yota691
Between the objections of Baghdad and the differences of Kurdish forces .. Kurdistan is preparing for a new "referendum" 2019-09-11 Although the parliamentary systems require the establishment of a constitution for each region, the # constitution of the Kurdistan Region is still not a draft, due to political differences within the internal forces in the region, in addition to the lack of understanding with Baghdad on the status of the areas covered by Article 140 of the Constitution Iraqi or what you know (disputed areas). The Kurdish opposition parties object to the powers granted to the president of the region and the prime minister, and stresses that there is overlapping powers between the three legislative, executive and judicial authorities. When will the Constitution of Kurdistan see the light? Media adviser to the Kurdistan Regional Parliament, # Tariq Jawhar , confirmed that the Constitution was supposed to be adopted during the last parliamentary session, but several reasons prevented it. Jawhar explained to the solution Iraq, that «the war on ISIS and the political crisis with Baghdad in addition to disrupting the parliament of the region, prevented the adoption of the # Kurdistan Constitution during the previous parliamentary session». He pointed out that «the presidency of the Parliament of the Territory held several meetings during the current session with political leaders and government leaders from various quarters, to take their opinion and political agreement before the formation of # Constitutional_Drafting Committee within the parliament». He added that «this constitution will be competent to regulate matters and determine the powers within the Kurdistan region, and await the resolution of the status of the # disputed areas _ because they are areas of Kurdistan, to be included in the referendum on voting on the Constitution». He pointed out that «the Constitution of Kurdistan will not conflict with the federal constitution at all, and will be competent to internal issues, while the sovereign issues are provided for within the Iraqi Constitution». He pointed out that «Parliament during the next few years, will form a permanent committee to draft the constitution as a first step, in preparation for the referendum that will be held in the current session because the political atmosphere is fully prepared for this step». Does Baghdad allow the province to take this step? Legal expert Ali al-Tamimi, said: «# federal system allows each region to create its own constitution governing internal affairs and determine the powers». Al-Tamimi confirmed to the reporter "Solution Iraq" that «Baghdad can not object to the establishment of the Constitution in the Kurdistan region, provided that it does not conflict with the original, which is the Iraqi Constitution in all articles and paragraphs». He added that «the Constitution of the region must adopt # parliamentary system , and divides the powers between the authorities on the basis of what is contained in the Iraqi constitution, and presented to a competent committee of the Iraqi parliament, if it is not not incompatible with the original constitution is not problematic and will go towards a referendum within the region» . Iraqi parliament expresses objection While the law and the Iraqi constitution affirm the right of the Kurdistan region to establish its own constitution, members of the Council of Representatives object to some paragraphs in that constitution. The MP in the Iraqi parliament, Nada Shaker Jawdat, told the solution to Iraq: The «Constitution of the region to be established if it is in accordance with the law and does not conflict with the Constitution of the mother, which is the Federal Constitution is not harmful». He pointed out that «there is a fear that the vote on the establishment of the Constitution, another prelude to secession from Iraq, but if it is just to determine the powers and the organization of things do not object to it». She pointed out that «the constitution of the region, must adhere to the provinces of Kurdistan, and the disputed areas can not talk or refer to the paragraphs of the Constitution at all, because it may cause a new crisis similar to that occurred during the # referendum # separation from Iraq». Why do some Kurdish forces object to the draft constitution? Leader of the # movement -altgier # Mahmod_heik_wahab , confirms the solution for Iraq, that « the draft constitution which was prepared in 2009, we have a lot of observations and objections». He pointed out that «the most prominent objections is that the draft granted wide powers to the President of the Kurdistan region, and this is contrary to the Iraqi Constitution, which depends on the parliamentary system of governance, and secondly, the Constitution may allow uniqueness of decisions within the region». He added that «the draft is also full of many contradictory paragraphs and materials that need to be interpreted, which is similar to the Iraqi constitution, which was written on hastily, and that draft should be carefully scrutinized and reviewed». He added that «should be the use of experts in Iraqi law, and in other competencies, financial, military and other, so that the draft is mature can not be rejected by the people, if put to a vote referendum». He said that «the general political atmosphere seems appropriate in the event was taken notes on the political system, which should be the powers of the Prime Minister and the ministers greater than the powers of the President of the region, provided that all return to Parliament». 6ly410
Financial dispute again and invoke the text of the law https://www.mustaqila.com/الخلاف-المالي-مجددا-والاحتكام-لنص-الق/ 11/09/2019 Read the content of Article 10 in the Federal Budget Law of Iraq 2019 Dr.. Haider Hussein Al Tohmeh Al - Furat Center for Development and Strategic Studies The relationship between the Center and the region has seen many points of contention since the formation of modern Iraqi governments after 2003 and until the present time. Topics of the independence of Kurdistan and the province of Kirkuk and the oil wealth of the political scene for years, has achieved amazing gains due to the division of political parties on the one hand and political savvy in the exploitation of weaknesses existing in the management of the state on the other. There is a relative stalemate in the subject of Kirkuk and the independence of the Kurds (especially after the failure of the referendum of the region at the end of September 2017 to achieve the Kurdish dream). However, the file of oil and energy and the region's share of the general budget is still the subject of renewed conflict between the federal government and the Kurdistan Regional Government and is raised annually when voting on the budget and also implementation. The federal budget of the Government of Iraq in 2019 dealt with the ongoing dispute between the Center and the region on the issue of oil exports through the text of Article (10) in the Federal Budget Law for 2019 and published in the Gazette No. 4529 on 11/2/2019. Which is presented as follows: Article 10: First: Settlement of dues between the Kurdistan Region and the Federal Government for the years 2004 to 2018 after being audited by the Federal Financial Supervision Bureau by calculating the share of the Kurdistan Region in the light of the actual expenses of previous years shown by the final accounts approved by the Federal Financial Supervision Bureau. Second: The Kurdistan Regional Government is committed to exporting at least 2,500,000 barrels (two hundred and fifty thousand barrels) of crude oil a day from crude oil produced from its fields to be marketed through SOMO and provided that the oil revenues shall be delivered to the State Treasury. B - Allocate a percentage of the allocations of federal forces to the Iraqi army to the salaries of the Peshmerga forces to the said forces as part of the Iraqi security system. (C) The Federal Government shall pay the dues of the Kurdistan Region, including compensation for the employees of the Region, and shall deduct the amount of the damage from the share of the Region in the event that it is not delivered to the prescribed share of oil in item (a). (D) The Federal Government and the governorates of the Kurdistan Region shall, upon an increase in the exported quantities mentioned in Article (1-I-B) of the Budget Law, commit to deliver the revenues actually earned to the State Treasury. Despite the existence of an agreement between the House of Representatives and Prime Minister Adel Abdul Mahdi to deduct the share of Kurdistan in the budget in the event did not commit the region to pay for the imports of Kurdistan oil. However, the federal government did not deduct anything from the share of the region until the month of August, although the region did not send oil export amounts since the first of December last until now, note that the Kurdistan government exported nearly 480 thousand barrels per day and not 250 thousand, according to the latest statement by the Minister of Oil Iraqi Thamer Ghadban. Who is responsible for violating the General Budget Law? Existing violations of the text of Article (10) of the Federal Budget Law of 2019 in force are concentrated with a number of points, most notably: Violation of the Kurdistan Region to the text of article (10 / second / a) in the federal budget law for 2019, which is not to deliver the sumo company agreed quota of 250 thousand barrels per day. Violation of the Kurdistan Region to the text of article (10 / second / d) in the federal budget law for the year 2019 in force, which obliges the federal government and the provinces of the Kurdistan Region when there is an increase in the exported quantities mentioned in Article (1-I-B) of the budget law to deliver the revenues actually earned to the account State Treasury. The increase is already achieved, according to the Federal Oil Minister. Violation of the Federal Minister of Finance Fouad Hussein to the text of Article (10 / second / c) in the federal budget law for the year 2019, which is deducted the amount of damage resulting from the failure of the Kurdistan region to deliver (250,000 barrels per day) of the region's share in the budget for the year 2019 So. 1

(Photo: KRG president's office) Kurdistan KRG Iraq Economy A+AA- ERBIL (Kurdistan 24) – Discussions of how to boost foreign investment and private sector job opportunities led a meeting on Thursday between President of the Kurdistan Region Nichervan Barzani and Nouri Sabah al-Dulaimi, Iraq’s planning minister. In the meeting, which took place in the Kurdistan Region's capital of Erbil, Barzani and Dulaimi both stressed the necessity of initiatives that would spur growth in the economies of Iraq and the Kurdistan Region, according to a statement released afterward by the Kurdistan Regional Government (KRG). Both stressed “careful planning, better policies, and reorganizing economic administration for a better and more developed fiscal future.” They also addressed preparations for the national census, set to take place in 2020, saying that “Cooperation and coordination between the federal government, the KRG, and the international community in the process,” was essential. The meeting concluded with a discussion on Iraq’s 2020 budget bill and the process of rebuilding areas damaged as a result of the past takeover by, and conflict with, fighters of the Islamic State. The KRG and the federal government of Iraq have multiple longstanding and often seemingly insurmountable disagreements related to the budget, oil and gas, and the nation's disputed territories. Ties between Erbil and Baghdad were strained considerably in late 2017 following the Kurdistan Region’s independence referendum, which saw a landslide majority favoring statehood. Following the formation of the new Iraqi government led by Prime Minister Adil Abdul Mahdi in late 2018, relations between them have improved significantly. 1

Speaking to reporters on Saturday, Minister Thamir Ghadhban said Erbil and Baghdad continue negotiating on the submission of 250,000 barrels of oil daily by the former to Baghdad. He said they expect the talks to reach a conclusion in the near future, which would most likely have an impact on the 2020’s budget bill. According to the minister, Iraq has set the price for a barrel of crude at $50 in the budget bill for the next year.
