The Supreme Judicial Council (SJC) Judge Abdul Sattar Birekdar announced Monday that the judiciary has directed judges in cooperation with the competent authorities to close the phantom offices that are not connected to state institutions.

Iraqi Prime Minister Adil Abdul Mahdi issued on Monday a decree heavily curbing the powers of mostly Iran-backed Shiite armed groups and forcing them to further integrate into the country's formal armed forces.
The groups have a lot of influence in Iraqi politics.
Abdul Mahdi's decree integrates paramilitary units into the military and forces groups to pick between political or military activity. Groups have until July 31 to abide by the new regulations, the decree said.
Following the announcement, the influential Shiite cleric Muqtada Al-Sadr announced on Monday the dissolution of his armed wing — Saraya Al-Salam — and ordered the closure of its headquarters, cancellation of its names and its re-association with the Iraqi official security establishment.
What was issued by the prime minister relating the Shia militias is an important decision and a correct step towards building a strong state, Al-Sadr said in a statement.
“What I care about is that Saraya Al-Salam — which I established — would be the first one to apply this decision, hence, I announce that I completely disassociate myself from it,” he added.

ERBIL - Iraqi Shi'ite cleric Muqtada al- Sadr, head of the al-Saeroon coalition and the leader of Saraya al-Salam, a Shi'ite militia operating under pro-Iranian Hashd al-Shaabi, has welcomed a decision by PM Adil Abdul-Mahdi to curb the power of the Shi'ite militias in Iraq.

Abdul-Mahdi has ordered the Hashd al-Shaabi to be part of the national army, according to which, there will be no difference between the Shi'ite militias and Iraqi forces in terms of regulations. He also vowed that he would view any armed factions under the operation of Hashd al-Shaabi as illegitimate if they do not follow the order.

However, Sadr in his statement on Twitter, has showed his readiness to dissolve his Shi'ite faction of Saraya al-Salam as part of following the new policy, pointing out that this could be a positive step towards establishing a stronger country.

But he also expressed concerns on the mechanism of the implementation of the new decision, hoping the rights of the members of the Saraya al-Salam will be preserved after the order is implemented.

Hashd al-Shaabi was established in 2014 based on a religious decree by Iraq’s top Shi’ite cleric Ali Sistani. However, it is accused of various cases of violations against human rights in the Sunni-populated areas where it fought the Islamic State (IS).

ERBIL, Kurdistan Region – A July 31 deadline has been set for all Popular Mobilization Forces (PMF, known as Hashd al-Shaabi in Arabic) paramilitaries to integrate into the Iraqi army, said the Iraqi Prime Minister in a statement on Monday, reining them in to centralized control.

 

“All Hashd al-Shaabi forces will work as an inseparable part of the armed forces. All rules applied to the armed forces will be applied to them, unless special letters decree otherwise,” read the first section of a decree released by Adil Abdul Mahdi on Monday evening.

 

Formally incorporated into Iraq’s armed forces back in 2016 following a parliament bill, the forces will work under the Commander-in-Chief of the Iraqi armed forces - the Prime Minister - and Falih Fayadh, current National Security advisor and head of the Hashd al-Shaabi Commission, an authority to oversee the groups who was appointed by the PM.

 

The almost entirely Shiite PMF paramilitaries were formed in 2014 based on a fatwa (religious decree) by Ayatollah Sistani, the highest Shiite authority in Iraq, as Islamic State (ISIS) began looming uncomfortably close to Baghdad.

 

While many of the PMFs soldiers are individuals who responded to the threat of ISIS, many had fought against US forces during its occupation of Iraq, while some received Iranian training and funding. 


Each paramilitary group has its own name, with the most known among them including Asaib Ahl al-Haq, Badr Corps, and Hezbollah Iraq. 


“All other names under which the factions of Hashd al-Shaabi operated during the heroic battles that eradicated the Daesh terrorist entity will be abandoned and replaced with military terms (division, brigade, regiment, et cetera),” said the decree, while PMF members will also adopt military rankings.

 

Implementation of the decree looks less than certain, though, considering the extensive political influence of PMF groups.

 

In Iraq’s May 12, 2018 elections, a newly-formed coalition, named the Fath Alliance, won the second highest number of seats in the Iraqi parliament. The Alliance was composed of parties who each possessed their own PMF faction. Abdul-Mahdi’s decree seeks to sever these political ties “on an individual or organizational level.”  


With PMF soldiers training in centralized Iraqi military barracks, bases belonging to any faction of the PMF will be shut down, while all checkpoints, “economic offices” or interests outside the “new working framework” will be closed, the PM added.

 

Forces who choose not to integrate may “transform” into a political party, but they will not be allowed to carry weapons for any reason other than the protection of its offices, according to the decree.

 

Abdul-Mahdi has been under pressure to curb the actions of Iran-affiliated groups after a spate of rocket attacks against US military and economic targets in Iraq, with attacks carried out on ExxonMobil’s Basra headquarters and military camps where US troops are stationed, as well as a near-miss attack against the US embassy in Baghdad. Additionally, a May 14 attack on US ally Saudi Arabia’s oil infrastructure, attributed to Iran-backed Houthis, is suspected by US officials to have been launched from Iraq.

 

The attacks have largely been attributed to PMF factions, some of whom have expressed support for Iran as tensions between it and the US rise.

Iraq’s prime minister issued an order on Monday to rein in armed groups known as popular mobilization forces in an effort to curtail their growing influence over some of the economy and their control of checkpoints in some provinces.

Because some of the armed groups have ties to Iran, Prime Minister Adel Abdul Mahdi has been under pressure to move against them from the United States and some Arab countries that fear Iranian influence in Iraq.

In March 2018, Mr. Mahdi’s predecessor, Haider al-Abadi, tried to chip away at the militias’ independence by formally making them part of the country’s security forces. But they have remained largely independent.

Mr. Mahdi’s decree restated Mr. al-Abadi’s order and went further by ordering the militias to leave their local military headquarters and shut down their so-called economic offices.

 

It is uncertain how Mr. Mahdi plans to enforce the order, or even whether he can. He has set a tight deadline for the militias to comply: July 31.

The decree was welcomed by many of the popular mobilization groups, including some of the largest and most powerful. The Peace Brigades, which are attached to Moktada al-Sadr, the influential Shiite cleric, said they were already putting the new rules in place.

“From today we have dismantled the Peace Brigades and they are now disconnected from Moktada al-Sadr,” said Safa’a al-Tamimi, the brigade’s spokesman. “From now on we will be known as Brigade 313, 314 and 315. We are giving up the name ‘Peace Brigades’ — although we love this name — but we will go with the procedures and we will be under the control of the prime minister.”

Behind the official language, Mr. Mahdi is trying to address a multifaceted problem that has plagued Iraq since the Islamic State began to seize Iraqi territory in 2014. That prompted the formation of informal armed groups to help fight the extremists. Some of those groups were initially fostered, financed and backed by Iran, but they soon multiplied, and many had little or no connection to Tehran.

The United States has become increasingly suspicious about the role of the militias and has designated two of them — Qutab al Hezbollah and Qutab al Nujaba — as foreign terrorist organizations. When Secretary of State Mike Pompeo visited Iraq in June, he raised concerns that some of the Iranian-linked groups posed a threat to American forces in Iraq.

 

Officials who work closely with Mr. Mahdi said he had issued his order to curtail the armed groups’ power under pressure from the United States.

The groups will remain under the direct control of the prime minister rather than being integrated fully into the Ministry of Defense or the Interior Ministry, which controls the police.

After Prime Minister al-Abadi tried last year to gain more influence over the militias’ leadership and reduce their power, their numbers actually expanded. There are now about 30 armed groups with a total of about 130,000 to 150,000 members.

The order issued Monday says that the groups must close their local headquarters and their economic offices, as well as the checkpoints they control.

Establishing control over the groups has been difficult, because when they came to the defense of the country as the Islamic State had the Iraqi army on the run in 2014, they achieved the status of heroes.

When the fight against ISIS subsided, the militias showed little inclination to disarm and go home.

With fewer extremists to fight, the groups began to branch out, making money by using their checkpoints to extort truckers.

In some provinces, their economic offices became involved in existing businesses. In Nineveh, for example, two or three popular mobilization groups took over the scrap metal business for a time, making millions of dollars until they were shut down by the Iraqi government.

That type of activity has been deeply resented by local business people, who view some of the groups as behaving like homegrown mafias.

Shafaq News / Legal expert Ali al-Tamimi said on Tuesday that the commander-in-chief of the armed forces, Prime Minister Adel Abdul-Mahdi, is not entitled to appoint a chairman of the popular crowd. 
Al-Tamimi told Ashqaf News that "the appointment of the head of the Popular People's Assembly is not the general commander of the armed forces exclusively as stated in this Diwani order yesterday." 
He pointed out that "this post with the rank of (minister) and according to Article (76) of the Iraqi Constitution, here the Prime Minister presents the name of his candidate for the presidency of the popular crowd, and the parliament decides it, through voting by a majority of his deputies, the same as ministers. 
The Iraqi prime minister, the commander-in-chief of the armed forces, Adel Abdul Mahdi, on Monday, a special command of the popular mobilization. 
He ordered the closure of all the headquarters of the armed factions inside and outside the cities, asking the armed factions to integrate into the regular forces.
The Diwani order, which includes 10 points, stated: "The necessity of ending the armed manifestations and the official joining of the commander-in-chief of the armed forces and the termination of all the names used during the war were urgent and replaced by military names (brigade, brigade, regiment, etc.)." 
Under the decree, the Iraqi prime minister prevented armed factions that choose political action from taking up arms, as well as ordered the military wings of the factions to sever any connection to the political wings. 
The decree requires all armed factions to implement the new regulations by July 31.
