On Thursday, legal expert Ali Al-Tamimi clarified the options that Abdul Mahdi will resort to in the event that the Allawi government does not form or does not gain the confidence of Parliament before the second of next March, which is the period that Abdul Mahdi set to resort to constitutional options in the event that the new government is not formed.

Al-Tamimi said in a statement to "Al-Maalouma", that "the constitutional breach exists from the beginning because the resignation submitted by Abdul-Mahdi had to leave the position and take over the administration of the country, according to Article 81 of the Constitution."

He added that "the caretaker government should last for 30 days only in the case of resignation, and it differs from the dismissal and the transitional stage in which the country is living."

And he stated, "Abdul-Mahdi feels embarrassed and tries to get rid of this deadlock, especially since he should have handed over the tasks to the President of the Republic."

He explained that "Allawi's government, in the event that it does not see the light in the coming days, despite Allawi's call for an extraordinary session, Abdul Mahdi will resort to one of two options, either handing over the tasks to the President of the Republic or resorting to the Federal Court." 25 n ended

The Designated Prime Minister drags his opponents into a public battle

Designated Iraqi Prime Minister Muhammad Tawfiq Allawi announced on Wednesday that he had finished forming an "independent government without the participation of political party candidates", and called on Parliament to hold an extraordinary session next week to vote on giving it confidence, while sources indicated that there is American pressure on the Kurdish leader Masoud Barzani to reduce Conditions for the participation of the Kurds in the Allawi government.

BAGHDAD - Prime Minister-designate Muhammad Tawfiq Allawi put the political parties opposed to the members of his anonymous cabinet up to date, in great embarrassment, when Parliament demanded a meeting on Monday to vote on his government and its ministerial program, after he refused to comply with the demands of the Sunni and Kurdish blocs.

According to observers, Allawi wants to drag the political parties opposed to his options into an open battle, which was defeated by Parliament, which will emerge victorious, if his government gains confidence or fails to do so. In the event that it gains confidence, it will have achieved its goal of a government independent of the parties.

Allawi said in a speech addressed to the Iraqi people, "Your historic battle for the homeland for which you have borne heavy burdens and heavy sacrifices has changed political rules and resulted in an independent government formation for the first time in decades without the participation of candidates of political parties," noting that his expected ministerial formation "It was chosen because of the competence and qualifications of its owners in addition to what they have of programs that are applicable to cross the country to safety and serve citizens of all their affiliations." He continued, "This formation will be for all Iraqis and will gain their trust through what it will accomplish and after Parliament gives it its confidence."

Allawi called, “The House of Representatives presidency and members to hold an extraordinary session in order to vote on granting confidence to the government next Monday,” wishing the deputies to “prove to all Iraqis their desire for reform, and to bear the national responsibility incumbent on them, and to think about the present and future of Iraq and not Special interests prevent them from making the right decision, because Iraq is above all interests.

He said, "Let me remind you that we cannot evade genuine reform. After these protests are not the same as before, and if the demonstrations recede, they will return at any time stronger and broader than what we have witnessed," noting that "the precious blood that was spilled will not go in vain." Whatever the price, and this particular issue will be one of the priorities of my government, as soon as it is given confidence, it will begin investigating everything that took place in the demonstration arenas, revealing to the people the elements that attacked the demonstrators and security forces, pursuing them and bringing them to justice, whatever their locations and releasing the peaceful demonstrators.

Allawi did not reveal any of the candidates for positions in his new cabinet, reinforcing doubts that his options may not come to the whim of some big political parties.

Allawi's speech came hours after the letter of resigned Prime Minister Adel Abdul Mahdi to parliament and political forces, warning him of a "new vacuum" in the event that the Allawi government did not gain the confidence of the House of Representatives.

Abdul-Mahdi said, “The constitutional deadline of 30 days to grant the confidence of the House of Representatives to members of the new government and its ministerial platform expires on March 2, 202, so I send this message before the constitutional deadline expires to my brothers and sisters from the people's representatives to warn of the danger of entering a new vacuum because of the procrastination of formation Instead of expediting the formation of the new government, it can carry out the tasks assigned to it, including holding early elections as soon as possible.

Abdul-Mahdi added, “It is incorrect and inappropriate to continue bearing responsibilities after the date of 2 March 2020, and I will have no choice but to resort to the solutions stipulated in the constitution or the internal system of the cabinet,” indicating that the prime minister’s tasks will be transferred to a president The Republic automatically, in the event of vacancy of the position of Prime Minister.

Masoud Barzani may respond to American pressure that may include guarantees for Kurdish interests in the new government

Although the criticisms leveled at the Iraqi authorities for their continued bloody repression against peaceful demonstrators in Baghdad and the provinces, they no longer find anyone to target them, due to the multiplicity of power centers between a resigned head of government and another charged with forming the new government, and between them a range of parties and militias that have been involved in Violence against the street, encouraged or silent on the street, in the hope of preserving its interests, but it is still continuing and comes from the highest international levels.

After his visit to Iraq and conducting a series of meetings with senior officials in Baghdad, including the President of the Republic Barham Salih, Speaker of Parliament Muhammad al-Halbousi and the head of the resigned government, Adel Abdul-Mahdi, the US Assistant Secretary of State for Near East Affairs, criticized the continued repression of peaceful demonstrators in Iraq.

Schenker quoted the US embassy in Baghdad as denouncing "the ongoing attacks against peaceful demonstrators who exercise their democratic right to freedom of expression, including their demands for political and economic reform," and called on the authorities in Baghdad to "end these criminal practices and bring the perpetrators to justice."

The US official stressed his country's commitment to "support the basic democratic right of Iraqi citizens to freedom of peaceful assembly and expression, while affirming the United States' respect for the" important and permanent role of the (Shi'a) authority in Iraq. "

And the US embassy, on the sixth of this month, has condemned a bloody massacre against peaceful demonstrators from the Iraqi city of Najaf, who was accused by the supporters of the Shiite cleric Moqtada Al-Sadr.

For the first time, the US embassy used very sharp words, such as "bullying" to describe the attacks on Iraqi protesters. She said, "It is the responsibility of the Iraqi government and its security forces, to put an end to this bullying that includes kidnapping and assassination of civilian activists and journalists, as well as hitting, using live ammunition and burning tents in peaceful demonstrations," and she called "the Iraqi government to put an end to these criminal practices and bring their perpetrators to justice." ”

Observers say that international condemnations of the bloody repression against the demonstrators are no longer useful, after the resignation of the government of Adel Abdul-Mahdi and the assignment of Muhammad Tawfiq Allawi to compose the new booth, which opens the way for pro-Iranian militias to carry out more assassinations, sniping and kidnapping against militants.

They point out that the US condemnation of violence against militants coincides with its absolute support for Prime Minister-designate Muhammad Allawi, who is rejected by the demonstrators, which means that Washington may try to cover up its utilitarian position.

According to "Arab" sources, American mediators are pressing Masoud Barzani, the prominent Kurdish leader, to ease the conditions for Kurdish participation in the Allawi government.

The sources indicate that Barzani may respond to American pressure, which may include undeclared guarantees for Kurdish interests in the new government.

Three rooms on voting day!

Alawi called the House of Representatives to convene next Monday, to vote on his cabinet, while a source familiar with the scenes revealed on the day of the vote.

According to the source, “It was agreed to form several mini-teams from the Accountability and Justice Authority, and representatives of political forces and integrity, in three rooms, within the House of Representatives, to check the names of the candidates, where names are to be audited in the Accountability and Justice Authority, then in integrity and restrictions Criminal, to send those names to the Office of Political Forces, to agree on it, and review it, then send it to the House of Representatives to vote on it hours before the session, as Allawi nominated three names for each ministry, to ensure its passage, in case it fell into one of the pitfalls of scrutiny, the alternative would be ready Then it is put directly.

The source added, "The taxpayer’s plan to pass his government will follow the tactic of former Prime Minister Adel Abdul Mahdi, which is to authorize half of the cabinet, or that the ministries remain in dispute, or those that the Sunnis and Kurds believe are from their share to a later time."

He added, “This plan aims to absorb Sunni and Kurdish anger and street anger, where the Allawi team holds, passing half of the cabinet, and keeping other ministries, will give Sunni and Kurdish blocs, hoping to obtain them, or some of them, especially since there are some signs from Alawi To those blocs, regarding the issue of consulting with them, and not ignoring their demands and opinion on the new cab. ”
