The flagrant constitutional breach of Parliament in the formation of the Constitution Amendment Committee

For many years I have been bitterly noticing the lack of constitutional, and even legal, awareness in the public at all levels. Almost everyone suffers from this bitter intellectual reality. I would like to exclude here the brilliant professors of the law - who are exclusively thought-minded - who represent very few. However, the problem is that these few people do not have a role in the ripening of public opinion or correcting its paths. Perhaps no foreigners are right if I say that the picture is bleak - in this regard - and does not bode well at all; In what they do not know. Despite their obvious mistakes, the media cannot reveal this, which is misleading public opinion !! 

As for the parliament, and I do not know what the parliament, the problem here is a real ruse, especially since the constitutional and legal awareness of the parliament is in decline and decline continuously cycle after session; Third .. And so that we have reached the stage of what is less described as (tragedy) in terms of constitutional and legal awareness !! It is noticeable that most of what the parliament is talking about constitutional issues may be without guidance or a bright book !! Noting that this is the whole parliamentary system in our country, not a particular parliament. 
In order not to prolong nor enter into the many details in which the Parliament has signed itself in constitutional breach, I will talk about the latest of these violations and irregularities and the most scandalous and scandalous; In order to brief the reader, I will briefly note that this article calls for the formation of a committee to amend the Constitution within four months, in order for the amendment to be effective, it must be approved by the parliament by an absolute majority, and then approved by the people through a referendum, provided that no two-thirds of the voters in three or more provinces do not object. It is even more surprising that the Parliament voted on this resolution, although it represents a clear constitutional violation and a clear violation; for the following reasons, in summary:
1. Article (142) of the Constitution is a temporary transitional article contained in the transitional provisions, and was placed in the last moments of the writing and drafting of the Constitution by the so-called (political cuisine), after the completion of all its texts, in order to reassure the Sunni component - according to the term - His representatives said at the time that this component did not contribute all the details of writing the constitution, and that if the constitution is presented in this way it will get approval and will be implemented as long as the Shiites and Kurds will vote for it; hence this temporary article gives the Sunni component the opportunity to reject the constitution if not approved His texts.
2. The article was intended to be applied at the first parliamentary session following the adoption of the Constitution in 2005, and is not a permanent article that can be relied upon at any time, or at any parliamentary session; hence the text - Article 142 - reads as follows:
(The House of Representatives at the beginning of its work a committee ...). Parliament was not then called the Council of Representatives, but rather the Iraqi Transitional National Assembly. Article in the first parliamentary session, this committee was composed of (27) members, and added two observers from the Chaldeans and Sabeans, and thus became (29) members representing the main components of Iraqi society. The Committee held its first meeting on 15 November 2006 Hammam Baqer Hamoudi chose her president and Fouad Masou Iyad al-Samarrai and two deputies. The Committee continued its work until 2009. The committee violated the time-frame mentioned in the above-mentioned article that the judge must complete its work within four months, as it lasted for almost three years, after its work was extended more than once; The controversy continued until the disagreement between the main components over the amendment articles, especially the Kurdish side, was voted to end the work of the Committee; By the death of matter (142), not death

3. The death and termination of Article 142 does not mean that the Constitution cannot be amended, but rather the need to revert to the provisions of Article 126 of the Constitution. In the final provisions (not transitional) some texts laying out the modification mechanism. This is the same as that contained in Article (126), which is included in the final provisions. In the sense that any amendment to the Constitution after the end of the work of the aforementioned committee must be in accordance with the provisions of Article (126) one statement is not contrary to only ignorant alphabets of the Constitution. 
4. The brothers who wrote the Constitution still exist among you, as well as the brothers who worked on the constitutional amendment committee referred to above. The Chairman and Vice-Chairmen of the Constitutional Drafting Committee and the Chairman and Vice-Chairmen of the Constitutional Amendment Committee are still in your midst, and they know this fact - Article 142 is a transitional interim article that is over. This fact has never been debated. Parliament must ask them before the country is embroiled in these endless calamities. I call on them to assume their legal responsibility in explaining this fact and not to fall into a flagrant constitutional violation, especially the former chairman of the committee Hamoudi and his deputy infallible, especially since the latter was president of the republic and closely familiar with the constitution.
5 - If we give up everything that is not mentioned, we can ask the following question:
How can any constitution in the world put a detailed text related to its amendment, and then come in the transitional provisions to put another text of the amendment contrary to the previous text, and is there any reasonable can accept this !! Although the logic here is that it is impossible to combine the two contradictions, and to assume the possibility of accepting the possibility of this hypothesis that it is permissible to collect - which is, of course, impossible - why did the legislator not combine the two texts together and make them one text? It !!
 If Article (126) consists of five paragraphs, we could add a sixth paragraph to put another mechanism for example !!
On the basis of the foregoing, the decision of Parliament to form a committee to amend the Constitution in accordance with the provisions of the dead Article (142) is null and void, with no value and no effect; It is the right of Iraqis to be surprised by the most surprising of this flagrant violation, and to ask about the legal in parliament where they went? And where advisers where they resolved? Is it conceivable after all these long years of parliamentary work to fall into such an inexcusable and unforgivable mistake? 
 
Our proposal to address this problem:
It is worth mentioning that the aim of this talk is to defend the truth and the Constitution only, and not to stand in the face of the amendment. To be adjusted later to keep pace with time and the need of society. However, it is intended to be an amendment to the constitutional mechanism, not a departure from it. In this regard, I propose the following proposal to address the problem in which we have signed Parliament, together with the appropriate constitutional mechanism for amendment
 the Constitution :
1. Parliament must now, without delay, drop its aforementioned decision, even if it is essentially null and void even if it does not, it is a non-existent decision.
 Constitutional. However, the correction of the decision is better for the parliament in front of the people to proceed in breach; Parliament has resorted to this only in response to the demands of the masses, how can proceed with the reform of the constitutional violation !!
2. I then propose that the Iraqi safety valve, the Supreme Religious Reference, be put forward on the composition of what it called the Committee of Experts. The unavoidable condition is that the committee be from outside the parties and from independent personalities known for their outstanding legal, political and economic fields. And that this committee in turn split into two committees, the first to develop appropriate proposals for the amendment of the Constitution, and the second working to develop appropriate mechanisms to achieve reform, at various levels, political, economic and other. To benefit from the work of the Constitutional Amendment Committee referred to above. 
3. After the Commission's constitutional amendment committee has completed its work, which should be determined with a known time limit, its proposals are presented to the Chamber of Deputies. 
Here, these proposals are dealt with in accordance with Article 126 of the Constitution. 
Needless to say, this article does not have a time limit, which is that the amendments must be resolved within four months, 
Also, this article does not include the substantive restriction, which is that two-thirds of the voters in three or more governorates should not object, which are the two restrictions mentioned in the ended Article (142). This is to say that the invalid parliament's decision based on Article (142) may be due to lack of know-how; this is possible, and may be premeditated premeditated; they want to make the amendment pending the condition of not objecting three or more provinces, while the The origin of the amendment of the Constitution - whether at the level of the Iraqi Constitution or international constitutions - to be pending the approval of the general public, not the provinces, and article (142) was only an exception to the original, and for a limited period; The exception is not extended, nor measured. In general, Article (126) defines the mechanism of amendment, and has drawn two tracks, namely:
 
Track 1:
Submit a joint request for the amendment proposal from the President of the Republic and the Prime Minister, after the latter receives the approval of the Council of Ministers.
 
Track II:
In this regard, the proposals of the Committee of Experts on the amendment of the Constitution may be adopted through either of these tracks; The next steps are followed by the following:
After submitting a proposal to amend the constitution according to the aforementioned mechanism to be voted in the House of Representatives, if approved by two-thirds of its members, it is submitted to the people through the constitutional referendum.
 In the past, the recourse to Article (142) of the Constitution is a constitutional breach and an invalid order that has no effect, and there is no way to amend the Constitution except the way of Article (126). In this regard, we have proposed that the Committee of Experts on Amendment develop the appropriate proposals for this amendment, and then adopted by the Presidents of the Republic and the ministers or one-fifth of the members of the House of Representatives, and then voted on in the House,
