Iran has credibility in Iraq, and it has no influence

The former Iranian ambassador to Iraq said that the Islamic Republic of Iran wants Iraq for stability, peace, prosperity, development and decent living for all Iraqi sects.

Iraqi Prime Minister Adel Abdul-Mahdi resigned following the disaffected popular protests that have engulfed Iraq, and the religious authority in Najaf has blessed this resignation.

The Iraqi parliament approved the resignation one day after the letter of the resignation arrived, and the President of the Republic was mandated, according to the Iraqi constitution, to name a person in charge of forming the government within a period not to exceed 15 days, while the Iraqi scene is still experiencing a state of instability.

The Mehr News Agency had a dialogue with the former Iranian ambassador to Iraq and the secretary-general of the Iran-Iraq Economic Relations Development Organization, "Hassan Danae Far" on the situation in Iraq.

The new prime minister must address the problems and concerns of the Iraqi people, and at the forefront of these problems are unemployment, combating endemic corruption in Iraq, as well as equitable distribution of wealth and services to all citizens equally.

The person in charge of forming the government should have a plan to cross Iraq to safety.

How do you evaluate the role of the religious authority in protecting the new government and returning calm and stability to the Iraqi arena?

We also saw that the religious authority in Najaf played an unprecedented role in the recent incidents, and certainly the reference will be supportive of the new government if it takes steps that calm the Iraqi street.

In a joint statement after a meeting on Dec. 7, between Iraqi caretaker ptime minister Adel Abdul Mahdi and the ambassadors of Britain, France, and Germany, the European ambassadors condemned the "the terrible crime" against Iraqi demonstrators, urging Abdul Mahdi to "arrest the perpetrators and bring them to trial as well as working accurately in order to these types of crimes must never again be allowed to occur".

However, as the government fails in taking action against the perpetrators, calls for international prosecution rises significantly.

Former Iraqi Prime Minister Ayad Allawi and others are threatening to seek international prosecution against officials they believe are responsible for the deaths of hundreds of protesters unless the Iraqi government takes action.

Allawi’s threats come after more than 400 protesters were killed in less than two months and about 16,000 were wounded. Since Oct. 12, the Iraqi Bar Association has received complaints from individuals who say they have been abused during the protests and are seeking to file suit against Iraqi security forces.

 

Al-Monitor obtained information from sources in Geneva affiliated with the Gulf Center for Human Rights and the Iraqi Observatory for Human Rights, who said the groups will press to internationalize the issue and hold the killers accountable. The sources asked to remain anonymous, but they said that if necessary these organizations will file suit against recently resigned Iraqi Prime Minister Adel Abdul Mahdi, who was head of the armed forces; Defense Minister Najah Hassan Ali al-Shammari; and Interior Minister Yassin al-Yasiri, who is the main person responsible for internal security.

A new government is one of the protesters' goals. They are demonstrating against severe unemployment, poor public services, corruption and Iran's growing influence.

This is the first time activists and human rights defenders in Iraq have moved to find lobbies and international alliances to hold accountable the killers of protesters. Their efforts come after a government report failed to identify perpetrators or hold them accountable. It said, in fact, that officers simply lost control of their forces and "there were no orders from the top" to use live ammunition.

One of the human rights sources told Al-Monitor, “If the Iraqi judiciary doesn't deal professionally with the issue and takes no serious or real action … we will be filing lawsuits against these [officials] in European courts.”

This lines up with a report published Nov. 3 by some Iraqi media outlets that said, “A human rights team is seeking to file a lawsuit against the [Abdul Mahdi] and several security officials for murdering and carrying out a genocide against peaceful demonstrators on the Al-Joumhouriya and Al-Sanak bridges and in Tahrir Square, among other protest sites, using live bullets and tear gas.”

Moath al-Momani, a legal expert at Lawyers Without Borders, told Al-Monitor a UN resolution will be needed for international prosecution because Iraq is not a party to the International Criminal Court (ICC) Rome Statute of 1998. Iraq didn't vote on the draft UN resolution at the time because then-President Saddam Hussein feared international trials. The current political regime also fears such trials.

“Unfortunately, Iraq is not a member of the Rome Statute, so it might not be able to achieve justice when it comes to the prerogatives of the ICC prosecutor,” Belkis Wille, a senior Iraq researcher in the Middle East and North Africa division at Human Rights Watch, told Al-Monitor.

“Iraqi activists can petition the UN Human Rights Council in Iraq to hold a special session on the situation in Iraq and maybe prompt the [council] to establish some kind of investigative mechanism for violations in Iraq. This would be the best way for Iraqis to draw the international community’s attention to the government’s behavior,” she added.

The United Nations, the European Union and the United States have all condemned the Iraqi government’s ongoing killing of protesters. This doesn't bode well for Abdul Mahdi and members of his government.

Abdul Mahdi is a French citizen, which could facilitate an international trial, according to the human rights sources. If an accused person is a national of an ICC member state, and that state sees fit, a trial can be held. In other words, France could be pressured to try Abdul Mahdi. 

This would take time and effort, but it is possible. Stockholm prosecutors, for instance, already are investigating Shammari, who holds dual citizenship in Iraq and Sweden, for possible crimes against humanity.

Those seeking international prosecutions can also find lobbies capable of pressuring the UN Security Council into referring the killers to the ICC. The Darfur atrocities case was referred to the ICC in March 2005, which prompted the ICC to indict former Sudanese President Omar al-Bashir. That case remains on hold, however, as Bashir must be present to be tried, and he is currently imprisoned and possibly facing the death penalty in Sudan.

The efforts to hold at least some of the killers responsible will take some time but are likely to come to fruition. In addition to the institutional organized action carried out by human rights and civil society activists, members of the Iraqi diaspora in Europe are working to prosecute Iraqi officials responsible for the violence against protesters.

“The international community and international human rights institutions seem to be the only way for Iraqis to conduct a fair investigation and prosecute the perpetrators of these crimes,” Zahra Ali, an assistant professor at Rutgers University in New York, told Al-Monitor.

ERBIL - Thr US has reiterated its support to the Iraqi protesters for reforms, saying that Baghdad should respect the demands of the demonstrators.

The comments were made by US Vice President Mike Pence in a phone call with Iraqi President Barham Salih on Monday, according to a statement by Salih's office.

The pair discussed the current unrest in Iraq, with Pence noting that Washington supports stability in the country, the statement added.

Iraq has been rocked by mass protests against the government since early October. Over 450 people have so far been killed and thousands of others were wounded.

Iraqi protesters have clashed with police and torched government offices, a premier has resigned and precious blood spilt. As modern institutions collapse, a centuries-old force is making a comeback: Iraq's tribes.

With their own hierarchies, moral and justice codes, not to mention huge arms caches, tribes have once again become among the most powerful actors in Iraq's rural and oil-rich south.

They have a history of revolt, turning against the British colonising forces in a major boost to the 1920 uprising that led to the country's independence.

A century later, revolution has hit Iraq again.

Baghdad and the Shiite-majority region have been rocked by two months of the worst unrest since the 2003 US-led invasion that toppled Saddam Hussein.

Anti-regime protesters have burned state headquarters and party offices in outrage at corruption, poor public services and Iran's perceived political interference.

It has been the perfect storm in which Iraq's tribes could reassert their leadership, said Phillip Smyth of the Washington Institute for Near East Policy.

In recent years, many Shiites had "become more urbanised and have loosened up their identity when it comes to being tribal," he said.

Youth, which make up 60 percent of Iraq's 40 million people, were particularly prone to look outward and shed their tribal identities.

"But the reason the tribes have a lot more strength now is that you have a very weak central government and an outside power -- the Iranians -- that is viewed as being complicit with this government," Smyth told AFP.

"These guys are looking at this and saying, let's revert back to sources of power that we know," he added.

- Trusting the tribes -

Nasiriyah in southern Iraq is a prime example.

Authorities dispatched commander Jamil al-Shammary late last month to snuff out widespread rallies in the city.

But tribal fighters then came out in force, cutting off roads to prevent troops from reaching Nasiriyah.

They negotiated a halt to the bloodshed, which had already cost 97 lives since protests erupted in October.

"It was the tribes that found a solution to the crisis while the politicians did nothing," said Qaysar al-Husseinawi, a leading figure in Nasiriyah's Husseinat tribe.

Their role did not stop there: the clans are also seeking justice for around 100 families pursuing legal cases against Shammary, himself a member of a powerful tribe.

Shammary's clan has excommunicated him over the crackdown.

Tribal tradition dictates that "blood money" must be paid to the victims' families -- otherwise they have the right to seek equally violent vengeance.

- Tribal law -

Influential clan structures have so far intervened to end bloodshed but if they choose to take up arms, many in the south expect full-blown conflict.

One police officer told AFP he'd rather desert than fight them.

"The state could never protect its own men against tribal law," he said.

Indeed, tribal tradition often trumps state law in Iraq, with accused criminals being released after tribal talks and even marital disputes resolved by mediators.

The tribes blend modern life and centuries-old tradition, with sheikhs juggling two iPhones while ordering wave after wave of sugary tea be served to their guests.

In the southernmost province of Basra, armed tribe members have often shut the streets outside national or even international oil companies to demand well-paid jobs there.

"The social bargain of any tribe is that the sheikh is a river to his people," providing them with work, justice and stability, said Nicholas Heras of the Center for a New American Security, a think-tank in Washington.

So naturally, the widespread upheaval in recent weeks over unemployment and poor services touched tribes, too.

"Tribal anger is directed at leaders in Baghdad that are viewed as having not kept their part of the social bargain," Heras told AFP.

- 'Bridges burned' -

The British colonising forces had a tribal revolt on their hands in the early 1900s after they arrested a tribal sheikh over a tax issue.

Nearly a century later, tribal support for the anti-government movement can also be linked to a push-back against central government authority in distant Baghdad.

But resolving the dispute won't be so simple.

"A lot of bridges have been burned," said Smyth.

"If you have people fundamentally angry at how institutions are corrupt, mismanaged and just bad, you won't just get bought off with a job," he added.

The government may seek to appease tribes with offers of more jobs or services, but there is no guarantee they could keep their support for long.

"You can never buy tribal groupings," said Smyth, pointing to their often shifting tactical allegiances.

"They're for rent."

Thanks pricestar8. Wouldn't it be something if a leader would come up from the tribe and bring a new revolution in Iraq. After about 13 years in this investment, yeah I know I'm the baby investor, I have never been more excited than I am right now. There is something real going on in Iraq right now and there will be a revolution the people have had it they're fed up, this could be the turning point we've been looking. After all these years I never would have put hope in the Iraq citizens actually being energized to make a change.  In my opinion this is a wonderful start to what we want to see.

Abdul Mahdi renews the call to accelerate the formation of the new government

Prime Minister Adel Abdul-Mahdi expressed his desire that the government of the day-to-day running of matters not be extended, once again inviting the House of Representatives and political forces to form the new government with full powers, and while congratulating the Iraqis on the anniversary of the Victory Day on "Daeshi" terrorism, he decided to suspend the official working day today, Tuesday, December 10

The Prime Minister's Office said in a statement, "Al-Sabah" received a copy of it: "Abdul-Mahdi received the ambassadors of European Union countries in Baghdad," noting that "cooperation relations between the two sides and the demonstrations taking place in Iraq were discussed and the importance of protecting them and preserving their integrity."
He added, "The European Union ambassadors expressed their continuing desire to support Iraq as the democratic country that represents an important model in the Middle East, and that the European Union considers Iraq a partner and is keen on its reputation and strengthening its system and democratic experience," noting that they "praised the prime minister's role in achieving an important development In Iraq's external relations, especially with the European Union countries. "
The ambassadors expressed their concern, according to the statement, "about the targeting of the demonstrators by the saboteurs and the importance of preventing any attacks against them and the security forces."
The Prime Minister affirmed, “Iraq’s pride in partnership and cooperation relations with the European Union, and Iraq’s commitment to human rights principles, including the protection of the right to peaceful demonstrations and the right to life, work and study,” noting that “the government revealed in its report on the mistakes that occurred at the beginning of the demonstrations and the excessive use of force Investigative measures have been taken and judicial procedures are continuing in this regard. "
He continued: "The government made a strict decision to confine arms to the state, but what is regrettable is the occurrence of sabotage operations carried out by vandals among peaceful demonstrators and the burning of state institutions, police stations, religious shrines, consulates and homes of citizens," explaining that "the security forces have a duty to protect everyone and maintain security and stability" all over the country".
He pointed out that "Iraq has had a major role in combating terrorism and its people are paying the price of war against ISIS in its economic, social and security conditions," again, "inviting the House of Representatives and political forces to form the new government with full powers and its desire that the government not run for the duration of daily affairs."
On the other hand, the Prime Minister, Commander in Chief of the armed forces, Adel Abdul Mahdi, issued a statement saying that "On the occasion of the anniversary of the victory day over the terrorist group ISIS and the liberation of Mosul and all Iraqi soil, we extend our sincere congratulations and blessings to all of our dear Iraqi people, and we call for the recall of heroism The sacrifices of the brave and brave fighters of our armed forces in all its forms and formations from the army, the police, the popular crowd and the peshmerga who defeated the enemy and liberated the land and donated one hand with our people with his youth and his youth when the masses fulfilled the fatwa of the jihad that was declared by the religious authority a Perhaps the Iraqis scored a great victory for their country and humanity. "
He added, "A salute to the martyrs and wounded who made the victory and their noble families, and to the heroic fighters from the armed forces and the security services who are still confronting the remnants of ISIS and defending their country and their people and their peaceful protesters and making dear sacrifices once again, and they give us all of our thanks, respect and appreciation."
And Abdul-Mahdi concluded his statement by saying: "On this occasion, as we did last year, it was decided to suspend the official working hours (today, Tuesday) in celebration of Victory Day."

ERBIL — Protesters in Baghdad and across the southern provinces are calling for President Barham Salih’s resignation after the country’s prime minister stepped down, a Kurdish lawmaker said.

Activists called on protesters in other provinces to join a massive march in central Baghdad on Tuesday. MP Hassan Aali told BasNews that the situation is not easy to control now while protesters’ demands are growing beyond jobs and public services.

“They are now seeking a change in Iraq’s political system,” Aali, from the Patriotic Union of Kurdistan (PUK), said.

He explained that protesters are not satisfied with the resignation of Adil Abdul Mahdi from premiership, but they want the president to step down as well, and will call for the resignation of parliament speaker later.

The MP pointed out that the people have the right to call for reforms in the political system, but if the president and parliament speaker are also forced to step down, “then Iraq will enter a massive turmoil”.

“The Peace Palace [Iraq’s presidential palace] is likely to be stormed by protesters. However, nothing is certain while everything develops during the protests.”

Iraqi protesters issue cautious Baghdad mass mobilization call

ERBIL, Kurdistan Region – With Baghdad’s Tahrir Square on Tuesday set to witness its largest scale demonstrations since national anti-government protests began, Iraqis on social media have launched a two-pronged campaign to safely mobilise protesters.

Since Monday, protesters in Baghdad’s Tahrir Square have shared videos on Twitter using the hashtag “you come too,” calling on Iraqis from across the country to join them in protest.

Iraqis in Baghdad and the country’s central and southern provinces have been on the streets since October 1, protesting corruption, unemployment and poor provision of basic services like water and electricity. Demands evolved to include overhaul of the country’s parliamentary system and electoral law.

The protesters have been met with deadly force, including the fire of military–grade tear gas and live ammunition rounds. More than 420 protesters have been killed and 16,000 wounded since protests began.  The Shiite-majority provinces of Dhi Qar, Najaf, and Karbala have witnessed the massacre of protesters, and at least 17 protesters were killed in Baghdad’s Khilani Square on Friday night.

To celebrate the anniversary of the defeat of ISIS, Iraq’s outgoing prime minister announced Tuesday, December 10 would be a national holiday.

December 10 is also the United Nations’ Human Rights Day. Iraq’s Independent Higher Council for Human Rights (IHCHR) on Monday announced it would not participate in commemoration of International Human Rights Day, as a sign of respect to all the Iraqis who have lost their lives over the course of the protests.

Anticipation and apprehension hung over Tahrir Square this morning, reported Halkawt Aziz, Rudaw’s reporter in Baghdad. Security measures have been tightened, the roads are emptier, and Tahrir was at the most crowded it has ever been at mid-morning.

As protesters continue to flock to Tahrir, over a million protesters are projected to take part in Tuesday’s demonstrations, Aziz added.

However, protesters gathering from across the country have been warned by local protesters not to attempt to cross over into the Green Zone, in a campaign hashtagged “don’t enter the Green Zone.” 

For months now, local protesters have been locked in tension with security forces on the Ahrar, Shuhada, and Jumhuriyah bridges - all of which lead to the Green Zone, home to government buildings.

“They [security forces, politicians] are dying to come to Tahrir. Why would we go to them in the Green Zone?” a protester is heard saying in a video recorded from Tahrir and published on social media.

Others urged protesters to avoid going to the fortified Green Zone for the sake “of the blood of the martyrs.”

Protesters in Tahrir were also told by one of their own to be wary of any call to enter the Green Zone.

“Brothers from the other provinces. There is a plot by the corrupt to make these protests about sabotage, but they live a big delusion. We are conscious of preserving our peacefulness and for our protests to continue in the squares. We won’t accept massacres against the blood of our brothers,” a protester wielding a megaphone announced.

“Therefore, we announce we have nothing to do with calls to break into the Green [Zone].”

Protest ‘plots’

Warnings of protest sabotage have been issued by Qais al-Khazali, leader of Asaib Ahl al-Haq - one of the factions of the Iran-backed Popular Mobilization Forces (PMF), also known as Hashd al-Shaabi in Arabic.

“We will talk about information [we have obtained]. There is intelligence planning from many sides that want bad things to happen to this country, to exploit these events, to cause chaos in Baghdad province,” al-Khazali said in speech he published on Twitter.

Khazali claimed plotters are focusing on Baghdad because national destabilization can’t take place “as long as the capital is strong.”

“The events and plots of December 10 is aimed at transferring chaos to inside Baghdad, to mess with the security condition, to have as many as possible killed and injured, to have the institutions of the state burned, to have the central bank robbed.”

“Why December 10? Because it is the International Human Rights Day. These want to cause security chaos to send a message on the level of the international community, to say look at the killed, the destruction that is happening in the country, to put the responsibility on the security forces and Hashd al-Shaabi.”

The PMF, widely thought to be responsible for violence against protesters, has from day one been vocal against “plots” emanating from the protests.

Following the December 8 attack in Khilani, the group admitted its presence in the square via a statement. It also admitted that it had clashed with the Saraya al-Salam (Peace Brigades) of firebrand cleric Muqtada al-Sadr, a backer of the protests.

The statement was deleted soon after publication. The PMF disowned the statement, claiming its social media and website had been hacked. 

PMF elements have since been dismissed from the vicinity of Khilani announced General Abdulkareem Khalaf, spokesperson for commander in chief of Iraqi armed forces.

“The commander-in-chief of the armed forces [Adil Abdul-Mahdi] issued directions to Hashd al-Shaabi about not interfering in security related matters,” Khalaf said, though the militia group remained in their Baghdad offices.

Khazali’s warnings and claims were met with ridicule by protesters in Tahrir.

“We will step on the head of Qais al-Khazali and his group with our flip flops,” they were heard to chant.

In light of today’s expected escalation of unrest, the US Embassy in Baghdad on Monday announced a travel advisory to Americans in Iraq, excluding the Kurdistan Region.

“According to reports, demonstrations are expected to increase in size starting on Tuesday, December 10, 2019. US citizens may see a heavy security presence,” the advisory read.

The embassy called on Americans to avoid areas of demonstrations and comply with directives of authorities.

Al-Khalidi added that "other meetings will be held during the next few days to sort out the character that is agreed upon and to meet the demands of the demonstrators." Meanwhile, spokesperson for the victory coalition, Ayat Muzaffar, confirmed that her coalition "does not have any candidate or objection to whoever has a set of criteria to be prime minister in the next stage." Muzaffar added to Al-Sabah that the coalition had previously put forward a set of criteria for the person who received this position, the most prominent of which was independence and won the approval of the street. For his part, Member of Parliament Jassem Al-Bukhati said: "There is a political consensus that the personality of the next prime minister be with specifications that are acceptable to all."

Priorities and conditions
While Nada Shaker Jawdat, the representative of the Victory Alliance, stressed that "the next government will be temporary, and among its priorities is to organize the election process and preserve the security of the citizen, as well as advance the administration process, as its role is temporary, in addition to its important project, which is organizing elections according to constitutional terms."
Jawdat indicated to "Al-Sabah" that "the duties of the actual government and the next prime minister after the transitional government are to choose a cabinet cabinet to rehabilitate the institutions whose priority must be the advancement of the economic sector and its transformation from mono-rent to a diversified economy, building infrastructure, housing units, hospitals and the judiciary On corruption, and its most important priority is the disarmament of armed factions. ” She indicated, “The task of the next government is not a difficult task, but there are those who are trying to impede its work. It can put plans that will restore confidence between it and the citizen by supporting young people who are able to work by paying salaries estimated at (250,000 dinars) and within the age of Work to operate local projects that specialize in industry and infrastructure, and then raise these sums after they are employed. ” She emphasized that "the planning and strategy of the next government will put an end to this deterioration in the economy and industry and the increase in unemployment through its next government program."
 
Early elections
In turn, he favored the MP from the Alliance of Saeron Badr Al-Ziyadi, to be assigned to the next government for a specific period, followed by going to early elections.
Al-Ziyadi said in a press interview: “The next government will definitely be assigned for a specified period, whether for six months or more until the constitutional provisions are amended, then go to early elections.” He indicated that “the only solution that works to calm the street is going to early elections and changing Faces and achieve the reform demanded by the street ». He added, "The national forces must participate strongly in the upcoming elections, just as the Iraqi people must also participate strongly by voting for people who believe that they will fulfill their legitimate demands." In the first part, we discussed mentioning evidence and arguments of the opinion that the resignation of the Prime Minister should be submitted to the House of Representatives for the purpose of voting on it, or submitted to the President of the Republic. And we mentioned that these arguments can be refuted through two sides. We dealt with the first party in which we presented two arguments and we echoed them, which are related to the absence or silence of the constitutional text on the mention of the party to which the resignation is submitted, and the measurement of the resignation rule against the general rules in the administrative law and the civil service law. Today we will address the third argument to discuss and respond to it.
Third: Measuring the rule of resignation over dismissal and withdrawing confidence:
Here, the abras are poured, and our pain increases from the constitutional reality in Iraq.
If we had relinquished everything that had happened in the previous two paragraphs (first and second) from the reasoning of the dissenting opinion referred to in the first part and we were satisfied with this paragraph only - thirdly - related to their reasoning, this would alone represent a totalitarian constitutional thought without exaggeration !! Many of those who gave their opinion on the matter have misdemeanors to infer that the Prime Minister must submit his resignation to the House of Representatives, according to what was stated in the text of Article (61 / VIII / 3) of the Constitution, related to withdrawing confidence from the Prime Minister. As the government prepares by this text to resign when withdrawing confidence from the prime minister, and when the government became resigned here after the vote to withdraw confidence from its president, so they built their ruling that resignation not associated with the withdrawal of confidence requires the parliament’s vote as well, in order for confidence to be withdrawn from the resigned prime minister, Resignation briefly takes the ruling of withdrawing confidence. This reasoning, in turn, is not correct, and it does not conform to the provisions of the Iraqi constitution at all, for the following reasons:
 
1 - There is resignation and dismissal in legal thought, however, there is no term in it (termination of the Prime Minister), but rather (withdrawal of confidence).
This confusion of terminology among these people confirms once again not to take note of the provisions of the Constitution, which is also due to what we have mentioned above from their measurement of general rules in other branches of law on the provisions of the Constitution; it is invalid as it was shown above.
 
2- There is a big difference between resignation and withdrawing confidence, in terms of causes and results. Neither the reasons between them are consistent, nor are the results and their effects united.
I was aware that this understanding is an axiomatic understanding for everyone, but it turned out that it is otherwise, and many still do not distinguish between them !!
Very briefly, the process of withdrawing confidence means that the parliament that previously gave confidence to the government to implement its governmental approach and achieve the interests of the people is no longer satisfied with its policy, nor is it convinced of its merit that the trust granted to it is sought; it seeks through constitutional frameworks to hold it accountable and drop it constitutionally; and then it interrogates its president in preparation for the withdrawal of confidence from him. And when he decides to withdraw confidence from the latter, that means withdrawing confidence from all members of the government - the ministers - then the constitutional age for it ends. Based on the foregoing, the withdrawal of trust is considered part of the process of accountability and accountability, but it is the largest, most important and most dangerous procedure in this process. Hence, the superficiality of that view indicates that withdrawal of confidence is an ordinary routine work; indeed, it is a political action that carries several serious meanings that lead to dropping The government and embarrass it in front of the public opinion; what may have a negative impact on its position in the elections !! And since the withdrawal of confidence means accountability and accountability, it is only achieved after questioning, as it is required to be preceded by conducting the questioning, as it is a necessary condition here, and it is inevitable of it in order to listen to the responses and defenses of the Prime Minister, because the questioning carries with it the meaning of the accusation - political -. As for resignation, it is a completely different process, as it represents a political behavior by the prime minister to express a position, such as if he intends to embarrass Parliament before public opinion, or to express his objection to Parliament enacting a law that contradicts the government’s policy, or that a public pressure wave calls for the government to resign; You have to provide it .. and other examples and cases. And all these cases have been achieved in the parliamentary experiences, past and present. The British Prime Minister (David Cameron) resigned, simply because the people voted through the referendum to leave the European Union, contrary to the desire of the government that was against the exit policy, then resigned after him (Theresa May); She was able to find a convincing formula for the parliament to leave the union, and before them she resigned (Margaret Thatcher); after the popular rejection of the government's policy of imposing taxes ... And so dozens, but hundreds of examples and cases that have occurred in this regard in parliamentary systems, which is not hidden from the follower and the specialist.
Hence resignation is an expression of a political position of the prime minister, and a weapon in his hand against his opponents; and with this description, it becomes a prominent political behavior in political action, and a personal constitutional right for the Prime Minister, which cannot be denied from him in any way, nor his comment on a condition or acceptance from any side .
Resignation has two types: 
Real resignation, and wise resignation.
Real resignation is achieved when the Prime Minister voluntarily submits it on his own initiative to express a specific political position; therefore, it can be expressed as (voluntary resignation).
As for the governmental resignation, it is achieved in all cases where the prime minister does not resign on his own initiative, but the government prepares by virtue of the resigned in certain cases mentioned in the constitution, such as the case of withdrawing confidence from the government or the dissolution of Parliament, and other cases Similar. 
In order not to dwell, nor get off the topic, I will leave these details for another position.
Based on the foregoing, it is not possible to accept the measurement of the voluntary resignation ruling against the ruling of withdrawing confidence, because of the big difference between the two in terms of causes and results.
For further corroborative evidence, address the following opinion-holders with the following questions:
 
A- It has been revealed to you that the constitution stipulated that the Prime Minister must be interrogated before proceeding with the process of withdrawing confidence from him.
And since you said that the resignation was the same as the withdrawal of confidence must be accompanied by the approval and vote of Parliament, this means that the prime minister must be interrogated when introducing the voluntary resignation?
Do you accept this result ??
 Will the lowest one who has knowledge of the constitution and parliamentary experiences accept this strange strange result? !!
 
B- These democratic democratic experiences are present before you. Can you come up with one example - only one - in one parliamentary state, from East to West, whose constitution requires that the prime minister be questioned when he presents the voluntary resignation?
Can you come up with one practical experience - just one - for one of these countries whose parliament questioned the prime minister when he resigned voluntarily ??
This Lebanese Prime Minister Al-Hariri resigned yesterday. Was the parliament questioning him? Have the two British prime ministers who were resigned, mentioned above, been questioned?
I do not know where they come from such provisions? !! Evidence that they are not closely acquainted with the constitution, or with international constitutional experiences; and it confirms that the matter is nothing more than their giving opinions for the sake of opinion, nothing more, and if it leads to misleading public opinion !! 
 
A- The interrogation of the prime minister - as mentioned above - is very dangerous, and carries with it many dangerous meanings. If the voluntary resignation is tantamount to withdrawing confidence, and withdrawing confidence requires conducting the interrogation, why did he ignore the constitutional text of such serious provisions, even though he mentioned Many things are less important and dangerous than interrogation and withdrawal of confidence? !!
