fields and widespread corruption in all joints, and ended in 2014, disaster control organization Daesh on nearly one-third of the country's territory.

Representatives in the Iraqi parliament expect that the country will take about three months before life returns to normal due to the measures to contain Corona, including regular sessions of the parliament.

Observers say that the signs of solidarity between the executive, judicial and legislative authorities may change the gloomy atmosphere surrounding the country due to the desperation of the population to fight corruption, the economic crisis caused by the collapse of oil prices and the spread of unemployment.

Iraqis are looking for sincerity and seriousness with the new prime minister in his intention to reform and fight corruption, which is the first reason for crises in the country in all its forms, but others reduce the ceiling of hopes placed on him in this field due to the lack of means to confront the corrupt who have been operating lobbying within the state for nearly Seventeen years old.
