Kurdistan Alliance MP Fian Sabri confirmed on Friday that the Kurdish delegation will complete the ongoing talks to solve the outstanding problems between the Center and the region.

Sabri said in an interview with "Covenant" that Article 140 and the budget and the oil file are the most important files that will be discussed by the two sides in the negotiations.

She pointed out that there are major challenges need to atmosphere of reconciliation among the Iraqi political parties in order to overcome, noting that the committees formed to seek to resolve outstanding issues in accordance with the Constitution and understandings agreed between the parties.

She added that the 2020 budget will be a budget for projects and performance, including the development of the sectors of agriculture, tourism and human resources.

A legal expert confirmed the ruling of the Federal Supreme Court on the validity of Article (140) of the Constitution, pointing out that the time limits provided for in the Constitution include the obligation on the bodies responsible for the implementation of those articles, pointing out that the withdrawal of any text of the Constitution requires an amendment in accordance with mechanisms Official.

"The ruling issued by the Federal Supreme Court regarding the validity of Article (140) of the Constitution is true and binding on all authorities," said expert Mohammed Sharif, noting that "the abolition of any article of the Constitution requires an amendment in accordance with the mechanisms provided for in the Constitution itself."

He pointed out that "a number of questions are being asked about the ruling of the Federal Supreme Court on this article and the first time of the issuance of this ruling, and why the judicial decision coincided with the political movement between the federal government and the Kurdistan region."

Al-Sharif pointed out that the court did not issue its verdict on its own, but this came upon an explanatory request received from the House of Representatives dated (15/7/2019), and therefore became necessary for the judiciary to decide. He added that "the timing must be asked by the interpreter, although the right of access to justice is guaranteed to everyone in accordance with Article (19 / III) of the Constitution, at any time."

Al-Sharif added that "the court issued its interpretative judgment a few days after receiving the request after it completed its study of all formal and substantive aspects in order to issue the verdict in it, on (28/7/2019)." He stressed that "when the court issued the verdict was in accordance with Article (92 / second) of the Constitution, in accordance with its interpretative jurisdiction, which ruled in several judgments, including on the (age of the electoral cycle and the largest parliamentary bloc and the opposition bloc and the unity of Iraq and territorial integrity)."

Al-Sharif stated that "the explanatory request contained a clear inquiry which can be found in the form of provision numbered (71 / Federal / 2019), which is (kindly explain the text of article (140) of the Constitution as to whether it applies or not)." He stressed that "the explanatory request, the House of Representatives, limited his request to know whether this article is still in force or not ?, The court according to legal contexts are obliged to answer that question whenever the correct formal and substantive conditions for the request for interpretation and otherwise will put itself before the responsibility ( Refrain from fulfilling the right)."

Sharif said that "the pretext mentioned by the objectors in their criticism of the ruling of the Federal Supreme Court is the existence of a time limit in Article (140) of the Constitution, is (31/12/2007) a maximum to implement." He added that "resolving the issue requires a return to the philosophy of the existence of time limits in the constitutional articles, is that exceeding them is the birthplace of those articles."

Sharif pointed out that "the examination of article (140) of the Constitution paragraphs (first and second) shows that it begins with the words (the executive takes steps) ... and ends with the words (not later than the thirty-first of December in the year two thousand and seven)." He continued, "This period, as stated in the constitutional text, imposes an obligation on the executive authority to accomplish its task during that period and not to drop the article, that is, if the executive authority lags in the completion of this constitutional task will be subject to accountability in accordance with the mechanisms provided for in the Constitution."

Sharif stressed that "dropping an article in the Constitution means that we are making an amendment to it, and this amendment can be obtained only through the mechanisms provided for in the Constitution itself." He pointed out that "the constitutional legislator, if he wanted to exclude Article (140) of the Constitution from the rules of amendment of the Constitution stipulated in its articles, to mention it explicitly, as his intention was clear that this period was designed to oblige the executive authority to a certain task, and that skipping it will make it accountable ".

Al-Sharif stated that "the position of the Federal Supreme Court on this matter is not the first of its kind, but it went in the same position in the interpretation of Article (142) of the Constitution by virtue of the number (54 / Federal / 2017) issued on 21/5/2017 on the mechanisms to amend the Constitution". He added that "Article (142), which was also included in the transitional provisions and provided for time limits for the amendments, but the court said in its interpretative ruling that that article is still in force as well."

Sharif added that "the same position with regard to Article (137) of the Constitution, which talked about the formation of the Council of the Union (the second wing of the legislative authority), after the end of the first electoral cycle for the years (2006-2010), but the Federal Supreme Court in many of its judgments on the formation of this Council even though we are in the fourth electoral cycle now. " He pointed out that "the summary of the above shows us that exceeding constitutional provisions is not intended to drop its articles as this requires an amendment in accordance with the mechanisms provided for in the Constitution itself, but to determine the responsibility of the body responsible for its implementation and if exceeded are held accountable in accordance with the constitutional contexts of the concerned authorities."

The market economy is based on the ownership of the means of production of individuals and the right to practice economic activity directly, unconditionally only contrary to the public interest, in order to achieve profits and that the price (the market) is the guarantor to determine the size and efficiency of production, and this does not mean there are no problems With the intent or accompaniment of a market economy it can contribute to its failure. Thus, getting rid of these failures is a guarantee for the success of a market economy, but getting rid of these failures is very difficult.

The most prominent of these failures are the lack of competition, public goods, side effects (external) and economic stability that encourage or discourage the market economy, and can be addressed as follows:

Lack of competition

Competition is inherent to the market economy. Whenever there is a market economy there is competition, but the problem of lack of this competition and incomplete, which contribute to the failure of the market. Some production with minimal resources, which contributes to the absence of the optimal allocation of resources and the recent waste, which exacerbates the economic problem!

The monopoly contributes to the valuation of products at a price that is far from their due to the fact that producers are the minority and can control prices according to their own interests.

However, under the full prevalence of competition (full competition), which is represented by a large number of producers and buyers, freedom of entry and exit to and from the market, homogeneity of quantities and qualities produced by producers, and information available to producers and consumers on market conditions, optimal resource allocation will be achieved and waste will be eliminated. Resources and market distortions, as producers compete among themselves for profit, they are forced to minimize production costs and raise product efficiency.

General goods

There are some commodities that the private sector does not invest in for many technical, ethical and economic reasons. [1] For example, the nature of security is indivisible and cannot be measured by the extent to which the individual benefits from it, and therefore must be saturated collectively and cannot be dispensed with, in addition to its technical nature. The moral reason is not worthy of putting them at the mercy of the private sector and bargaining them, for example, bargaining in security.There are some commodities of a technical nature that allow to know the extent of the benefit of the individual, but it requires monitoring and alimony, which makes it economically useless, it would be better to provide free of charge by the state.

The nature of these commodities does not allow to know the extent of the individual benefit from them and can not be excluded from consumption because it did not pay the price of benefiting from them, and this reduces the incentive of investors to turn to them, so they remain without the satisfaction of the private sector and here requires the entry of the state to satisfy them.

When the private sector is engaged in its economic activity, there will be some side effects that can not be measured so that they can bear their costs or benefits. These effects are positive and sometimes negative. By producing scientific theories, society will benefit from them without any financial return for all who benefited from the aesthetics of the region and scientific theories, that is, it will be part of the benefit of society at the expense of producers, and this is known as positive side effects.

Economic instability

It is well known that economic stability is one of the important factors for the smooth functioning of economic activity, and vice versa.

The main indicators of economic stability are unemployment and inflation. The first is often a result, but the second can be a reason given that inflation is based on the depreciation of the value of money. The ideas of this article are based on a vision that the country's money and wealth belong to its own people. The Constitution approved this for oil and gas in Article (111), which says: "Oil and gas is the property of all the Iraqi people in all regions and provinces."

It is the duty of the state, among other things, to ensure the equitable distribution of wealth in society, and this is achieved through two basic mechanisms: work and need. On the basis of the work done by the citizen, he gets his share of public money. Therefore, the State strives to ensure that its employees or in the private sector receive fair, equitable and decent wages. It is this that called me to make great efforts to improve the conditions of workers in the Iraqi media network by increasing their salaries, and the same thing I did with artists and others in the many dramas produced by the network when I was president. Some have criticized me for the comfortable wages we paid to artists. My answer was that these are Iraqi citizens and this is one way to get a decent share of the wealth of their country through the art work they do for the network.

This is for those who are able to work, but for those who are unable for various reasons, they get their share of their country's wealth through the social protection network or social security.

The state should also address the situation of those suffering "natural inequality." They are suffering from poverty and destitution for reasons beyond their means completely, while others enjoy the joys of life for reasons beyond their direct efforts. The Koran showed how to address this situation through the principle: "Those who have in their money a known right of the liquid and deprived."

The second mechanism is to determine the share of the citizen of the public wealth, in light of the actual need to enjoy a decent life. A decent life may be a relative term that varies from one society to another, but in the present era, the outline or minimum has become known and shared. The need may arise because of the inability of the citizen to work at all, or because of his insufficient work to meet the needs of goods and services required by a minimum of decent life. In this case, the society, directly or through the state, to fill the needy needy, not out of charity and security, but out of the right of social solidarity.

The state can devise various ways to help those in need. One of these methods is easy lending to these citizens. The needy citizen expects to receive a small loan from the state on concessional terms and nominal interest. This is the case in many countries.

These days, government banks are announcing small loans to citizens working in the public sector and nationalizing their salaries in the banks that provide the loan. But I noticed that these banks carry a small loan with an interest rate of 40%, under the pretext of easy repayment on a monthly basis. Anyone who borrows 10 million dinars, for example, to buy a taxi to work on, will pay the state about 14 million dinars. This is undoubtedly a large sum and a heavy burden on a low-income citizen. The state would not have made such a move. This is "a door in which he has mercy and his appearance by His torment." I know many of the citizens who reluctantly accepted this heavy load because their need for little money is great, and the state simply and clearly exploit this need obscene, and contrary to the right of the public money when it needs it.

In this context, it is possible to understand the ferocious trade, monetary and technical wars that Washington has been waging with China and with many countries in the world since President Trump's rise to power. As well as his attack on the United Nations, which reduced the volume of US funding for many of its development and humanitarian programs.

President Trump, according to his stated policies, does not want to deal with economic or political blocs, whether friendly or unfriendly, but seeks to renegotiate with each country individually, so that he can exploit the size of the huge US economy estimated at $ 20 trillion and the size of the market consumption of 11 Trillion dollars and the influence of the dollar in kneeling States and dictate its terms without discussion or argument.

 

As for the war on the Chinese yuan in the context of the multi-purpose trade war, President Trump does not like Chinese President Xi Jinping's plans to internationalize the yuan, that is, he is disturbed by the trade expansion of China through the strategy of "belt and road" and seeks to block the way to build a Chinese commercial space . Parliament Speaker Khadija Ali announced on Sunday that Prime Minister Adel Count Al-Mahdi has authorized the Education Committee to choose the candidate of the Ministry of Education, indicating that the committee is determined to be a woman and a Nineveh.

Ali told Al-Maalouma that “Prime Minister Adel Abdul Mahdi has sent an official letter to the Parliamentary Education Committee to authorize her to choose a candidate for the Ministry of Education to meet the professional requirements.”

She added that "the Education Committee insists that the candidate is a woman because the cabinet cab is free of any representation of the feminist element," pointing out that "the candidate will be from the people of Nineveh."

She explained that "the Commission is obliged to choose a candidate to meet the acceptance of all political blocs to ensure the passage of its name within the House of Representatives when put to gain confidence."

The talks between the federal government and the Kurdistan Regional Government (KRG) are scheduled to resume this weekend, with several committees set up for this purpose. 

 

According to the information, "the Kurdistan Regional Government identified its members in the legal and technical committees concerned with the negotiation with the federal government, and completed preparations to visit Baghdad this week for a dialogue on the settlement of differences between the two sides."  "A delegation from the Kurdistan region is scheduled to visit Baghdad this week," said Faris Issa, head of the Kurdistan Regional Government (KRG) in Baghdad. 

During the previous meetings between Baghdad and Erbil, it was decided to form two committees, one legal and the other technical to negotiate between the two sides, and is scheduled to hold the first round of talks in Baghdad.

"The legislative recess of the House of Representatives is scheduled to begin on the third of July, but the Council extended its term expired for a month," Ali said.

She added that "the legislative holiday ends on the third of next September and the Council reconvenes for the new legislative term." "The presidency will call for the convening of the council in the absence of anything new on the third of September next."

Economic expert Jassim Mohammed, on Sunday, that the draft federal budget law for 2020 will turn the country into an open market for international capital.

Mohammed said in a statement to the information, that "the government will make an economic mistake in the budget of 2020 being a similar version of the budgets of previous years, as it was allocated for investment only 2%, in addition to the absence of development," pointing out that "the budget is no longer in the hands of competent and this matter Negatively affects its financial estimates.”

He added that "the government's fiscal policy in the preparation of federal budgets will turn the country to an open market for international capital," noting that "the preparation of the budget needs specialists to avoid recurring financial errors."

The parliamentary strategic planning committee, on Wednesday, attributed the high deficit of federal budgets to the absence of planning experts and the economy in the numbers of budgets, while showing that the surplus and deficit is estimated and away from reality.

Earlier, the Parliamentary Finance Committee revealed a large deficit in the budget of 2020 to reach 72 trillion dinars, after a year characterized by prosperity was a deficit of 27 trillion guesses compared to what is expected next year.

Hamed Younis said in a statement to the ministry on Saturday that gasoline production has witnessed a daily increase of more than three million liters per day of this article, was added to the production last year, bringing the daily rate to 14 million and 293 thousand liters per day, after the production of the year The past is about 11 million and 485 thousand liters per day .

He added that the production of fuel oil gas (kerosene) has also witnessed a remarkable increase, which increased by nearly (4 million liters per day) compared to last year's production rates, thus increasing to 11 million and 228 thousand liters per day, after the rate of production last year approaching 7 million and 836 thousand Lt per day .

The Undersecretary for liquidation affairs, said that this increase was the result of the ministry's plans to increase the production capacity of Iraqi refineries through the addition of new production units in refineries south and central, as well as the reconstruction and rehabilitation of a number of refineries that have been sabotaged and destroyed in our dear northern provinces by Terrorist gangs, including the Al-Samoud refinery in Baiji .

For his part, ministry spokesman Assem Jihad said that this increase contributes to cover a large part of the local need for citizens and the electricity sector as well as reduce the import rates of petroleum products from fuel (gasoline) and (gas oil), which provides hard currency for the federal treasury .

Jihad added that the liquidation sector is currently witnessing a gradual and steady growth after years of security and economic challenges have directly affected the plans of the ministry.

He pointed out that the ministry succeeded in exporting surplus liquid gas and condensate to global markets after meeting the local need of them .

They are so ready to be like Westerners it’s not even funny. This country has been so beaten down by tyrannical rule for so long they will explode in a good way with international investment and a currency that has some buying power. Iran is ready to get rid of the Mullah’s leadership too.  It’s just a shame that all that oil revenue is wasted when people are starving and without basic services.
