Thousands of Iraqis protested Monday in Baghdad and other parts of the country after politicians missed an overnight deadline for naming a new prime minister.

Anti-government rallies have rocked the capital and the Shiite-majority south since October with people protesting against corruption, poor services and a lack of jobs.

President Barham Salih and parliament have missed several deadlines to appoint a new prime minister following Adel Abdul Mahdi's resignation last month. Mahdi and his government agreed to stay on in a caretaker role until a new prime minister is approved.

Mahdi's resignation failed to satisfy anti-government protesters who have said it is not enough for a new prime minister to take over.  They are demanding changes to the entire political system imposed after the U.S. invasion in 2003, which they say is corrupt, inept and does little to help impoverished Iraqis despite the nation’s oil wealth.

Protesters on Sunday decried a potential pick for the new prime minister, former higher education minister Qusay al-Suhail, who is opposed by critics for his ties to Iran. Demonstrators categorically reject his candidacy along with any other potential contenders who have been part of the government since 2003.

At least 460 people have died and tens of thousands of others have been wounded since the demonstrations erupted in October in Baghdad and in Shiite-majority areas in southern Iraq.

Court authorizes Salih to choose PM regardless largest bloc: expert

The President of the Republic should have assigned another person to assume the position within 15 days, which did not happen, causing people to talk about a constitutional violation, a constitutional vacuum, or a caretaker government.
This is not the first time that the formation of the government has been delayed. We have witnessed a delay that lasted for several months. The question I am trying to answer here is when will the existing government transform into a caretaker government?
Before answering, I must provide a quoted definition for the caretaker government that says: "The caretaker government or the caretaker government is an interim government lacking authority for the purposes of conducting things at times. It may be a transitional stage, elections or an emergency circumstance resulting from the failure to establish or delay a new government, nor This government has the right to decide the important and crucial matters, "
This definition is based on a principle in the constitutional law that says that the country should not be free of an administration, so if the formation of the new government is delayed after elections or because of the dissolution of the existing government by resignation or others, the administration at its minimum must continue until the formation of a new government. How did the Iraqi constitution deal with this situation?
The constitution used the term "conducting daily affairs" in two articles dealing with two cases.
The first case mentioned in Article 61, which is the state of withdrawing confidence from the government, where she said: “In the case of voting to withdraw confidence from the entire cabinet, the Prime Minister and the ministers continue in their positions to conduct daily matters, for a period not exceeding thirty days, until the formation of the new cabinet ".
This case did not happen to us in Iraq, and it does not apply to the current situation.
As for the second case, it was mentioned in Article 64 regarding the dissolution of the House of Representatives, where the article stipulated the following: “When the House of Representatives is dissolved, it calls for general elections in the country within a period not exceeding sixty days from the date of dissolution, and in this case the Council of Ministers prepares Resigned, and continues to do things daily. "
Also, this case did not happen previously, and it does not apply to the current case. As for Article 81, it dealt with a different third case, which is “vacancy of the position for any reason”, but the article did not mention these reasons; or not. Here are two opinions, the first says fit, and the second denies that.
Regardless of this difference, Article 81 says:
 First: The President of the Republic shall act as the Prime Minister when the position becomes vacant for any reason.
Second: Upon verification of the case stipulated in Clause "First" of this Article, the President of the Republic shall assign another candidate to form the Ministry, within a period not exceeding fifteen days.
It is understood from this article that the resignation of the person of the prime minister, if we consider it one of the certificates of vacancy in the position, does not lead to her resignation, but the government remains in place, but it is headed by the President of the Republic who assigns a person to form the new government within 15 days. In turn, the prime minister-designate must form his government within 30 days. The total will be a maximum of 45 days. The existing government headed by the President of the Republic will be temporary. But what is striking here is that the constitution does not speak of a caretaker government, which may allow the saying that the existing government can continue as a government with full powers until the formation of the new government, the state of the existing government, when the elections are held and before the formation of the new government.

Meanwhile, the head of the victory coalition, Haider al-Abadi, renewed his rejection of any foreign interference in choosing the next prime minister or interference in the internal Iraqi affairs.
Al-Abadi said during his meeting with the delegation of the General Syndicate of Iraqi Trainers: The Victory Coalition has a steady stance regarding choosing an independent personality that enjoys the confidence of the people for a temporary phase that ends with early elections under international supervision, warning from reaching a state of political suffocation, which will cast a shadow on the country’s status and the importance of hearing the people's voice And achieve his demands and aspirations.
For his part, the KDP, headed by Masoud Barzani, criticized President of the Republic Barham Salih for postponing the assignment of the new prime minister, blaming him with "the greatest responsibility" in "violating" constitutional deadlines.
The party’s deputy, Diyar Barwari, said in a press statement: “The breach of constitutional timing does not bode well in terms of non-compliance with the constitution and the laws in force, and the failure to take a decision to nominate the prime minister does not serve the interests of any party, so the only victim is the Iraqi state as a whole. Observance of the constitution ».
Barwari added that "exceeding the temporal ceilings and constitutional periods is not a remedy for the problems, but adherence to it imposes better remedies than not adhering to it, and entering into these abuses is an unhealthy condition and is calculated on the President of the Republic and the performance of the Iraqi state in general," noting that "the pressures on the president The republic is to nominate a prime minister by the parties, their political blocs, or from the demonstrators; it cannot be a justification for delaying the assignment and submitting to constitutional transgressions. ”
Barwari said that "not appointing a prime minister and exceeding the constitutional deadline will be borne by the president of the republic as the guardian of the constitution, and despite this, the larger bloc must be clear in order for the president to assign it, and that does not prevent the great responsibility from falling on him and the larger bloc in parliament."
 
Responding to people's demands
In the meantime, the MP from the Alliance of Raiders Riyad Al-Masoudi warned the political blocs against continuing their obstinacy and adhering to the nomination of personalities that do not conform to the standards of the people's demands, indicating that this would delay the nomination of the next prime minister.

Al-Masoudi pointed out that "the appointment of a new prime minister will be delayed at the present time because of the insistence on paying names that do not conform to the criteria of the demands of some of the blocs supporting the demonstrators."
To that, media and academic Khaled Nimah confirmed that the Iraqi political scene has witnessed a continuous political movement during the past days to form a government and there is a race and stampede among the political forces to gain the formation of the largest bloc in a crisis political atmosphere.

As for the outputs of constitutional timing in forming the ministry, the legal expert Bashar Al-Hattab pointed out that the end of the constitutional period of fifteen days imposes on the President of the Republic an obligation under which he assigns a candidate to form the new ministry in accordance with the provisions of Article (81 / second) of the constitution without reaching A political settlement that resolves this matter imposes the important question, which is the effect of the failure of the President of the Republic to use this duty within the specified period. 
Al-Hattab added, in an interview with Al-Sabah, that the answer to this question requires us to return to the stable trend in constitutional jurisprudence, according to which the passing of the period in the cases stipulated is not an exception that does not lead to the disappearance of jurisdiction, and that determining the period is a presumption to urge vigor and speed up the behavior And this trend applies regarding this situation in the executive branch in Iraq. 
Al-Hattab explained that the passage of the time period specified for the President of the Republic in the constitution does not prevent him from performing his duty to assign the appropriate person to head the government as he is the one who ensures that the provisions of the constitution are adhered to. As for the fate of the caretaker government, it is obligated to continue running the daily business in implementation of the well-known rule that continuously requires the minister Resigned to manage the work of public facilities regularly and steadily. 
Al-Hattab pointed out that the date of resignation by the Prime Minister is the ruling on the extent of the legitimacy of the decisions taken by the resigned government or the resigned minister during the day-to-day business, and this result is not hypothetical but realistic for the executive authority in Iraq today and that its outputs are in place even if The constitutions did not explicitly state it.

The protester and political researcher Imran Al-Ubaidi said: “The dependence of political forces on the time factor is nothing but a wrong accreditation, especially in the previous stage that came out with statements far from reality and which provoked the demonstrators in addition to discovering that the seriousness of the reforms is non-existent, and this is confirmed by the group of laws that were included in the reform list They are very superficial reforms and have raised an important question, including why these forces did not initiate reforms previously if they were convinced of them and that they are necessary.
 
Irreplaceable demands 
One of the demonstrators said, "asking not to be named," that time is no longer in the interest of the political forces and it has to deal with the issue in a manner befitting its seriousness after things reached a dead end between the masses and those parties that have to realize that the masses demand logical requirements and even demand government changes. Iran wants to keep the Shiite parties loyal to it all its political gains, in order to be able to continue to lead the country, but this requirement may go into the category of luxury these days.

Under the pressure of the street, the chances of candidate Qusay al-Suhail to succeed Abdul Mahdi, whose name was given by the leader of the State of Law coalition Nuri al-Maliki, have declined.

Immediately after the nomination of Al-Suhail, the protesters hung their image next to the image of al-Maliki in the most important protest arenas in Baghdad and the provinces, and put an "x" in it to indicate his rejection.

The construction alliance, which is close to Iran, held an urgent meeting on Monday evening, to discuss the candidacy of Al-Suhail, which has caused wide political divisions, given his suspicious relations with the Lebanese Hezbollah and his subordination to the owners.

After the meeting, the leader of the coalition, Ahmed Al-Asadi, said that the building will finalize its nomination today permanently, adding that “We have names, an alternative that can be put forward, but we are committed to the nomination of Al-Suhail and we will engage in dialogues with other blocs to form the government.”

Arab sources say that the construction coalition does not want to rush to give up Al-Suhail, because this matter will encourage the protesters to reject other candidates.

But the coalition is already trading other names, most notably Asaad al-Eidani, who is currently the governor of Basra, and he is known as a personal friend of the commander of the Quds Force in the Iranian Revolutionary Guard, Qassem Soleimani, and the former youth minister Abd al-Hussein Abtan, who was nominated by the stream of wisdom led by Ammar al-Hakim.

Political sources said that the member of the new commission, Judge Abbas Farhan Al-Fatlawi, is a candidate for the State of Law coalition in the 2014 elections, adding that Judge Jalil Adnan Khalaf had previously been nominated on the lists of the Sadrist movement in the city of Nasiriyah.

She explained that the third member of the commission, Judge Amer Musa, had previously been nominated on the lists of the Badr Organization, while the fourth judge, Fayyad Hussein Yassin, was nominated for membership of the commission by the leader of the Salvation Alliance, Osama al-Nujaifi.

The rest of the candidates, Muhammad al-Halbousi, the two major parties in the Kurdish region, the Kurdistan Democratic Party, and the National Union, shared the remaining candidates.

The main demands of the protesters were to form a fair election commission, independent of the parties, to ensure a real change in the political scene.

And if the political forces loyal to Iran manage to pass their candidate to head the new government and install the new commission members in their chosen locations, the political change will be a postponed dream in Iraq, observers believe that it may not be achieved except with a violent uprising against the ruling political class.
