The House of Representatives votes to form a committee to amend the Constitution and dissolve the provincial and district councils and districts and cancel the privileges of senior officials

 

The House of Representatives voted in its tenth session held under the chairmanship of Mr. Mohammed Halbousi, Speaker of the Council and the presence of 222 deputies on Monday 28/10/2019 on a package of important decisions, foremost of which is the formation of a committee to amend the Constitution and dissolve the provincial and district councils and districts and the abolition of privileges of senior officials, in addition to voting on The names of the Federal Public Service Council and the first reading of the law of the Reconstruction Council.

At the outset of the session, which was devoted to discuss the demands of the demonstrators and the implementation of reform packages, Mr. Al-Halbousi offered condolences on behalf of the council to the martyrdom of a constellation of peaceful demonstrators demanding their constitutional rights guaranteed by the constitution, stressing the importance of increasing the momentum to proceed to protect the demonstrators and meet their requirements quickly without waiting, stressing the need for the leader The General Armed Forces shall preserve the lives of citizens and public and private property.

The council then read Surat Al-Fatiha to the martyrs who died during the demonstrations of civilians and security forces.

The Council voted on the basis of Article 142 of the Constitution to form a committee represented by its main components in Iraqi society, whose task is to report to the Council of Representatives within a period not exceeding four months to make a recommendation of the necessary amendments to the Constitution, provided that the amendments proposed by the Committee at once to vote on them. The amended articles shall then be submitted to the people for referendum within a period not exceeding two months, provided that the referendum is successful with the approval of the majority of voters if not rejected by two thirds of the voters in three or more governorates.

The recommendations provided for the exclusion of the provisions of this Article from the provisions of Article 126 relating to the amendment of the Constitution until a decision on the amendments provided for in this article.

The council voted on the names of the formed committee, which included MPs Mohammed Al-Ghabban, Faleh Al-Sari, Adnan Al-Zarfi, Nabil Al-Tarfy, Sabah Al-Saadi, Naeem Al-Aboudi, Mohammed Shea'a Al-Sudani, Rashid Al-Azzawi, Falah Hassan Zidan, Mohammed Tamim, Mohammed Al-Karbouli, Vian Sabri, Joan Ihsanem, Yonadam Kanna, Yousef Mohammed Sadek, Arshad Al-Salhi, Ammar Tohma and Saeb Khedr.

The Council also voted to dissolve the provincial councils in the province at the request of 192 deputies and based on article 20 of the law provincial councils amended No. 21, as well as a vote on the termination of the work of district and district councils in the provinces not organized in the province and local councils in Baghdad Date of vote.

The Council also voted to authorize the Governor to one of his deputies to the Department of Financial and Administrative Affairs and to receive receivables from the dissolved provincial councils that the House of Representatives to oversee and monitor the performance of the governors until the elections of the provincial councils, in addition to the vote to submit the governors to submit their own budget to the Finance Committee Parliament during the preparation of the General Budget Law.

In the same matter, the Council voted to be the supervision and control of the performance of the Governor of Kirkuk and his two deputies by members of the House of Representatives representatives of the province.

The Council voted on the decision to cancel all privileges and allocations of the three presidencies, including members of the House of Representatives, ministers and senior officials in the independent bodies and the judiciary, including the Federal Court and the Supreme Judicial Council, in addition to the ministries' agents, their ranks, advisors, general directors, governors, and their ranks as of today.

The Council also voted on a resolution requiring the government to implement immediately the abolition of the combination of two salaries of beneficiaries of social justice laws, including the Rafha privileges.

The President of the Council announced that the Council will continue to hold its session until the Government sends a package of reforms announced by the Prime Minister and the stages that have been implemented.

The Council voted on the members of the Federal Public Service Council after the sending of the names by the Council of Ministers, which included ladies and Messrs. Abdul Hussein and Joan Ahmed Jamour and Arif Saleh Dulaimi.

On the other hand, the Council completed the first reading of the draft law of the Reconstruction Council, submitted by the committees of services, reconstruction, finance and strategic planning in order to implement the major projects effectively and well planning, management, supervision, employment and job creation and develop the skills of workers and maximize the benefit of Iraqi citizens from state resources.

The Speaker of the House of Representatives announced that the Presidency of the Council received requests to question the ministers of oil, electricity, industry, agriculture and finance, in addition to receiving a request to question the Prime Minister, pointing to the completion of legal procedures from the formal and substantive questioning of ministers of industry, oil and agriculture to be questioned in November Within timelines to be determined.

The President of the Council continued the session to resume its work on Tuesday.

Gregp, I understand your frustrations. Iraq was peaceful for many years and Alak, the CBI governor, who was appointed by Maliki, by the way, didn't pull the RV trigger and move the country to a real market economy. Article 5 of the Act stipulates:

First: The Council shall consist of a Chairman, a Vice-President and seven full-time members who hold at least an initial university degree, two of whom shall be in law, and two in administration and economics, and one in medicine, engineering and agriculture.

Second: A. The President of the Council shall be a special member.

(B) The Vice-Chairman and members of the Council shall be a Director General.

Third: The Council of Ministers shall nominate the President of the Council, its Deputy and its members in accordance with the conditions set forth in this Law, and they shall be approved by the Council of Representatives.

Fourth: The nomination mentioned in paragraph (III) of this Article shall be in accordance with the following mechanism:

The Council of Ministers announces the opening of the door for submission in all audio-visual and print media for a period not less than (20) twenty days and not more than (30) thirty days.

B- The announcement shall include all the conditions of the candidates mentioned in this law.

Fifth: The President, the Vice-President and the members of the Council shall meet the following requirements:

The applicant must have the experience and competence that qualifies him to fill this position and who has an actual service and practice in his specialty for a period of not less than (15) fifteen years after obtaining the preliminary university degree. And (10) ten years for a PhD.

He must be an Iraqi who is at least 37 years of age.

He must be of good conduct.

Not to be covered by the Accountability and Justice Law.

Not to be convicted of a felony or misdemeanor violating honor.

Sixth: The President, the Vice-President and the members of the Council shall be appointed in accordance with the law for a period of five (5) years, renewable once.

Seventh: The President of the Council shall exercise the authority of the competent minister in regard to the administrative and financial affairs of the Council.

Eighth: The President of the Council or his deputy or any of the members of the Council shall be dismissed upon a proposal by the Council of Ministers and endorsed by the House of Representatives on the basis of incompetence, integrity or serious breach of the duties of the post, and shall be deprived of the privileges of the post assigned to it under this law in the event of the dismissal order.

The approval comes as part of the Prime Minister's commitment to implement the reforms that came with the government program.
