ERBIL (Kurdistan 24) – A member of Iraq’s integrity committee in the council of representatives announced on Saturday the preparation of a project to amend the law of the Iraqi Commission of Integrity to fight corruption.

October’s deadly and Iraqi-wide demonstrations saw two weeks of pause midway through the month but continue today as protestors demand action against corruption that is widespread throughout governmental institutions in the country.

Handren Lazgin, a member of the Iraqi integrity committee in the Iraqi Parliament, announced that the project to amend the Iraqi Integrity Commission law is ready for voting in the parliament.

“If voted on, it will enable the commission to effectively act against corruption and take legal action and punish those charged with corruption,” Lazgin said.

“There are several open cases of corruption in the commission of integrity; however, most of them refer back to the previous governments in Iraq,” he noted, adding that “the current government, under the leadership of Adil Abdul Mahdi, has stood against corruption the most in comparison to the previous ones.”  

Since demonstrations in Baghdad and other major Iraqi cities began in early October, at least 320 people have been killed on both sides and over 15,000 wounded amid a violent crackdown by security forces. International observers and human rights organizations have widely condemned the use of force.

Demonstrations continue as protesters are calling for an end to the economic woes of the public and a complete governmental overhaul amid shortages of public services, high rates of unemployment, and chronic institutional corruption.

The amendment aims to form a court called the Banking Business Court, which will be headed by a judge and two judges.

The Banking Business Court will also consider an action to cancel or amend the order or decision to impose administrative penalties and claims related to the custody, rehabilitation, liquidation and judicial custody of banks, and the determination of guardianship, guardian, liquidator, judicial guard and rehabilitation procedures shall be subject to court supervision.

In amended article 67, it recommends that orders and decisions issued by the Central Bank remain in force unless a court order to suspend executive proceedings or issue a cancellation or amendment order.

However, article 68 confirms that the orders issued by the court shall be subject to appeal by way of grievance within three days of being notified or considered as an amount before the court.The decision issued by the court shall be subject to appeal before the competent court of appeal as discriminatory within seven days from the date of notification or as an amount.

In article 70, the provisions of the Code of Civil Procedure and the Evidence Act are in force when there is no provision in this Act.

On November 12, the Council of Ministers issued Resolution No. 412 approving a new election law that will replace Law No. 45 of 2013. It appears that the Cabinet version will replace the President of the Republic, which merged three laws into one law. The draft has been sent to the House of Representatives for voting according to the mechanism adopted in the House.
This step comes after the voices of citizens raised the need to legislate a fair and fair election law. This requirement was supported by the Supreme Religious Authority in many sermons.
The terms of reference of the fair law are as follows:
1. Restores citizens' confidence in the electoral process
2. It does not prejudice political parties and currents;
3. It gives a real opportunity to change the forces that have ruled the country over the past years
The bill consists of 50 points. In a closer reading of the project it is clear that he did not meet these conditions despite the existence of some positive points in it.
The main thing missing in the project is that it did not embrace the idea of individual elections that most citizens demand. The draft law kept the election method on the list, dividing Iraq into 18 electoral districts according to the provinces in Iraq. Although the law approved the nomination on the single list, but keeping the constituencies unchanged reduces the chances of winning the individual lists that will have to compete party lists in the whole province. Individual elections require Iraq to be divided into regional constituencies with an equal number of parliamentary seats, narrowing the electoral competition to the narrowest possible range, enabling individual candidates to contest a fair and competitive election. This is not provided by the proposed bill. Article 15 is the most important article in the draft law as it relates to the distribution of electoral votes among candidates. To simplify the matter, I say that the article mentioned the division of parliamentary seats in advance between parties and individuals equally, giving each team a percentage of 50%. This division is based on an unproven presumption that parties represent 50% of the population. 
There is no evidence. It was supposed to leave the distribution of parliamentary seats to the votes of the voters themselves without arbitrary sharing in advance. This is proof that the political class rejects the individual election, because it fears that it will dismantle the political fiefdoms imposed by the method of election on the list. Article 13 reduced the number of deputies to 251. This is in line with the demands of the public. But this definition is like mine in the bill because it needs a constitutional amendment and cannot pass a law. This means that the current deputies will have two things: either to cancel this article, or postpone the adoption of the bill until the amendment of the Constitution. I do not know whether this issue missed the authors of the project or whether they deliberately put it as a mine in the project. The bill did not mention the MPs' job status. The draft was supposed to mention that the deputy returns to his previous job after the end of his membership in parliament, provided that the period of prosecution for the purposes of promotion and retirement for his previous job. Deputies who were not employees of the state are not entitled to a pension. As regards the requirement of the certificate, the preparatory certificate is mentioned as a minimum. This limit does not make the deputy qualified to legislate laws and it was better to require a university degree (BA), especially since the new parliament will be charged with preparing the draft amendment to the Constitution.
Article 6 prohibited the holders of high positions and special grades from the Director General and above and up to the President of the Republic from nominating for elections to the House of Representatives. This involves both pros and cons. I don't know if the author of the project was paying attention. This needs further discussion.
The most important point in the bill is that it reveals that its authors are not aware of the concerns of the Iraqi street and therefore it does not achieve a satisfactory response to their legitimate aspirations for change and reform.
That's what I showed from the first reading of the bill.

Parliament is holding an evening session today that may witness an unprecedented event
(Baghdad: Euphrates News) The House of Representatives, its regular session on Tuesday evening.
The House session may witness an unprecedented event by voting on an important package of laws at once.
The Council is scheduled to vote on six important laws: (Law on the abolition of financial privileges of officials in the state and amend the law of the elections of the provincial councils and the law of unified retirement and health insurance and the amendment of the Commission on Integrity - the first reading of the law) Parliament.
The vote coincides with the largest public pressure after 2003, where popular demonstrations have continued in the country since the beginning of last month demanding reforms, fighting corruption and improving the living and service conditions.
The pressure prompted 12 political forces at a meeting on Monday to agree on important decisions and recommendations to demand the protesters' demands and ease the crisis. The government, led by Adel Abdel Mahdi, has only 45 days to implement its promised reforms. 
The meeting was attended by alliance of conquest, victory coalition, the rule of law, the coalition of Iraqi forces, the Kurdistan Democratic Party, the Patriotic Union of Kurdistan, the stream of wisdom, the National Coalition, the Salvation and Development Front, the National Tender Bloc, the National Contract Block and the Turkmen Front, and the absence of the Alliance.
Participants in the meeting agreed on six resolutions and recommendations in addition to five important proposals, while threatening to withdraw confidence from the government and hold early elections if it shows the inability of the government or the House of Representatives to implement the articles and steps mentioned within the timings indicated.
