Michael Cohen admitted to lying in part of his guilty plea during a March 25 phone call with actor, comedian and vocal Trump critic Tom Arnold.

Trump's former fixer told Arnold, who was recording the phone call without Cohen's knowledge, that he only admitted to the five counts of tax fraud because prosecutors were targeting his wife and he wanted to protect her.

'I love this woman, and I am not going to let her get dragged into the mud of this crap,' Cohen said on the tapes, according to The Wall Street Journal. 'And I never thought the judge was going to throw a three-year fricking sentence.'

Prosecutors wrote in a court filing that some of the $2.4 million in interest payments from loans that Cohen did not disclose to the Internal Revenue Service were deposited in an account under his wife's name.

'There is no tax evasion,' he said on the call. 'And the Heloc (home equity line of credit)? I have an 18% loan-to-value on my home. How could there be a Heloc issue? How? Right?…It's a lie.'

 

Cohen’s attorney Lanny Davis said that the conversations between Davis and his client did not go against what he said in his sentencing memorandum.

“Nothing said by Mr. Cohen to Tom Arnold contradicts Mr. Cohen’s previous defense attorney, Guy Petrillo, in his sentencing memorandum to the presiding federal US District Court Judge William H. Pauley III back in December,” Davis said in a statement Wednesday in response to the WSJ article.

“I would also add the important words used by Special Counsel Robert Mueller, and others, in describing Michael Cohen’s cooperation and testimony as “credible” addressing the “core” issues involved in his investigation,” Davis continued.

Cohen will report to prison on May 6 to begin serving his three-year sentence, but since his sentencing hearing in December has been working with congressional investigations into President Donald Trump's campaign and administration to try and reduce his sentence.

He pleaded guilty to eight criminal charges, including campaign finance violations in dishing out hush-money payments to porn star Stormy Daniels and former Playboy model Karen McDougal in exchange for them keeping quiet about their affairs with Trump ahead of the presidential election.

The charges included five counts of tax fraud, one count of making false statements to financial institutions, one count of making unlawful corporate contributions, and one count of making excessive campaign contributions. 

'You would think that you would have folks, you know, stepping up and saying, 'You know what, this guy's lost everything,' Cohen told Arnold on the recorded call. 'My family's happiness, and my law license. I lost my business…my insurance, my bank accounts, all for what? All for what? Because Trump, you know, had an affair with a porn star? That's really what this is about.'

Arnold, who initially made contact with Cohen back in June, said he made the March phone call to give Cohen moral support, and said that he 'tapes everything and I wanted to remember what we talked about.'

 

Cohen's lawyers attempted earlier in April to get their client's sentence delayed for a second time, claiming it would take time to go through a 'substantial trove of new information' and files found recently. They claim this would assist in his cooperation with Congress in its investigations.

He was already granted a delay by a federal judge in February. Cohen was supposed to report to prison on March 6, but will report a full two month later.

The excuse for the initial delay was to allow Cohen to recover from a recent surgery and give him time to prepare to testify before congressional committees.
