The General Authority of the Federal Court of Cassation issued at its meeting held on 27/1/2020, a decision to agree that what is issued by the Federal Supreme Court and is not complete quorum according to the provisions of Articles 3 and 5 of the Court Law No. 30 of 2005 is not valid and non-binding.

A statement issued by the media center of the Supreme Judicial Council stated that "the General Authority of the Federal Court of Cassation considered Article 97 of the Municipal Administration Law in effect and not void because the decision of the Federal Supreme Court to cancel it does not meet the legal form stipulated in Articles 3 and 5 of the Court Law because the quorum of the court is incomplete He does not consider any decision issued by it and it is not complete quorum. "

Deputy: Stopping federal court decisions will delay early elections

The deputy of the Alliance of Others, Abbas Alaiwi, affirmed on Thursday that the Supreme Judicial Council’s decision to suspend the decisions of the Federal Court will delay the holding of early elections.

Alioui said in a statement to "Information", that "most members of the Federal Court have reached the stages of aging and need to legislate a law that regulates their work."

He added that "this decision will delay the holding of early elections because the court is concerned with approving the election results," noting that "Parliament is obliged to legislate the Federal Court Law after the end of the legislative holiday to get rid of constitutional problems and not to create other legal violations."

The head of the Supreme Judicial Council, Judge Faeq Zaidan, had confirmed, earlier, that the decisions of the Federal Court were legally non-existent due to the lack of a quorum.

The Federal Court settled 16 constitutional cases, including the quota and validity of the membership of some representatives



Baghdad / Obelisk: The Federal Supreme Court announced, on February 9, 2020, the resolution of 16 constitutional cases, noting that it entrenched important constitutional principles related to private ownership and the quota of women in the House of Representatives.

The court's spokesperson, Iyas al-Samuk, said in a statement reported to the obelisk: During the past month, the Federal Supreme Court settled 16 constitutional cases that were filed at the end of last year.

He added: In these cases, the court issued rulings and decisions consistent with the constitution, in letter and spirit, in public sessions held in the presence of the parties.

He pointed out that through these provisions the court established the constitutional principles for protecting and preserving private property and the women's quota in the House of Representatives and clarified the legal tasks for the work and decisions of the Hearing and Appeals Committees in the Media and Communications Authority.
