SULAIMANI — The Iraqi Council of Representatives on Tuesday (December 24) approved the electoral law during a session from which the Kurdish blocs withdrew. The New Generation caucus, however, stayed in the session. 

The Council of Representatives voted on 50 articles of the electoral bill during its session. 

During an earlier session on December 18, the parliament discussed the first fourteen articles of the bill, but disagreements over articles fifteen and sixteen, which concern the establishment of new electoral districts and voting eligibility, led lawmakers to set them aside until a later date.

NRT Digital Media reporter Omed Mohammed said the Kurdish blocs had walked out of the session during voting on the Articles 15 and 16 of the electoral bill.

The New Generation caucus, however, stayed in the session.

"The Kurdish blocs have problems with the content of Article 15," Mohammed added, noting that the Kurds have expressed concern about the article. 

Article 15 is about the election circles. Each district is considered as a circle election in the law. The number of each seat is 100,000 votes. If a district received less than 100,000 votes, its votes would be given to another district. 

The old electoral law considered each governorate as an election circle, according to the reporter. 

The Kurdish blocs believe it would damage Kurds' votes in the disputed areas mentioned in Article 140 of the Iraqi Constitution, the reporter noted. 

Head of the Kurdistan Islamic Group’s bloc Musana Amin said “those who spoiled the electoral law should take responsibility of the situation.”

Shia lawmakers, however, said the electoral bill should be passed as the protesters have demanded its approval.

New Generation President Shaswar Abdulwahid said in a tweet on Tuesday that the movement had voted for the electoral law as the movement had promised. 

“We are on our promises. We as the New Generation caucus have not boycotted the session of parliament on the electoral law voting and we did not walk out, unlike the Kurdish blocs,” Abdulwahid tweeted. 

“We support the protesters’ demands and have voted for individual candidate and multi-circles on the level of the districts,” he added.

Iraq has been rocked by anti-government protests for nearly three months. Initially the demonstrators wanted the government to do more to fight corruption, increase job opportunities, and improve public services, but they are now adamant that the current government and parties should be swept aside and new elections held.

The House of Representatives votes on the Parliamentary Elections Law

The House of Representatives voted in its twenty-fourth session, which was held under the chairmanship of Mr. Hassan Al-Kaabi, the first deputy speaker of the Council, in the presence of 184 deputies today, Tuesday 24/12/2019, on the Iraqi Parliament’s Elections Law.

At the beginning of the session, Hamid, Wassan Al-Saeedi and Mahmoud Al-Zagrawi took the oath, replacing representatives of Parliament, Raed Fahmy, Haifa Al-Amin, and Hassan Al-Aquli, who resigned from the House of Representatives.

The Council finished the first reading of the proposal of the First Amendment Law of the Federal Financial Administration Law No. (6) for the year 2019 submitted by the Finance Committee for the purpose of the Ministry of Finance being able to apply the law in accordance with the actual expenses of the previous year after excluding non-duplicate expenditures in addition to the ministries and governorates being able to continue to spend the amounts funded for them During the year preceding the completion of the required services and ongoing projects, as they are an acquired right for the governorate and the governorate departments with the ministries.

The Council completed the voting on the draft law on the elections of the Iraqi Council of Representatives submitted by the Legal Committee in order to conduct free and fair elections and take place with high transparency and for the purpose of truly representing the will of the voter and allowing for legitimate competition, granting equal opportunities and advancing the democratic process.

At the end of the session, which was presided over by Mr. Muhammad Al-Halbousi, President of the Council, he pointed out that the Presidency of the Council received a proposal to amend the article on dual nationality, pledging that there would be no president or official in the Iraqi state who holds more than one nationality.

Mubasher: The Iraqi Council of Representatives announced today, Tuesday, that it approved the new election law with all its provisions .

A council statement issued today stated that the parliament elections law was voted in the presence of 184 deputies .

The Council completed the voting on the Iraqi Parliament’s election law bill submitted by the Legal Committee in order to hold free, fair and transparent elections, with the aim of truly representing the will of the voter and giving way to legitimate competition, equal opportunities, and the advancement of the democratic process .

The statement noted that the Council ended, today, the first reading of the proposal of the First Amendment Law of the Federal Financial Management Law No. (6) for the year 2019 submitted by the Finance Committee, for the purpose of the Ministry of Finance being able to apply the law in accordance with the actual expenses of the previous year after excluding non-duplicate expenditures .

He pointed out that the law also aims to enable the ministries and governorates to continue spending the amounts funded for them during the previous year to accomplish the required services and ongoing projects, as they are an acquired right for the governorate and the governorate departments with the ministries .

Mohamed al-Halbousi, the council president, said that a proposal had been received to amend the article on dual nationality, pledging that there would be no president or official in the Iraqi state who holds more than one nationality .

The first deputy of the President of the Iraqi Council of Representatives, Hassan Karim al-Kaabi, directed earlier to hold a meeting of heads of political blocs , to resolve the proposals received from the various blocs on the election law, quoting a statement of the Iraqi parliament .

The amendment of the election law in Iraq comes in light of the reform decisions taken by the Arab country against the backdrop of popular demonstrations in protest against the living and economic conditions .

After a great political and public debate and debate, the House of Representatives voted in its twenty-fourth session, which was chaired by the First Vice-President of Parliament Hassan Al-Kaabi and in the presence of 184 deputies yesterday, Tuesday, on the law of elections for the Iraqi parliament. Speaker of Parliament Muhammad Al-Halbousi confirmed at the end of the session that the presidency I received a proposal to amend the article on dual nationality, pledging that there would be no president or official in the Iraqi state who holds more than one nationality, and upon the approval of the election law, the leader of the Sadrist movement, Muqtada al-Sadr, blessed this accomplishment, usually, "to fulfill another demand of the people."

At the end of the session, which was presided over by one of the Speaker of the House of Representatives, Muhammad Al-Halbousi, he indicated that the Presidency of the House received a proposal to amend the article relating to dual citizenship, and added: "I will adopt with the members of the House of Representatives a decision to prevent dual nationals from assuming any position," pledging that "there will be no An official in the Iraqi state holds more than one nationality. "
After a short break, the House of Representatives held its 25th session headed by Speaker of Parliament Muhammad Al-Halbousi yesterday evening, where he finished the first reading of the second amendment bill to the Unified Retirement Law No. (9) of 2014.
At the beginning of the session, Al-Halbousi stressed, "The parliament’s keenness to address some cases of emptiness that may occur in state institutions after the application of the unified pension law recently approved by the parliament, especially university professors and doctors with rare specialties," noting that "the amendment of the law will not be limited to one segment From state employees, "noting that" the next session includes the inclusion of the second reading of the Financial Management Law and the amendment of the Unified Retirement Law, in addition to voting on the Civil Service Law. "
The council finished the first reading of the draft law of the second amendment to the unified retirement law No. 9 of 2014 submitted by the Finance Committee, after which it was decided to adjourn the session to tomorrow, Thursday.
 
Tweet Al-Sadr and Hakim's position
Commenting on the parliament’s approval of the election law, the leader of the Sadrist movement, Muqtada al-Sadr, said in a tweet on his account on “Twitter”, which was followed by “Al-Sabah”: (In the name of the people. Another demand of the people's demands was fulfilled after the authority, the sane, the wise, the original, and all the honorable patriots of the parliament and others stood with him .. the election law will exclude all corrupt parties, praise be to God).
Mr. Al-Sadr added, “We are anxiously awaiting that the Electoral Commission be a truly independent and impartial commission, and we will not allow otherwise.” He concluded his tweet with the hashtag # Al-Mujallal_ Al-Jadali _ No_Try ... # The People's Candidate - will win.
The head of the National Wisdom Stream, Mr. Ammar Al-Hakim, reiterated - just before the parliament’s vote - the need to legislate an election law that would adopt individual candidacy and individual constituencies as it represented the demand of the Iraqi people.
Mr. Hakim stressed during his meeting yesterday, Chinese Ambassador, Zhang Tao, the importance of nominating an independent, non-controversial person for the position of Prime Minister, who has the acceptance of the people, has the competence and experience in managing the country at this sensitive stage and bears responsibility for preparing for early elections.
 
Resolve the controversy
And the House of Representatives resolved in its session yesterday, the dialectic of the political blocs regarding Article 15 of the new election law, whereby resolving the contentious paragraphs in the electoral law as follows:
- Multiple circuits
Individual election
- The winner is the one who gets the highest number of votes in the circle.
- In case the votes are equal, the voting shall be held among equal candidates.
The electoral districts are divided on the basis of an electoral district for each district in the governorate.
- The Ministry of Planning provides the commission with the number of districts in each governorate and the number of souls in the judiciary.
 
The new generation
The voting session of the election law witnessed the withdrawal of a large number of Kurdish representatives in protest against the vote regarding Article 15 and 16 of the law; but the withdrawal did not break the quorum for the session.
On Tuesday, the Kurdish Parliamentary Bloc of the New Generation voted in favor of Article 15 of the Electoral Law, which was a major demand among the demonstrators. The voting session on the articles of the electoral law, contrary to the Kurdish boycott blocs, and we supported the demands of the protesters and our vote in favor of individual candidacy and the multiplicity of districts at the district level.
The former independent political deputy, Sarwa Abdul Wahid, wrote in a tweet on Twitter: “The New Generation Bloc is the only Kurdish bloc that voted for Article 15 of the electoral law,” and added, “The new generation with multiple constituencies and 100 percent individual elections.”
 
Kurdish position
The Kurdish parliamentary blocs expressed their objection to proceeding to vote on the parliamentary elections bill, and the head of the National Union bloc Joan Ihsan said in a press conference for the Kurdish blocs: "What happened in the session of passing the law, is its forcible seizure without consensus, study and listening to the street demanding reform." And the enactment of a law that does not reproduce the system itself, does not allow the domination of authoritarian parties, does not distort the political system, and allows early elections to be held. "
She added, "The lawmakers insistence on overriding the original text that was included to develop the districts to be at the level of districts is a clear will not to hold early elections because of the technical complications and problems related to the identity of dozens of districts at the level of Iraq, as well as insisting on the adoption of electronic counting and counting and reliance on The electronic card without the biometry is a clear indication of fraud and forgery of the will of the voters, stating that "the winner’s approval of the highest votes is to reap the dominant parties for the seats in the council, burn the vast majority of the votes of the voters, return Iraq to tribal and territorial affiliations, and cut the road ahead for you Fataat and independents, "she said.
 
Parliamentary opinions 
For his part, said the deputy for the Alliance of Raiders Riad Muhammad: "The new law for elections without a census will keep the number of parliamentary seats 329 parliamentary seats distributed by one seat per 100,000 people."
He added, "If the election date is determined after the date of the census set in November 2020, there will be changes in the number of seats," noting that "the change does not reduce the number of seats, but there will be an increase according to the population increase recorded in the census."
He explained, "The situation until now depends on setting the date for the early parliamentary elections, whose features will determine the next government."
In turn, Nada Shaker, a member of the victory coalition, said: "The demonstrators demanded to amend the election law with clauses guaranteeing the rights of all candidates and voters and the dismissal of the government."
She added, "The House of Representatives committed to vote the reference to pass the election law quickly to reduce the escalation of the mass," noting that "passing the law is a great victory and will achieve electoral justice for all components."
Shaker explained, "The Kurdish political blocs objected to the vote of the House of Representatives, as it demanded that one electoral district be adopted and not go towards multiple districts."
And before the parliament session yesterday, the building alliance adopted the collection of signatures for deputies, with the aim of passing a proposal related to the election law, and a parliamentary source said, "The building alliance adopted the collection of signatures of 153 deputies to pass one of the proposals related to Article 15 of the election law."
The source explained, "The proposal requires that each governorate consider one electoral district, with individual nominations for the highest votes."
