A legal expert confirmed the ruling of the Federal Supreme Court on the validity of Article (140) of the Constitution, pointing out that the time limits provided for in the Constitution include the obligation on the bodies responsible for the implementation of those articles, pointing out that the withdrawal of any text of the Constitution requires an amendment in accordance with mechanisms Official.

"The ruling issued by the Federal Supreme Court regarding the validity of Article (140) of the Constitution is true and binding on all authorities," said expert Mohammed Sharif, noting that "the abolition of any article of the Constitution requires an amendment in accordance with the mechanisms provided for in the Constitution itself."

He pointed out that "a number of questions are being asked about the ruling of the Federal Supreme Court on this article and the first time of the issuance of this ruling, and why the judicial decision coincided with the political movement between the federal government and the Kurdistan region."

Al-Sharif pointed out that the court did not issue its verdict on its own, but this came upon an explanatory request received from the House of Representatives dated (15/7/2019), and therefore became necessary for the judiciary to decide. He added that "the timing must be asked by the interpreter, although the right of access to justice is guaranteed to everyone in accordance with Article (19 / III) of the Constitution, at any time."

Al-Sharif added that "the court issued its interpretative judgment a few days after receiving the request after it completed its study of all formal and substantive aspects in order to issue the verdict in it, on (28/7/2019)." He stressed that "when the court issued the verdict was in accordance with Article (92 / second) of the Constitution, in accordance with its interpretative jurisdiction, which ruled in several judgments, including on the (age of the electoral cycle and the largest parliamentary bloc and the opposition bloc and the unity of Iraq and territorial integrity)."

Al-Sharif stated that "the explanatory request contained a clear inquiry which can be found in the form of provision numbered (71 / Federal / 2019), which is (kindly explain the text of article (140) of the Constitution as to whether it applies or not)." He stressed that "the explanatory request, the House of Representatives, limited his request to know whether this article is still in force or not ?, The court according to legal contexts are obliged to answer that question whenever the correct formal and substantive conditions for the request for interpretation and otherwise will put itself before the responsibility ( Refrain from fulfilling the right)."

Sharif said that "the pretext mentioned by the objectors in their criticism of the ruling of the Federal Supreme Court is the existence of a time limit in Article (140) of the Constitution, is (31/12/2007) a maximum to implement." He added that "resolving the issue requires a return to the philosophy of the existence of time limits in the constitutional articles, is that exceeding them is the birthplace of those articles."

Sharif pointed out that "the examination of article (140) of the Constitution paragraphs (first and second) shows that it begins with the words (the executive takes steps) ... and ends with the words (not later than the thirty-first of December in the year two thousand and seven)." He continued, "This period, as stated in the constitutional text, imposes an obligation on the executive authority to accomplish its task during that period and not to drop the article, that is, if the executive authority lags in the completion of this constitutional task will be subject to accountability in accordance with the mechanisms provided for in the Constitution."

Sharif stressed that "dropping an article in the Constitution means that we are making an amendment to it, and this amendment can be obtained only through the mechanisms provided for in the Constitution itself." He pointed out that "the constitutional legislator, if he wanted to exclude Article (140) of the Constitution from the rules of amendment of the Constitution stipulated in its articles, to mention it explicitly, as his intention was clear that this period was designed to oblige the executive authority to a certain task, and that skipping it will make it accountable ".

The question was about the expiration date of 12/31/2007 for implementation as stated in Art. 140 and 

the court said it would require a constitutional amendment to change or do away with Art. 140.

I think this is a good thing for sure. And interesting timing. 

We know the profit sharing portion of HCL has already been addressed. 

As usual it seems to be all about the implementation with Iraq.  

Art. 140 was good to go 12 years ago...

The Executive Director of the Iraqi market for securities Taha Ahmed Abdul Salam need to expand the establishment of joint stock companies.

Abdul Salam said that this trend leads to the advancement of the Iraqi economy, through the expansion of investments and employment of efficiencies, pointing to the need to be the contribution of local companies in the GDP is high and close to the global ratios ranging between 40-70 percent. 

He pointed out that the number of joint-stock companies in Iraq must touch the 500 companies, in an economy of this size and trade exchanges and its natural wealth and human resources. 

Abdul Salam warned that investing in stocks and bonds supports the national economy and the economy of the family and achieve benefits that raise the standard of living.

During the past fifty years, Iraq has experienced significant economic fluctuations that could have been positively invested if the means and tools for advancement were available at that stage.

The discovery of oil early and in large quantities and the increasing global demand for it and high prices and the decision of nationalization were great opportunities were not invested properly by the Iraqi state, which reflected negatively on the political, economic and social reality.  Perhaps one of the most important reasons for the loss of these opportunities is not to build solid institutions for the development of investments properly, which led to the Iraqi economy has become a distorted present.

The important question in this regard, is to remedy it.  In my opinion, yes, it is possible to rectify the issue, but we need to be accurate in diagnosing the imbalance and courage in proposing the solution.

In a previous article, we personally and beyond any doubt, that the depth of the problems of Iraq is of an economic dimension, and stressed that abstract political solutions alone will not lift Iraq from its inaction, and according to this diagnosiswe must begin with solutions with an economic dimension. 

After a large study of the situation of countries near Iraq, which had successful economic experiences, we found that the best step towards the predominance of economic solutions must begin with the establishment of a national sovereign and central followed by the establishment of a number of investment funds specialized development.

Without a sovereign fund to accumulate cash surpluses and channel them into sustainable development sectors, all other measures would be an absurd increase.

The first measure: begins with the formation of a higher committee whose task is to study the best international experiences in this area and what are the best legislation that organized those experiences.

A federal law is then enacted to create a national sovereign fund, followed by the establishment of a number of development investment funds with a clear development plan that includes the objectives and sectors to be promoted.

When reviewing the experiences of the countries that founded investment funds was not better than the case of Iraq at the moment of the establishment of those funds, but we will find that the difference has become a big difference between the reality of Iraq now and the reality of those countries.

Announced the spokesman for the Kurdistan Regional Government, Gutiar Adel, on Monday, the willingness of the region to deposit the price of 250 thousand barrels of oil per day with Baghdad, as agreed previously. 

Adel said in a press conference in Erbil, "The share of the Kurdistan region of the financial budget 12.84 trillion dinars, but Baghdad has not sent to Kurdistan since the adoption of the budget only 5.44 trillion dinars and therefore is cut 7.39 trillion dinars."  He added, "The amounts that are deducted from the province's financial share more than the price of 250 thousand barrels, which should be sent by the regional government to Baghdad on a daily basis in accordance with an earlier agreement." 

Adel pointed out, "The Kurdistan government demanded the federal government to address this matter while stressing that there is an understanding of this problem by Baghdad," stressing the readiness of the Kurdistan region to deposit oil amounts equivalent to the sale of 250 thousand barrels of oil to Baghdad. He pointed out that "there are efforts by the regional and federal governments to resolve the problem of disputed areas where a committee has been formed in this regard," pointing out that "the Kurdistan Regional Government stresses that any solution based on the provisions of the Iraqi constitution."

The spokesman for the Kurdistan Regional Government, on Monday evening, that the Iraqi government deducts from the share of the region of the federal budget, far more than the value of 250 thousand barrels per day of Kurdistan's oil.

"The Kurdistan Region's share of the federal budget is 12.84 trillion dinars, but Baghdad sent only 5.44 trillion dinars to the region within a year," said Gutiar Adel at a news conference attended by a reporter (Pasnews).

Adel explained that «this amount deducted from the region's share of the federal budget far exceeds the value of the sale of 250 thousand barrels of Kurdistan oil per day».

The spokesman for the Kurdistan Regional Government, the region is nevertheless ready to deliver that amount of oil to the Iraqi government.

Adel pointed out that the Iraqi government deducts annually 7.39 trillion dinars from the region's share of the federal budget annually, pointing out that Baghdad has been approached in this regard, hoping to reach a fair agreement on this subject.
