Baghdad / News

Iraqi political forces are seeking substantial amendments to the constitution after a wave of popular protests in the country on October 1.

The Iraqi constitution was drafted during the US occupation of Iraq, voted in a referendum in October 2005, and came into force in 2006.

In order to amend the constitution, the proposals must have an absolute majority of members of parliament, a majority of voters in a referendum, and not be rejected by two thirds of voters in three or more provinces.

President Barham Saleh revealed his intention to hold a national conference to reconsider the constitution and its paragraphs, stressing that there is a real problem in the electoral law that requires finding appropriate solutions to it.

The Presidential Advisor for Legal Affairs, Amir al-Kanani, said that "the presidency can not make constitutional amendments, except through a national conference," indicating the President's endeavor to open dialogue with political and community forces and academic figures, in addition to the importance of the opinion of the religious authority, to review The most important material that is usually the obstacle in building the state. "

Al-Kinani said in a statement quoted by the official Iraqi News Agency that "the dialogue will discuss the system of government, whether parliamentary or presidential is the best, and the relationship between the Center and the region for wealth, and how to distribute, especially oil, as well as discuss the powers of the provinces, and what the powers of the Center, and the issue of councils Provinces, and the election of the governor directly by the people or will be through the provincial council according to the current mechanism. "

He added that "these amendments need a period of time up to months for the lack of ease mechanisms to amend the Constitution, and the President of the Republic is determined to amend some paragraphs," pointing out that "the President adopted other topics concerning the independent bodies referred to by the Constitution."

For his part, said the leader of the current wisdom, Ammar al-Hakim, in a tweet on the "Twitter" that "Constitutions do not write to immortal but write to amend and develop, and the amendment of the Iraqi Constitution and the popular referendum is a fundamental reform demand."

In turn, the leader of the "Asaib Ahl al-Haq," Qais Khazali, close to Tehran, in a tweet: "We support and support the President of the Republic to launch a national dialogue to amend the Constitution, demanding" elites and competencies, media and the middle class to interact with them. "

The leader of the Badr Organization, a member of the Iraqi parliament, Qasim al-Araji, said in a tweet is also: "In support of the trends of President Barham Saleh, yes, the Constitution needs amendments to suit the interests of the country and the people."

Araji said that the priorities for those amendments are to reduce the number of members of the House of Representatives in half.

In contrast, the Alliance for Reform and Reconstruction blamed Sunni and Kurdish forces for obstructing the movement to amend the constitution.

The coalition MP Jassim Bukhati said in press statements that "the Shiite blocs put forward and try to make an amendment to the Constitution during the current parliamentary session, but this demand clashes with the rejection of other components, which makes it very difficult."

He explained that "the amendment of the Constitution governs the position of members of the House of Representatives, and the latter can not agree to the amendment, which requires the transformation of the government to the presidential, because that needs to be sacrificed, and the political blocs are not ready to do so."

Dissolution in constitutional article 64

Monday, October 14, 2019 189

Dissolution in constitutional article 64

Mohammed Abdul Jabbar Carp

Iraq is in a severe crisis. I do not want to go into this argument, which was demonstrated by the October 1 uprising, which embodied total mistrust between the ruling political class and the general public.
To begin with, my readers will be able to say that I have been calling for change and reform since the formation of the Governing Council, which inaugurated a series of institutional defects and mistakes of practice that have been and continue to be the incubator of financial, political and administrative corruption.
There are two ways out of the crisis: the constitutional path and the revolutionary road.
The constitutional road adheres to the articles of the constitution and the democratic mechanisms that we have embarked upon. The revolutionary road goes beyond the constitution and the democratic mechanisms and seizes power through the popular revolution or coup.
Military.
Here I focus on saying that I am with the constitutional path as long as possible, if not possible, it must be a revolutionary path. I have no political node of the second solution if it is not possible
the first.
The starting point in the constitutional solution is the dismantling and sharing of the power-industry institution, namely the House of Representatives. The Constitution allows us to dissolve parliament legally, according to the operative part and article 64 of the Constitution, which says:
"First: The Council of Representatives shall be dissolved, by an absolute majority of its members, at the request of one third of its members, or at the request of the Prime Minister and with the consent of the President of the Republic."
If this is done, we proceed to the second step provided for in the same article:
Second: The President of the Republic, upon dissolution of the House of Representatives, shall call for general elections in the country within a maximum period of sixty days from the date of dissolution.
This means that the government becomes a caretaker government for a maximum of 60 days.
In the meantime, new parliamentary elections must be held. In order to achieve the purpose of these elections must be conducted by the method of individual election, and not by way of election on the list, and in as many circles as the number of deputies. The constitution provided for elections, and did not mention the method of elections on the list chosen by the political class to ensure the survival of its blocs in
 Parliament.
The Iraqi constitution allowed every Iraqi citizen to run for a seat in the House of Representatives. Article 49 / First of the Constitution that "is required in the candidate for membership of the House of Representatives to be a fully qualified Iraqi." It is clear that the constitutional text speaks of "individual candidate" and not "list of candidates." However, paragraph (III) of the said article, "Regulates by law, the conditions of the candidate and the voter and everything related
 Elections. "
The Electoral Law No. 45 of 2013, amended (twice), regulated the conditions of the candidate, the voter, and everything related to the elections. In the first article, the law introduced the definitions of terms related to elections as follows:
"Candidate: Any Iraqi whose nomination has been officially accepted by the Independent High Electoral Commission for membership of the Iraqi Council of Representatives.
Individual List: This is the list in which one individual is entitled to be nominated for elections provided that he is registered with the Commission.
Open List: This list contains the names of the declared candidates.
Constituency: Each designated area has been allocated a number of seats in accordance with the provisions of this law.
It is noted that the law added the concept of "open list" to the method of nomination, which is not mentioned in the Constitution.
In Article (12) the law said: "Nomination shall be by open list and the number of candidates therein shall not be less than three. The voter shall have the right to vote for the list or list and one of the candidates therein.
He notes that this article has made "open-list nomination" the basis, and authorized, with the exception of this basis, "individual nomination". The law did not address the individual nomination except for this position. The call for individual elections does not include more than amend this article to be as follows: "The nomination in the elections of the House of Representatives in an individual manner." With the deletion of the phrase “the candidacy shall be in an open list manner and the number of candidates therein shall not be less than three. And individual voting and counting.
If it is not possible to amend the law, the Electoral Commission may find a way to adopt the individual election. Politicians.

When it comes to kicking the can(s) down the road, delays, postponements, feeble & pathetic excuses& dishing out truckloads of bureaucratic verbal diarrhea and just plain good old fashioned :bs:; these people wrote the book - they own this.

Everyone inside and outside of Iraq sees this . . . whats galling is they ( GOI ) continue to push this transparent, ridiculous narrative expecting everyone to buy what these fools are selling.

Fingers crossed they make the final push over the finish line so we may realize the monetary gains we've waited for - SOON.

Baghdad - “Liberation squares”

The Iraqi National Project, led by Sheikh Jamal al-Dari, issued a special statement calling for a comprehensive national conference on amending the constitution. The following highlights were included:

%D8%A7%D9%84%D8%B4%D9%8A%D8%AE-%D8%AC%D9
* The Iraqi National Project supports the call of President Barham Saleh to reconsider the Constitution and with great interest to call on the President of the Republic on the convening of a comprehensive national conference to consider the current constitution and review the state system and the inter-relations between the authorities.
* The call to amend the constitution came as a deserved and appropriate reaction to the just popular demands expressed by the demonstrators and called for by the Iraqi national project since its establishment.
* Calling for a constitutional amendment is a key to all possible solutions in Iraq, centered on the structure and failure of the political process.
* Reviewing the constitution and possibly amending it or rewriting it cannot in turn regulate the same mistakes that were made at the time of writing.
* It is not permissible to make time and effort and jump on the expectations of our dear people and their dreams through the reproduction of crises.
* The future of the country cannot be mortgaged by the same forces that have tampered with its past, present and brought it to this difficult stage.
* Exclude all traditional political forces that contributed to the drafting of the current constitution from the review process.
* The presence of traditional political forces that contributed to the drafting of the current constitution will be a reason to question the feasibility of the entire process.
* The existence of traditional political forces that have contributed to the current constitution would be just a way to contain the people 's will and gain time for procrastination and rotation in the same circle of failure
* supports the Iraqi national project to invite His Excellency President Barham Saleh on reconsider the constitution by offering his vision of the topic in the following :
Forming a general secretariat include personalities from the academic competencies not affiliated to any party or political organization and no administrative office can hold the rank of director or above.
- The General Secretariat shall invite academic and legal competencies specialized in constitutions, regional, ethnic and tribal personalities and representatives of trade unions and popular committees to establish a comprehensive national conference.
- The General Secretariat shall manage the sessions and determine the agenda of the discussions and priorities and determine the relationship between the Secretariat and the popular and political forces from outside.
- Call on the United Nations, the European Union, the Arab League, international legal unions and civil society organizations to monitor and assist in the development of the constitutional amendment process.
- Open the door to social and factional discussions at home and abroad on all axes and issues related to the Constitution.
- All media shall grant special times or spaces for these discussions, provided that a special body in the management of the conference is concerned with following up the views of the public and conveying them to the General Secretariat.
- Introduce the first draft of the amendments to the broad discussions among Iraqis before returning to study within the conference.
